Said the disciples, "We are Allah's helpers!" then a portion of the Children of Israel believed, and a portion disbelieved: But We gave power to those who believed, against their enemies, and they became the ones that prevailed.

SahihAlBukhari-017-001-1104Narrated Abu Huraira: A man from the Muslims and a man from the Jews quarrelled; and the Muslim said; By Him Who gave superiority to Muhammad over all the people! The Jew said; By Him Who gave superiority to Moses over all the people! On that the Muslim lifted his hand and slapped the Jew. The Jew went to Allah Messenger ﷺ and informed him of all that had happened between him and the Muslim. The Prophet ﷺ said; Do not give me superiority over Moses; for the people will fall unconscious on the Day of Resurrection; I will be the first to regain consciousness and behold; Moses will be standing there; holding the side of the Throne. I will not know whether he has been one of those who have fallen unconscious and then regained consciousness before me; or if he has been one of those exempted by Allah from falling unconscious. SahihAlBukhari-017-001-1302Narrated AlMiswar Bin Makhrama: The group of people whom Umar had selected as candidates for the Caliphate gathered and consulted each other. Abdulrahman said to them; I am not going to compete with you in this matter; but if you wish; I would select for you a caliph from among you. So all of them agreed to let Abdulrahman decide the case. So when the candidates placed the case in the hands of Abdulrahman the people went towards him and nobody followed the rest of the group nor obeyed any after him. So the people followed Abdulrahman and consulted him all those nights till there came the night we gave the oath of allegiance to Uthman. AlMiswar bin Makhrama added: Abdulrahman called on me after a portion of the night had passed and knocked on my door till I got up; and he said to me; I see you have been sleeping! By Allah; during the last three nights I have not slept enough. Go and call AlZubair and Sad. So I called them for him and he consulted them and then called me saying; Call Ali for me. I called Ali and he held a private talk with him till very late at night; and then Al; got up to leave having had much hope to be chosen as a Caliph but Abdulrahman was afraid of something concerning Ali. Abdulrahman then said to me; Call Uthman for me. I called him and he kept on speaking to him privately till the Muadh-dhin put an end to their talk by announcing the Adhan for the Fajr prayer. When the people finished their morning prayer and that six men group gathered near the pulpit; Abdulrahman sent for all the Muhajirin emigrants and the Ansar present there and sent for the army chief who had performed the Hajj with Umar that year. When all of them had gathered; Abdulrahman said; None has the right to be worshipped but Allah; and added; Now then; O Ali; I have looked at the people tendencies and noticed that they do not consider anybody equal to Uthman; so you should not incur blame by disagreeing. Then Abdulrahman said to Uthman ; I gave the oath of allegiance to you on condition that you will follow Allah Laws and the traditions of Allah Apostle and the traditions of the two Caliphs after him. SahihAlBukhari-017-001-1512Narrated Abu Huraira: The Prophet Solomon said; Tonight I will sleep with my ninety wives; each of whom will get a male child who will fight for Allah Cause. On that; his companion Sufyan said that his companion was an angel said to him; Say; If Allah will Allah willing. But Solomon forgot to say it. He slept with all his wives; but none of the women gave birth to a child; except one who gave birth to a halfboy. SahihAlBukhari-017-001-1513Narrated Zahdam AlJarmi: We were sitting with Abu Mousa AlAshsari; and as there were ties of friendship and mutual favors between us and his tribe. His meal was presented before him and there was chicken meat in it. Among those who were present there was a man from Bani Taimillah having a red complexion as a non-Arab freed slave; and that man did not approach the meal. Abu Mousa said to him; Come along! I have seen Allah Messenger ﷺ eating of that i.e.; chicken. The man said; I have seen it chickens eating something I regarded as dirty; and so I have taken an oath that I shall not eat its meat chicken. Abu Mousa said; Come along! I will inform you about it i.e.; your oath. Once we went to Allah Messenger ﷺ in company with a group of Ashairiyin; asking him for mounts while he was distributing some camels from the camels of Zakat. Ayoub said; I think he said that the Prophet was in an angry mood at the time. The Prophet ﷺ said; By Allah! I will not give you mounts; and I have nothing to mount you on. After we had left; some camels of booty were brought to Allah Apostle and he said; Where are those Ashariyin? Where are those Ashariyin? So we went to him and he gave us five very fat good-looking camels. We mounted them and went away; and then I said to my companions; We went to Allah Messenger ﷺ to give us mounts; but he took an oath that he would not give us mounts; and then later on he sent for us and gave us mounts; perhaps Allah Messenger ﷺ forgot his oath. By Allah; we will never be successful; for we have taken advantage of the fact that Allah Messenger ﷺ forgot to fulfill his oath. So let us return to Allah Messenger ﷺ to remind him of his oath. We returned and said; O Allah Messenger ﷺ ! We came to you and asked you for mounts; but you took an oath that you would not give us mounts but later on you gave us mounts; and we thought or considered that you have forgotten your oath. The Prophet ﷺ said; Depart; for Allah has given you Mounts. SahihAlBukhari-017-001-1683Narrated Malik Bin Aus: I went and entered upon Umar; his doorman; Yarfa came saying Uthman; Abdulrahman AlZubair and Saad are asking your permission to see you. May I admit them? Umar said; Yes. So he admitted them Then he came again and said; May I admit Ali and Abbas? He said; Yes. Abbas said; O; chief of the believers! Judge between me and this man Ali. Umar said; I beseech you by Allah by Whose permission both the heaven and the earth exist; do you know that Allah Messenger ﷺ said; Our the Apostles property will not be inherited; and whatever we leave after our death is to be spent in charity? And by that Allah Messenger ﷺ meant himself. The group said; No doubt ; he said so. Umar then faced Ali and Abbas and said; Do you both know that Allah Messenger ﷺ said that? They replied; No doubt ; he said so. Umar said; So let me talk to you about this matter. Allah favored His Apostle with something of this Fai i.e. booty won by the Muslims at war without fighting which He did not give to anybody else; Allah said:- And what Allah gave to His Apostle Fai Booty.........to do all things.... 59.6 And so that property was only for Allah Messenger ﷺ. Yet; by Allah; he neither gathered that property for himself nor withheld it from you; but he gave its income to you; and distributed it among you till there remained the present property out of which the Prophet ﷺ used to spend the yearly maintenance for his family; and whatever used to remain; he used to spend it where Allah property is spent i.e. in charity etc.. Allah Messenger ﷺ followed that throughout his life. Now I beseech you by Allah; do you know all that? They said; Yes. Umar then said to Ali and Abbas; I beseech you by Allah; do you know that? Both of them said; Yes. Umar added; And when the Prophet ﷺ died; Abu Bakr said; I am the successor of Allah Messenger ﷺ ; and took charge of that property and managed it in the same way as Allah Messenger ﷺ did. Then I took charge of this property for two years during which I managed it as Allah Messenger ﷺ and Abu Bakr did. Then you both Ali and Abbas came to talk to me; bearing the same claim and presenting the same case. O Abbas! You came to me asking for your share from the property of your nephew; and this man Ali came to me; asking for the share of h is wife from the property of her father. I said; If you both wish; I will give that to you on that condition i.e. that you would follow the way of the Prophet ﷺ and Abu Bakr and as I Umar have done in man aging it. Now both of you seek of me a verdict other than that? Lo! By Allah; by Whose permission both the heaven and the earth exist; I will not give any verdict other than that till the Hour is established. SahihAlBukhari-017-001-1993Narrated Aisha: Allah Messenger ﷺ used to like sweets and also used to like honey; and whenever he finished the Asr prayer; he used to visit his wives and stay with them. Once he visited Hafsa and remained with her longer than the period he used to stay; so I enquired about it. It was said to me; A woman from her tribe gave her a leather skin containing honey as a present; and she gave some of it to Allah Messenger ﷺ to drink. I said; By Allah; we will play a trick on him. So I mentioned the story to Sauda the wife of the Prophet and said to her; When he enters upon you; he will come near to you whereupon you should say to him; O Allah Messenger ﷺ ! Have you eaten Maghafir? He will say; No. Then you say to him; What is this bad smell? And it would be very hard on Allah Messenger ﷺ that a bad smell should be found on his body. He will say; Hafsa has given me a drink of honey. Then you should say to him; Its bees must have sucked from the AlUrfut a foul smelling flower. I too; will tell him the same. And you; O Saifya; say the same. So when the Prophet ﷺ entered upon Sauda the following happened. Sauda said; By Him except Whom none has the right to be worshipped; I was about to say to him what you had told me to say while he was still at the gate because of fear from you. SahihAlBukhari-017-001-2356Narrated Sahl Bin Sad: An Arab lady was mentioned to the Prophet ﷺ so he asked Abu Usaid AlSaidi to send for her; and he sent for her and she came and stayed in the castle of Bani Saida. The Prophet ﷺ came out and went to her and entered upon her. Behold; it was a lady sitting with a drooping head. When the Prophet ﷺ spoke to her; she said; I seek refuge with Allah from you. He said; I grant you refuge from me. They said to her; Do you know who this is? She said; No. They said; This is Allah Messenger ﷺ who has come to command your hand in marriage. She said; I am very unlucky to lose this chance. Then the Prophet and his companions went towards the shed of Bani Saida and sat there. Then he said; Give us water; O Sahl! SahihAlBukhari-017-001-3351Narrated Aisha: the wife of the Prophet Allah Messenger ﷺ died while Abu Bakr was at a place called AlSunah AlAliya Umar stood up and said; By Allah! Allah Messenger ﷺ is not dead! Umar later on said; By Allah! Nothing occurred to my mind except that. He said; Verily! Allah will resurrect him and he will cut the hands and legs of some men. Then Abu Bakr came and uncovered the face of Allah Messenger ﷺ ; kissed him and said; Let my mother and father be sacrificed for you; O Allah Messenger ﷺ ; you are good in life and in death. By Allah in Whose Hands my life is; Allah will never make you taste death twice. Then he went out and said; O oath-taker! Dont be hasty. When Abu Bakr spoke; Umar sat down. Abu Bakr praised and glorified Allah and said; No doubt! Whoever worshipped Muhammad; then Muhammad is dead; but whoever worshipped Allah; then Allah is Alive and shall never die. Then he recited Allah Statement.:- O Muhammad Verily you will die; and they also will die. 39.30 He also recited:- Muhammad is no more than an Apostle; and indeed many Apostles have passed away; before him; If he dies Or is killed; will you then Turn back on your heels? And he who turns back On his heels; not the least Harm will he do to Allah And Allah will give reward to those Who are grateful. 3.144 The people wept loudly; and the Ansar were assembled with Sad Bin Ubada in the shed of Bani Saida. They said to the emigrants. There should be one Amir from us and one from you. Then Abu Bakr; Umar Bin AlKhattab and Abu baida Bin AlJarrah went to them. Umar wanted to speak but Abu Bakr stopped him. Umar later on used to say; By Allah; I intended only to say something that appealed to me and I was afraid that Abu Bakr would not speak so well. Then Abu Bakr spoke and his speech was very eloquent. He said in his statement; We are the rulers and you Ansars are the ministers i.e. advisers ; Hubab Bin AlMundhir said; No; by Allah we wont accept this. But there must be a ruler from us and a ruler from you. Abu Bakr said; No; we will be the rulers and you will be the ministers; for they i.e. Quarish are the best family amongst the Arabs and of best origin. So you should elect either Umar or Abu Ubaida Bin AlJarrah as your ruler. Umar said to Abu Bakr ; No but we elect you; for you are our chief and the best amongst us and the most beloved of all of us to Allah Messenger ﷺ. So Umar took Abu Bakr hand and gave the pledge of allegiance and the people too gave the pledge of allegiance to Abu Bakr. Someone said; You have killed Sad Bin Ubada. SahihMuslim-017-001-17450Jabir Bin Abdullah reported: Allah Messenger may peace he upon him sent us on an expedition. We were three hundred riders and our chief leader was Ubaida Bin AlJarrah. We were on the look out for a caravan of the Quraish. So we stayed on the coast for half a month; and were so much afflicted by extreme hunger that we were obliged to eat leaves. That is why it was called the Detachment of the Leaves. The ocean cast out for us an animal which was called AlAnbar whale. We ate of that for half of the month and rubbed its fat on our bodies until our bodies became stout. Abu Ubaida caught hold of one of its ribs and fixed that up. He then cast a glance at the tallest man of the army and the highest of the camels. and then made him ride over that; and that-tnan passed beneath it the rib ; and many a man could sit in its eye-socket; and we extracted many pitchers of fat from the cavity of its eye. We had small bags containing dates with us before finding the whale. Ubaida gave every person amongst us a handful of dates and when the provision ran short ; he then gave each one of us one date. SahihMuslim-017-001-17657Jabir Allah be pleased with him reported that a woman gave her garden as a life grant to her son. He died and later on she also died and left a son behind and brothers also; The sons of the woman making life grant said to those who had been conferred upon this Umra : This garden has returned to us. The sons of the one who had been given life grant said: This belonged to our father; during his lifetime and in case of his death. They took their dispute to Tariq; the freed slave of Uthman. He called Jabir and he gave testimony of Allah Messenger ﷺ having said: Life grant belongs to one who is conferred upon this privilege. Tariq gave this decision and then wrote to Abd AlMalik and informed him; Jabir bearing witness to it. Abd AlMalik said: Jabir has told the truth. SahihMuslim-017-001-18066It has been narrated on the authority of Anas Bin Malik who said: When the Muhajirs migrated from Mecca to Medina; they came in a state that they had not anything i. e. money in theirhands; while the Ansar possessed lands and date palms. They divided their properties with the Muhajirs. The Ansar divided and gave them on the condition that they would give half the fruit from the orchards every year; and the Muhajirs would recompense them by working with them and putting in labour. The mother of Anas Bin Malik was called Umm Sulaim and she was also the mother of Abdullah Bin Talha who was a brother of Anas from his mother side. The mother of Anas had given the Messenger of Allah ﷺ her date-palms. He bestowed them upon Umm Aiman; the slave-girl who had been freed by him and was the mother of Usama Bin Zaid. When the Messenger of Allah ﷺ had finished the war with the people of Khaibar and returned to Medina; the Muhajirs returned to the Ansar all the gifts which they had given them out of the fruits. Anas Bin Malik said: The Messenger of. Allah ﷺ returned to my mother her date-palms and gave to Umm Aiman instead of them date-palms from his orchard. Ibn Shihab says that Umm Aiman was the mother of Usama Bin Zaid who was the slave-girl of Abdullah Bin Abd AlMuttalib and hailed from Abyssinia. When Amina gave birth to the Messenger of Allah ﷺ after the death of his father; Umm Aiman used to nurse him until he grew up. He later on freed her and married her to Zaid Bin Haritha. SahihMuslim-017-001-18206Ibn Umar Allah be pleased with them reported: Allah Messenger ﷺ handed over the land of Khaibar on the condition of the share of produce of fruits and harvest; and he also gave to his wives every year one hundred wasqs: eighty wasqs of dates and twenty wasqs of barley. When Umar became the caliph he distributed the lands and trees of Khaibar; and gave option to the wives of Allah Apostle ﷺ to earmark for themselves the land and water or stick to the wasqs that they got every year. They differed in this matter. Some of them opted for land and water; and some of them opted for wasqs every year. He said: Yes He gave him his donkey and said: Ride it; and tie the turban round your head. Some of his companions said: May Allah pardon you; you gave to this desert Arab the donkey on which you enjoyed ride for diversion and the turban which you tied round your. head. She served him the evening meal and he took it. He then came to her and had sexual intercourse with her and when it was all over she said: Make arrangements for the burial of the child. When it was morning. Abu Talha came to Allah Messenger ﷺ and informed him; whereupon he said: Did you spend the night with her. He said: Yes. He the Holy Prophet then said: O Allah; bless both of them and as a result of blessing she gave birth to a child. Abu Talha said to me Anas Bin Malik to take the child; so I took him and came to Allah Messenger ﷺ. She Umm Sulaim also had sent some dates along with the child. Allah Apostle ﷺ took him the child in his lap and said: Is there anything with you for Tahnik. They the Companions said: Yes. Allah Apostle ﷺ took hold of them dates and chewed them. Allah Messenger may peace he upon him took hold of him the child and he placed him in his lap and then called for dates. Aisha said: Some time was spent before we were able to find them. He the Holy Prophet chewed them and then put his saliva in his mouth. The first thing that entered his stomach; was the saliva of Allah Messenger ﷺ. Asma said: He then rubbed him and blessed him and gave him the name of Abdullah. He Abdullah went to him the Holy Prophet when he had attained the age of seven or eight years in order to pledge allegiance to Allah Messenger ﷺ as AlZubair had commanded him to do. He had come in a land inhabited by haughty and cruel men along with Sara. She was very good-looking amongst the people; so he said to her: If these people were to know that you are my wife they would snatch you away from me; so if they ask you tell them that you are my sister and in fact you are my sister in Islam; and I do not know of any other Muslim in this land besides I and you. And when they entered that land the tyrants came to see her and said to him the king : There comes to your land a woman; whom you alone deserve to possess; so he the king sent someone towards her and she was brought to him; and Ibrahim ﷺ stood in prayer. When she visited him the tyrant king came he could help but stretch his hand towards her and his hand was tied up. He said: Supplicate to Allah so that He may release my hand and I will do no harm to you. She did that and the man repeated the same highhandedness and his hand was again tied up more tightly than on the first occasion. He said the same thing to her again; and she again did that supplicated ; but he repeated the same highhandedness and his hands were tied up more tightly than on the previous occasion. He then again said: Supplicate your Lord so that He may set my hand free; by Allah I shall do no harm to you. She did and his hand was freed. Then he called the person who had brought her and said to him: You have brought to me the satan and you have not brought to me a human being; so turn them out from my land; and he gave Hajar as a gift to her. She returned along with Hajar and when Ibrahim ﷺ saw her; he said: How have you returned? She said: With full safety have I returned. Allah held the hand of that debauch and he gave me a maid-servant. I said: I seek refuge in Allah from being like the emissary of Ad. So the Messenger of Allah ﷺ said: And what of the emissary of Ad? He said: I said: You have got the one who is informed about it. When Ad suffered from famine they sent Qail and he stayed with Bakr Bin Muawiyah. He gave him wine to drink and two slave girls to sing for him. Then he went out towards the mountains of Murrah and said: O Allah! I did not come to You to cure a sick person; nor to ransom a captive! So give water to Your slave as You used to do; and give water to Bakr Bin Muawiyah along with him. He said that out of gratitude for the wine which he gave him to drink. So two clouds appeared and it was said to him: Choose one of them. So he chose the black one. It was said to him: Take it as ashes that will leave none in Ad. SunanAlTermithi-017-001-7852Narrated Yazid Bin Hurmuz: That Najdah AlHaruri wrote to Ibn Abbas asking if the Messenger of Allah ﷺ would fight along with women; and if he would fix a share of the spoils of war for them. Ibn Abbas wrote to him: You wrote to me asking me if the Messenger of Allah ﷺ would fight along with women. He did fight along with them; as they would treat the wounded. They received something from the spoils of war; but as for their share; then he did not fix a share for them.There is something on this topic from Anas and Umm Atiyah.This Hadith isHassan Sahih. And By Allah; the One Whom there is none worthy of worship besides Him I would lay on the ground on my liver side due to hunger; And I would fasten a stone to my stomach out of hunger. One day I sat by the way that they the Companions use to come out through. Abu Bakr passed and so I asked him about an Ayah from Allah Book; not asking him except that he might tell me to follow him for something to eat. But he passed on without doing so. Then Umar passed; so I asked him about an Ayah from Allah Book; not asking him except that he might tell me to follow him. But he passed on without doing so. Then Ab AlQasim s.a.w passed; and he smiled when he saw me; and said: Abu Huraira? I said: I am here O Messenger of Allah! He said: Come along. He continued and I followed him; he entered his house; so I sought permission to enter; and he permitted me. He found a bowl of milk and said: Where did this milk come from? It was said: It was a gift to us from so and so. So the Messenger of Allah s.a.w said: O Abu Huraira I said: I am here O Messenger of Allah! He said: Go to the people of AlSuffah to invite them. - Now; they were the guests of the people of Islam; they had nothing of people nor wealth to rely upon. Whenever some charity was brought to him; he would send it to them without using any of it. And when a gift was given to him s.a.w ; he would send for them to participate and share with him in it. I became upset about that; and I said to myself : What good will this bowl be among the people of AlSuffah and I am the one bringing it to them? Then he ordered me to circulate it among them So I wondered what of it would reach me from it; and I hoped that I would get from it what would satisfy me. But I would certainly not neglect to obey Allah and obey His Messenger; so I went to them and invited them. When they entered upon him they sat down. He said: Abu Huraira; take the bowl and give it to them. So I gave it to a man who drank his fill; then he gave it to another one; until it ended up with the Messenger of Allah s.a.w ; and all of the people had drank their fill. The Messenger of Allah s.a.w took the bowl; put it on his hand;then raised his head. He smiled and said: Abu Huraira; drink. So I drank; then he said: Drink. I kept drinking and he kept on saying; Drink. Then I said: By the One Who sent you with the truth! I have no more space for it. So he took the bowl and praised Allah; mentioned His Name and drank. When we ran out of them it became very difficult for us. We used to hit the Khabat leaves with our bows to knock them down and swallow them; then drink water with it. We became known as Jaish AlKhabat the Khabat army. Then; when we were about to turn inland; we saw a beast like a hill; caloled AlAnbar. Abu Ubaidah said: It is dead meat; do not eat it. So we arte from it and we made some if it into jerked meat. Thirteen men could sit in its eye-socket. Abu Ubaidah took one of its ribs and seated a man on the biggest camel that the people had; and they passed beneath it. When we came to the Messenger of Allah; he said: What kept you so long? We said: The Quraish and we told him about the beast. He said: That is provision that Allah granted to you. Do you have anything of it with you? The Prophet said: O Jabir; I see that your camel has become energetic. Abdullah Bin Arm died and left behind young druthers; and I did not like to bring to them someone who was like them; so I married a previously married woman who could teach the; and rise them with good manners. So he gave me permission; and said to me; Go to When I arrived; I told my maternal uncle that I had sold the camel and he scolded me. They know that the Messenger of Allah said: We are not inherited from; what we leave behind is charity. He said: And in this narration of it AlZuhri said: It the Khumus was under the control of the Messenger of Allah ; and he took provision for himself and for his family from it; and disposed to the rest of it as he disposed of other wealth belonging to the Muslims. Then Abu Bakr took control of it; then I took control of it after Abu Bakr; and I did with it what he sued to do. Then these two came to me and asked me to give it to them so that they could dispose of it as the Messenger of Allah disposed of it; and as Abu Bakr disposed of it; and as I disposed of it. So I gave it to them and I took promises from them that they would take proper care of it. Then they came to me and this one said. Give me my share from my brothers son: and this one said: Give me my share from my wife. If they want me to give it to them on the condition that they would dispose of it in the same manner as the Messenger of Allah did; and as Abu Bakr did; and as I did; I would give it to them; but if they refuse; then they do not have to worry about it. Then he said: And know that whatever of spoils of war that you may gain; verily; one-fifth of it is assigned to Allah; and to the Messenger; and to the near relatives of the Messenger Muhammad ; and also the orphans; AlMasakin the poor and the wayfarer AlAnfal 8:41 this if for them. AlSadaqat here it means Zakah are only for the Fuqara poor ; and AlMasakin the poor and those employed to collect the funds ; and to attract the hearts of those who have been inclined toward Islam ; and to free the captives; and for those in debt; and for Allah cause I.e. for Mujahidun - those fighting in a holy battle - this is for them. And what Allah gave as booty Fay to His Messenger Muhammad from them - for this you made no expeditin with either cavalry or camels. AlZuhri said: This applies exclusively to the Messenger of Allah and refers to an Arab village called Fadak; and so on. What Allah gave as booty Fay to His Messenger Muhammad from the people of the townships - it is for Allah; His Messenger Muhammad ; the kindred of Messenger Muhammad ; the orphans; AlMasakin the poor ; and the wayfarer And there is also a share in this booty for the poor emigrants; who were expelled from their homes and their property And it is also for those who; before them; had homes in AlMadinah and had adopted the Faith And those who came after them. SunanAbuDawoud-017-001-25781Narrated Abu Dawud: I found in my notebook from Shaiban and I did not hear from him ; Abu Bakr; a reliable friend of ours; said: Shaiban - Muhammad Bin Rashid - Sulaiman Bin Mousad - Amr Bin Suhaib; On his father authority; said that his grandfather said: The Messenger of Allah ﷺ would fix the blood-money for accidental killing at the rate of four hundred dinars or their equivalent in silver for townsmen; and he would fix it according to the price of camels. So when they were dear; he increased the amount to be paid; and when cheap prices prevailed he reduced the amount to be paid. In the time of the Messenger of Allah ﷺ they reached between four hundred and eight hundred dinars; their equivalent in silver being eight thousand dirhams. He said: The Messenger of Allah ﷺ gave judgment that those who possessed cattle should pay two hundred cows; and those who possessed sheep two thousand sheep. He said: The Messenger of Allah ﷺ said: The blood-money is to be treated as something to be inherited by the heirs of the one who has been killed; and the remainder should be divided among the agnates. He said: The Messenger of Allah ﷺ gave judgment that for cutting off a nose completely there was full blood-money; one hundred camels were to be paid. If the tip of the nose was cut off; half of the blood-money;i.e. fifty camels were to be paid; or their equivalent in gold or in silver; or a hundred cows; or one thousand sheep. For the hand; when it was cut of;f half of the blood-money was to be paid; for one foot of half; the blood-money was to be paid. For a wound in the head; a third of the blood-money was due; i.e. thirty-three camels and a third of the blood-money; or their equivalent in gold; silver; cows or sheep. For a head thrust which reaches the body; the same blood-money was to be paid. Ten camels were to be paid for every finger; and five camels for every tooth. The Messenger of Allah ﷺ gave judgment that the blood-money for a woman should be divided among her relatives on her father side; who did not inherit anything from her except the residence of her heirs. If she was killed; her blood-money should be distributed among her heirs; and they would have the right of taking revenge on the murderer. The Messenger of Allah ﷺ said: There is nothing for the murderer; and if he the victim has no heir; his heir will be the one who is nearest to him among the people; but the murderer should not inherit anything. SunanAbuDawoud-017-001-26636Narrated Imran Ibn Husayn: A woman belonging to the tribe of Juhaynah according to the version of Aban came to the Prophet ﷺ and said that she had committed fornication and that she was pregnant. The Messenger of Allah ﷺ called her guardian. Then the Messenger of Allah ﷺ said to him: Be good to her; and when she bears a child; bring her to me. When she gave birth to the child; he brought her to him. The Prophet ﷺ gave orders regarding her; and her clothes were tied to her. He then commanded regarding her and she was stoned to death. He commanded the people to pray and they prayed over her. Thereupon Umar said: Are you praying over her; Messenger of Allah; when she has committed fornication? He said: By Him in Whose hand my soul is; she has repented to such an extent that if it were divided among the seventy people of Medina; it would have been enough for them all. And what do you find better than the fact that she gave her life. She returned; and on the next day she came to him again; and said: Perhaps you want to send me back as you did to Maiz Bin Malik. I swear by Allah; I am pregnant. He said to her: Go back. She then returned and came to him the next day. He said to her: Go back until you give birth to a child. She then returned. When she gave birth to a child; she brought the child to him; and said: Here it is! I have given birth to it. He said: Go back; and suckle him until you wean him. When she had weaned him; she brought him the boy to him with something in his hand which he was eating. The boy was then given to a certain man of the Muslims and he the Prophet commanded regarding her. So a pit was dug for her; and he gave orders about her and she was stoned to death. Khalid was one of those who were throwing stones at her. He threw a stone at her. When a drop blood fell on his cheeks; he abused her. The Prophet ﷺ said to him: Gently; Khalid. By Him in whose hand my soul is; she has reported to such an extent that if one who wrongfully takes extra tax were to repent to a like extent; he would be forgiven. Abdulrahman Bin Awuf said: We think that you should prescribe the lightest punishment. So he fixed eight lashes for it.Abu Dawud said: It has also been transmitted by Ibn AlArubah from Qatadah from the Prophet ﷺ to the effect that he gave a beating forty times with palm branches and sandals. And Shubah narrated it from Qatadah on the authority of Anas from Prophet ﷺ. Humran and another man bore witness against him for drinking wine. One of them testified that he had seen him drinking wine; and the other testified that he had seen him vomiting it. Uthman said: He could not vomit it; unless he did not drink it. He said to Ali: Inflict the prescribed punishment on him. Ali said to AlHasan: Inflict the prescribed punishment on him. AlHasan said: He who has enjoyed its pleasure should also bear its burden. So Ali said to Abdullah Ibn Jafar: Inflict the prescribed punishment on him. He took a whip and struck him with it while Ali was counting. When he reached struck forty lashes ; he said: It is sufficient. The Prophet ﷺ gave forty lashes. I think he also said: And Abu Bakr gave forty lashes; and Uthman eighty. This is all sunnah standard practice. SunanAbuDawoud-017-001-26685Narrated Abdulrahman Ibn Azhar: I saw the Messenger of Allah ﷺ on the morning of the conquest of Mecca when I was a young boy. He was walking among the people; seeking the camp of Khalid Ibn AlWalid. A man who had drunk wine was brought before him and he ordered them to beat him. So they beat him with what they had in their hands. Some struck him with whips; some with sticks and some with sandals. The Messenger of Allah ﷺ threw some dust on his face. When a man who had drunk wine was brought before Abu Bakr; he asked them i.e. the people about the number of beatings which they gave him. They numbered it forty. So Abu Bakr gave him forty lashes. When Umar came to power; Khalid Ibn AlWalid wrote to him: The people have become addicted to drinking wine and they look down upon the prescribed punishment and its penalty. He said: They are with you; ask them. The immigrants who embraced Islam in the beginning were with him. He asked them and they agreed on the fact that a drunkard should be given eighty lashes. Ali said: When a man drinks wine; he tells lies. He said: Messenger of Allah; would that you purchased it and wore it on Friday and when a delegation came to you. The Messenger of Allah ﷺ said: Only he who has no portion in the next world wears this silk. Then the Messenger of Allah ﷺ came in possession of some robes made of silk and gave one of them to Umar Bin AlKhattab. So the Messenger of Allah; may Allah bless him and grant him peace; sat down; and I stood up and went to a sack of ours. I looked in it for something and found a small cucumber and broke it. Then I brought it to the Messenger of Allah; may Allah bless him and grant him peace. He said; From where did you get this? I said; We brought it from Madina; Messenger of Allah. Jabir continued; We had a friend of ours with us whom we used to equip to go out to guard our mounts. I gave him what was necessary and then he turned about to go to the mounts and he was wearing two threadbare cloaks of his. She took her long head scarf and wrapped up the bread with part of it and put it into my Anass hand and gave me part of it to wear. Then she sent me to the Messenger of Allah; may Allah bless him and grant him peace. Anas continued; I took it; and I found the Messenger of Allah; may Allah bless him and grant him peace; sitting in the Masjid with some people. I watched them. The Messenger of Allah; may Allah bless him and grant him peace; said; Did Abu Talha send you? I replied; Yes. He said; For food? I said; Yes. The Messenger of Allah; may Allah bless him and grant him peace; said to those with him; Let us go. He set off and I went among them until I came to Abu Talha and told him. MuwataMalik-017-001-34948Yahya related that he heard Malik say that if a man gave a washer a garment to dye and he dyed it; and then the owner of the garment said; I did not order you to use this dye; and the washer protested that he had done so; then the washer was to be believed. It was the same with the tailor and the gold-smith. They took an oath about it unless they produced something they would not normally have been employed to do. In that situation their statement was not allowed and the owner of the garment had to take an oath. If he rejected it and refused to swear; then the dyer was made to take an oath. Yahya said; I heard Malik speak about a dyer who was given a garment and he made a mistake and gave it to another man and the one to whom he gave it wore it. He said; The one who wore it has no damages against him; and the washer pays damages to the owner of the garment. That is when the man wears the garment which was given him without recognizing that it is not his. MuwataMalik-017-001-34952Malik related to me from Ibn Shihab from Urwa Ibn AlZubair that Aisha; the wife of the Prophet; may Allah bless him and grant him peace; said; Abu Bakr AlSiddiq gave me palm trees whose produce was twenty awsuq from his property at AlGhaba. When he was dying; he said; By Allah; little daughter; there is no one I would prefer to be wealthy after I die than you. There is no one it is more difficult for me to see poor after I die than you. I gave you palm-trees whose produce is twenty awsuq. Had you cut them and taken possession of them; they would have been yours; but today they are the property of the heirs; and they are your two brothers and your two sisters; so divide it according to the Book of Allah. Aisha continued; I said; My father! By Allah; even if it had been more; I would have left it. There is only Asma. Who is my other sister? Abu Bakr replied; What is in the womb of Kharija? Kharija was the wife of Abu Bakr brother from the Ansar. MuwataMalik-017-001-35010Yahya said that Malik spoke about an investor who gave qirad money to a man; and then the man sought a loan from the investor or the investor borrowed money from the agent; or the investor left goods with the agent to sell for him; or the investor gave the agent dinars to buy goods with. Malik said; There is no harm if the investor leaves his goods with him knowing that if the agent did not have his money and he had asked a similar thing of him; he would have still done it because of the brotherhood between them or because it would have been no bother to him and that had the agent refused that; he would not have removed his capital from him. Or if the agent had borrowed from the investor or carried his goods for him and he knew that if the investor had not had his capital with him; he would have still done the same for him; and had he refused that to him; he would not have returned his capital to him. If that is true between both of them and it is in the way of a favour between them and it is not a condition in the terms of the qirad; it is permitted and there is no harm in it. If a condition comes into it; or it is feared that the agent is only doing it for the investor in order to safeguard the capital in his possession; or the investor is only doing it because the agent has taken his capital and will not return it to him; that is not permitted in qirad and it is part of what the people of knowledge forbid.The Chapter on Financial Transactions And Profits in HodHood Indexing, The Book of The Decree in Muwata Malik
MuwataMalik-017-001-35087Yahya related to me from Malik that he had heard that Muhammad Seereen used to say; Do not sell grain on the ears until it is white. Malik said; If someone buys food for a known price to be delivered at a stated date; and when the date comes; the one who owes the food says; I do not have any food; sell me the food which I owe you with delayed terms. The owner of the food says; This is not good; because the Messenger of Allah; may Allah bless him and grant him peace; forbade selling food until the deal was completed. The one who owes the food says to his creditor; Sell me any kind of food on delayed terms until I discharge the debt to you. This is not good because he gives him food and then he returns it to him. The gold which he gave him becomes the price of that which is his right against him and the food which he gave him becomes what clears what is between them. If they do that; it becomes the sale of food before the deal is complete. Malik spoke about a man who was owed food which he had purchased from a man and this man was owed the like of that food by another man. The one who owed the food said to his creditor; I will refer you to my debtor who owes me the same amount of food as I owe you; so that you may obtain the food which I owe you. Malik said; If the man who had to deliver the food; had gone out; and bought the food to pay off his creditor; that is not good. That is selling food before taking possession of it. If the food is an advance which falls due at that particular time; there is no harm in paying off his creditor with it because that is nota sale. It is not halal to sell food before receiving it in full since the Messenger of Allah; may Allah bless him and grant him peace; forbade that. However; the people of knowledge agree that there is no harm in partnership; transfer of responsibility and revocation in sales of food and other goods. Malik said; That is because the people of knowledge consider it as a favour rendered. They do not consider it as a sale. It is like a man lending light dirhams. He is then paid back in dirhams of full weight; and so gets back more than he lent. That is halal for him and permitted. Had a man bought defective dirhams from him as being the full weight; that would not be halal. Abdullah Ibn Umar said; That is usury. Abdullah said; Loans are of three types: A free loan which you lend by which you desire the pleasure of Allah; and so you have the pleasure of Allah. A free loan which you lend by which you desire the pleasure of your companion; so you have the pleasure of your companion; and a free loan which you lend by which you take what is impure by what is pure; and that is usury. He said; What do you order me to do; Abu Abdulrahman He said; I think that you should tear up the agreement. If he gives you the like of what you lent him; accept it. If he gives you less than what you lent him; take it and you will be rewarded. Abu Bakr said to her; You have nothing in the Book of Allah; and I do not know that you have anything in the sunna of the Messenger of Allah; may Allah bless him and grant him peace. Go away therefore; until I have questioned the people. i.e.the Companions. He questioned the people; and AlMughira Ibn Shuba said; I was present with the Messenger of Allah; may Allah bless him and grant him peace; when he gave the grandmother a sixth. Abu Bakr said; Was there anybody else with you? Muhammad Ibn Maslama AlAnsari stood up and said the like of what AlMughira said. Abu Bakr AlSiddiq gave it to her. Then the other grandmother came to Umar Ibn AlKhattab and asked him for her inheritance. MuwataMalik-017-001-35146Yahya related to me from Malik from Abdu Rabbih Ibn Said that Abu Bakr Ibn Abdulrahman Ibn AlHarith Ibn Hisham only gave a fixed share to two grandmothers together. Malik said; The generally agreed on way of doing things among us in which there is no dispute and which I saw the people of knowledge in our city doing; is that the maternal grandmother does not inherit anything at all with the mother. Outside of that; she is given a sixth as a fixed share. The paternal grandmotherdoes not inherit anything along with the mother or the father. Outside of that she is given a sixth as a fixed share. If both the paternal grandmother and maternal grandmother are alive; and the deceased does not have a father or mother outside of them; Malik said;.I have heard that if the maternal grandmother is the nearest of the two of them; then she has a sixth instead of the paternal grandmother. If the paternal grandmother is nearer; or they are in the same position in relation to the deceased; the sixth is divided equally between them. Malik said; None of the female grand-relations except for these two has any inheritance because I have heard that the Messenger of Allah; may Allah bless him and grant him peace; gave the grandmother inheritance; and then Abu Bakr asked about that until someone reliable related from the Messenger of Allah; may Allah bless him and grant him peace; that he had made the grandmother an heir and given a share to her. Another grandmother came to Umar Ibn AlKhattab; and he said; I am not one to add to fixed shares. If there are two of you together; it is between you. If either of you is left alone with it; it is hers. MuwataMalik-017-001-35426Yahya related to me from Malik that it reached him that a slave of Abdullah Ibn Umar escaped and one of his horses wandered off; and the idol worshippers seized them. Then the Muslims recaptured them; and they were returned to Abdullah Ibn Umar; before the division of the spoils took place. I heard Malik say about muslim property that had been seized by the enemy; If it is noticed before the distribution; then it is returned to itsowner. Whatever has already been distributed is not returned to anyone. Malik; when asked about a man whose young male slave was taken by the idol worshippers and then the Muslims re-captured him; said; The owner is more entitled to him without having to pay his price or value or having to incur any loss before the distribution takes place. If the distribution has already taken place then I think that the slave belongs to his master for his price if the master wants him back. Regarding an umm walad of a Muslim man who has been taken by the idol worshippers and then recaptured by the Muslims and allotted in the distribution of spoils and then recognised by her master after the distribution; Malik said; She is not to be enslaved. I think that the Imam should pay a ransom for her for her master. If he does not do it; then her master must pay a ransom for her and not leave her. I do not think that she should be made a slave by whoever takes her and intercourse with her is not halal. She is in the position of a free woman because her master would be required to pay compensation if she injured somebody and so she is in the same position as a wife. He must not leave the mother of his son to be enslaved nor may intercourse with her be made halal. Malik was asked about a man who went to enemy territory to pay ransom or to trade; and he bought a free man or a slave; or they were given to him. He said; As for the free man; the price he buys him for is a debt against the man and he is not made a slave. If the captive is given to him freely; he is free and owes nothing unless the man gave something in recompense for him. That is a debt against the free man; the same as if a ransom had been paid for him. As for a slave; his former master can choose to take him back and pay his price to the man who bought him or he can choose to leave him; as he wishes. If he was given to the man; the former master is more entitled to him; and he owes nothing for him unless the man gave something for him in recompense.
