They will come swiftly to you. Know that Allah is Mighty, Wise."

When they saw him, they did extol him, and (in their amazement) cut their hands: they said, "Allah preserve us! no mortal is this! this is none other than a noble angel!"

In it there are for them all kinds of fruits; and Grace from their Lord. (Can those in such Bliss) be compared to such as shall dwell for ever in the Fire, and be given, to drink, boiling water, so that it cuts up their bowels (to pieces)?

SahihAlBukhari-017-001-1730Narrated AlMiqdad Bin Amr AlKindi: An ally of Bani Zuhra who took part in the battle of Badr with the Prophet; that he said; O Allah Apostle! If I meet an unbeliever and we have a fight; and he strikes my hand with the sword and cuts it off; and then takes refuge from me under a tree; and says; I have surrendered to Allah i.e. embraced Islam ; may I kill him after he has said so? Allah Messenger ﷺ said; Do not kill him. AlMiqdad said; But O Allah Messenger ﷺ ! He had chopped off one of my hands and he said that after he had cut it off. May I kill him? The Prophet ﷺ said. Do not kill him for if you kill him; he would be in the position in which you had been before you kill him; and you would be in the position in which he was before he said the sentence. The Prophet ﷺ also said to AlMiqdad; If a faithful believer conceals his faith Islam from the disbelievers; and then when he declares his Islam; you kill him; you will be sinful. Anas added; Allah Messenger ﷺ ﷺ raised both his hands and said; O Allah! Bless us with rain! O Allah! Bless us with rain! O Allah! Bless us with rain! Anas added; By Allah; we could not see any trace of cloud in the sky and there was no building or a house between us and the mountains of Sila. Anas added; A heavy cloud like a shield appeared from behind it i.e. Sila Mountain. When it came in the middle of the sky; it spread and then rained. Anas further said; By Allah! We could not see the sun for a week. Next Friday a person entered through the same gate and at that time Allah Messenger ﷺ was delivering the Friday Khutba. The man stood in front of him and said; O Allah Messenger ﷺ ! The livestock are dying and the roads are cut off; please pray to Allah to withhold rain. Anas added; Allah Messenger ﷺ I raised both his hands and said; O Allah! Round about us and not on us. O Allah! On the plateaus; on the mountains; on the hills; in the valleys and on the places where trees grow. So the rain stopped and we came out walking in the sun. Sharik asked Anas whether it was the same person who had asked for the rain the last Friday. SahihAlBukhari-017-001-3992Narrated Ali: I got a camel in my share of the war booty on the day of the battle of Badr; and the Prophet ﷺ had given me a camel from the Khumus. When I intended to marry Fatima; the daughter of Allah Apostle; I had an appointment with a goldsmith from the tribe of Bani Qainuqa to go with me to bring Idhkhir i.e. grass of pleasant smell and sell it to the goldsmiths and spend its price on my wedding party. I was collecting for my camels equipment of saddles; sacks and ropes while my two shecamels were kneeling down beside the room of an Ansari man. I returned after collecting whatever I collected; to see the humps of my two camels cut off and their flanks cut open and some portion of their livers was taken out. When I saw that state of my two camels; I could not help weeping. I asked; Who has done this? The people replied; Hamza Bin Abdul Muttalib who is staying with some Ansari drunks in this house. I went away till I reached the Prophet ﷺ and Zaid Bin Haritha was with him. The Prophet ﷺ noticed on my face the effect of what I had suffered; so the Prophet ﷺ asked. What is wrong with you. I replied; O Allah Messenger ﷺ ! I have never seen such a day as today. Hamza attacked my two camels; cut off their humps; and ripped open their flanks; and he is sitting there in a house in the company of some drunks. The Prophet ﷺ then asked for his covering sheet; put it on; and set out walking followed by me and Zaid Bin Haritha till he came to the house where Hamza was. He asked permission to enter; and they allowed him; and they were drunk. Allah Messenger ﷺ started rebuking Hamza for what he had done; but Hamza was drunk and his eyes were red. Hamza looked at Allah Messenger ﷺ and then he raised his eyes; looking at his knees; then he raised up his eyes looking at his umbilicus; and again he raised up his eyes look in at his face. Hamza then said; Arent you but the slaves of my father? I let both of them kneel at the door of one of the Ansar; intending to carry Idhkhir on them to sell it and use its price for my wedding banquet on marrying Fatima. A goldsmith from Bani Qainqa was with me. Hamza Bin Abd AlMuttalib was in that house drinking wine and a lady singer was reciting: O Hamza! Kill the two fat old she camels and serve them to your guests. So Hamza took his sword and went towards the two camels and cut off their humps and opened their flanks and took a part of their livers. I said to Ibn Shihab; Did he take part of the humps? He replied; He cut off their humps and carried them away. Ali further said; When I saw that dreadful sight; I went to the Prophet ﷺ and told him the news. They said: Who would speak to Allah Messenger ﷺ about her? They again said: Who can dare do this but Usama Bin Zaid; the loved one of Allah Messenger ﷺ ? She was brought to Allah Messenger ﷺ and Usama Bin Zaid spoke about her to him interceded on her behalf. The color of the face of Allah Messenger ﷺ changed; and he said: Do you intercede in one of the prescribed punishments of Allah? He Usama said: Messenger of Allah; seek forgiveness for me. When it was dusk. Allah Messenger ﷺ stood up and gave an address. He first glorified Allah as He deserves; and then said: Now to our topic. This injustice destroyed those before you that when any one of high rank committed theft among them; they spared him; and when any weak one among them committed theft; they inflicted the prescribed punishment upon him. By Him in Whose Hand is my life; even if Fatima daughter of Muhammad were to commit theft; I would have cut off her hand. SahihMuslim-017-001-18051It has been narrated on the authority of Umar Bin AlKhattab who said: When it was the day on which the Battle of Badr was fought; the Messenger of Allah ﷺ cast a glance at the infidels; and they were one thousand while his own Companions were three hundred and nineteen. The Prophet ﷺ turned his face towards the Qibla. Then he stretched his hands and began his supplication to his Lord: O Allah; accomplish for me what Thou hast promised to me. O Allah; bring about what Thou hast promised to me. O Allah; if this small band of Muslims is destroyed. Thou will not be worshipped on this earth. He continued his supplication to his Lord; stretching his hands; facing the Qibla; until his mantle slipped down from his shoulders. So Abu Bakr came to him; picked up his mantle and put it on his shoulders. Then he embraced him from behind and said: Prophet of Allah; this prayer of yours to your Lord will suffice you; and He will fulfill for you what He has promised you. So Allah; the Glorious and Exalted; revealed the Quranic verse : When ye appealed to your Lord for help; He responded to your call saying : I will help you with one thousand angels coming in succession. So Allah helped him with angels. Abu Zumail said that the hadith was narrated to him by Ibn Abbas who said: While on that day a Muslim was chasing a disbeliever who was going ahead of him; he heard over him the swishing of the whip and the voice of the rider saying: Go ahead; Haizum! He glanced at the polytheist who had now fallen down on his back. When he looked at him carefully he found that there was a scar on his nose and his face was torn as if it had been lashed with a whip; and had turned green with its poison. An Ansari came to the Messenger of Allah ﷺ and related this event to him. He said: You have told the truth. This was the help from the third heaven. The Muslims that day i.e. the day of the Battle of Badr killed seventy persons and captured seventy. The Messenger of Allah ﷺ said to Abu Bakr and Umar Allah be pleased with them : What is your opinion about these captives? Abu Bakr said: They are our kith and kin. I think you should release them after getting from them a ransom. This will be a source of strength to us against the infidels. It is quite possible that Allah may guide them to Islam. Then the Messenger of Allah ﷺ said: What is your opinion; Ibn AlKhattab? He said: Messenger of Allah; I do not hold the same opinion as Abu Bakr. I am of the opinion that you should hand them over to us so that we may cut off their heads. Hand over Aqil to Ali that he may cut off his head; and hand over such and such relative to me that I may cut off his head. They are leaders of the disbelievers and veterans among them. The Messenger of Allah ﷺ approved the opinion of Abu Bakr and did not approve what I said. The next day when I came to the Messenger of Allah ﷺ ; I found that both he and Abu Bakr were sitting shedding tears. I said: Messenger of Allah; why are you and your Companion shedding tears? Tell me the reason. For I will weep; or I will at least pretend to weep in sympathy with you. The Messenger of Allah ﷺ said: I weep for what has happened to your companions for taking ransom from the prisoners. I was shown the torture to which they were subjected. It was brought to me as close as this tree. He pointed to a tree close to him. Then God revealed the verse: It is not befitting for a prophet that he should take prisoners until the force of the disbelievers has been crushed... to the end of the verse: so eat ye the spoils of war; it is lawful and pure. And Hamza Bin Abd AlMuttalib was busy in drinking in that house in the company of a singing girl who was singing to him. She said: Hamza; get up for slaughtering the fat camels. Hamza attacked them with the sword and cut off their humps and ripped their haunches; and then took out their livers. I said to Ibn Shihab: Did he take out anything from the hump? He said: He cut off the humps altogether. Ibn Shihab reported Ali having said: I saw this horrible sight and it shocked me; and I came to Allah Apostle ﷺ and there was Zaid b; Haritha with him and communicated to him this news. He came in the company of Zaid and I also went along with him and he went to Hamza and he expressed anger with him. Hamza raised his eyes and said: Are you not but the servants of my father? SahihMuslim-017-001-20909Husain Bin Ali reported Ali having said: There fell to my lot a camel out of the spoils of war on the Day of Badr; and Allah Messenger ﷺ gave me another camel on that day out of the Khums one-fifth reserved for Allah and His Messenger. When I made up my mind to consummate my marriage with Fatima; the daughter of Allah Messenger ﷺ ; I prevailed upon a goldsmith of the tribe of Qainuqa to go along with me so that we might bring Idhkhir wishing to sell that to the goldsmiths and thus I should be able to arrange my wedding feast. While I was arranging the equipments. i. e. litters; sacks and ropes; my two camels were sitting down at the side of the apartment of a person of the Ansar. I collected the different articles of equipment and found to my surprise that their humps had been chopped off and their haunches had been cut off and their livers had been taken out. I could not help weeping when I saw that plight of theirs. I said: Who has done that? They said: Hamza Bin Abd AlMuttalib has done this. and he is in this house dead drunk in the company of some of the Ansair with Aasi nging girl singing before him and his companions. She said in her song: O Hamza. get up and attack these falty camels. Thereupon Hamza stood up with a sword in his hand and cut off their humps and ripped their haunches and tore out their livers. Ali said: I went away until I came to Allah Messenger ﷺ and there was with him Zaid Bin Haritha. Allah Messenger ﷺ recognised from my face what I had experienced; whereupon Allah Messenger ﷺ said: What has happened to you? I said: Messenger of Allah; by Allah; I have never seen such an unfortunate day as this day. Hamza has committed aggression to my camels; and has cut off their humps. and ripped their haunches; and he is in a house in the company of some drunkards. Hearing this Allah Messenger ﷺ sent for his mantle and; putting it on him; he proceeded; and I and Zaid Bin Haritha followed him; until he came to the door of the house in which there was Hamza. He the Holy Prophet sought permission which they granted him. and they were all drunk. Allah Messenger ﷺ began to reprimand Hamza for what he had done. Hamza eyes were red. He cast a glance at Allah Messenger ﷺ and then looked towards his knees. and then lifted his eyes and cast a glance at his waist and then lifted his eyes and saw his face. And then Hamza said: Are you anything but the slaves of my father? SahihMuslim-017-001-22773Abdullah Bin Abu Qatada reported on the authority of his father Allah be pleased with him : The Messenger of Allah ﷺ set out for Pilgrimage and we also set out along with him. He Abu Qatada said: There proceeded on some of his Companions and Abu Qatada was one of them. He the Prophet said: You proceed along the coastline till you meet me. He Abu Qatada said: So they proceeded ahead of the Prophet of Allah ﷺ ; all of them had entered upon the state of Ihram; except Abu Qatada; he had not put on ihram. As they went on they saw a wild ass; and Abu Qatada attacked it and cut off its hind legs. They got down and ate its meat. They said: We ate meat In the state of Ihram. They carried the meat that was left of it. As they came to the Messenger of Allah way ﷺ they said: Messenger of Allah; we were in the state of Ihram whereas Abu Qatada was not. We saw a wild ass and Abu Qatada attacked it and cut off its hind legs. We got down and ate its meat and we thus ate the meat of a game while we were In the state of Ihram. We have carried to you what was left out of its meat. Thereupon he the holy Prophet said: Did anyone among you command him to hunt or point to him with anything to do so ? SahihMuslim-017-001-23214Ibn Abbas Allah be pleased with him reported Allah Messenger ﷺ as saying on the Day of Victory over Mecca: There is no Hijra emigration but only Jihad and good intention; and when you are called to battle; then go forth. He also said on the Day of Victory over Mecca: Allah made this town sacred on the day He created the earth and the heavens; so it is -sacred by the sacred- ness conferred on it by Allah until the Day of Resurrection and fighting in it was not lawful to anyone before me; and it was made lawful for me only during an hour on one day; for it is sacred by the sacredness conferred on it by Allah until the Day of Resurrection. Its thorns are not to be cut; its game is not to be molested; and the things dropped are to be picked up only by one who makes a public announcement of it; and its fresh herbage is not to be cut. Abbas Allah be pleased with him said: Messenger of Allah; exception may be made in case of rush; for it is useful for their blacksmiths and for their houses. She was brought to the Messenger of Allah; and her people went to Usamah Bin Zaid; who spoke to the Messenger of Allah concerning her. The face of ht Messenger of Allah changed color while he was speaking to him. Then the Messenger of Allah said to him: Are you interceding with me concerning one of ht Hadd punishments decreed by Allah? Usamah said: Pray for forgiveness for me; O Messenger of Allah! SunanAlNasai-017-001-12220It was narrated that AlZuhri said: Urwah Bin AlZubair told me that a woman stole at the time of the Messenger of Allah; during the Conquest. Her people went to Uswamah Bin Zaid; to ask him to intercede. Urwah said: When Usamah spoke to him concerning her; the face of the Messenger of Allah changed color and he said: Are you speaking to me concerning one of the Hadd punishments of Allah? SunanAlNasai-017-001-12275It was narrated from Amr Bin Shuaib; from his father; that his grandfather Abdullah Bin Amr; that a man from Muzainah came to the Messenger of Allah and said: O Messenger of Allah; what do you think about a sheep stolen from the pasture? He said: The thief must pay double and be punished. There is no cutting off of the hand for stealing livestock; except what which has been put in the pen; if its value is equal to that of a shield; in which case the thiefs hand is to be cut off. If its value is not equal to that of a shield; then he should pay a penalty of twice its value and be flogged as a punishment. He said: O Messenger of Allah! SunanAbuDawoud-017-001-25781Narrated Abu Dawud: I found in my notebook from Shaiban and I did not hear from him ; Abu Bakr; a reliable friend of ours; said: Shaiban - Muhammad Bin Rashid - Sulaiman Bin Mousad - Amr Bin Suhaib; On his father authority; said that his grandfather said: The Messenger of Allah ﷺ would fix the blood-money for accidental killing at the rate of four hundred dinars or their equivalent in silver for townsmen; and he would fix it according to the price of camels. So when they were dear; he increased the amount to be paid; and when cheap prices prevailed he reduced the amount to be paid. In the time of the Messenger of Allah ﷺ they reached between four hundred and eight hundred dinars; their equivalent in silver being eight thousand dirhams. He said: The Messenger of Allah ﷺ gave judgment that those who possessed cattle should pay two hundred cows; and those who possessed sheep two thousand sheep. He said: The Messenger of Allah ﷺ said: The blood-money is to be treated as something to be inherited by the heirs of the one who has been killed; and the remainder should be divided among the agnates. He said: The Messenger of Allah ﷺ gave judgment that for cutting off a nose completely there was full blood-money; one hundred camels were to be paid. If the tip of the nose was cut off; half of the blood-money;i.e. fifty camels were to be paid; or their equivalent in gold or in silver; or a hundred cows; or one thousand sheep. For the hand; when it was cut of;f half of the blood-money was to be paid; for one foot of half; the blood-money was to be paid. For a wound in the head; a third of the blood-money was due; i.e. thirty-three camels and a third of the blood-money; or their equivalent in gold; silver; cows or sheep. For a head thrust which reaches the body; the same blood-money was to be paid. Ten camels were to be paid for every finger; and five camels for every tooth. The Messenger of Allah ﷺ gave judgment that the blood-money for a woman should be divided among her relatives on her father side; who did not inherit anything from her except the residence of her heirs. If she was killed; her blood-money should be distributed among her heirs; and they would have the right of taking revenge on the murderer. The Messenger of Allah ﷺ said: There is nothing for the murderer; and if he the victim has no heir; his heir will be the one who is nearest to him among the people; but the murderer should not inherit anything. SunanAbuDawoud-017-001-26584Narrated Rafi Ibn Khadij: Muhammad Ibn Yahya Ibn Hibban said: A slave stole a plant of a palm-tree from the orchard of a man and planted it in the orchard of his master. The owner of the plant went out in search of the plant and he found it. He solicited help against the slave from Marwan Ibn AlHakam who was the Governor of Medina at that time. Marwan confined the slave and intended to cut off his hand. The slave master went to Rafi Ibn Khadij and asked him about it. He told him that he had heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. The man then said: Marwan has seized my slave and wants to cut off his hand. I wish you to go with me to him and tell him that which you have heard from the Messenger of Allah ﷺ. So Rafi Ibn Khadij went with him and came to Marwan Ibn AlHakam. Rafi said to him: I heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. SunanAbuDawoud-017-001-26590Narrated Safwan Bin Umayah: I was sleeping in the Masjid on a cloak mine whose price was thirty dirhams. A man came and pinched it away from me. The man was seized and brought to the Messenger of Allah ﷺ. He ordered that his hand should be cut off. I came to him and said: Do you cut off only for thirty dirhams ? I sell it to him and make the payment of its price a loan ? He said: Why did you not do so before bringing him to me ?Abu Dawud said: Zaidah has also transmitted it from Simak from Juayd Ibn Hujayr. MuwataMalik-017-001-34793Yahya related to me from Malik from Abdullah Ibn Abi Bakr Ibn Hazim that Amra bint Abdulrahman said; Aisha; the wife of the Prophet; may Allah bless him and grant him peace; went out to Makka and she had two girl mawlas of hers and a slave belonging to the sons of Abdullah Ibn Abi Bakr AlSiddiq. She sent a figured cloak with the two mawlas which was sewn up in a piece of green cloth. Amra continued; The slave took it and unstitched it and took out the cloak. In its place; he put some felt or skin and sewed it up again. When the mawla girls came to Madina; they gave it to his people. When they opened it; they found felt in it and did not find the cloak. They spoke to the two women and they spoke to Aisha; the wife of the Prophet; may Allah bless him and grant him peace; or they wrote to her and suspected the slave. The slave was asked about it and confessed. Aisha; the wife of the Prophet; may Allah bless him and grant him peace; gave the order and his hand was cut off. Aisha said; A thief hand is cut off for a quarter of a dinar and upwards. Malik said; The limit I prefer above which cutting off the hand is obliged is three dirhams; whether the exchange is high or low. That is because the Messenger of Allah; may Allah bless him and grant him peace; cut off the hand of a thief for a shield whose value was three dirhams; and Uthman Ibn Affan cut off the hand of a thief for a citron which was estimated at three dirhams. Abdullah Ibn Umar sent him to Said Ibn AlAs; who was the amir of Madina; to cut off his hand. Said refused to cut off his hand. He said; The hand of a runaway slave is not cut off when he steals. Abdullah Ibn Umar said to him; In what Book of Allah did you find this? MuwataMalik-017-001-34795Yahya related to me from Malik that Zurayq Ibn Hakim informed him that he had a runaway slave who had stolen. He said; The situation was obscure for me; so I wrote to Umar Ibn Abd AlAziz to ask him about it. He was the governor at that time. I informed him that I had heard that if a runaway slave stole while he was a fugitive; his hand was not cut off. Umar Ibn Abd AlAziz wrote to contradict my letter; You wrote to me that you have heard that when the runaway slave steals; his hand is not cut off. Allah; the Blessed; the Exalted; says in His Book; The thief; male and female; cut off the hands of both; as a recompense for what they have earned; and an exemplary punishment from Allah. Allah is Mighty; Wise. Surat 5 ayat 41 When his theft reaches a quarter of a dinar; and upwards; his hand is cut off. Yahya related to me from Malik that he had heard that AlQasim Ibn Muhammad and Salim Ibn Abdullah and Urwa Ibn AlZubair said; When a runaway slave steals something for which cutting off the hand is obliged; his hand is cut off. MuwataMalik-017-001-34798Yahya related to me from Malik from Abdulrahman Ibn AlQasim from his father that a man from Yemen who had his hand and foot cut off came and went before Abu Bakr AlSiddiq and complained to him that the governor of the Yemen had wronged him; and the man used to pray part of the night. Abu Bakr said; By your father; your night is not the night of a thief. Then they missed a necklace of Asma bint Umays; the wife of Abu Bakr AlSiddiq. The man came to go around with them looking for it. He said; O Allah! You are responsible for the one who invaded the people of this good house by night! They found the jewelry with a goldsmith. He claimed that the maimed man had brought it to him. The maimed man confessed or it was testified against him. Abu Bakr AlSiddiq ordered that his left hand be cut off. Abu Bakr said; By Allah! His dua against himself is more serious; as far as I am concerned; than his theft. Yahya said that Malik said; What is done among us about the person who steals several times and is then called to reckoning; is that only his hand is cut off for all he stole when the hadd has not been applied againsthim. MuwataMalik-017-001-34799Yahya related to me from Malik that Abuz-Zinad informed him that a governor of Umar Ibn Abd AlAziz took some people in battle and had not killed any of them. He wanted to cut off their hands or kill them; so he wrote to Umar Ibn Abd AlAziz about that Umar Ibn Abd AlAziz wrote to him; Better to take less than that. Yahya said that he heard Malik say; What is done among us about a person who steals the goods of people which are placed under guard in the markets; and their owners put them in their containers and store them together is that if anyone steals any of that from where it is kept; and its value reaches that for which cutting off the hand is obliged; his hand must be cut off; whether or not the owner of the goods is with his goods and whether it is night or day. Malik said about some one who stole something for which cutting off the hand was obliged and then what he stole was found with him and he returned it to its owner; His hand is cut off. Malik said; If someon says; How can his hand be cut off when the goods have been taken from him and returned to their owner?; it is because he is in the same position as the wine drinker when the smell of the wine is found on his breath and he is not drunk. He is flogged with the hadd. The hadd is imposed for drinking wine even if it does not make the man intoxicated. That is because he drank it to become intoxicated. It is the same as that with cutting off the hand of the thief for theft when it is taken from him; even if he has not profited from it and it was returned to its owner. When he stole it; he stole it to take it away. Malik said that if some people came to a house and robbed it together; and then they left with a sack or box or a board or basket or the like of that which they carried together; and when they took it out of its guarded place; they carried it together; and the price of what they took reached that for which cutting off the hand was obliged; and that was three dirhams and upwards; each of them had his hand cut off. If each of them takes out something by himself; whoever of them takes out something whose value reaches three dirhams and upwards must have his hand cut off. If any of them takes out something whose value does not reach three dirhams; he does not have his hand cut off. Yahya said that Malik said; What is done among us is that when a man house is locked and he is the only one living in it; cutting off the hand is not obliged against the one who steals something from it until he takes it out of the house completely. That is because all of the house is a place of custody. If someone other than him lives in the house and each of them locks his door; and it is a place of custody for each of them; whoever steals anything from the apartments of that house must have his hand cut off when he leaves the apartment and goes into the main house. He has removed it from its place of custody to another place and he must have his hand cut off. Malik said; What is done in our community about a slave who steals from the property of his master is that if he is not in service and among those trusted in the house and he enters secretly and steals from his master something that for which cutting off the hand is obliged; his hand is not cut off. It is like that with a slave-girl when she steals from her master property. Her hand is not cut off. Malik then spoke about a slave who was not in service and not one of those trusted in the house; and he entered secretly and stole from the property of his master wife that for which cutting off the hand was obliged. He said; His hand is cut off. It is like that with the wife slave-girl when she does not serve her or her husband nor is she trusted in the house and she enters secretly and steals from her mistress property that for which cutting off the hand is obliged. Her hand is not cut off. It is like that with the wife slave-girl who is not in her service and is not trusted in the house and she enters secretly and steals from the property of her mistress husband something for which cutting off the hand is obliged. Her hand is cut off. It is like that with the man who steals from his wife goods or the wife who steals from her husband goods something for which cutting off the hand is obliged. If the thing which one of them steals from his spouse property is in a room other than the room which they both lock for themselves; or it is in a place of custody in a room other than the room which they are in; whichever of them steals something for which cutting off the hand is obliged; their hand should be cut off. Malik spoke about a small child and a foreigner who does not speak clearly. He said; If they are robbed of something from its place of custody or from under a lock; the one who stole it has his hand cut off. If the property is outside of its place of custody or locked room when it is stolen ; the one who robbed them does not have his hand cut off. It is then in the position of sheep stolen from the mountain and uncut fruit hanging on the trees Malik said; What is done among us about a person who robs graves is that if what he takes from the grave reaches what cutting off the hand is obliged for; his hand is cut off. That is because the grave is a place of custody for what is in it just as houses are a place of custody for what is in them. MuwataMalik-017-001-34800Yahya related to me from Malik from Yahya Ibn Said from Muhammad Ibn Yahya Ibn Habban that a slave stole a small palm from a man garden and planted it in the garden of his master. The owner of the palm went out looking for the palm and found it. He asked for help against the slave from Marwan Ibn AlHakam. Marwan jailed the slave and wanted to cut off his hand. The master of the slave rushed off to Rafi Ibn Khadij and asked him about it. Rafi informed him that he heard the Messenger of Allah; may Allah bless him and grant him peace; say; The hand is not cut off for fruit or palm pith. The man said; Marwan Ibn AlHakam has taken a slave of mine and wants to cut off his hand. I would like you to go with me to him so you can tell him what you heard from the Messenger of Allah; may Allah bless him and grant him peace. So; Rafi went with him to Marwan Ibn AlHakam. He said; Did you arrest a slave for this? He said; Yes. He said; What will you do with him? He said; I want to cut off his hand. Rafi said to him; I heard the Messenger of Allah; may Allah bless him and grant him peace; say; The hand is not cut off for dates or palm pith. Amra bint Abdulrahman sent a girl mawla to him called Umaya. Abu Bakr said that she had come to him while he was among the people and said that his aunt Amra sent word to him saying; Son of my brother! You have taken a Nabatean for something insignificant which was mentioned to me. Do you want to cut off his hand? He had said; Yes. She said; Amra says to you not to cut off the hand except for a quarter of a dinar and upwards. Abu Bakr added; So I let the Nabatean go. Malik said; The generally agreed on way of doing things among us about the confession of slaves is that if a slave confesses something against himself; the hadd and punishment for it is inflicted on his body. His confession is accepted from him and one does not suspect that he would inflict something on himself. Malik said; As for the one of them who confesses to a matter which will incur damages agains this master; his confession is not accepted against his master. Malik said; One does not cut off the hand of a hireling or a man who is with some people to serve them; if he robs them; because his state is not the state of a thief. His state is the state of a treacherous one. The treacherous one does not have his hand cut off. Malik said about a person who borrows something and then denies it; His hand is not cut off. He is like a man who owes a debt to another man and denies it. He does not have his hand cut off for what he has denied. Malik said; The generally agreed-on way of dealing among us; with the thief who is found in a house and has gathered up goods and has not taken them out; is that his hand is not cut off. That is like the man who places wine before him to drink it and does not do it. The hadd is not imposed on him. That is like a man who sits with a woman and desires to have haram intercourse with her and does not do it and he does not reach her. There is no hadd against that either. Yahya said; Malik was asked about cutting off the lower lid of the eye and the bone around the eye. He said; There is only ijtihad in that unless the vision of the eye is impaired. He is entitled to an amount that is compatible to the extent the vision of the eye has been impaired. MuwataMalik-017-001-34893Yahya said that he heard Malik speak about a man who bought goods - animals or clothes or wares; and the sale was found not to be permitted so it was revoked and the one who had taken the goods was ordered to return the owner his goods. Malik said; The owner of the goods only has their value on the day they were taken from him; and not on the day they are returned to him. That is because the man is liable for them from the day he took them and whatever loss is in them after that is against him. For that reason; their increase and growth are also his. A man may take the goods at a time when they are selling well and are in demand; and then have to return them at a time when they have fallen in price and no one wants them. For instance; the man may take the goods from the other man; and sell them for ten dinars or keep them while their price is that. Then he may have to return them while their price is only a dinar. He should not go off with nine dinars from the man property. Or perhaps they are taken by the man; and he sells them for a dinar or keeps them; while their price is only a dinar; then he has to return them; and their value on the day he returns them is ten dinars. The one who took them does not have to pay nine dinars from his property to the owner. He is only obliged to pay the value of what he took possession of on the day it was taken. He said; Part of what clarifies this is that when a thief steals goods; only their price on the day he stole them is looked at. If cutting off the hand is necessary because of it; that is done. If the cutting off is delayed; either because the thief is imprisoned until his situation is examined or he flees and then is caught; the delay of the cutting off of the hand does not make the hadd; which was obliged for him on the day he stole; fall from him even if those goods become cheap after that. That is against the slave person and does not exceed the price of the slave whether it is little or much. If his master wishes to give the value of what the slave took or ruined; or pay the blood-price for the injury; he pays it and keeps his slave. If he wishes to surrender him; he surrenders him; and none of that is against him. MuwataMalik-017-001-34950Yahya said that he heard Malik say; If a man buys a garment which has a defect; a burn or something else; which the seller knows about and that is testified against him or he confirms it; and the man who has bought it causes a new tear which decreases the price of the garment; and then he learns about the original defect; he can return it to the seller and he is not liable for his tearing it. If a man buys a garment which has a defect of a burn or flaw; and the one who sold it to him claims that he did not know about it; and the buyer has cut the garment or dyed it; then the buyer has an option. If he wishes; he can have a reduction according to what the burn or flaw detracts from the price of the garment and he can keep the garment; or if he wishes to pay damages for what the cutting or dyeing has decreased of the price of the garment and return it; he can do so. If the buyer has dyed the garment with a dye which increases the value; the buyer has an option. If he wishes; he has a reduction from the price of the garment according to what the defect diminishes or if he wishes to become a partner with the one who sold the garment he does so. The price of the garment with a burn or flaw is looked at. If the price is ten dirhams; and the amount by which the dyeing increased the value is five dirhams; then they are partners in the garment; each according to his share. Malik was asked whether some one in ihram who had an ear-complaint could use medicinal oil which was not perfumed for dropping into his ears; and he said; I do not see any harm in that; and even if he were to put it into his mouth I still would not see any harm in it. He took my forehead and said; Shave your hair and fast three days or feed six poor people. The Messenger of Allah; may Allah bless him and grant him peace; was aware that I did not have anything with me to sacrifice. Malik said; concerning paying compensation fidya for the relief of physical discomfort; The custom concerning it is that no one pays compensation until he has done something which makes it obligatory to pay compensation just as making amends kaffara is only done when it has become obligatory for the one who owes it. The person can pay the compensation wherever he wishes; regardless of whether he has to sacrifice an animal or fast or give sadaqa - in Makka or in any other town. Malik said; It is not correct for a person in ihram to pluck out any of his hair or to shave it or cut it until he has left ihram; unless he is suffering from an ailment of the head; in which case he owes the compensation Allah the Exalted has ordered. It is not correct for a person in ihram to cut his nails; or to kill his lice; or to remove them from his head or from his skin or his garment to the ground. If a person in ihram removes lice from his skin or his garment; he must give away the quantity of food that he can scoop up with both hands. Malik said;Anyone who; while in ihram; plucks out hairs from his nose or armpit or rubs his body with a depilatory agent or shaves the hair from around a head wound out of necessity or shaves his neck for the place of the cupping glasses; regardless of whether it is in forgetfulness or in ignorance; owes compensation in all these instances; and he must not shave the place of the cupping glasses.
