When ye do divorce women, divorce them at their prescribed periods, and count (accurately), their prescribed periods: And fear Allah your Lord: and turn them not out of their houses, nor shall they (themselves) leave, except in case they are guilty of some open lewdness, those are limits set by Allah: and any who transgresses the limits of Allah, does verily wrong his (own) soul: thou knowest not if perchance Allah will bring about thereafter some new situation.
Surat AlBaqara Ayah 275Surat AlBaqara-0.4387الَّذِينَ يَأْكُلُونَ الرِّبَا لَا يَقُومُونَ إِلَّا كَمَا يَقُومُ الَّذِي يَتَخَبَّطُهُ الشَّيْطَانُ مِنَ الْمَسِّ ذَلِكَ بِأَنَّهُمْ قَالُوا إِنَّمَا الْبَيْعُ مِثْلُ الرِّبَا وَأَحَلَّ اللَّهُ الْبَيْعَ وَحَرَّمَ الرِّبَا فَمَنْ جَاءَهُ مَوْعِظَةٌ مِنْ رَبِّهِ فَانْتَهَى فَلَهُ مَا سَلَفَ وَأَمْرُهُ إِلَى اللَّهِ وَمَنْ عَادَ فَأُولَئِكَ أَصْحَابُ النَّارِ هُمْ فِيهَا خَالِدُونَThose who devour usury will not stand except as stand one whom the Evil one by his touch Hath driven to madness. That is because they say: "Trade is like usury," but Allah hath permitted trade and forbidden usury. Those who after receiving direction from their Lord, desist, shall be pardoned for the past; their case is for Allah (to judge); but those who repeat (The offence) are companions of the Fire: They will abide therein (for ever).

Avoid suspicion as much (as possible): for suspicion in some cases is a sin: And spy not on each other behind their backs. Would any of you like to eat the flesh of his dead brother? Nay, ye would abhor it... But fear Allah: For Allah is Oft-Returning, Most Merciful.

Surat AlBaqara Ayah 230Surat AlBaqara-0.2687فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ فَإِنْ طَلَّقَهَا فَلَا جُنَاحَ عَلَيْهِمَا أَنْ يَتَرَاجَعَا إِنْ ظَنَّا أَنْ يُقِيمَا حُدُودَ اللَّهِ وَتِلْكَ حُدُودُ اللَّهِ يُبَيِّنُهَا لِقَوْمٍ يَعْلَمُونَSo if a husband divorces his wife (irrevocably), He cannot, after that, re-marry her until after she has married another husband and He has divorced her. In that case there is no blame on either of them if they re-unite, provided they feel that they can keep the limits ordained by Allah. Such are the limits ordained by Allah, which He makes plain to those who understand.

But if they turn renegades, seize them and slay them wherever ye find them; and (in any case) take no friends or helpers from their ranks;-
Surat AlQasas Ayah 47Surat AlQasas-0.2345وَلَوْلَا أَنْ تُصِيبَهُمْ مُصِيبَةٌ بِمَا قَدَّمَتْ أَيْدِيهِمْ فَيَقُولُوا رَبَّنَا لَوْلَا أَرْسَلْتَ إِلَيْنَا رَسُولًا فَنَتَّبِعَ آيَاتِكَ وَنَكُونَ مِنَ الْمُؤْمِنِينَIf (We had) not (sent thee to the Quraish), - in case a calamity should seize them for (the deeds) that their hands have sent forth, they might say: "Our Lord! why didst Thou not sent us a messenger? We should then have followed Thy Signs and been amongst those who believe!"

Surat Saba Ayah 23Surat Saba-0.2254وَلَا تَنْفَعُ الشَّفَاعَةُ عِنْدَهُ إِلَّا لِمَنْ أَذِنَ لَهُ حَتَّى إِذَا فُزِّعَ عَنْ قُلُوبِهِمْ قَالُوا مَاذَا قَالَ رَبُّكُمْ قَالُوا الْحَقَّ وَهُوَ الْعَلِيُّ الْكَبِيرُ"No intercession can avail in His Presence, except for those for whom He has granted permission. So far (is this the case) that, when terror is removed from their hearts (at the Day of Judgment, then) will they say, 'what is it that your Lord commanded?' they will say, 'That which is true and just; and He is the Most High Most Great'."

Say thou: "My Lord knoweth best their number; It is but few that know their (real case)." Enter not, therefore, into controversies concerning them, except on a matter that is clear, nor consult any of them about (the affair of) the Sleepers.

Surat AlKahf Ayah 28Surat AlKahf-0.06766وَاصْبِرْ نَفْسَكَ مَعَ الَّذِينَ يَدْعُونَ رَبَّهُمْ بِالْغَدَاةِ وَالْعَشِيِّ يُرِيدُونَ وَجْهَهُ وَلَا تَعْدُ عَيْنَاكَ عَنْهُمْ تُرِيدُ زِينَةَ الْحَيَاةِ الدُّنْيَا وَلَا تُطِعْ مَنْ أَغْفَلْنَا قَلْبَهُ عَنْ ذِكْرِنَا وَاتَّبَعَ هَوَاهُ وَكَانَ أَمْرُهُ فُرُطًاAnd keep thy soul content with those who call on their Lord morning and evening, seeking His Face; and let not thine eyes pass beyond them, seeking the pomp and glitter of this Life; no obey any whose heart We have permitted to neglect the remembrance of Us, one who follows his own desires, whose case has gone beyond all bounds.
Surat AlNisa Ayah 11Surat AlNisa-0.0692يُوصِيكُمُ اللَّهُ فِي أَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ فَإِنْ كُنَّ نِسَاءً فَوْقَ اثْنَتَيْنِ فَلَهُنَّ ثُلُثَا مَا تَرَكَ وَإِنْ كَانَتْ وَاحِدَةً فَلَهَا النِّصْفُ وَلِأَبَوَيْهِ لِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ مِمَّا تَرَكَ إِنْ كَانَ لَهُ وَلَدٌ فَإِنْ لَمْ يَكُنْ لَهُ وَلَدٌ وَوَرِثَهُ أَبَوَاهُ فَلِأُمِّهِ الثُّلُثُ فَإِنْ كَانَ لَهُ إِخْوَةٌ فَلِأُمِّهِ السُّدُسُ مِنْ بَعْدِ وَصِيَّةٍ يُوصِي بِهَا أَوْ دَيْنٍ آبَاؤُكُمْ وَأَبْنَاؤُكُمْ لَا تَدْرُونَ أَيُّهُمْ أَقْرَبُ لَكُمْ نَفْعًا فَرِيضَةً مِنَ اللَّهِ إِنَّ اللَّهَ كَانَ عَلِيمًا حَكِيمًاAllah (thus) directs you as regards your Children's (Inheritance): to the male, a portion equal to that of two females: if only daughters, two or more, their share is two-thirds of the inheritance; if only one, her share is a half. For parents, a sixth share of the inheritance to each, if the deceased left children; if no children, and the parents are the (only) heirs, the mother has a third; if the deceased Left brothers (or sisters) the mother has a sixth. (The distribution in all cases ('s) after the payment of legacies and debts. Ye know not whether your parents or your children are nearest to you in benefit. These are settled portions ordained by Allah; and Allah is All-knowing, Al-wise.
Surat AlTaubah Ayah 69Surat AlTaubah-0.016113كَالَّذِينَ مِنْ قَبْلِكُمْ كَانُوا أَشَدَّ مِنْكُمْ قُوَّةً وَأَكْثَرَ أَمْوَالًا وَأَوْلَادًا فَاسْتَمْتَعُوا بِخَلَاقِهِمْ فَاسْتَمْتَعْتُمْ بِخَلَاقِكُمْ كَمَا اسْتَمْتَعَ الَّذِينَ مِنْ قَبْلِكُمْ بِخَلَاقِهِمْ وَخُضْتُمْ كَالَّذِي خَاضُوا أُولَئِكَ حَبِطَتْ أَعْمَالُهُمْ فِي الدُّنْيَا وَالْآخِرَةِ وَأُولَئِكَ هُمُ الْخَاسِرُونَAs in the case of those before you: they were mightier than you in power, and more flourishing in wealth and children. They had their enjoyment of their portion: and ye have of yours, as did those before you; and ye indulge in idle talk as they did. They!- their work are fruitless in this world and in the Hereafter, and they will lose (all spiritual good).
Surat AlTahrim Ayah 2Surat AlTahrim-0.012107قَدْ فَرَضَ اللَّهُ لَكُمْ تَحِلَّةَ أَيْمَانِكُمْ وَاللَّهُ مَوْلَاكُمْ وَهُوَ الْعَلِيمُ الْحَكِيمُAllah has already ordained for you, (O men), the dissolution of your oaths (in some cases): and Allah is your Protector, and He is Full of Knowledge and Wisdom.

SahihAlBukhari-017-001-1208Narrated Abu Huraira: While we were with Allah Messenger ﷺ a bedouin got up and said; O Allah Messenger ﷺ ! Settle my case according to Allah Book Laws. Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. SahihAlBukhari-017-001-1228Narrated AlQasim Bin Muhammad: Ibn Abbas mentioned the case of a couple on whom the judgment of Lian has been passed. Abdullah Bin Shaddad said; Was that the lady in whose case the Prophet ﷺ said; If I were to stone a lady to death without a proof against her ? Ibn Abbas said; No! That was concerned with a woman who though being a Muslim used to arouse suspicion by her outright misbehavior. SahihAlBukhari-017-001-1268Narrated Umm Salamah : Allah Messenger ﷺ said; I am only a human being; and you people opponents come to me with your cases; and it may be that one of you can present his case eloquently in a more convincing way than the other; and I give my verdict according to what I hear. So if ever I judge by error and give the right of a brother to his other brother then he the latter should not take it; for I am giving him only a piece of Fire. SahihAlBukhari-017-001-1269Narrated Abu Qatada: Allah Messenger ﷺ said on the Day of the battle of Hunain; Whoever has killed an infidel and has a proof or a witness for it; then the salb arms and belongings of that deceased will be for him. I stood up to seek a witness to testify that I had killed an infidel but I could not find any witness and then sat down. Then I thought that I should mention the case to Allah Messenger ﷺ I and when I did so a man from those who were sitting with him said; The arms of the killed person he has mentioned; are with me; so please satisfy him on my behalf. Abu Bakr said; No; he will not give the arms to a bird of Quraish and deprive one of Allah lions of it who fights for the cause of Allah and His Apostle. Allah Messenger ﷺ I stood up and gave it to me; and I bought a garden with its price; and that was my first property which I owned through the war booty. The people of Hijaz said; A judge should not pass a judgment according to his knowledge; whether he was a witness at the time he was the judge or before that And if a litigant gives a confession in favor of his opponent in the court; in the opinion of some scholars; the judge should not pass a judgment against him till the latter calls two witnesses to witness his confession. And some people of Iraq said; A judge can pass a judgement according to what he hears or witnesses the litigant confession in the court itself; but if the confession takes place outside the court; he should not pass the judgment unless two witnesses witness the confession. Some of them said; A judge can pass a judgement depending on his knowledge of the case as he is trust-worthy; and that a witness is Required just to reveal the truth. The judge knowledge is more than the witness. Some said; A judge can judge according to his knowledge only in cases involving property; but in other cases he cannot. SahihAlBukhari-017-001-1279Narrated Umm Salamah : the wife of the Prophet Allah Messenger ﷺ heard some people quarreling at the door of his dwelling; so he went out to them and said; I am only a human being; and litigants with cases of dispute come to me; and someone of you may happen to be more eloquent in presenting his case than the other; whereby I may consider that he is truthful and pass a judgment in his favor. The Prophet ﷺ said; By Him in Whose Hand my soul is; I will judge you according to Allah Laws. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you; O Unais! Go to the wife of this man and if she confesses ; stone her to death. SahihAlBukhari-017-001-1612Narrated Sahl Bin Sad: I witnessed the case of Lian the case of a man who charged his wife for committing illegal sexual intercourse when I was fifteen years old. The Prophet ﷺ ordered that they be divorced; and the husband said; If I kept her; I would be a liar. I remember that AlZubair also said; It was said that if that woman brought forth the child with such-and-such description; her husband would prove truthful; but if she brought it with such-and-such description looking like a Wahra a red insect ; he would prove untruthful. Abdulrahman who was the youngest of them all; started talking. The Prophet ﷺ said; Let the older among you speak first. So they spoke about the case of their murdered friend. Marwan in Sulaiman version said; Abdulrahman Bin AlHakam did not obey me or had a convincing argument. In AlQasim versions Marwan said; Have you not heard of the case of Fatima bint Qais? Aisha said; The case of Fatima bint Qais is not in your favor. Fatima said: By Allah; I will never talk to him about this matter. Aisha further reported: The wives of Allah Apostle ﷺ then sent Zainab Bin Jahsh; the wife of Allah Apostle ﷺ ; and she was one who was somewhat equal in rank with me in the eyes of Allah Messenger ﷺ and I have never seen a woman more advanced in religious piety than Zainab; more God-conscious; more truthful; more alive to the ties of blood; more generous and having more sense of self-sacrifice in practical life and having more charitable disposition and thus more close to God; the Exalted; than her. She; however; lost temper very soon but was soon calm. Allah Messenger ﷺ permitted her to enter as she Aisha was along with Allah Messenger ﷺ in her mantle; in the same very state when Fatima had entered. She said: Allah Messenger; your wives have sent me to you seeking equity in case of the daughter of Abu Quhafa. She then came to me and showed harshness to me and I was seeing the eyes of Allah Messenger ﷺ whether he would permit me. Zainab went on until I came to know that Allah Messenger ﷺ would not disapprove if I retorted. Then I exchanged hot words until I made her quiet. I often bestow something upon a person; whereas someone else is dearer to me than he; because of the fear that he may fall headlong into the fire. When the month of Ramadan entered; I pronounced Zihar upon my wife to last until the end of Ramadan; fearing that I might have an encounter with her during the night; and I would continue doing that until daylight came upon me; and I would not be able to stop. One night while she was serving me; something of her became exposed for me; so I rushed myself upon her. When the morning came I went to my people to inform them about what happened to me. I said: Accompany me to the Messenger of Allah to inform him about my case. They said: No by Allah! We shall not do that; we feat that something will be revealed about us in the Quran; or the Messenger of Allah might say something about us; the disgrace of which will remain upon us. But you do and do whatever you want. He said: So I left and I went to the Messenger of Allah; and informed him of my case. He said: You are the one who did that? I said: I am the one. He said: You are the one who did that? I said: I am the one. He said: You are the one who did that? SunanAlTermithi-017-001-7417Hamnah bint Jahsh narrated: I had a case of blood flow that was severe and excessive. So I went to the Prophet to inform him and ask him about it. I found him in the house of my sister Zainab bint Jahsh. I said; O Messenger of Allah! I suffer from a case of severe and excessive blood flow. So what do you order me to do for it; and does this prevent me from fasting and performing Prayer? He said: Tie a cotton rag around yourself and the bIood will go away. I said; It is more than that. He said: Make it tight. I said; It is more than that. He said: Then use a cloth to bind it. I said; it is more than that. It flows too much. So the Prophet said: I will order you to do one of two things; which ever of them you do; it will be acceptable for you. You should know which of them you are able to do. Then he said: This is only a blow from Shaitan. Menstruate for six or seven days; which Allah knows; then perform Ghusl. When you see that you have become pure and clean; then perform Prayer for twenty-three or twenty-four nights and their days. Perform Prayer and fast; and that will be acceptable for you. So do this if you can just as other women who menstruate and become pure during their periods of menstruation and purity. If not; and you are able to delay Zuhr and hasten Asr then perform Ghusl when you have become pure; and pray Zuhr and Asr together. Then delay Maghrib and hasten Isha; then perform Ghusl and combine the two prayers. So do this if you are able. Then perform Ghusl with the dawn and pray. Do this; and fast if you are able to do so. He ﷺ expressed his gratitude to Allah and praised Him; and reminded and exhorted; then he said: Which day is most sacred? Which day is most sacred? Which day is most sacred? Indeed the Muslim is the brother of the Muslim; so it is not lawful for the Muslim to do anything to his brother; which is not lawful to be done to himself. Behold! All Riba from Aljahiliyah is invalid; for you is the principle of your wealth; but your are not to wrong nor be wronged - except in the case of Riba of AlAbbas Bin Abd AlMuttalib - otherwise it is all invalid. Behold! All retribution regarding cases of blood during Aljahiliyah are invalid. The first case of blood retribution invalidated among those of Aljahiliyah; is the blood of AlHarith Bin Abd AlMuttalib who was nursed among Banu Laith and killed by Hudhail. Behold! I order you to treat women well; for they are but like captives with you; you have no sovereignty beyond this over them; unless they manifest lewdness. If they do that; then abandon their beds; and beat them with a beating that is not painful. Then if they obey you; then there is no cause for you against them beyond that. Behold! There are rights for you upon your women; and rights for your women upon you. As for your rights upon them;then they are not to allow anyone on your bedding whom you dislike; nor to permit anyone whom you dislike in your homes. Behold! He said: The thief must pay double and be punished. There is no cutting off of the hand for stealing livestock; except what which has been put in the pen; if its value is equal to that of a shield; in which case the thiefs hand is to be cut off. If its value is not equal to that of a shield; then he should pay a penalty of twice its value and be flogged as a punishment. He said: O Messenger of Allah! What do you think about fruit on the tree? He said: The thief must pay double and be punished. SunanAbuDawoud-017-001-25129Ubaid Allah said Marwan sent someone Qabisah to Fatimah and asked her about the case. She said that she was the wife of Abu Hafs. The Prophet ﷺ appointed Ali as governor in a certain part of Yemen. Her husband also proceeded with him. From there he sent a message to her pronouncing one divorce that had yet remained. He commanded Ayash Bin Abi Rabiah and AlHarith Bin Hisham to provide maintenance to her. They said By Allah there is no sustenance for her except in case she is pregnant. She came to the Prophet ﷺ who said There is no sustenance for you except in case you are pregnant. She then asked permission to shift from her house and he gave her permission. She asked Where should I shift. Apostle of Allaah ﷺ ? The Apostle of Allaah ﷺ said to Ibn Umm Maktum. He was blind. She would undress herself and he could not see her. She lived there till her waiting period passed. The Prophet ﷺ married her to Usamah. Qabisah then returned to Marwan and narrated that to him. Marwan said We did not hear this tradition except from a woman; so we shall follow the reliable practice on which we found the people. When this reached Fatimah she said between me and you is the Book of Allah. Allaah the exalted said Divorce them for their waiting period... Thou knowest not it may be that Allaah will afterward bring some new thing to pass. She said What a new thing will emerge after triple divorce.Abu Dawud said A similar tradition has been narrated by Yunus on the authority of AlZuhri. Ahmad said: The correct version is glittering collyrium kuhl Aljala. She sent her slave-girl to Umm Salamah; and she asked her about the use of glittering collyrium kuhl Aljala. She said: Do not apply it except in the case of dire need which is troubling you. In that case you can use it at night; but you should remove it in the daytime. Then Umm Salamah said: The Messenger of Allah ﷺ came to visit me when Abu Salamah died; and I had put the juice of aloes in my eye. He asked : What is this; Umm Salamah? I replied: It is only the juice of aloes and contains no perfume. He said: It gives the face a glow; so apply it only at night and remove it in daytime; and do not comb yourself with scent or henna; for it is a dye. I asked: What should I use when I comb myself; Messenger of Allah? A vessel was then brought to him. He inclined it towords his right hand poured water upon it. He then put it in the water three times; and washed his face three times. He then put his hand in the water and took it out; then he wiped his head and ears; in and out only once. He then washed his feet; and said : Where are those who asked me to perform ablution? I saw the Messenger of Allah ﷺ performing ablution like that. Abu Dawud said : All the sound traditions narrated by Uthman indicated that the head is to be wiped once; because they mentioned the washing of each part in ablution three times. In their versions of tradition they mentioned the wordings: he wiped his head. They brought four witnesses. Who testified that they had seen his sexual organ penetrated in her female organ like a collyrium stick when enclosed in its case. SunanAbuDawoud-017-001-28938Narrated Amr Bin Suhaib: On his father authority; said that his grandfather reported: Rabab Ibn Hudhayfah married a woman and three sons were born to him from her. Their mother then died. They inherited her houses and had the right of inheritance of her freed slaves. Amr Ibn AlAs was the agnate of her sons. He sent them to Syria where they died. Amr Ibn AlAs then came. A freed slave of hers died and left some property. Her brothers disputed with him and brought the case to Umar Ibn AlKhattab. Umar reported the Messenger of Allah ﷺ as saying: Whatever property a son or a father receives as an heir will go to his agnates; whoever they may be. He then wrote a document for him; witnessed by Abdulrahman Ibn Awuf ; Zayd Ibn Thabit and one other person. When AbdulMalik became caliph; they presented the case to Hisham Ibn Ismail or Ismail Ibn Hisham the narrator is doubtful. He sent them to Abd AlMalik who said: This is the decision which I have already seen. MuwataMalik-017-001-34907Malik related to me that he heard that Abu Salama Ibn Abdulrahman and Sulayman Ibn Yasar were both asked; Does one pronounce judgement on the basis of an oath with one witness? They both said; Yes. Malik said; The precedent of the sunna in judging by an oath with one witness is that if the plaintiff takes an oath with his witness; he is confirmed in his right. If he draws back and refuses to take an oath; the defendant is made to take an oath. If he takes an oath; the claim against him is dropped. If he refuses to take an oath; the claim is confirmed against him. Malik said; This procedure pertains to property cases in particular. It does not occur in any of the hadd-punishments; nor in marriage; divorce; freeing slaves; theft or slander. If some one says; Freeing slaves comes under property; he has erred. It is not as he said. Had it been as he said; a slave could take an oath with one witness; if he could find one; that his master had freed him. However; when a slave lays claim to a piece of property; he can take an oath with one witness and demand his right as the freeman demands his right. Malik said; The sunna with us is that when a slave brings somebody who witnesses that he has been set free; his master is made to take an oath that he has not freed him; and the slave claim is dropped. Malik said; The sunna about divorce is also like that with us. When a woman brings somebody who witnesses that her husband has divorced her; the husband is made to take an oath that he has not divorced her. If he takes the oath; the divorce does not proceed. Malik said; There is only one sunna of bringing a witness in cases of divorce and freeing a slave. The right to make an oath only belongs to the husband of the woman; and the master of the slave. Freeing is a hadd matter; and the testimony of women is not permitted in it because when a slave is freed; his inviolability is affirmed and the hadd punishments are applied for and against him. If he commits fornication and he is a muhsan; he is stoned. If he kills a slave; he is killed for it. Inheritance is established for him; between him and whoever inherits from him. If somebody disputes this; arguing that if a man frees his slave and then a man comes to demand from the master of the slave payment of a debt; and a man and two women testify to his right; that establishes the right against the master of the slave so that his freeing him is cancelled if he only has the slave as property; inferring by this case that the testimony of women is permitted in cases of setting free. The case is not as he suggests i.e. it is a case of property not freeing. It is like a man who frees his slave; and then the claimant of a debt comes to the master and takes an oath with one witness; demanding his right. By that; the freeing of the slave would be cancelled. Or else a man comes who has frequent dealings and transactions with the master of the slave. He claims that he is owed money by the master of the slave. Someone says to the master of the slave; Take an oath that you dont owe what he claims. If he draws back and refuses to take an oath; the one making the claim takes an oath and his right against the master of the slave is confirmed. That would cancel the freeing of the slave if it is confirmed that property is owed by the master. Malik said; It is the same case with a man who marries a slave-girl and then the master of the slave-girl comes to the man who has married her and claims; You and so-and-so have bought my slave-girl from me for such an amount of dinars. The husband of the slave-girl denies that. The master of the slave-girl brings a man and two women and they testify to what he has said. The sale is confirmed and his claim is considered true. So the slave-girl is haram for her husband and they have to separate; even though the testimony of women is not accepted in divorce. Malik said; It is also the same case with a man who accuses a free man; so the hadd falls on him. A man and two women come and testify that the one accused is a slave. That would remove the hadd from the accused after it had befallen him; even though the testimony of women is not accepted in accusations involving hadd punishments. Malik said; Another similar case in which judgement appears to go against the precedent of the sunna is that two women testify that a child is born alive and so it is necessary for him to inherit if a situation arises where he is entitled to inherit; and the child property goes to those who inherit from him; if he dies; and it is not necessary that the two women witnesses should be accompanied by a man or an oath even though it may involve vast properties of gold; silver; live-stock; gardens and slaves and other properties. However; had two women testified to one dirham or more or less than that in a property case; their testimony would not affect anything and would not be permitted unless there was a witness or an oath with them. Malik said; There are people who say that an oath is not acceptable with only one witness and they argue by the word of Allah the Blessed; the Exalted; and His word is the Truth; And call in to witness two witnesses; men; or if the two be not men; then one man and two women; such witnesses as you approve of. Surat 2 ayat 282. Such people argue that if he does not bring one man and two women; he has no claim and he is not allowed to take an oath with one witness. Malik said; Part of the proof against those who argue this; is to reply to them; Do you think that if a man claimed property from a man; the one claimed from would not swear that the claim was false? If he swears; the claim against him is dropped. If he refuses to take an oath; the claimant is made to take an oath that his claim is true; and his right against his companion is established. There is no dispute about this with any of the people nor in any country. By what does he take this? In what place in the Book of Allah does he find it? So if he confirms this; let him confirm the oath with one witness; even if it is not in the Book of Allah; the Mighty; the Majestic! It is enough that this is the precedent of the sunna. However; man wants to recognise the proper course of action and the location of the proof. MuwataMalik-017-001-35139Malik said; The generally agreed on way of doing things among us is that full siblings do not inherit anything with sons nor anything with grandsons through a son; nor anything with the father. They do inherit with the daughters and the granddaughters through a son when the deceased does not leave a paternal grandfather. Any property that is left over; they are in it as paternal relations. One begins with the people who are allotted fixed shares. They are given their shares. If there is anything left over after that; it belongs to the full siblings. They divide it between themselves according to the Book of Allah; whether they are male or female. The male has a portion of two females. If there is nothing left over; they have nothing. If the deceased does not leave a father or a paternal grandfather or children or male or female grandchildren through a son; a single full sister gets a half. If there are two or more full sisters; they get two thirds. If there is a brother with them; sisters; whether one or more; do not have a fixed share. One begins with whoever shares in the fixed shares. They are given their shares. Whatever remains after that goes to the full siblings. The male has the portion of two females except in one case; in which the full siblings have nothing. They share in this case the third of the half-siblings by the mother. That case is when a woman dies and leaves a husband; a mother; half- siblings by her mother; and full siblings. The husband has a half. The mother has one sixth. The half-siblings by the mother have a third. Nothing is left after that; so the full siblings share in this case with the half-siblings by the mother in their third. The male has the portion of two females in as much as all of them are siblings of the deceased by the mother. They inherit by the mother. That is because Allah; the Blessed; the Exalted; said in His Book; If a man or a woman has no direct heir and he has a brother or a sister; each one of the two gets a sixth. If there are more than that; they share equally in the third. Surat 4 ayat 12.
