SahihAlBukhari-017-001-227Narrated Abdullah Bin Ubaidullah Bin Abi Mulaika: One of the daughters of Uthman died at Mecca. We went to attend her funeral procession. Ibn Umar and Ibn Abbas were also present. I sat in between them or said; I sat beside one of them. Then a man came and sat beside me. Abdullah Bin Umar said to Amr Bin Uthman; Will you not prohibit crying as Allah Messenger ﷺ has said; The dead person is tortured by the crying of his relatives.? Ibn Abbas said; Umar used to say so. Then he added narrating; I accompanied Umar on a journey from Mecca till we reached AlBaida. There he saw some travelers in the shade of a Samura A kind of forest tree. He said to me ; Go and see who those travelers are. So I went and saw that one of them was Suhaib. I told this to Umar who then asked me to call him. So I went back to Suhaib and said to him; Depart and follow the chief of the faithful believers. Later; when Umar was stabbed; Suhaib came in weeping and saying; O my brother; O my friend! on this Umar said to him; O Suhaib! Are you weeping for me while the Prophet ﷺ said; The dead person is punished by some of the weeping of his relatives? Ibn Abbas added; When Umar died I told all this to Aisha and she said; May Allah be merciful to Umar. By Allah; Allah Messenger ﷺ did not say that a believer is punished by the weeping of his relatives. But he said; Allah increases the punishment of a non-believer because of the weeping of his relatives. Aisha further added; The Quran is sufficient for you to clear up this point as Allah has stated: No burdened soul will bear another burden. 35.18. Ibn Abbas then said; Only Allah makes one laugh or cry. SahihAlBukhari-017-001-3394Narrated Aisha: Fatima sent somebody to Abu Bakr asking him to give her her inheritance from the Prophet ﷺ from what Allah had given to His Apostle through Fai i.e. booty gained without fighting. She asked for the Sadaqa i.e. wealth assigned for charitable purposes of the Prophet ﷺ at Medina; and Fadak; and what remained of the Khumus i.e.; one-fifth of the Khaibar booty. Abu Bakr said; Allah Messenger ﷺ said; We Prophets ; our property is not inherited; and whatever we leave is Sadaqa; but Muhammad Family can eat from this property; i.e. Allah property; but they have no right to take more than the food they need. By Allah! O Abu Talha ; it is fruitful property. We have accepted it from you and now we return it to you. Distribute it amongst you relatives. So; Abu Talha distributed it amongst his relatives; amongst whom were Ubai and Hassan. When Hassan sold his share of that garden to Muawiya; he was asked; How do you see Abu Talha Sadaqa? He replied; Who should not I sell a Sa of date for Sa of money ? SahihAlBukhari-017-001-4086Narrated Anas Bin Malik: Abu Talha had the greatest wealth of date-palms amongst the Ansar in Medina; and he prized above all his wealth his garden Bairuha; which was situated opposite the Masjid of the Prophet ﷺ. The Prophet used to enter It and drink from its fresh water. When the following Divine Verse came:- By no means shall you attain piety until you spend of what you love; 3.92 Abu Talha got up saying. O Allah Messenger ﷺ ! Allah says; You will not attain piety until you spend of what you love; and I prize above AlI my wealth; Bairuha which I want to give in charity for Allah Sake; hoping for its reward from Allah. So you can use it as Allah directs you. On that the Prophet ﷺ said; Bravo! It is a profitable or perishable property. Ibn Maslama is not sure as to which word is right; i.e. profitable or perishable. I have heard what you have said; and I recommend that you distribute this amongst your relatives. On that Abu Talha said; O Allah Messenger ﷺ ! I will do as you have suggested. SahihAlBukhari-017-001-4878Narrated Anas: AlRabi; the daughter of AlNadr broke the tooth of a girl; and the relatives of AlRabi requested the girl relatives to accept the Irsh compensation for wounds etc. and forgive the offender ; but they refused. So; they went to the Prophet ﷺ who ordered them to bring about retaliation. Anas Bin AlNadr asked; O Allah; Apostle! Will the tooth of AlRabi be broken? No; by Him Who has sent you with the Truth; her tooth will not be broken. The Prophet ﷺ said; O Anas! Allah; law ordains retaliation. Later the relatives of the girl agreed and forgave her. SahihAlBukhari-017-001-6582Narrated Aisha: Fatima the daughter of the Prophet ﷺ sent someone to Abu Bakr when he was a caliph ; asking for her inheritance of what Allah Messenger ﷺ had left of the property bestowed on him by Allah from the Fai i.e. booty gained without fighting in Medina; and Fadak; and what remained of the Khumus of the Khaibar booty. On that; Abu Bakr said; Allah Messenger ﷺ said; Our property is not inherited. Whatever we leave; is Sadaqa; but the family of the Prophet Muhammad can eat of this property. By Allah; I will not make any change in the state of the Sadaqa of Allah Messenger ﷺ and will leave it as it was during the lifetime of Allah Messenger ﷺ ; and will dispose of it as Allah Messenger ﷺ used to do. So Abu Bakr refused to give anything of that to Fatima. So she became angry with Abu Bakr and kept away from him; and did not task to him till she died. She remained alive for six months after the death of the Prophet. When she died; her husband Ali; buried her at night without informing Abu Bakr and he said the funeral prayer by himself. When Fatima was alive; the people used to respect Ali much; but after her death; Ali noticed a change in the people attitude towards him. So Ali sought reconciliation with Abu Bakr and gave him an oath of allegiance. Ali had not given the oath of allegiance during those months i.e. the period between the Prophet death and Fatima death. Ali sent someone to Abu Bakr saying; Come to us; but let nobody come with you; as he disliked that Umar should come; Umar said to Abu Bakr ; No; by Allah; you shall not enter upon them alone Abu Bakr said; What do you think they will do to me? By Allah; I will go to them So Abu Bakr entered upon them; and then Ali uttered Tashah-hud and said to Abu Bakr ; We know well your superiority and what Allah has given you; and we are not jealous of the good what Allah has bestowed upon you; but you did not consult us in the question of the rule and we thought that we have got a right in it because of our near relationship to Allah Messenger ﷺ. Thereupon Abu Bakr eyes flowed with tears. And when Abu Bakr spoke; he said; By Him in Whose Hand my soul is to keep good relations with the relatives of Allah Messenger ﷺ is dearer to me than to keep good relations with my own relatives. But as for the trouble which arose between me and you about his property; I will do my best to spend it according to what is good; and will not leave any rule or regulation which I saw Allah Messenger ﷺ following; in disposing of it; but I will follow. On that Ali said to Abu Bakr; I promise to give you the oath of allegiance in this after noon. So when Abu Bakr had offered the Zuhr prayer; he ascended the pulpit and uttered the Tashah-hud and then mentioned the story of Ali and his failure to give the oath of allegiance; and excused him; accepting what excuses he had offered; Then Ali got up and praying to Allah for forgiveness; he uttered Tashah-hud; praised Abu Bakr right; and said; that he had not done what he had done because of jealousy of Abu Bakr or as a protest of that Allah had favored him with. Ali added; But we used to consider that we too had some right in this affair of rulership and that he i.e. Abu Bakr did not consult us in this matter; and therefore caused us to feel sorry. On that all the Muslims became happy and said; You have done the right thing. SahihAlBukhari-017-001-6817Narrated Ibn Abbas: The law of Qisas i.e. equality in punishment was prescribed for the children of Israel; but the Diya i.e. blood money was not ordained for them. So Allah said to this Nation i.e. Muslims : O you who believe! The law of AlQisas i.e. equality in punishment is prescribed for you in cases of murder: The free for the free; the slave for the slave; and the female for the female. But if the relatives or one of them of the killed person forgive their brother i.e. the killers something of Qisas i.e. not to kill the killer by accepting blood money in the case of intentional murder --then the relatives of the killed person should demand blood-money in a reasonable manner and the killer must pay with handsome gratitude. This is an allevitation and a Mercy from your Lord; in comparison to what was prescribed for the nations before you. SahihAlBukhari-017-001-6868Narrated Anas Bin Malik: Out of all the Ansar; living in Medina; Abu Talha had the largest number of date palm trees gardens; and the most beloved of his property to him was Bairuha garden which was standing opposite the Masjid of the Prophet. Allah Messenger ﷺ used to enter it and drink of its good water. When the Verse:-By no means shall you attain righteousness unless you spend in charity of that which you love. 3.92 Abu Talha got up and said; O Allah Messenger ﷺ ; Allah says:-By no means shall you attain righteousness unless you spend in charity of that which you love. 3.92 and the most beloved of my property to me is the Bairuha garden; so I give it as a charitable gift in Allah Cause and hope to receive good out of it; and to have it stored for me with Allah. So; O Allah Messenger ﷺ ! Dispose it of i.e. utilize it in the way Allah orders you to dispose it of. Allah Messenger ﷺ said; Bravo! That is a fruitful property! That is a fruitful property! I have heard what you have said and I think that you should distribute that garden amongst your relatives. SahihAlBukhari-017-001-6893Narrated Ibn Abbas: regarding the Divine Verse: O you who believe! You are forbidden to inherit women against their will; and you should not treat them with harshness that you may take back part of the Mahr dower you have given them. 4.19 Before this revelation if a man died; his relatives used to have the right to inherit his wife; and one of them could marry her if he would; or they would give her in marriage if they wished; or; if they wished; they would not give her in marriage at all; and they would be more entitled to dispose her; than her own relatives. I said; He is really entitled to assume authority for his father; AlZubair was the helper of the Prophet; his maternal grandfather; Abu Bakr was the Prophets companion in the cave; his mother; Asma was Dhatun-Nitaq; his aunt; Aisha was the mother of the Believers; his paternal aunt; Khadija was the wife of the Prophet ﷺ ; and the paternal aunt of the Prophet ﷺ was his grandmother. He himself is pious and chaste in Islam; well versed in the Knowledge of the Quran. By Allah! SahihMuslim-017-001-17346AlMughira Bin Shuba reported that a woman struck her co-wife with a tent-pole and she was pregnant and she killed her. One of them belonged to the tribe of Lihyan. Allah Messenger ﷺ made the relatives of the murderer responsible for the payment of blood-wit on her behalf; and fixed a slave or a female slave as the indemnity for what was in her womb. One of the persons amongst the relatives of the murderer said: Should we pay indemnity for one who; neither ate; nor drank; nor made any noise; who was just like a nonentity? Thereupon Allah Messenger ﷺ remarked: He speaks rhymed phrases like the people of the desert. SahihMuslim-017-001-18152It has been narrated on the anthority of Yazid Bin Hurmuz who said: Najda wrote to Ibn Abbas. I was sitting in the company of Ibn Abbas when he read his letter and wrote its reply. Ibn Abbas said: Were it not for preventing him from falling into wickedness. I would not have replied to his letter; may he never be joyful. He wrote in reply to him referring to the share of the close relatives of the Holy Prophet from the booty whom God has mentioned. I have to tell you that we thought we were the close relatives of the Messenger of Allah ﷺ ; but our people have refused to recognise us as such. You have asked about the orphan as to when his orphanhood comes to an end. I have to say that when he reaches the age of marriage; attains maturity of mind; and his property is returned to him; then he is no longer an orphan. You have inquired whether the Messenger of Allah may peace be upo him used to kill anyone from the children of the polytheists in the war. You should know that the Messenger of Allah ﷺ used not to kill any one of their children; and you too should not kill any one of them; except when you knew about them what Khadir had known about the boy whom he killed. And you have inquired whether there is a fixed share of the booty for women and slaves when they participate in a battle. SahihMuslim-017-001-21951Anas Bin Malik is reported as saying: Abu Talha was the one among the Ansar of Medina who possessed the largest property and among his property he valued most was his garden known as Bairaha which was opposite the Masjid; and the Messenger of Allah ﷺ often visited it and he drank of its sweet water. When this verse was revealed: You will never attain righteousness till you give freely of what you Have iii. 91 ; Abu Talha got up and; going to Allah Messenger ﷺ ; said: Allah says in His Book: You will never attain righteousness till you give freely of what you love; and the dearest of my property is Bairaha so I give it as Sadaqa to God from Whom I hope for reward for it and the treasure with Allah; so spend it; Messenger of Allah; on whatever purpose you deem it proper. The Messenger of Allah ﷺ said: Bravo I that is profit earning property. I have heard what you have said; but I think you should spend it on your nearest relatives. And perhaps He only oened His speech about the Fay and the Khumus; mentioning Himself; because that is the noblest of earnings. And Allah knows best.It was said that something should be taken form the spoils of war and placed inside the Kabah; and this is the share that is for Allah; the Mighty and Sublime. The share of the Messenger is to be given to the imam to buy horses and weapons; and to give to whomever he thinks will benefit the people of Islam; and to the people of Hadith; Knowledge; Fiqh and the Quran. The share that is for near relatives should be given to Banu Hashim and Banu AlMuttablib; rich and poor alike; or it was said that it should be given to the poor among them and not to the rich; such as orphans and wayfarers. This is the view that is more appropriate in my view; and Allah knows best. And the young and the old; male and female; are equal in that; because Allah; the mighty and sublime; has allocated it to them and the Messenger of Allah distributed it among them; and there is nothing in the Hadith to indicate that he preferred some of them over others. And there is no scholarly dispute; as far as we know; to suggest that if a man bequeaths one-third of his wealth to such a tribe; to be distributed out among them equally; that it should be done otherwise; unless the giver stipulated otherwise. And Allah is the source of strength. And there is a share for the orphans among the Muslims; and a share for the poor among the Muslims; and a share for the wayfarers among the Muslims. No one should be given both a share for the poor and a share for the wayfarer; it is to be said to him: Take whichever of them you want. And the other four-fifths are to be divided by the imam among those adult Muslims who were present in the battle. The dearest of his properties to him was Bayruha which was in front of the Masjid. The Messenger of Allah; may Allah bless him and grant him peace; used to go into it and drink from the pleasant water which was in it. Anas continued; When this ayat was sent down You will not obtain rightness of action until you expend of what you love; Surat 2 ayat l76 ; Abu Talha went to the Messenger of Allah; may Allah bless him and grant him peace; and said; Messenger of Allah! Allah; the Blessed; the Exalted; has said; You will not obtain until you expend of what you love. The property which I love the best is Bayruha. It is sadaqa for Allah. I hope for its good and for it to be stored up with Allah. Place it wherever you wish; Messengerof Allah. The Messenger of Allah; may Allah bless him and grant him peace; said; Well done! That is property which profits! That is property which profits. I have heard what you have said about it and I think that you should give it to your relatives. Abu Talha said; I will do it; Messenger of Allah! MuwataMalik-017-001-34742Yahya said from Malik from Yahya Ibn Said that Bushayr Ibn Yasar informed him that Abdullah Ibn Sahl AlAnsari and Muhayisa Ibn Masud went out to Khaybar; and they separated on their various businesses and Abdullah Ibn Sahl was killed. Muhayisa; and his brother Huwayisa and Abdulrahman Ibn Sahl went to the Prophet; may Allah bless him and grant him peace; and Abdulrahman began to speak before his brother. The Messenger of Allah; may Allah bless him and grant him peace; said; The older first; the older first. Therefore Huwayisa and then Muhayisa spoke and mentioned the affair of Abdullah Ibn Sahl. The Messenger of Allah; may Allah bless him and grant him peace; said to them; Do you swear with fifty oaths and claim the blood-money of your companion or the life of the murderer? They said; Messenger of Allah; we did not see it and we were not present. The Messenger of Allah; may Allah bless him and grant him peace; said; Will you acquit the jews for fifty oaths? They said; Messenger of Allah; how can we accept the oaths of a people who are kafirun? Yahya Ibn Said said; Bushayr Ibn Yasar claimed that the Messenger of Allah; may Allah bless him and grant him peace; paid the blood-money from his own property. Malik said; The generally agreed on way of doing things in our community and that which I heard from whoever I am content with; concerning the oath of qasama; and upon which the past and present imams agree; is that those who claim revenge begin with the oaths and swear. The oath for revenge is only obligatory in two situations. Either the slain person says; My blood is against so-and-so; or the relatives entitled to the blood bring a partial proof of it that is not irrefutable against the one who is the object of the blood-claim. This obliges taking an oath on the part of those who claim the blood against those who are the object of the blood-claim. With us; swearing is only obliged in these two situations. Malik said; That is the sunna in which there is no dispute with us and which is still the behaviour of the people. The people who claim blood begin the swearings; whether it is an intentional killing or an accident. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; began with Banu Harith in the case of the killing of their kinsman murdered at Khaybar. Malik said; If those who make the claim swear; they deserve the blood of their kinsman and whoever they swear against is slain. Only one man can be killed in the qasama. Two cannot be killed in it. Fifty men from the blood-relatives must swear fifty oaths. If their number is less or some of them draw back; they can repeat their oaths; unless one of the relatives of the murdered man who deserves blood and who is permitted to pardon it; draws back. If one of these draws back; there is no way to revenge. Yahya said that Malik said; The oaths can be made by those of them who remain if one of them draws back who is not permitted to pardon. If one of the blood-relatives draws back who is permitted to pardon; even if he is only one; more oaths can not be made after that by the blood- relatives. If that occurs; the oaths can be on behalf of the one against whom the claim is made. So fifty of the men of his people swear fifty oaths. If there are not fifty men; more oaths can be made by those of them who already swore. If there is only the defendant; he swears fifty oaths and is acquitted. Yahya said that Malik said; One distinguishes between swearing for blood and oaths for one rights. When a man has a money-claim against another man; he seeks to verify his due. When a man wants to kill another man; he does not kill him in the midst of people. He keeps to a place away from people. Had there only been swearing in cases where there is a clear proof and had one acted in it as one acts about one rights i.e. needing witnesses ; the right of blood retribution would have been lost and people would have been swift to take advantage of it when they learned of the decision on it. However; the relatives of the murdered man were allowed to initiate swearing so that people might restrain themselves from blood and the murderer might beware lest he was put into a situation like that i.e. qasama by the statement of the murdered man. Yahya said; Malik said about a people of whom a certain number are suspected of murder and the relatives of the murdered man ask them to take oaths and they are numerous; so they ask that each man swears fifty oaths on his own behalf. The oaths are not divided out between them according to their number and they are not acquitted unless each man among them swears fifty oaths on his own behalf. Malik said; This is the best I have heard about the matter. He said; Swearing goes to the paternal relatives of the slain.
