It is not lawful for you, (Men), to take back any of your gifts (from your wives), except when both parties fear that they would be unable to keep the limits ordained by Allah. If ye (judges) do indeed fear that they would be unable to keep the limits ordained by Allah, there is no blame on either of them if she give something for her freedom. These are the limits ordained by Allah; so do not transgress them if any do transgress the limits ordained by Allah, such persons wrong (Themselves as well as others).

They said: "How can he exercise authority over us when we are better fitted than he to exercise authority, and he is not even gifted, with wealth in abundance?" He said: "Allah hath Chosen him above you, and hath gifted him abundantly with knowledge and bodily prowess: Allah Granteth His authority to whom He pleaseth. Allah careth for all, and He knoweth all things."

Aye, indeed they bring them nearer (to Him): soon will Allah admit them to His Mercy: for Allah is Oft-forgiving, Most Merciful.

SahihAlBukhari-017-001-1262Narrated Abdullah Bin AlSadi: That when he went to Umar during his Caliphate. Umar said to him; Havent I been told that you do certain jobs for the people but when you are given payment you refuse to take it? Abdullah added: I said; Yes. Umar said; Why do you do so? I said; I have horses and slaves and I am living in prosperity and I wish that my payment should be kept as a charitable gift for the Muslims. Umar said; Do not do so; for I intended to do the same as you do. Allah Messenger ﷺ s used to give me gifts and I used to say to him; Give it to a more needy one than me. Once he gave me some money and I said; Give it to a more needy person than me; whereupon the Prophet ﷺ said; Take it and keep it in your possession and then give it in charity. SahihAlBukhari-017-001-1273Narrated Abu Humaid AlSaidi: The Prophet ﷺ appointed a man from the tribe of Bani Asad; called Ibn AlUtabiya to collect the Zakat. When he returned with the money he said to the Prophet ; This is for you and this has been given to me as a gift. The Prophet ﷺ stood up on the pulpit Sufyan said he ascended the pulpit ; and after glorifying and praising Allah; he said; What is wrong with the employee whom we send to collect Zakat from the public that he returns to say; This is for you and that is for me? Why didnt he stay at his father and mother house to see whether he will be given gifts or not? By Him in Whose Hand my life is; whoever takes anything illegally will bring it on the Day of Resurrection by carrying it over his neck: if it is a camel; it will be grunting: if it is a cow; it will be mooing: and if it is a sheep it will be bleating! The Prophet ﷺ then raised both his hands till we saw the whiteness of his armpits and he said ; No doubt! Havent I conveyed Allah Message? SahihAlBukhari-017-001-1293Narrated Abu Humaid AlSaidi: The Prophet ﷺ employed Ibn AlUtbiya to collect Zakat from Bani Sulaim; and when he returned with the money to Allah Messenger ﷺ the Prophet ﷺ called him to account; and he said; This amount is for you; and this was given to me as a present. Allah Messenger ﷺ said; Why dont you stay at your father house or your mother house to see whether you will be given gifts or not; if you are telling the truth? Then Allah Messenger ﷺ stood up and addressed the people; and after glorifying and praising Allah; he said: Amma Badu then after I employ some men from among you for some job which Allah has placed in my charge; and then one of you comes to me and says; This amount is for you and this is a gift given to me. Why doesnt he stay at the house of his father or the house of his mother and see whether he will be given gifts or not if he was telling the truth by Allah; none of you takes anything of it i.e.; Zakat for himself Hisham added: unlawfully but he will meet Allah on the Day of Resurrection carrying it on his neck! I do not want to see any of you carrying a grunting camel or a mooing cow or a bleating sheep on meeting Allah. Then the Prophet ﷺ raised both his hands till I saw the whiteness of his armpits; and said; No doubt ! SahihAlBukhari-017-001-4768Narrated Urwa from Aisha: The wives of Allah Messenger ﷺ were in two groups. One group consisted of Aisha; Hafsa; Safiya and Sauda; and the other group consisted of Umm Salamah and the other wives of Allah Messenger ﷺ. The Muslims knew that Allah Messenger ﷺ loved Aisha; so if any of them had a gift and wished to give to Allah Messenger ﷺ ; he would delay it; till Allah Messenger ﷺ had come to Aisha home and then he would send his gift to Allah Messenger ﷺ in her home. The group of Umm Salamah discussed the matter together and decided that Umm Salamah should request Allah Messenger ﷺ to tell the people to send their gifts to him in whatever wife house he was. Umm Salamah told Allah Messenger ﷺ of what they had said; but he did not reply. Then they those wives asked Umm Salamah about it. She said; He did not say anything to me. They asked her to talk to him again. She talked to him again when she met him on her day; but he gave no reply. When they asked her; she replied that he had given no reply. They said to her; Talk to him till he gives you a reply. When it was her turn; she talked to him again. He then said to her; Do not hurt me regarding Aisha; as the Divine Inspirations do not come to me on any of the beds except that of Aisha. On that Umm Salamah said; I repent to Allah for hurting you. Then the group of Umm Salamah called Fatima; the daughter of Allah Messenger ﷺ and sent her to Allah Messenger ﷺ to say to him; Your wives request to treat them and the daughter of Abu Bakr on equal terms. Then Fatima conveyed the message to him. The Prophet ﷺ said; O my daughter! Dont you love whom I love? She replied in the affirmative and returned and told them of the situation. They requested her to go to him again but she refused. They then sent Zainab bint Jahsh who went to him and used harsh words saying; Your wives request you to treat them and the daughter of Ibn Abu Quhafa on equal terms. On that she raised her voice and abused Aisha to her face so much so that Allah Messenger ﷺ looked at Aisha to see whether she would retort. Aisha started replying to Zainab till she silenced her. SahihAlBukhari-017-001-4814Narrated Ibn Shihab AlZuhri: Anas Bin Malik said; When the emigrants came Medina; they had nothing whereas the Ansar had land and property. The Ansar gave them their land on condition that the emigrants would give them half the yearly yield and work on the land and provide the necessaries for cultivation. Numan said : So father took hold of my hand and I was at that time a boy; and came to Allah Messenger ﷺ. and said: Allah Messenger; the mother of this son of mine ; daughter of Rawaha wishes that I should call you witness to what I confer as gift to her son. Allah Messenger may pease be upon him said: Bashir; have you any other son besides this son of yours ? He said: Yes. He the Holy Prophet said: Have you given gifts to all of them like this? By God; any one of you will not take anything from the public funds without any justification; but will meet his Lord carrying it on himself on the Day of judgment. SahihMuslim-017-001-20714Aisha reported that one day there sat together eleven women making an explicit promise amongst themselves that they would conceal nothing about their spouses. The first one said: My husband is a sort of the meat of a lean camel placed at the top of a hill; which it is difficult to climb up; nor the meat is good enough that one finds in oneself the urge to take it away from the top of that mountain. The second one said: My husband is so bad that I am afraid I would not be able to describe his faults-both visible and invisible completely. The third one said: My husband is a long-statured fellow i. e. he lacks intelligence. If I give vent to my feelings about him; he would divorce me; and if I keep quiet I would be made to live in a state of suspense neither completely abandoned by him nor entertained as wife. The fourth one said: My husband is like the night of Tihama the night of Hijaz and Mecca ; neither too cold nor hot; neither there is any fear of him nor grief. The fifth one said: My husband is like a leopard as he enters the house; and behaves like a lion when he gets out; and he does not ask about that which he leaves in the house. The sixth one said: So far as my husband is concerned; he eats so much that nothing is left back and when he drinks he drinks that no drop is left behind. And when he lies down he wraps his body and does not touch me so that he may know my grief. The seventh one said: My husband is heavy in spirit; having no brightness in him; impotent; suffering from all kinds of conceivable diseases; heaving such rough manners that he may break my head or wound my body; or may do both. The eighth one said: My husband is as sweet as the sweet-smelling plant; and as soft as the softness of the hare. The ninth one said: My husband is the master of a lofty building; long-statured; having heaps of ashes at his door and his house is near the meeting place and the inn. The tenth one said: My husband is Malik; and how fine Malik is; much above appreciation and praise of mine. He has many folds of his camel; more in number than the pastures for them. When they the camels hear the sound of music they become sure that they are going to be slaughtered. The eleventh one said: My husband is Abu Zara. How fine Abu Zara is! He has suspended in my ears heavy ornaments and fed me liberally that my sinews and bones are covered with fat. So he made me happy. He found me among the shepherds living in the side of the mountain; and he made me the owner of the horses; camels and lands and heaps of grain and he finds no fault with me. I sleep and get up in the morning at my own sweet will and drink to my heart content. The mother of Abu Zara; how fine is the mother of Abu Zara! Her bundles are heavily packed or receptacles in her house are filled to the brim and the house quite spacious. So far as the son of Abu Zara is concerned; his bed is as soft as a green palm-stick drawn forth from its bark; or like a sword drawn forth from its scabbard; and whom just an arm of a lamb is enough to satiate. So far as the daughter of Abu Zara is concerned; how fine is the daughter of Abu Zara; obedient to her father; obedient to her mother; wearing sufficient flesh and a source of jealousy for her co-wife. As for the slave-girl of Abu Zara; how fine is she; she does not disclose our affairs to others outside the four walls of the house. She does not remove our wheat; or provision; or take it forth; or squander it; but she preserves it faithfully as a sacred trust. And she does not let the house fill with rubbish. One day Abu Zara went out of his house when the milk was churned in the vessels; that he met a woman; having two children like leopards playing with her pomegranates chest under her vest. He divorced me Umm Zara and married that woman whom Abu Zara met on the way. I Umm Zara later on married another person; a chief; who was an expert rider; and a fine archer: he bestowed upon me many gifts and gave me one pair of every kind of animal and said: Umm Zara; make use of everything you need and send forth to your parents but the fact is that even if I combine all the gifts that he bestowed upon me; they stand no comparison to the least gift of Abu Zara. SahihMuslim-017-001-21016Sahl Bin Saad reported: An Arab woman was mentioned before Allah Messenger ﷺ. He commanded Abu Usaid to send a message to her and he accordingly sent a message to her. She came and stayed in the fortresses of Banu Saidah. Allah Messenger ﷺ went out until he came to her while she was at that time sitting with her head downcast. When Allah Messenger ﷺ talked to her; she said: I seek refuge with Allah from you. Thereupon he said: I have decided to keep you away from me. They the people near her said: Do you know who he is? She said: No. They said: He is the Messenger of Allah ﷺ. He came to you in order to give you the proposal of marriage. She said: Then I am the most unfortunate woman because of this i. e. my defiance. Sahl said: Allahs. Messenger ﷺ then set forth on that day until he sat in the Saqifa of Banu Saidah along with his Companions. He then said to Sahl: Serve us drink. He Sahl said: I brought out for them this bowl containing drink and served them this. Abu Hazim said: Sahl brought out this cup for us and we also drank from that. Then Umar Bin Abd AlAziz asked him to give that cup as a gift to him and he gave it to him as a gift. The wise people of the Ansar said: Messenger of Allah; so far as the sagacious amongst us are concerned they have said nothing; but we have amongst us persons of immature age; they said: May Allah grant pardon to the Messenger of Allah ﷺ that he gave to the Quraish and ignored us despite the fact that our swords are besmeared with their blood. Upon this the Messenger of Allah ﷺ said: I give at times material gifts to persons who were quite recently in the state of unbelief; so that I may incline them to truth Dont you feel delighted that people should go with riches; and you should go back to your places with the Messenger of Allah? By Allah; that with which you would return is better than that with which they would return. They said: Yes; Messenger of Allah; we are pleased. The Prophet said too: You would find marked preference in conferring of the material gifts in future; so you should show patience till you meet Allah and His Messenger and I would he at the Haud Kauthar. SunanAlTermithi-017-001-9719Abu Huraira narrated: The people of AlSuffah were the guests of the people of Islam;they had nothing of people nor wealth to rely upon. And By Allah; the One Whom there is none worthy of worship besides Him I would lay on the ground on my liver side due to hunger; And I would fasten a stone to my stomach out of hunger. One day I sat by the way that they the Companions use to come out through. Abu Bakr passed and so I asked him about an Ayah from Allah Book; not asking him except that he might tell me to follow him for something to eat. But he passed on without doing so. Then Umar passed; so I asked him about an Ayah from Allah Book; not asking him except that he might tell me to follow him. But he passed on without doing so. Then Ab AlQasim s.a.w passed; and he smiled when he saw me; and said: Abu Huraira? I said: I am here O Messenger of Allah! He said: Come along. He continued and I followed him; he entered his house; so I sought permission to enter; and he permitted me. He found a bowl of milk and said: Where did this milk come from? It was said: It was a gift to us from so and so. So the Messenger of Allah s.a.w said: O Abu Huraira I said: I am here O Messenger of Allah! He said: Go to the people of AlSuffah to invite them. - Now; they were the guests of the people of Islam; they had nothing of people nor wealth to rely upon. Whenever some charity was brought to him; he would send it to them without using any of it. And when a gift was given to him s.a.w ; he would send for them to participate and share with him in it. I became upset about that; and I said to myself : What good will this bowl be among the people of AlSuffah and I am the one bringing it to them? Then he ordered me to circulate it among them So I wondered what of it would reach me from it; and I hoped that I would get from it what would satisfy me. But I would certainly not neglect to obey Allah and obey His Messenger; so I went to them and invited them. When they entered upon him they sat down. He said: Abu Huraira; take the bowl and give it to them. So I gave it to a man who drank his fill; then he gave it to another one; until it ended up with the Messenger of Allah s.a.w ; and all of the people had drank their fill. The Messenger of Allah s.a.w took the bowl; put it on his hand;then raised his head. He smiled and said: Abu Huraira; drink. So I drank; then he said: Drink. I kept drinking and he kept on saying; Drink. Then I said: By the One Who sent you with the truth! I have no more space for it. So he took the bowl and praised Allah; mentioned His Name and drank. I said: Muhammad Bin Seereen narrated that Shuraih said: The Prophet of Allah ruled that a lifelong gift is permissible. Qatadah said: I said: And AlNadr Bin Anas narrated to me; from Bashir Bin Nahik; from Abu Huraira; that the Prophet of Allah said: A lifelong gift is permissible. Qatadah said: I said: AlHasan used to say: A lifelong gift is permissible. Qatadah said: AlZuhri said: A lifelong gift is when it is stipulated that it is for the one to whom it is given and his descendants; but if his descendants were not mentioned then the condition is valid and it reverts to the one who gave it. Qatadah said: So Ata Bin Abi Rabah was asked; and he said: Jabir Bin Abdullah narrated to me that Allah Messenger said: Umra is permissible. He said him: I have given my son AlNuman a gift; and Umrah has asked me to call you as witness to it. He asked him: Have you children other than him? He said: I replied: Yes. He again asked: Have you given the rest of them the same as you have given AlNuman ? He said: No. Some of these narrators said in their version that the Prophet said: This in injustice. The others said in their version that the Prophet said: This is under force. So call some other person than me as witness to it. Mughirah said in his version: The Prophet asked : Are you not pleased with the fact that all of them may be equal in virtue and grace ? He replied: Yes. He said: Then call some other person than me as witness to it. Malik said; What is done in our community is that if a man gives his small child some gold or silver and then dies and he has it in his own keeping; the child has none of it unless the father set it Aasi de in coin or placed it with a man to keep for the son. MuwataMalik-017-001-34954Yahya said that he heard Malik say; What is done in our community about some one who gives a gift not intending a reward is that he calls witnesses to it. It is affirmed for the one to whom it has been given unless the giver dies before the one to whom it was given receives the gift. He said; If the giver wants to keep the gift after he has had it witnessed; he cannot. If the recipient claims it from him; he takes it. Malik said; If some one gives a gift and then withdraws it and the recipient brings a witness to testify for him that he was given the gift; be it goods; gold; silver or animals; the recipient is made to take an oath. If he refuses; the giver is made to take an oath. If he also refuses to take an oath; he gives to the recipient what he claims from him if he has at least one witness. If he does not have a witness; he has nothing. Malik said; If someone gives a gift not expecting anything in return and then the recipient dies; the heirs are in his place. If the giver dies before the recipient has received his gift; the recipient has nothing. That is because he was given a gift which he did not take possession of. If the giver wants to keep it; and he has called witnesses to the gift; he cannot do that. If some one; however; gives a gift seeking by it favour or reward; he has his gift and can reclaim it if he does not have satisfaction from it. MuwataMalik-017-001-34956Yahya said that he heard Malik say; The way of doing things in our community about which there is no dispute; is that if a man gives sadaqa to his son - sadaqa which the son takes possession of or which is in the father keeping and the father has had his sadaqa witnessed; he cannot take back any of it because he cannot reclaim any sadaqa. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. MuwataMalik-017-001-35315Yahya related to me from Malik that he had heard that Umar Ibn Abd AlAziz during his khalifate; wrote to one of his governors; Whatever a father; or guardian; who gives someone in marriage; makes a condition in the way of unreturnable gift or of favour; belongs to the woman if she wants it. Malik spoke about a woman whose father gave her in marriage and made an unreturnable gift a condition of the bride-price which was to be given. He said; Whatever is given as a condition by which marriage occurs belongs to the woman if she wants it. If the husband parts from her before the marriage is consummated; the husband has half of the unreturnable gift by which the marriage occurred. Malik said about a man who married off his young son and the son had no wealth at all; that the bride- price was obliged of the father if the young man had no property on the day of marriage. If the young man did have property the bride- price was taken from his property unless the father stipulated that he would pay the bride-price. The marriage was affirmed for the son if he was a minor only if he was under the guardianship of his father. Malik said that if a man divorced his wife before he had consummated the marriage and she was a virgin; her father returned half of the bride-price to him. That half was permitted to the husband from the father to compensate him for his expenses. Malik said that that was because Allah; the Blessed; the Exalted; said in His Book; Unless they women with whom he had not consummated marriage make remission or he makes remission to him in whose hand is the knot of marriage. Surat 2 ayat 237. He being the father of a virgin daughter or the master of a female slave. Malik said; That is what I have heard about the matter; and that is how things are done among us. Malik said that a jewish or christian woman who was married to a jew or christian and then became muslim before the marriage had been consummated; did not keep anything from the bride-price. Malik said; I do not think that women should be married for less than a quarter of a dinar.
