When this desertion lasted long; Abdullah Bin AlZubair sought intercession with her; but she said; By Allah; I will not accept the intercession of anyone for him; and will not commit a sin by breaking my vow. When this state of affairs was prolonged on Ibn AlZubair he felt it hard on him ; he said to AlMiswar Bin Makhrama and Abdulrahman Bin AlAswad Bin Abu Yaghuth; who were from the tribe of Bani Zahra; I beseech you; by Allah; to let me enter upon Aisha; for it is unlawful for her to vow to cut the relation with me. Thereupon he the prisoner said: Why have you taken me as prisoner and why have you caught hold of one proceeding the pilgrims the camel as she carried the Prophet on her back and walked ahead of the multitude ? He the Holy Prophet said: Yours is a great fault. I my men have caught hold of you for the crime of your allies; Banu Thaqif. He the Holy Prophet then turned away. He again called him and said: Muhammad; Muhammad; and since Allah Messenger ﷺ was very compassionate; and tenderhearted; he returned to him; and said: What is the matter with you? I fixed my eyes on him. My father came near him while he was riding his camel. He had a whip like the whip of scribes. I heard the bedouin and the people say: The whip; the whip. My father came near him and held his foot. She said: He admitted his Prophethood and stood and listened to him. He said: Messenger of Allah; I have made a vow that if a son is born to me; I shall slaughter a number of sheep at the end of Buwanah in the dale of hill. The narrator said: I do not know for certain that she said: Fifty sheep. The Messenger of Allah ﷺ said: Does it contain any idol? He said: No. Then he said: Fulfil your vow that you have taken for Allah. He then gathered them i.e. the sheep and began to slaughter them. A sheep ran away from them. SunanAbuDawoud-017-001-28581Imran Bin Hosain said: Adba belonged to a man of Banu Aqil. It used to go ahead of pligrims. The man was then captivated. He was brought in chains to the Prophet ﷺ. The Prophet ﷺ was riding on a donkey with a blanket on him. He said: Muhammad; why do you arrest me and capture the one i.e. the camel which goes ahead of the pilgrims. He replied: We are arresting you on account of the crime committed by your allies Thaqid. Thaqif captivated two persons from among the Companions of the Prophet ﷺ. He said whatever he said I am a Muslim; or he said: I have embraced Islam. When the Prophet ﷺ went ahead; he called him: O Muhammed; O Muhammed. Abu Dawud said: I learnt it from the version of the narrator Muhammad Bin Isa. The Prophet ﷺ was compassionate and kind hearted. So he returned to him; and asked: What is the matter with you ? He replied: I am a Muslim. He said: Had you said it when the matter was in your hand; you would have succeeded completely. Abu Dawud said: I then returned to the version of the narrator Sulaiman Bin Harb. He said: Muhammad; I am hungry; so feed me. I am thirsty; so give me water. The Prophet ﷺ said: This is your need; or he said: This is his need the narrator is doubtful. Later on the man was taken back by Thaqif as a ransom for the two men of the Companions of the Prophet. The Prophet ﷺ retained Adba for his journey. The narrator said: The polytheists raided the pasturing animals of Medina and they took away Adba. When they took away Adba; they also captivated a Muslim woman. They used to leave their camels in the fields for rest at night. One night they slept and the Muslim woman stood up. Any camel on which she put her hand brayed until she came to Adba. She came to a camel which was docile and experienced. She then rode on her and vowed to Allah that if He saved her; she would sacrifice it. When she came to Medina; the people recognized the camel of the Prophet ﷺ. The Prophet ﷺ was then informed about it and he sent for her. She was brought to him and she informed him about her vow. He said: It is a bad return that you have given it. Allah has not saved you; on its back that you now sacrifice it. SunanAbuDawoud-017-001-29095Nafi Abu Ghalib said: I was in the Sikkat AlMirbad. A bier passed and a large number of people were accompanying it. They said: Bier of Abdullah Ibn Umayr. So I followed it. Suddenly I saw a man; who had a thin garment on riding his small mule. He had a piece of cloth on his head to protect himself from the sun. I asked: Who is this important man? People said: This is Anas Ibn Malik. When the bier was placed; Anas stood and led the funeral prayer over him while I was just behind him; and there was no obstruction between me and him. He stood near his head; and uttered four takbirs Allah is Most Great. He neither lengthened the prayer nor hurried it. He then went to sit down. They said: Abu Hamzah; here is the bier of an Ansari woman. They brought her near him and there was a green cupola-shaped structure over her bier. He stood opposite her hips and led the funeral prayer over her as he had led it over the man. He then sat down. AlAla Ibn Ziyad asked: Abu Hamzah; did the Messenger of Allah ﷺ say the funeral prayer over the dead as you have done; uttering four takbirs Allah is Most Great over her; and standing opposite the head of a man and the hips of a woman? He replied: Yes. He asked: Abu Hamzah; did you fight with the Messenger of Allah? He replied: Yes. I fought with him in the battle of Hunayn. The polytheists came out and invaded us so severely that we saw our horses behind our backs. Among the people i.e. the unbelievers there was a man who was attacking us; and striking and wounding us with his sword. Allah then defeated them. They were then brought and began to take the oath of allegiance to him for Islam. A man from among the companions of the Prophet ﷺ said: I make a vow to myself that if Allah brings the man who was striking us with his sword that day; I shall behead him. The Messenger of Allah ﷺ kept silent and the man was brought as a captive. When he saw the Messenger of Allah ﷺ ; he said: Messenger of Allah; I have repented to Allah. The Messenger of Allah ﷺ stopped for a while receiving his oath of allegiance; so that the other man might fulfil his vow. But the man began to wait for the order of the Messenger of Allah ﷺ for his murder. He was afraid of the Messenger of Allah ﷺ to kill him. When the Messenger of Allah ﷺ saw that he did not do anything; he received his oath of allegiance. The man said: Messenger of Allah; what about my vow? He said: I stopped receiving his oath of allegiance today so that you might fulfil your vow. He said: Messenger of Allah; why did you not give any signal to me? The Prophet ﷺ said: It is not worthy of a Prophet to give a signal. Abu Ghalib said: I asked the people about Anas standing opposite the hips of a woman. They told me that this practice was due to the fact that in the days of the Prophet there were no cupola-shaped structures over the biers of women. So the imam used to stand opposite the hips of a woman to hide her from the people.Abu Dawud said: The saying of the Prophet ﷺ I have been commanded to fight against the people until they say: There is no god bu Allah abrogated this tradition of fulfilling the vow by his remark: I have repented. The Chapter on Standing For Prayers And Satan in HodHood Indexing, Chapter on Where Should The Imam Stand In Relation To The Deceased When Offering The Funeral Prayer in Sunan Abu Dawoud

MuwataMalik-017-001-35202Yahya related to me from Malik from Jafar Ibn Muhammad from his father that Ali Ibn Abi Talib said; When a man takes a vow to abstain from intercourse; divorce does not occur immediately. MuwataMalik-017-001-35205Yahya related to me from Malik that he had heard that Marwan Ibn AlHakam decided about a man who had made a vow to abstain from intercourse with his wife; that when four months had passed; it was a divorce and he could return to her as long as she was in her idda. Malik added; That was also the opinion of Ibn Shihab. Malik said that if a man made a vow to abstain from intercourse with his wife and at the end of four months he declared his intent to continue to abstain; he was divorced. He could go back to his wife; but if he did not have intercourse with her before the end of her idda; he had no access to her and he could not go back to her unless he had an excuse - illness; imprisonment; or a similar excuse. His return to her maintained her as his wife. If her idda passed and then he married her after that and did not have intercourse with her until four months had passed and he declared his intent to continue to abstain; divorce was applied to him by the first vow. If four months passed; and he had not returned to her; he had no idda against her nor access because he had married her and then divorced her before touching her. Malik said that a man who made a vow to abstain from intercourse with his wife and continued to abstain after four months and so divorced her; but then returned and did not touch her and four months were completed before her idda was completed; did not have to declare his intent and divorce did not befall him. If he had intercourse with her before the end of her idda; he was entitled to her. If her idda passed before he had intercourse with her; he had no access to her. This is what Malik preferred of what he had heard on the subject. Malik said that if a man made a vow to abstain from intercourse with his wife and then divorced her; and the four months of the vow were completed before completion of the idda of the divorce; it counted as two pronouncements of divorce. If he declared his intention to continue to abstain and the idda of the divorce finished before the four months the vow of abstention was not a divorce. That was because the four months had passed and she was not his on that day. Malik said; If someone makes a vow not to have intercourse with his wife for a day or a month and then waits until more than four months have passed; it is not ila. Ila only applies to someone who vows more than four months. As for the one who vows not to have intercourse with his wife for four months or less than that; I do not think that it is ila because when the term enters into it at which it stops; he comes out of his oath and he does not have to declare his intention. Malik said; If someone vows to his wife not to have intercourse with her until her child has been weaned; that is not ila. I have heard that Ali Ibn Abi Talib was asked about that and he did not think that it was ila.The Chapter on Wives And Relationship Sexual Intercourse in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35264Yahya related to me from Malik that he had heard that Umar Ibn AlKhattab; Abdullah Ibn Umar; Abdullah Ibn Masud; Salim Ibn Abdullah; AlQasim Ibn Muhammad; Ibn Shihab;and Sulayman Ibn Yasar all said; If a man has vowed to divorce his wife before marrying her and then he breaks his vow; divorce is obligatory for him when he marries her.The Chapter on Obligations And Vows And Oaths in HodHood Indexing, The Book of Qirad in Muwata Malik
MuwataMalik-017-001-35391Yahya related to me from Malik that Abdullah Ibn Abi Habiba said; I said to a man; when I was young; A man who only says that he must walk to the House of Allah and does not say that he has vowed to walk; does not have to walk. A man said; Shall I give you this small cucumber? and he had a small cucumber in his hand and you will say; I must walk to the house of Allah? I said; Yes and I said it; for at that time I was still immature. Then; when I came of age; some one said to me that I had to fulfill my vow. I went and asked Said Ibn AlMusayab about it; and he said to me; You must walk. So I walked. Malik said; That is the custom among us.The Chapter on Hands And Obligations in HodHood Indexing, The Book of Jihad in Muwata Malik
MuwataMalik-017-001-35393Yahya related to me from Malik that Yahya Ibn Said said; I vowed to walk; but I was struck by a pain in the kidney; so I rode until I came to Makka. I questioned Ata Ibn Abi Rabah and others; and they said; You must sacrifice an animal. When I came to Madina I questioned the ulama there; and they ordered me to walk again from the place from which I was unable to go on. So I walked. Yahya said that he had heard Malik say; What is done among us regarding someone who makes a vow to walk to the House of Allah; and then cannot do it and so rides; is that he must return and walk from the place from which he was unable to go on. If he cannot walk; he should walk what he can and then ride; and he must sacrifice a camel; a cow; or a sheep if that is all that he can find. Malik; when asked about a man who said to another; I will carry you to the House of Allah; answered; If he intended to carry him on his shoulder; by that he meant hardship and exhaustion to himself; and he does not have to do that. Let him walk by foot and make sacrifice. If he did not intend anything; let him do hajj and ride; and take the man on hajj with him. That is because he said; I will carry you to the house of Allah. If the man refuses to do hajj with him; then there is nothing against him; and what is demanded of him is cancelled. Yahya said that Malik was asked whether it was enough for a man who had made a vow that he would walk to the House of Allah a certain large number of times; or who had forbidden himself from talking to his father and brother; if he did not fulfil a certain vow; and he had taken upon himself; by the oath; something which he was incapable of fulfilling in his lifetime; even though he were to try every year; to fulfil only one or a smaller number of vows by Allah? Malik said; The only satisfaction for that that I know is fulfilling what he has obliged himself to do. Let him walk for as long as he is able and draw near Allah the Exalted by what he can of good. The Chapter on Hands And Obligations in HodHood Indexing, The Book of Jihad in Muwata Malik
MuwataMalik-017-001-35394Yahya related to me from Malik that what he preferred of what he had heard from the people of knowledge about a man or woman who vowed to walk to the House of Allah; was that they fulfilled the oath when performing umra; by walking until they had done say between Safa and Marwa. When they had done say it was finished. If they vowed to walk in the hajj; they walked until they came to Makka; then they walked until they had finished all the rites. Malik said; Walking is only for hajj or umra. The Chapter on Obligations And Vows And Oaths in HodHood Indexing, The Book of Jihad in Muwata Malik
MuwataMalik-017-001-35397Yahya related to me from Malik from Talha Ibn Abi AlMalik AlAyli from AlQasim Ibn Muhammad Ibn AlSiddiq from Aisha that the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever vows to obey Allah; let him obey Him. Whoever vows to disobey Allah; let him not disobey Him. Yahya said that he had heard Malik say; The meaning of the statement of the Prophet; may Allah bless him and grant him peace; Whoever vows to disobey Allah; let him not disobey Him is that for instance a man who vows that; if he speaks to such-and-such a person; he will walk to Syria; Egypt; or any other such things which are not considered as ibada; is not under any obligation by any of that; even if he did speak to the man or did break whatever it was he swore; because Allah does not demand obedience in such things. He should only fulfill those things in which there is obedience to Allah. 22.5 Rashness in OathsThe Chapter on Disobedience And Obligations in HodHood Indexing, The Book of Jihad in Muwata Malik
MuwataMalik-017-001-35400Yahya related to me from Malik from Suhayl Ibn Abi Salih from his father from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever makes an oath and then sees that something else would be better than it; should do kaffara for his oath and do what is better. Yahya said that he heard Malik say; Anyone who says that he has a vow but does not mention the name of Allah; is still obliged to make the kaffara for an oath if he breaks it. Malik said; Emphasis is when a man swears one thing several times; repeating the oath in his speech time after time. For instance; the statement; By Allah; I will not decrease it from such-and-such; sworn three times or more. The kaffara of that is like the kaffara of one oath. If a man swears; I will not eat this food or wear these clothes or enter this house; that is all in one oath; and he is only obliged to do one kaffara. It is the same for a man who says to his wife; You are divorced if I clothe you in this garment or let you go to the Masjid; and it is one entire statement in the normal pattern of speech. If he breaks any of that oath; divorce is necessary; and there is no breaking of oath after that in whatever he does. There is only one oath to be broken in that. Malik said; What we do about a woman who makes a vow without her husband permission is that she is allowed to do so and she must fulfill it; if it only concerns her own person and will not harm her husband. If; however; it will harm her husband; he may forbid her to fulfill it; but it remains an obligation against her until she has the opportunity to complete it.The Chapter on Oaths And Pledges And Kaffara in HodHood Indexing, The Book of Jihad in Muwata Malik
MuwataMalik-017-001-35524Yahya related to me from Malik that he had heard that Said Ibn AlMusayab was asked whether a man who had vowed to fast a month could fast voluntarily; and Said said; He should fulfil his vow before he does any voluntary fasting. Malik said; I have heard the same thing from Sulayman Ibn Yasar. Malik said; If someone dies with an unfulfilled vow to free a slave or to fast or to give sadaqa or to give away a camel; and makes a bequest that his vow should be fulfilled from his estate; then the sadaqa or the gift of the camel are taken from one third of his estate. Preference is given to it over other bequests; except things of a similar nature; because by his vow it has become incumbent on him; and this is not the case with something he donates voluntarily. They vows and voluntary donations are settled from a limited one-third of his estate; and not from the whole of it; since if the dying man were free to dispose of all of his estate; he might delay settling what had become incumbent on him i.e. his vows ; so that when death came and the estate passed into the hands of his heirs; he would have bequeathed such things i.e. his vows that were not claimed by anyone like debts. If that i.e. to dispose freely of his property were allowed him; he would delay these things i.e. his vows until when he was near death; he would designate them and they might take up all of his estate. He must not do that. The Chapter on Obligations Of Fasting in HodHood Indexing, The Book of Divorce in Muwata Malik
MuwataMalik-017-001-35925Yahya related to me from Malik from Nafi that Abdullah Ibn Umar said; Someone who vows to sacrifice a camel or a cow to Allah should garland it with two sandals about its neck; and brand it by causing blood to flow from its side. He should then sacrifice it either at the House or at Mina on the day of sacrifice. There are no other correct places apart from those. However; someone who vows to slaughter a camel or a cow simply as a sacrifice can sacrifice it wherever he wishes. The Chapter on Animal Sacrifice And Cows in HodHood Indexing, The Book of Business Transactions in Muwata Malik
