This day have those who reject faith given up all hope of your religion: yet fear them not but fear Me. This day have I perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion. | SahihAlBukhari-017-001-1174 | Narrated Ibn Umar: A Jew and Jewess were brought to the Prophet ﷺ on a charge of committing an illegal sexual intercourse. The Prophet ﷺ asked the Jews; What do you usually do with them? They said; We blacken their faces and disgrace them. He said; Bring here the Torah and recite it; if you are truthful. They fetched it and came and asked a one-eyed man to recite. He went on reciting till he reached a portion on which he put his hand. The Prophet ﷺ said; Lift up your hand! He lifted his hand up and behold; there appeared the verse of AlRajm stoning of the adulterers to death. Then he said; O Muhammad! They should be stoned to death but we conceal this Divine Law among ourselves. Then the Prophet ﷺ ordered that the two sinners be stoned to death and; and they were stoned to death; and I saw the man protecting the woman from the stones. | SahihAlBukhari-017-001-1208 | Narrated Abu Huraira: While we were with Allah Messenger ﷺ a bedouin got up and said; O Allah Messenger ﷺ ! Settle my case according to Allah Book Laws. Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. What is the legal punishment for this sin in your Book Torah ? They replied; Our priests have innovated the punishment of blackening the faces with charcoal and Tajbiya. Abdullah Bin Salam said; O Allah Messenger ﷺ ; tell them to bring the Torah. The Torah was brought; and then one of the Jews put his hand over the Divine Verse of the Rajam stoning to death and started reading what preceded and what followed it. On that; Ibn Salam said to the Jew; Lift up your hand. Behold! The Divine Verse of the Rajam was under his hand. So Allah Apostle ordered that the two sinners be stoned to death; and so they were stoned. Where he lifted it there appeared the verse of the Rajam. So they said; O Muhammad! He has said the truth; the verse of the Rajam is in it Torah. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. | SahihMuslim-017-001-17384 | Sulaiman Bin Buraida reported on the authority of his father that Ma; iz Bin Malik came to Allah Apostle ﷺ and said to him: Messenger of Allah; purify me; whereupon he said: Woe be upon you; go back; ask forgiveness of Allah and turn to Him in repentance. He the narrator said that he went back not far; then came and said: Allah Messenger; purify me. whereupon Allah Messenger ﷺ said: Woe be upon you; go back and ask forgiveness of Allah and turn to Him in repentance. He the narrator said that he went back not far; when he came and said: Allah Messenger; purify me. Allah Apostle ﷺ said as he had said before. When it was the fourth time; Allah Messenger may; ﷺ said: From what am I to purify you? He said: From adultery; Allah Messenger ﷺ asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah Messenger ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been divided into two groups about him Maiz. One of them said: He has been undone for his sins had encompassed him; whereas another said: There is no repentance more excellent than the repentance of Maiz; for he came to Allah Apostle ﷺ and placing his hand in his in the Holy Prophets hand said: Kill me with stones. This controversy about Maiz remained for two or three days. Then came Allah Messenger ﷺ to them his Companions as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Maiz Bin Malik. They said: May Allah forgive Maiz Bin Malik. Thereupon Allah Messenger ﷺ said: He Maiz has made such a repentance that if that were to be divided among a people; it would have been enough for all of them. He the narrator said: Then a woman of Ghamid; a branch of Azd; came to him and said: Messenger of of Allah; purify me; whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Maiz. Bin Malik. He the Holy; Prophet said: What has happened to you? She said that she had become pregnant as a result of fornication. He the Holy Prophet said: Is it you who has done that ? She said: Yes. He the Holy Prophet said to her: You will not be punished until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered of the child. He that Ansari came to Allah Apostle ﷺ and said the woman of Ghamid has given birth to a child. He turned him away. On the following day; he Maiz again came to him and said: Allah Messenger; I have committed adultery. Allah Messenger ﷺ turned him away for the second time; and sent him to his people saying: Do you know if there is anything wrong with his mind. They denied of any such thing in him and said: We do not know him but as a wise good man among us; so far as we can judge. He Maiz came for the third time; and he the Holy Prophet sent him as he had done before. He asked about him and they informed him that there was nothing wrong with him or with his mind. When it was the fourth time; a ditch was dug for him and he the Holy Prophet pronounced judg- ment about him and he wis stoned. He the narrator said: There came to him the Holy Prophet a woman from Ghamid and said: Allah Messenger; I have committed adultery; so purify me. He the Holy Prophet turned her away. On the following day she said: Allah Messenger; Why do you turn me away? Perhaps; you turn me away as you turned away Maiz. By Allah; I have become pregnant. He said: Well; if you insist upon it; then go away until you give birth to the child. When she was delivered she came with the child wrapped in a rag and said: Here is the child whom I have given birth to. He said: Go away and suckle him until you wean him. When she had weaned him; she came to him the Holy Prophet with the child who was holding a piece of bread in his hand. She said: Allah Apostle; here is he as I have weaned him and he eats food. He the Holy Prophet entrusted the child to one of the Muslims and then pronounced punishment. And she was put in a ditch up to her chest and he commanded people and they stoned her. Khalid b Walid came forward with a stone which he flung at her head and there spurted blood on the face of Khalid and so he abused her. The second claimant who was wiser than him said: Well; decide amongst us according to the Book of Allah; but permit me to say something. Thereupon Allah Messenger may peace be upon ham said: Say. They said: We darken their faces and make them ride on the donkey with their faces turned to the opposite direction and their backs touching each other ; and then they are taken round the city. He said: Bring Torah if you are truthful. They brought it and recited it until when they came to the verse pertaining to stoning; the person who was reading placed his hand on the verse pertaining to stoning; and read only that which was between his hands and what was subsequent to that. Abdullah Bin Salim who was at that time with the Messenger of Allah ﷺ said: Command him the reciter to lift his hand. He lifted it and there was; underneath that; the verse pertaining to stoning. Allah Apostle ﷺ called them the Jews and said: Is this the punishment that you find in your Book Torah as a prescribed punishment for adultery? They said: Yes. He the Holy Prophet called one of the scholars amongst them and said: I ask you in the name of Allah Who sent down the Torah on Moses if that is the prescribed punishment for adultery that you find in your Book. He said: No. Had you not asked me in the name of Allah; I would not have given you this information. We find stoning to death as punishment prescribed in the Torah. But this crime became quite common amongst our aristocratic class. So when we caught hold of any rich person indulging in this offence we spared him; but when we caught hold of a helpless person we imposed the prescribed punishment upon him. We then said: Let us argree on a punishment which we can inflict both upon the rich and the poor. So We decided to blacken the face with coal and flog as a substitute punishment for stoning. Thereupon Allah Messenger ﷺ said: O Allah; I am the first to revive Thy command when they had made it dead. He then commanded and he the offender was stoned to death. | SunanAlNasai-017-001-11563 | It was narrated that Anas Bin Malik said: When the Messenger of Allah ﷺ came to AlMadinah; he alighted in the upper part of AlMadinah among the tribe called Banu Amr Bin Awuf and he stayed with them for fourteen nights. Then he sent for the chiefs of Banu AlNajjar; and they came with their swords by their sides. It is as if I can see the Messenger of Allah ﷺ on his camel with Abu Bakr riding behind him on the same camel and the chiefs of Banu AlNajjar around him; until he dismounted in the courtyard of Abu Ayoub. The Prophet ﷺ used to offer the prayer wherever he was when the time for prayer came; and he would pray even in sheepfolds. Then he ordered that the Masjid be built. He sent for the chiefs of Banu AlNajjar; and when they came; he said: O Banu AlNajjar; name me a price for this grove of yours. They said: By Allah; we will not ask for its price except from Allah. Anas said: In that grove there were graves of idolators; ruins and date-palm trees. The Messenger of Allah ﷺ ordered that the graves of the idolators be dug up; the ruins be leveled and the date-palm trees be cut down. The trunks of the trees were arranged so as to form the walls facing the Qiblah. The stone pillars were built at the sides of its gate. They started to move the stones; reciting some lines of verse; and the Messenger of Allah ﷺ was with them when they were saying: O Allah! There is no good except the good of the Hereafter. His purpose in that was simply a hope that it might be a way of escape for him. So he went to him and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He the Prophet turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. He again turned away from him; so he came back and said: Messenger of Allah! I have committed fornication; so inflict on me the punishment ordained by Allah. When he uttered it four times; the Messenger of Allah ﷺ said: You have said it four times. The Messenger of Allah; may Allah bless him and grant him peace; asked them; What do you find in the Torah about stoning? They said; We make their wrong action known and flog them. Abdullah Ibn Salam said; You have lied! It has stoning for it; so bring the Torah. They spread it out and one of them placed his hand over the ayat of stoning. Then he read what was before it and what was after it. Abdullah Ibn Salam told him to lift his hand. He lifted his hand and there was the ayat of stoning. They said; He has spoken the truth; Muhammad. The ayat of stoning is in it. So the Messenger of Allah; may Allah bless him and grant him peace; gave the order and they were stoned. Then he raised his hands to the sky and said; O Allah! I have become old and my strength has weakened. My flock is scattered. Take me to You with nothing missed out and without having neglected anything. Then he went to Madina and addressed the people. He said; People! Sunan have been laid down for you. Obligations have been placed upon you. You have been left with a clear way unless you lead people astray right and left. Said said; There is a man who has had intercourse with his wife while in ihram who has sent a message to Madina asking about it. Some of them said; They should be kept apart until a future year; and Said Ibn AlMusayab said; They should carry on and complete the hajj which they have spoiled; and then return home when they have finished. If another hajj comes upon them; they must do hajj and sacrifice an animal. They should go into ihram at the same place where they went into ihram for the hajj that they spoiled; and they should keep apart until they have finished their hajj. Malik said; They should both sacrifice an animal. Malik said; about a man who had intercourse with his wife during hajj after he had come down from Arafa but before he had stoned the Jamra; He must sacrifice an animal and do hajj again in another year. If; however; he had intercourse with his wife after he stoned the Jamra; he only has to do an umra and sacrifice an animal and he does not have to do another hajj. Malik said; What spoils a hajj or an umra and makes sacrificing an animal and repeating the hajj necessary is the meeting of the two circumcised parts; even if there is no emission. It is also made necessary by an emission if it is the result of bodily contact. I do not think that a man who remembers something and has an emission owes anything; and if a man were to kiss his wife and no emission were to occur from that; he would only have to sacrifice an animal. A woman in ihram who has intercourse with her husband several times during hajj or umra out of obedience to him only has to do another hajj and sacrifice an animal. That is if her husband has intercourse with her while she is doing hajj. Malik said; The explanation of the hadith where the Messenger of Allah; may Allah bless him and grant him peace; allowed the camel-herders to delay the stoning of the jamras is; in our view; and Allah knows best; that they threw stones on the day of sacrifice; and then threw again two days later; which was the first possible day for leaving; and this throwing was for the day which had passed. They then threw again for the day itself; because it is only possible for someone to make up for something which is obligatory for him; and when something obligatory passes someone by without him doing it he must necessarily make it up afterwards and not beforehand. She and Safiya were delayed and did not arrive at Mina until after the sun had set on the day of sacrifice. Abdullah Ibn Umar told them both to stone the jamra at the time they arrived and he did not think that they owed anything. Yahya said that Malik was asked about some one who forgot to stone one of the jamras on one of the days of Mina until it was evening and he said; He should throw the stones at whatever time of day or night he remembers; just as he would pray the prayer if he forgot it and then remembered it at any time of day or night.
