Said the disciples, "We are Allah's helpers!" then a portion of the Children of Israel believed, and a portion disbelieved: But We gave power to those who believed, against their enemies, and they became the ones that prevailed.

For to Allah belongeth the dominion of the heavens and the earth, and all that is between. He createth what He pleaseth. For Allah hath power over all things."

Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. So in the year of Conquest of Mecca; Saad took him and said. This is my brother son whom my brother has asked me to take into my custody. Abd Bin Zama got up before him and said; He is my brother and the son of the slave girl of my father; and was born on my father bed. So they both submitted their case before Allah Apostle. Saad said; O Allah Messenger ﷺ ! This boy is the son of my brother and he entrusted him to me. Abd Bin Zama said; This boy is my brother and the son of the slave girl of my father; and was born on the bed of my father. Allah Messenger ﷺ said; The boy is for you; O Abd Bin Zama! Then Allah Apostle further said; The child is for the owner of the bed; and the stone is for the adulterer; He then said to Sauda bint Zama; Veil screen yourself before him; when he saw the child resemblance to Utba. Then I asked a learned man about this case and he informed me that my son should receive one hundred lashes and be exiled for one year; and the man wife should be stoned to death. The Prophet ﷺ said; By Him in Whose Hand my soul is; I will judge you according to the Laws of Allah. Your one-hundred sheep and the slave are to be returned to you; and your son has to receive one-hundred lashes and be exiled for one year. O Unais! Go to the wife of this man; and if she confesses; then stone her to death. Unais went to her and she confessed. Then I asked the religious learned people; and they told me that my son should be flogged with one-hundred stripes and be exiled for one year. The Prophet ﷺ said; By Him in Whose Hand my soul is; I will judge you according to Allah Laws. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you; O Unais! Go to the wife of this man and if she confesses ; stone her to death. SahihAlBukhari-017-001-1691Narrated Huzail Bin Shirahbil: Abu Mousa was asked regarding the inheritance of a daughter; a son daughter; and a sister. He said; The daughter will take one-half and the sister will take one-half. If you go to Ibn Masud; he will tell you the same. Ibn Masud was asked and was told of Abu Mousa verdict. Ibn Masud then said; If I give the same verdict; I would stray and would not be of the rightly-guided. The verdict I will give in this case; will be the same as the Prophet ﷺ did; i.e. one-half is for daughter; and one-sixth for the son daughter; i.e. both shares make two-thirds of the total property; and the rest is for the sister. SahihAlBukhari-017-001-1720Narrated Aisha: Saad Bin Abi Waqqas and Abu Bin Zama had a dispute over a boy. Saad said; O Allah Messenger ﷺ ! This boy is the son of my brother; Utba Bin Abi Waqqas who told me to be his custodian as he was his son. Please notice to whom he bears affinity. And Abu Bin Zama said; This is my brother; O Allah Messenger ﷺ ! He was born on my father bed by his slave girl. Then the Prophet ﷺ looked at the boy and noticed evident resemblance between him and Utba; so he said; He the toy is for you; O Abu Bin Zama; for the boy is for the owner of the bed; and the stone is for the adulterer. Screen yourself before the boy; O Sauda bint Zama. SahihAlBukhari-017-001-1723Narrated Abu Huraira: Allah Messenger ﷺ said; There were two women with whom there were their two sons. A wolf came and took away the son of one of them. That lady said to her companion; The wolf has taken your son. The other said; But it has taken your son. So both of them sought the judgment of the Prophet David who judged that the boy should be given to the older lady. Then both of them went to the Prophet Solomon; son of David and informed him of the case. Solomon said; Give me a knife so that I may cut the child into two portions and give one half to each of you. The younger lady said; Do not do so; may Allah bless you ! He is her child. On that; he gave the child to the younger lady. Abu Huraira added: By Allah! SahihAlBukhari-017-001-2041Narrated Abu Huraira and Zaid Bin Khalid: Two men had a dispute in the presence of Allah Messenger ﷺ. One of them said; O Allah Messenger ﷺ ! Judge between us according to Allah Laws. The other who was wiser; said; Yes; O Allah Apostle! Judge between us according to Allah Laws and allow me to speak. The Prophet ﷺ said; Speak. He said; My son was a laborer serving this person and he committed illegal sexual intercourse with his wife; The people said that my son is to be stoned to death; but I ransomed him with one-hundred sheep and a slave girl. Then I asked the learned people; who informed me that my son should receive one hundred lashes and will be exiled for one year; and stoning will be the lot for the man wife. Allah Messenger ﷺ said; Indeed; by Him in Whose Hand my soul is; I will judge between you according to Allah Laws: As for your sheep and slave girl; they are to be returned to you. Then he scourged his son one hundred lashes and exiled him for one year. Then Unais AlAslami was ordered to go to the wife of the second man; and if she confessed the crime ; then stone her to death. SahihAlBukhari-017-001-240Narrated Anas Bin Malik: One of the sons of Abu Talha became sick and died and Abu Talha at that time was not at home. When his wife saw that he was dead; she prepared him washed and shrouded him and placed him somewhere in the house. When Abu Talha came; he asked; How is the boy? She said; The child is quiet and I hope he is in peace. Abu Talha thought that she had spoken the truth. Abu Talha passed the night and in the morning took a bath and when he intended to go out; she told him that his son had died; Abu Talha offered the morning prayer with the Prophet ﷺ and informed the Prophet ﷺ of what happened to them. Aisha said that the lady came ; wearing a green veil and complained to her Aisha of her husband and showed her a green spot on her skin caused by beating. It was the habit of ladies to support each other; so when Allah Messenger ﷺ came; Aisha said; I have not seen any woman suffering as much as the believing women. Look! Her skin is greener than her clothes! When Abdulrahman heard that his wife had gone to the Prophet; he came with his two sons from another wife. She said; By Allah! I have done no wrong to him but he is impotent and is as useless to me as this; holding and showing the fringe of her garment; Abdulrahman said; By Allah; O Allah Messenger ﷺ ! She has told a lie! I am very strong and can satisfy her but she is disobedient and wants to go back to Rifaa. Allah Messenger ﷺ said; to her; If that is your intention; then know that it is unlawful for you to remarry Rifaa unless Abdulrahman has had sexual intercourse with you. Then the Prophet ﷺ saw two boys with Abdulrahman and asked him ; Are these your sons? On that Abdulrahman said; Yes. The Prophet ﷺ said; You claim what you claim i.e.. that he is impotent ? SahihAlBukhari-017-001-3285Narrated Usaid Bin Hudair: That while he was reciting Surat AlBaqara The Cow at night; and his horse was tied beside him; the horse was suddenly startled and troubled. When he stopped reciting; the horse became quiet; and when he started again; the horse was startled again. Then he stopped reciting and the horse became quiet too. He started reciting again and the horse was startled and troubled once again. Then he stopped reciting and his son; Yahya was beside the horse. He was afraid that the horse might trample on him. When he took the boy away and looked towards the sky; he could not see it. The next morning he informed the Prophet who said; Recite; O Ibn Hudair! Recite; O Ibn Hudair! Ibn Hudair replied; O Allah Messenger ﷺ ! My son; Yahya was near the horse and I was afraid that it might trample on him; so I looked towards the sky; and went to him. When I looked at the sky; I saw something like a cloud containing what looked like lamps; so I went out in order not to see it. The Prophet ﷺ said; Do you know what that was? The second claimant who was wiser than him said: Well; decide amongst us according to the Book of Allah; but permit me to say something. Thereupon Allah Messenger may peace be upon ham said: Say. He said: My son was a servant in the house of this person and he committed adultery with his wife. I was informed that my son deserved stoning to death as punishment for this offence. I gave one hundred goats and a slave girl as ransom for this. I asked the scholars if this could serve as an expiation for this offence. They informed me that my son deserved one hundred lathes and exile for one year. and this woman deserved stoning as she was married. Thereupon Allah Messenger may peace he upon him said: By Him in Whose Hand is my life. I will decide between you according to the Book of Allah. The slave-girl and the goats should be given back; and your son is to be punished with one hundred lashes and exile for one year. And; O Unais Bin Zuhaq AlAslami ; go to this woman in the morning; and if she makes a confession; then stone her. He the narrator said: He went to her in the morning and she made a confession. SahihMuslim-017-001-17657Jabir Allah be pleased with him reported that a woman gave her garden as a life grant to her son. He died and later on she also died and left a son behind and brothers also; The sons of the woman making life grant said to those who had been conferred upon this Umra : This garden has returned to us. The sons of the one who had been given life grant said: This belonged to our father; during his lifetime and in case of his death. They took their dispute to Tariq; the freed slave of Uthman. He called Jabir and he gave testimony of Allah Messenger ﷺ having said: Life grant belongs to one who is conferred upon this privilege. Tariq gave this decision and then wrote to Abd AlMalik and informed him; Jabir bearing witness to it. Abd AlMalik said: Jabir has told the truth. SahihMuslim-017-001-18914Anas Bin Malik reported: We were along with Umar between Mecca and Medina that we began to look for the new moon. And I was a man with sharp eye- sight; so I could see it; but none except me saw it. I began to say to Umar: Dont you see it? But he would not see it. Thereupon Umar said: I would soon be able to see it when it will shine more brightly. I lay upon bed. He then made a mention of the people of Badr to us and said: Allah Messenger ﷺ showed us one day before the actual battle the place of death of the people participating in the Battle of Badr and he was saying: This would be the place of death of so and so tomorrow; if Allah wills. Umar said: By Him Who sent him with truth; they did not miss the places of their death which Allah Messenger ﷺ had pointed for them. Then they were all thrown in a well one after another. Allah Messenger ﷺ then went to them and said: O; so and so; the son of so and so; O so and so; the son of so and so; have you found correct what Allah and His Messenger had promised you? I have; however; found absolutely true what Allah had promised with me. Umar said: Allah Messenger; how are you talking with the bodies without soul in them. I came back to my mother and informed her about it; and when he came to her she said: My son sneezed in your presence and you did not say: Allah may have mercy upon you; and she sneezed and you said for her: May Allah have mercy upon you. Use this Indian aloeswood; for it contains seven types of remedies; one among them being a remedy for pleurisy. SahihMuslim-017-001-20731Anas reported that the son of Abu Talba who was born of Umm Sulaim died. She Umm Sulaim said to the members of her family: Do not narrate to Abu Talha about his son until I narrate it to him. Abu Talha came home ; she presented to him the supper. He took it and drank water. She then embellished herself which she did not do before. He Abu Talha had a sexual intercourse with her and when she saw that he was satisfied after sexual intercourse with her; she said: Abu Talha ; if some people borrow something from another family and then the members of the family ask for its return; would they resist its return? He said: No. She said: I inform you about the death of your son. He was annoyed; and said: You did not inform me until I had a sexual intercourse with you and you later on gave me information about my son. He went to Allah Messenger ﷺ and informed him what had happened. Thereupon Allah Messenger ﷺ said: May Allah bless both of you in the night spent by you! He the narrator said: She became pregnant. Allah Messenger may peace he upon him was in the course of a journey and she was along with him and when Allah Messenger ﷺ came back to Medina from the journey he did not enter his house during the night. When the people came near Medina; she felt the pangs of delivery. He Abu Talha remained with her and Allah Messenger ﷺ proceeded on. Abu Talha said: O Lord; you know that I love to go along with Allah Messenger when he goes out and enter along with him when he enters and I have been detained as Thou seest. Umm Sulaim said: Abu Talha ; I do not feel so much pain as I was feeling formerly; so better proceed on. So we proceeded on and she felt the pangs of delivery as they reached Medina and a child was born and my mother said to me: Anas; none should suckle him until you go to Allah Messenger ﷺ tomorrow morning. And when it was morning I carried him the child and went along with him to Allah Messenger may peace beupon him. He said: I saw that he had in his hand the instrument for the cauterisation of the camels. When he saw me. he said: This is; perhaps; what Umm Sulaim has given birth to. I said: Yes. He laid down that instrument on the ground. I brought that child to him and placed it in his lap and Allah Messenger ﷺ asked Ajwa dates of Medina to be brought and softened them in his month. When these had become palatable he placed them in the mouth of that child. The child began to taste them. Then Allah Messenger ﷺ said: See what love the Ansar have for dates. Abd Bin Zama said Messenger of Allah; he is my brother as he was born on the bed of my father from his slave-girl. Allah Messenger ﷺ looked at his resemblance and found a clear resemblance with Utba. But he said: He is yours O Abd Bin Zama ; for the child is to be attributed to one on whose bed it is born; and stoning for a fornicator. Sauda bint Zama; O you should observe veil from him. He said: O Lord! Add to his age. He said: That is what I have written for him. He said: O Lord! Give him sixty of my years. He said: So you shall have it. He said: Then; he resided in Paradise as long as Allah willed; then he was cast from it; so Adam was counting for himself. He said: So the Angel of death came to him; and Adam said to him: You are hasty; one-thousand years were written for me. He said: Of course! But you gave sixty years to your son Dawud. So one of them stood before him and said: I ask you by Allah; O Messenger of Allah! Only that you would judge between us by the book of Allah. So his disputant said - and he was more eloquent that him: I agree of O Messenger of Allah! Judge between us by the Book of Allah; and allow me to speak. My son was a servant for this man and he committed adultery with his wife. So they told me that my son was to be stoned. I paid him one hundred female sheep and a female slave. Then I met some people from the people of knowledge and they said that my son was to be lashed one hundred times; and to be banished for a year and that stoning is only for this man wife. So the Prophet ﷺ said: By the One in Whose Hand is my soul! I will judge between you two by the Book of Allah. The one hundred female sheep and the female slave should be returned to you. For your son is one hundred lashes and banishment for a year. O Unais! Go to this Man wife; and if she confesses then stone her. I could not bear it so I went and got a dagger which I thrust into her stomach and leaned upon it; and killed her. In the morning she was found slain. Mention of that was made to the Prophet SAWSYMOBOL and he gathered the people and said: I adjure by Allah; a man over whom I have the right; that he should obey me; and he did what he did; to stand up. The blind man started to tremble and said: O Messenger of Allah SAWSYMOBOL; I am the one who killed her. She was my Umm Walad and she was kind and gentle toward me; and I have two sons like pearls from her; but she used to slander and defame you a great deal. I forbade her; but she did not stop; and I rebuked her; but she did not pay heed. Finally; I mentioned your name and she slandered you; so I went and got a dagger which I thrust into her stomach; and leaned on it until I killed her. He said: This is a Shafi - a sheep that has a child or is pregnant - and the Messenger of Allah forbade us to take a Shafi. So I went to a Mutat goat - a Mutat is one that has not given birth before; but has reached the age where it could produce young- and brought it out to them. They said: We will take it. So I lifted it up to them; and they took it with them on their camel and left. SunanAlNasai-017-001-15670It was narrated from Zurarah Bin Awuf a: When Saad Bin Hisham Bin Amir came to visit us; he told us that he came to Ibn Abbas and asked him about the witr of the Messenger of Allah ﷺ. He said: Shall I not tell you of the most knowledgeable person on Earth about the witr of the Messenger of Allah ﷺ ? I said: Who? He said: Aishah. So we went to her and greeted her with Salam and entered and asked her. I said: Tell me about the witr of the Messenger of Allah ﷺ. She said: We used to prepare for him his siwak and water for Ablution; then Allah SWT would wake him when He willed to wake him at night. He would clean his teeth and perform Ablution; then he would pray nine rakahs; during which he would not sit until the eighth. Then he would praise Allah SWT and remember Him and supplicate; then he would get up and not say the taslim. Then he would pray the ninth; then sit and praise Allah SWT and remember Him and supplicate; then he would say a taslim that we could hear. Then he prayed two rakahs sitting; and that was eleven rakahs; O my son. When the Messenger of Allah ﷺ grew older and put on weight; he prayed witr with seven; then he prayed two rakahs sitting after saying the taslim; and that was nine; O my son. SunanAlNasai-017-001-16505Mu awiyah Bin Qurrah narrated that his father said: When the Prophet of Allah sat; some of his Companions would sit with him. Among them was a man who had a little son who used to come to him from behind; and he would make him sit in front of him. He the child died; and the man stopped attending the circle because it reminded him of his son; and made him feel sad. The Prophet missed him and said: Why do I not see so-and-so? They said: O Messenger of Allah; his son whom you saw has died. The Prophet met him and asked him about his son; and he told him that he had died. He offered his condolences and said: O son-and-so; which would you like better; to enjoy his company all you life; or to come to any of the gates of Paradise on the Day of Resurrection; and find that he arrived there before you; and he is opening the gate for you? he said: O Prophet of Allah! For him to get to the gate of Paradise before me and open it for me is dearer to me. SunanAbuDawoud-017-001-24900Aisha wife of the Prophet ﷺ and Umm Salamah said Abu Hudaifah Bin Utbah Bin Rabiah Bin Abd Shams adopted Salim as his son and married him to his niece Hind; daughter of AlWalid Bin Utbah Bin Rabiah. He Salim was the freed slave of a woman from the Ansar the Helpers as the Apostle of Allaah ﷺ adopted Zaid as his son. In pre Islamic days when anyone adopted a man as his son; the people called him by his name and he was given a share from his inheritance. Allaah; the Exalted; revealed about this matter Call them by the name of their fathers; that is juster in the sight of Allaah. And if ye know not their fathers; then they are your brethren in the faith and your clients. They were then called by their names of their fathers. A man; whose father was not known; remained under the protection of someone and considered brother in faith. Sahlah daughter of Suhail Bin Amr AlQuraishi then came and said Apostle of Allaah ﷺ ; we used to consider Salim our son. He dwelled with me and Abu Hudhaifah in the same house; and he saw me in the short clothes; but Allaah the Exalted; has revealed about them what you know; then what is your opinion about him? The Prophet ﷺ said give him your breast feed. She gave him five breast feeds. He then became like her foster son. Hence; Aisha may Allaah be pleased with her used to ask the daughters of her sisters and the daughters of her brethren to give him breast feed five times; whom Aisha wanted to see and who wanted to visit her. Though he might be of age; he then visited her. But Umm Salamah and all other wives of the Prophet ﷺ refused to allow anyone to visit them on the basis of such breast feeding unless one was given breast feed during infancy. SunanAbuDawoud-017-001-25111Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. SunanAbuDawoud-017-001-28938Narrated Amr Bin Suhaib: On his father authority; said that his grandfather reported: Rabab Ibn Hudhayfah married a woman and three sons were born to him from her. Their mother then died. They inherited her houses and had the right of inheritance of her freed slaves. Amr Ibn AlAs was the agnate of her sons. He sent them to Syria where they died. Amr Ibn AlAs then came. A freed slave of hers died and left some property. Her brothers disputed with him and brought the case to Umar Ibn AlKhattab. Umar reported the Messenger of Allah ﷺ as saying: Whatever property a son or a father receives as an heir will go to his agnates; whoever they may be. He then wrote a document for him; witnessed by Abdulrahman Ibn Awuf ; Zayd Ibn Thabit and one other person. When AbdulMalik became caliph; they presented the case to Hisham Ibn Ismail or Ismail Ibn Hisham the narrator is doubtful. He sent them to Abd AlMalik who said: This is the decision which I have already seen. When he aid this to them; they beat him and he began to say Leave me; leave me. I shall tell you. When they left him he said I know nothing about Abu Sufyan; but this is the Quraish who have come here ; among them are Abu Jahl; Utbah; Shaibah the two sons of Rabiah and Umayah Bin Khalaf who have come here. The Prophet ﷺ was praying and hearing all that dialogue. When he finished; he said By Him in Whose hand my soul is; you beat him when he speaks the truth to you and you leave him when he tells a lie. This is the Quraish who have come here to defend Abu Sufyan. Anas said; The Apostle of Allaah ﷺ said This will be the place of falling of so and so tomorrow and he placed his hand on the ground. This will be the place of falling of so and so tomorrow and he put his hand on the ground. And this will be the place of falling of so and so tomorrow and he put his hand on the ground. I said to him; Peace be upon you and he said; Who is that? I replied; Umm Hani bint Abi Talib; and he said; Welcome; Umm Hani! When he had finished his ghusl; he stood and prayed eight rakas; covering himself with one garment; and then came away. I said; Messenger of Allah; the son of my mother; AIi; says that he is determined to kill so-and-so; son of Hubayra; a man I have placed under my protection. The Messenger of Allah; may Allah bless him and grant him peace; said; We give protection to whoever you have given protection to; Umm Hani. One of them said; Messenger of Allah! Judge between us by the Book of Allah! The other said; and he was the wiser of the two; Yes; Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. The Messenger of Allah; may Allah bless him and grant him peace; said; By him in whose Hand myself is; I will judge between you by the Book of Allah. As for your sheep and slave girl; they should be returned to you. Your son should have one hundred lashes and be exiled for a year. MuwataMalik-017-001-34785Malik related to me from Zurayq Ibn Hakim AlAyli that a man called Misbah asked his son for help and he thought him unnecessarily slow. When the son came; his father said to him; O fornicator. Zurayq said; So the son asked me to help him against the father. When I wanted to flog him; his son said; By Allah; if you flog him; I will acknowledge that I have committed fornication. When he said that; the situation was confused for me; so I wrote about it to Umar Ibn Abd AlAziz who was the governor at that time; and I mentioned it to him. Umar wrote me to permit his pardon. Zurayq said; I wrote to Umar Ibn Abd AlAziz also; What do you think about a man who is slandered or his parents are slandered and both or only one of them are dead? He said; Umar wrote to me; If he forgives; his pardon is permitted for himself. If his parents are slandered and one or both of them are dead; take the judgement of the Book of Allah for it unless he wants to veil it. Yahya said; I heard Malik say; That is because the slandered man might fear that if that is unveiled about him; a clear proof might be established. One of the two with the same mother died and left property and mawali. His full brother inherited his property and the wala of his mawali. Then he also died; and left as heirs his son and his paternal half brother. His son said; I obtain what my father inherited of property and the wala of the mawali. His brother said; It is not like that. You obtain the property. As for the wala of the mawali; it is not so. Do you think that had it been my first brother who died today; I would not have inherited from him? They argued and went to Uthman Ibn Affan. MuwataMalik-017-001-34837Malik related to me from Abdullah Ibn Abi Bakr Ibn Hazm that his father told him that he was sitting with Aban Ibn Uthman; and an argument was brought to him between some people from the Juhayna tribe and some people from the Banu AlHarith Ibn AlKhazraj. A woman of the Juhayna tribe was married to a man from the Banu AlHarith Ibn AlKhazraj; called Ibrahim Ibn Kulayb. She died and left property and mawali; and her son and husband inherited them from her. Then her son died and his heirs said; We have the wala of the mawali. Her son obtained them. Those of the Juhayna said; It is not like that. They are the mawali of our female associate. When her child died; we have their wala and we inherit them. He is more entitled to the man blood than any of his relatives after him. Malik said about a man who pardoned murder; after he had claimed his right and it was obliged for him; There is no blood-money against the murderer unless the one who pardons him stipulates that when he pardons him. Malik said about the murderer when he was pardoned; He is flogged one hundred lashes and jailed for a year. The Aidhi said; What would you think if it had been my son who killed him? Umar said; Then you would pay his blood-money. He said; He is then like the black and white Arqam snake. He took him by the arm and placed him before him on his mount. The grandmother of the child saw him and argued with Umar about the child so they went to Abu Bakr AlSiddiq. Umar said; My son. The woman said; My son. Abu Bakr said; Do not interfere between a child and its mother. Umar did not repeat his words. In the year of the conquest; Sad took him and said; He is the son of my brother. He covenanted with me about him. Abd Ibn Zama stood up and said; He is my brother and the son of my father slave-girl. He was born on his bed. They went to the Messenger of Allah; may Allah bless him and grant him peace. Sad said; Messenger of Allah! He is the son of my brother; he made a covenant with me about him. Abd Ibn Zama said; He is my brother and the son of my father slave-girl and was born on my father bed. The Messenger of Allah; may Allah bless him and grant him peace; said; He is yours; Abd Ibn Zama. Then the Messenger of Allah; may Allah bless him and grant him peace; said; A child belongs to the household where he was born and the adulterer is stoned. Then he told Sawda bint Zama; Veil yourself from him; since he saw in him a resemblance to Utba Ibn Abi Waqqas. MuwataMalik-017-001-34931Yahya said that he heard Malik say; The way of doing things generally agreed upon in our community in the case of a man who dies and has sons and one of them claims; My father confirmed that so-and- so was his son; is that the relationship is not established by the testimony of one man; and the confirmation of the one who confirmed it is only permitted as regards his own share in the division of his father property. The one testified for is only given his due from the share of the testifier. Malik said; An example of this is that a man dies leaving two sons; and 600 dinars. Each of them takes 300 dinars. Then one of them testifies that his deceased father confirmed that so-and-so was his son. The one who testifies is obliged to give 100 dinars to the one thus connected. This is half of the inheritance of the one thought to be related; had he been related. If the other confirms him; he takes the other 100 and so he completes his right and his relationship is established. His position is similar to that of a woman who confirms a debt against her father or her husband and the other heirs deny it. She must pay to the person whose debt she confirms; the amount according to her share of the full debt; had it been confirmed against all the heirs. If the woman inherits an eighth; she pays the creditor an eighth of his debt. If a daughter inherits a half; she pays the creditor half of his debt. Whichever women confirm him; pay him according to this. Malik said; If a man testimony is in agreement with what the woman testified to; that so- and-so had a debt against his father; the creditor is made to take an oath with one witness and he is given all his due. This is not the position with women because a man testimony is allowed and the creditor must take an oath with the testimony of his witness; and take all his due. If he does not take an oath; he only takes from the inheritance of the one who confirmed him according to his share of the debt; because he confirmed his right and the other heirs denied it. MuwataMalik-017-001-34956Yahya said that he heard Malik say; The way of doing things in our community about which there is no dispute; is that if a man gives sadaqa to his son - sadaqa which the son takes possession of or which is in the father keeping and the father has had his sadaqa witnessed; he cannot take back any of it because he cannot reclaim any sadaqa. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. MuwataMalik-017-001-34998Malik related to me from Zayd Ibn Aslam that his father said; Abdullah and Ubaydullah; the sons of Umar Ibn AlKhattab went out with the army to Iraq. On the way home; they passed by Abu Mousa AlAshari who was the amir of Basra. He greeted them and made them welcome; and told them that if there was anything he could do to help them; he would do it. Then he said; There is some of the property of Allah which I want to send to the amir Almuminin; so I will lend it to you; and you can buy wares from Iraq and sell them in Madina. Then give the principal to the amir Almuminin; and you keep the profit. They said that they would like to do it; and so he gave them the money and wrote to Umar Ibn AlKhattab to take the money from them. When they came to sell they made a profit; and when they paid the principal to Umar he asked; Did he lend everyone in the army the like of what he lent you? They said; No. Umar Ibn AlKhattab said; He made you the loan; because you are the sons of the amir Almuminin; so pay the principal and the profit. Abdullah was silent. Ubaydullah said; You do not need to do this; amir Almuminin. Had the principal decreased or been destroyed; we would have guaranteed it. Umar said; Pay it. Abdullah was silent; and Ubaydullah repeated it. A man who was sitting with Umar said; Amir Almuminin; better that you make it a qirad. Umar said; I have made it qirad. MuwataMalik-017-001-35026Yahya related to me from Malik from Ibn Shihab that he was asked about the suckling of an older person. He said; Urwa Ibn AlZubair informed me that Abu Hudhayfa Ibn Utba Ibn Rabia; one of the companions of the Messenger of Allah; may Allah bless him and grant him peace; who was present at Badr; adopted Salim who is called Salim; the mawla of Abu Hudhayfa as the Messenger of Allah; may Allah bless him and grant him peace; adopted Zayd Ibn Haritha. He thought of him as his son; and Abu Hudhayfa married him to his brother sister; Fatima bint AlWalid Ibn Utba Ibn Rabia; who was at that time among the first emigrants. She was one of the best unmarried women of the Quraysh. When Allah the Exalted sent down in His Book what He sent down about Zayd Ibn Haritha; Call them after their true fathers. That is more equitable in the sight of Allah. If you do not know who their fathers were then they are your brothers in the deen and your mawali; Surat 33 ayat 5 people in this position were traced back to their fathers. When the father was not known; they were traced to their mawla. Sahla bint Suhayl who was the wife of Abu Hudhayfa; and one of the tribe of Amr Ibn Luay; came to the Messenger of Allah; may Allah bless him and grant him peace; and said; Messenger of Allah! We think of Salim as a son and he comes in to see me while I am uncovered. We only have one room; so what do you think about the situation? The Messenger of Allah; may Allah bless him and grant him peace; said; Give him five drinks of your milk and he will be mahram by it. She then saw him as a foster son. Aisha umm Almuminin took that as a precedent for whatever men she wanted to be able to come to see her. She ordered her sister; Umm Kulthum bint Abi Bakr AlSiddiq and the daughters of her brother to give milk to whichever men she wanted to be able to come in to see her. The rest of the wives of the Prophet; may Allah bless him and grant him peace; refused to let anyone come in to them by such nursing. They said; No! By Allah! We think that what the Messenger of Allah; may Allah bless him and grant him peace; ordered Sahla bint Suhayl to do was only an indulgence concerning the nursing of Salim alone. No! By Allah! No one will come in upon us by such nursing! MuwataMalik-017-001-35135Yahya related to me from Malik; The generally agreed upon way of doing things among us and what I have seen the people of knowledge doing in our city about the fixed shares of inheritance of children from the mother or father when one or other of them dies is that if they leave male and female children; the male takes the portion of two females. If there are only females; and there are more than two; they get two thirds of what is left between them. If there is only one; she gets a half. If someone shares with the children; who has a fixed share and there are males among them; the reckoner begins with the ones with fixed shares. What remains after that is divided among the children according to their inheritance. When there are no children; grandchildren through sons have the same position as children; so that grandsons are like sons and grand-daughters are like daughters. They inherit as they inherit and they overshadow as they overshadow. If there are both children and grandchildren through sons; and there is a male among the children; then the grandchildren through sons do not share in the inheritance with him. If there is no surviving male among the children; and there are two or more daughters; the granddaughters through a son do not share in the inheritance with them unless there is a male who is in the same position as them in relation to the deceased; or further than them. His presence gives access to whatever is left over; if any; to whoever is in his position and whoever is above him of the granddaughters through sons. If something is left over; they divide it among them; and the male takes the portion of two females. If nothing is left over; they have nothing. If the only descendant is a daughter; she takes half; and if there are one or more grand-daughters through a son who are in the same position to the deceased; they share a sixth. If there is a male in the same position as the granddaughters through a son in relation to the deceased; they have no share and no sixth. If there is a surplus after the allotting of shares to the people with fixed shares; the surplus goes to the male and whoever is in his position and whoever is above him of the female descendants through sons. The male has the share of two females. The one who is more distant in relationship than grandchildren through sons has nothing. If there is no surplus; they have nothing. That is because Allah; the Blessed; the Exalted; said in His Book; Allah charges you about your children that the male has the like of the portion of two females. If there are more than two women they have two thirds of what is left. If there is one; she has a half. The inheritance of a wife from a husband who does not leave children or grandchildren through sons is a quarter. If he leaves children or grandchildren through sons; male or female; the wife has an eighth after bequests and debts. That is because Allah; the Blessed; the Exalted! said in His Book; You have a half of what your wives leave if they have no children. If they have children; you have a fourth of what they leave after bequests and debts. They have a fourth of what you leave if you have no children. MuwataMalik-017-001-35137Malik said; The generally agreed on way of doing things among us about which there is no dispute and what I have seen the people of knowledge in our city doing is that when a father inherits from a son or a daughter and the deceased leaves children; or grandchildren through a son; the father has a fixed share of one sixth. If the deceased does leave any children or male grandchildren through a son; the apportioning begins with those with whom the father shares in the fixed shares. They are given their fixed shares. If a sixth or more is left over; the sixth and what is above it is given to the father; and if there is less than a sixth left; the father is given his sixth as a fixed share; i.e. the other shares are adjusted. The inheritance of a mother from her child; if her son or daughter dies and leaves children or male or female grandchildren through a son; or leaves two or more full or half siblings is a sixth. If the deceased does not leave any children or grandchildren through a son; or two or more siblings; the mother has a whole third except in two cases. One of them is if a man dies and leaves a wife and both parents. The wife has a fourth; the mother a third of what remains; which is a fourth of the capital. The other is if a wife dies and leaves a husband and both parents. The husband gets half; and the mother a third of what remains; which is a sixth of the capital. That is because Allah; the Blessed; the Exalted; says in His Book; His two parents each have a sixth of what he leaves if he has children. If he does not have children; and his parents inherit from him; his mother has a third. If he has siblings; the mother has a sixth. Surat 4 ayat 11.
