Conceal not evidence; for whoever conceals it, - His heart is tainted with sin. And Allah Knoweth all that ye do.

Surat AlNisa Ayah 25Surat AlNisa0.05392وَمَنْ لَمْ يَسْتَطِعْ مِنْكُمْ طَوْلًا أَنْ يَنْكِحَ الْمُحْصَنَاتِ الْمُؤْمِنَاتِ فَمِنْ مَا مَلَكَتْ أَيْمَانُكُمْ مِنْ فَتَيَاتِكُمُ الْمُؤْمِنَاتِ وَاللَّهُ أَعْلَمُ بِإِيمَانِكُمْ بَعْضُكُمْ مِنْ بَعْضٍ فَانْكِحُوهُنَّ بِإِذْنِ أَهْلِهِنَّ وَآتُوهُنَّ أُجُورَهُنَّ بِالْمَعْرُوفِ مُحْصَنَاتٍ غَيْرَ مُسَافِحَاتٍ وَلَا مُتَّخِذَاتِ أَخْدَانٍ فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ ذَلِكَ لِمَنْ خَشِيَ الْعَنَتَ مِنْكُمْ وَأَنْ تَصْبِرُوا خَيْرٌ لَكُمْ وَاللَّهُ غَفُورٌ رَحِيمٌIf any of you have not the means wherewith to wed free believing women, they may wed believing girls from among those whom your right hands possess: And Allah hath full knowledge about your faith. Ye are one from another: Wed them with the leave of their owners, and give them their dowers, according to what is reasonable: They should be chaste, not lustful, nor taking paramours: when they are taken in wedlock, if they fall into shame, their punishment is half that for free women. This (permission) is for those among you who fear sin; but it is better for you that ye practise self-restraint. And Allah is Oft-forgiving, Most Merciful.

Will they then deny the favours of Allah?
Surat AlNoor Ayah 31Surat AlNoor0.15102وَقُلْ لِلْمُؤْمِنَاتِ يَغْضُضْنَ مِنْ أَبْصَارِهِنَّ وَيَحْفَظْنَ فُرُوجَهُنَّ وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا مَا ظَهَرَ مِنْهَا وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ وَلَا يُبْدِينَ زِينَتَهُنَّ إِلَّا لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ أَوِ التَّابِعِينَ غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ أَوِ الطِّفْلِ الَّذِينَ لَمْ يَظْهَرُوا عَلَى عَوْرَاتِ النِّسَاءِ وَلَا يَضْرِبْنَ بِأَرْجُلِهِنَّ لِيُعْلَمَ مَا يُخْفِينَ مِنْ زِينَتِهِنَّ وَتُوبُوا إِلَى اللَّهِ جَمِيعًا أَيُّهَ الْمُؤْمِنُونَ لَعَلَّكُمْ تُفْلِحُونَAnd say to the believing women that they should lower their gaze and guard their modesty; that they should not display their beauty and ornaments except what (must ordinarily) appear thereof; that they should draw their veils over their bosoms and not display their beauty except to their husbands, their fathers, their husband's fathers, their sons, their husbands' sons, their brothers or their brothers' sons, or their sisters' sons, or their women, or the slaves whom their right hands possess, or male servants free of physical needs, or small children who have no sense of the shame of sex; and that they should not strike their feet in order to draw attention to their hidden ornaments. And O ye Believers! turn ye all together towards Allah, that ye may attain Bliss.

While the Prophet ﷺ was delivering the Khutba on a Friday; a Bedouin stood up and said; O; Allah Messenger ﷺ ! Our possessions are being destroyed and the children are hungry; Please invoke Allah for rain. So the Prophet ﷺ raised his hands. At that time there was not a trace of cloud in the sky. By Him in Whose Hands my soul is as soon as he lowered his hands; clouds gathered like mountains; and before he got down from the pulpit; I saw the rain falling on the beard of the Prophet. It rained that day; the next day; the third day; the fourth day till the next Friday. The same Bedouin or another man stood up and said; O Allah Messenger ﷺ ! The houses have collapsed; our possessions and livestock have been drowned; Please invoke Allah to protect us. So the Prophet ﷺ raised both his hands and said; O Allah! Round about us and not on us. So; in whatever direction he pointed with his hands; the clouds dispersed and cleared away; and Medina sky became clear as a hole in between the clouds. They said: They the people sucked them and then drank water over them. He the narrator said : He the Holy Prophet invoked the blessings of Allah upon them provisions. He the narrator said: And there was such a miraculous increase in the stocks that the people replenished their provisions fully. He the narrator said: At that time he the Holy Prophet said: I bear testimony to the fact that there is no god but Allah; and I am His messenger. Allah Messenger mav ﷺ laughed and said: They are around me as you see; asking for extra money. Abu Bakr Allah be pleased with him then got up went to Aisha Allah be pleased with her and slapped her on the neck; and Umar stood up before Hafsa and slapped her saying: You ask Allah Messenger ﷺ which he does not possess. They said: By Allah; we do not ask Allah Messenger ﷺ for anything he does not possess. Then he withdrew from them for a month or for twenty-nine days. Then this verse was revealed to him: Prophet: Say to thy wives... for a mighty reward xxxiii. 28. He then went first to Aisha Allah be pleased with her and said: I want to propound something to you; Aisha; but wish no hasty reply before you consult your parents. She said: Messenger of Allah; what is that? He the Holy Prophet recited to her the verse; whereupon she said: Is it about you that I should consult my parents; Messenger of Allah? Nay; I choose Allah; His Messenger; and the Last Abode; but I ask you not to tell any of your wives what I have said He replied: Not one of them will ask me without my informing her. He commanded that a leather cloth be spread and dates; cottage cheese and ghee were placed on it; and that was his Walimah. The Muslims said: Will she be one of the Mothers of the Believers; or a female slave whom his right hand possesses? They said: If he has a Hijab for her; then she will be one of the Mothers of the Believers and if she does not have a Hijab then she will be a female slave whom his right hand possesses. SunanAbuDawoud-017-001-25163Narrated Hammad : I took a letter from Thumamah Bin Abdullah Bin Anas. He presumed that Abu Bakr had written it for Anas when he sent him to AlBahrain as a collector of zakat. This letter was stamped with the stamp of the Messenger of Allah ﷺ and was written by Abu Bakr for him Anas. This letter goes This is the obligatory sadaqah zakat which the Messenger of Allah ﷺ imposed on Muslims which Allah commanded his Prophet ﷺ to impose. Those Muslims who are asked for the proper amount must give it; but those who are asked for more than that must not give it. For less than twenty five Camels a goat is to be given for every five Camels. When they reach twenty five to thirty five; a she Camel in her second year is to be given. If there is no she Camel in her second year; a male Camel in its third year is to be given. When they reach thirty six to forty five; a she Camel in her third year is to be given. When they reach forty six to sixty ; a she Camel in her fourth year which is ready to be covered by a stallion is to be given. When they reach sixty one to seventy five; a she Camel in her fifth year is to be given. When they reach seventy six to ninety; two she Camel in their third year are to be given. When they reach ninety one to a hundred and twenty; two she Camels in their fourth year are ready to be covered by a stallion are to be given. When they exceed a hundred and twenty; a she Camel in her third year is to be given for every forty and a she Camel in her fourth year for every fifty Camels. In case the ages of the Camel vary in the payment of obligatory sadaqah zakat If anyone whose Camels reach the number on which a she Camel in her fifth year is payable does not possess one but possess one in her fourth year; that will be accepted from him along with two goats if he can conveniently give them; or else twenty dirhams. If anyone whose Camels reach the number on which a she Camel in her fourth year is payable does not possess but possesses one in her fifth year; that will be accepted from him; and the collector must give him twenty dirhams or two goats. If anyone whose Camels reach the number on which a she Camel in her fourth year is payable possesses only one in her third year; that will be accepted from him.Abu Dawud said From here I could not retain accurately from Mousa as I liked And he must give along with it two goats if he can conveniently give them; or else twenty dirhams. If anyone whose Camels reach the number on which a she Camel in her third year is payable possesses only one in her fourth year; that will be accepted from him. Abu Dawud said I was doubtful up to here; and retained correctly onward and the collector must give him twenty dirhams or two goats. If anyone whose Camels reach the number on which a she Camel in her third year is payable does not possess one but possesses one in her second year; that will be accepted from him; but he must give two goats or twenty dirhams. Anyone whose Camels reach the number on which a she Camel in her second year is payable does not possess one but possesses a male Camel in its third year; that will be accepted from him; and nothing extra will be demanded along with it. If anyone possesses only four Camels; no zakat will be payable on them unless their owner wishes. If the numbers of the pasturing goats reach forty to one hundred and twenty; one goat is to be given. Over one hundred and twenty up to two hundred; two goats are to be given. If they exceed two hundred reaching three hundred; three goats are to be given. If they exceed three hundred; a goat is to be for every hundred. An old sheep; one with a defect in the eye; or a male goat is not to be accepted as sadaqah zakat unless the collector wishes. Those which are in separate flocks are not to be brought together and those which are in one flock are not to be separated from fear of sadaqah zakat. Regarding what belongs to two partners; they can make claims for restitution from one another with equity; If a mans pasturing animals are less than forty; no sadaqah zakat is due on them unless their owner wishes. Whatever exceeds; that will be reckoned properly. The narrator said: I do not remember whether the words that will be reckoned properly were uttered by All himself or he attributed them to the Prophet ﷺ. No zakat is payable on property till a year passes on it. SunanAbuDawoud-017-001-25196Amr Bin Shuaib; on his father authority; said that his grandfather reported: Hilal; a man from the tribe of Banu Matan brought a tenth of honey which he possessed in beehives to the Messenger of Allah ﷺ. He asked him the apostle of Allah to give the wood known as Salabah as a protected or restricted land. The Messenger of Allah ﷺ gave him that wood as a protected land. When Umar Ibn AlKhattab succeeded; Sufyan Ibn Wahb wrote to Umar asking him about this wood. He said: This applied till Umar Allah be pleased with him became caliph and he made a speech in which he said: Take note! Camels have become dear. So Umar fixed the value for those who possessed gold at one thousand dinars; for those who possessed silver at twelve thousand dirhams ; for those who possessed cattle at two hundred cows; for those who possessed sheep at two thousand sheep; and for those who possessed suits of clothing at two hundred suits. MuwataMalik-017-001-34988Malik related to me that he heard the like of that from Sulayman Ibn Yasar. Malik spoke about a man who bought out one of the partners in a shared property; by paying the man with an animal; a slave; a slave-girl; or the equivalent of that in goods. Then another partner decided to exercise his right of pre-emption after that; and he found that the slave or slave-girl had died; and no one knew what her value had been. The buyer claimed; The value of the slave or slave-girl was 100 dinars. The partner with the right of pre-emption claimed; The value was 50 dinars. Malik said; The buyer takes an oath that the value of what he payed was 100 dinars. Then if the one with the right of pre-emption wishes; he can compensate him; or else he can leave it; unless he can bring a clear proof that the slave or slave-girl value is less than what the buyer said. If someone gives away his portion of a shared house or land and the recipient repays him for it by cash or goods; the partners can take it by pre-emption if they wish and pay off the recipient the value of what he gave in dinars or dirhams. If someone makes a gift of his portion of a shared house or land; and does not take any remuneration and does not seek to; and a partner wants to take it for its value; he cannot do so as long as the original partner has not been given recompense for it. If there is any recompense; the one with the right of pre-emption can have it for the price of the recompense. Malik spoke about a man who bought into a piece of shared land for a price on credit; and one of the partners wanted to possess it by right of pre-emption. Malik said; If it seems likely that the partner can meet the terms; he has right of pre-emption for the same credit terms. If it is feared that he will not be able to meet the terms; but he can bring a wealthy and reliable guarantor of equal standing to the one who bought into the land; he can also take possession. Malik said; A person absence does not sever his right of pre-emption. Even if he is a way for a long time; there is no time limit after which the right of preemption is cut off. Malik said that if a man left land to a number of his children; then one of them who had a child died and the child of the deceased sold his right in that land; the brother of the seller was more entitled to pre-empt him than his paternal uncles; the partners of his father. Malik said; This is what is done in our community. Malik said; Pre- emption is shared between partners according to their existing shares. Each of them takes according to his portion. If it is small; he has little. If it is great; it is according to that. That is if they are tenacious and contend with each other about it. Malik said; As for a man who buys out the share of one of his partners; and one of the other partners says; I will take a portion according to my share; and the first partner says; If you wish to take all the preemption; I will give it up to you. If you wish to leave it; then leave it. If the first partner gives him the choice and hands it over to him; the second partner can only take all the pre-emption or give it back. If he takes it; he is entitled to it. If not; he has nothing. Malik spoke about a man who bought land; and developed it by planting trees or digging a well etc.; and then someone came; and seeing that he had a right in the land; wanted to take possession of it by pre-emption. Malik said He has no right of preemption unless he compensates the other for his expenditure. If he gives him the price of what he has developed; he is entitled to pre- emption. If not; he has no right in it. Malik said that someone who sold off his portion of a shared house or land and then; on learning that some one with a right of pre-emption was to take possession by that right; asked the buyer to revoke the sale; and he did so; did not have the right to do that. The pre-emptor has more right to the property for the price for which he sold it. In the case of some one who bought along with a section of a shared house or land; an animal and goods that were not shared ; so that when any one demanded his right of pre-emption in the house or land he said; Take what I have bought altogether; for I bought it altogether; Malik said; The pre-emptor need only take possession of the house or land. Each thing the man bought is assessed according to its share of the lump sum the man paid. Then the pre-emptor takes possession of his right for a price which is appropriate on that basis. He does not take any animals or goods unless he wants to do that. Malik said; If someone sells a section of shared land; and one of those who have the right of preemption surrenders it to the buyer and another refuses to do other than take his pre-emption; the one who refuses to surrender has to take all the preemption; and he cannot take according to his right and leave what remains. In the case where one of a number of partners in one house sold his share when all his partners were away except for one man; the one present was given the choice of either taking the pre-emption or leaving it; and he said; I will take my portion and leave the portions of my partners until they are present. If they take it; that is that. If they leave it; I will take all the pre-emption; Malik said; He can only take it all or leave it. If his partners come; they can take from him or leave it as they wish. MuwataMalik-017-001-35033Yahya related to me from Malik from Nafi from Abdullah Ibn Umar that Umar Ibn AlKhattab said; If a slave who has wealth is sold; that wealth belongs to the seller unless the buyer stipulates its inclusion. Malik said; The generally agreed upon way of doing things among us is that if the buyer stipulates the inclusion of the slave property whether it be cash; debts; or goods of known or unknown value; then they belong to the buyer; even if the slave possesses more than that for which he was purchased; whether he was bought for cash; as payment for a debt; or in exchange for goods. This is possible because a master is not asked to pay zakat on his slave property. If a slave has a slave-girl; it is halal for him to have intercourse with her by his right of possession. If a slave is freed or put under contract kitaba to purchase his freedom; then his property goes with him. MuwataMalik-017-001-35103Yahya related to me from Malik from Yahya Ibn Said that AlQasim Ibn Muhammad said; I heard Abdullah Ibn Abbas say; when a man asked him about a man making an advance on some garments and then wanting to sell them back before taking possession of them; That is silver for silver; and he disapproved of it. Malik said; Our opinion is - and Allah knows best that was because he wanted to sell them to the person from whom he had bought them for more than the price for which he bought them. Had he sold them to some one other than the person from whom he had purchased them; there would not have been any harm in it. Malik said; The generally agreed on way of doing things among us concerning making an advance for slaves; cattle or goods is that when all of what is to be sold is described and an advance is made for them for a date; and the date falls due; the buyer does not sell any of that to the person from whom he has purchased it for more than the price which he advanced for it before he has taken full possession of what he has advanced for. It is usury if he does. If the buyer gives the seller dinars or dirhams and he profits with them; then; when the goods come to the buyer and he does not take them into his possession but sells them back to their owner for more than what he advanced for them; the outcome is that what he has advanced has returned to him and has been increased for him. Malik said; If someone advances gold or silver for described animals or goods which are to be delivered before a named date; and the date arrives; or it is before or after the date; there is no harm in the buyer selling those goods to the seller; for other goods; to be taken immediately and not delayed; no matter how extensive the amount of those goods is; except in the case of food because it is not halal to sell it before he has full possession of it. The buyer can sell those goods to some one other than the person from whom he purchased them for gold or silver or any goods. He takes possession of it and does not defer it because if he defers it; that is ugly and there enters into the transaction what is disapproved of: delay for delay. Delay for delay is to sell a debt against one man for a debt against another man. Malik said; If someone advances for goods to be delivered after a time; and those goods are neither something to be eaten nor drunk; he can sell them to whomever he likes for cash or goods; before he takes delivery of them; to some one other than the person from whom he purchased them. He must not sell them to the person from whom he bought them except in exchange for goods which he takes possession of immediately and does not defer. Malik said; If the delivery date for the goods has not arrived; there is no harm in selling them to the original owner for goods which are clearly different and which he takes immediate possession of and does not defer. Malik spoke about the case of a man who advanced dinars or dirhams for four specified pieces of cloth to be delivered before a specified time and when the term fell due; he demanded delivery from the seller and the seller did not have them. He found that the seller had cloth but inferior quality; and the seller said that he would give him eight of those cloths. Malik said; There is no harm in that if he takes the cloths which he offers him before they separate. It is not good if delayed terms enter into the transaction. MuwataMalik-017-001-35338Yahya related to me from Malik that he had asked Ibn Shihab about a man who had a slave-girl as a wife; and then he bought her; and divorced her once. He said; She is halal for him by the possession of the right hand as long as he does not make his divorce irrevocable. If he irrevocably divorces her; she is not halal for him by the possession of the right hand until she has married another husband. Malik said that if a man rnarried a female slave and then she had a child by him; and then he bought her; she was not an umm walad for him because of the child born to him while she belonged to another; until she had had a child by him while she was in his possession after he had purchased her. MuwataMalik-017-001-35346Malik said; It is not halal to marry a christian or jewish slave-girl because Allah the Blessed; the Exalted; said in His Book; Believing women who are muhsanat and women of those who were given the Book before you who are muhsanat; Surat 5 ayat 6 and they are free women from the Christians and Jews. Allah; the Blessed; the Exalted; said in His Book; If you are not affluent enough to marry believing women who are muhsanat; take believing slave-girls whom your right hands own. Surat 4 ayat 24 Malik said; In our opinion; Allah made marriage to believing slave-girls halal; and He did not make halal marriage to christian and jewish slave-girls from the People of the Book.
