They said: "What affair is this of ours?" Say thou: "Indeed, this affair is wholly Allah's." They hide in their minds what they dare not reveal to thee. They say (to themselves): "If we had had anything to do with this affair, We should not have been in the slaughter here." Say: "Even if you had remained in your homes, those for whom death was decreed would certainly have gone forth to the place of their death"; but (all this was) that Allah might test what is in your breasts and purge what is in your hearts. For Allah knoweth well the secrets of your hearts.

Had there not been believing men and believing women whom ye did not know that ye were trampling down and on whose account a crime would have accrued to you without (your) knowledge, (Allah would have allowed you to force your way, but He held back your hands) that He may admit to His Mercy whom He will. If they had been apart, We should certainly have punished the Unbelievers among them with a grievous Punishment.

SahihAlBukhari-017-001-089Narrated Mahmud Bin AlRabi AlAnsari: that he remembered Allah Messenger ﷺ and he also remembered a mouthful of water which he had thrown on his face; after taking it from a well that was in their house. Mahmud said that he had heard Itban Bin Malik; who was present with Allah Messenger ﷺ in the battle of Badr saying; I used to lead my people at Bani Salim in the prayer and there was a valley between me and those people. Whenever it rained it used to be difficult for me to cross it to go to their Masjid. So I went to Allah Messenger ﷺ and said; I have weak eyesight and the valley between me and my people flows during the rainy season and it becomes difficult for me to cross it; I wish you would come to my house and pray at a place so that I could take that place as a praying place. Allah Messenger ﷺ said; I will do so. So Allah Messenger ﷺ and Abu Bakr came to my house in the next morning after the sun had risen high. Allah Messenger ﷺ asked my permission to let him in and I admitted him. He did not sit before saying; Where do you want us to offer the prayer in your house? I pointed to the place where I wanted him to pray. So Allah Messenger ﷺ stood up for the prayer and started the prayer with Takbir and we aligned in rows behind him; and he offered two rakat; and finished them with Taslim; and we also performed Taslim with him. I detained him for a meal called KhaZirr which I had prepared for him.- KhaZirr is a special type of dish prepared from barley flour and meat soup - When the neighbors got the news that Allah Messenger ﷺ was in my house; they poured it till there were a great number of men in the house. One of them said; What is wrong with Malik; for I do not see him? One of them replied; He is a hypocrite and does not love Allah and His Apostle. On that Allah Apostle said; Dont say this. Havent you seen that he said; None has the right to be worshipped but Allah for Allah sake only. The man replied; Allah and His Apostle know better; but by Allah; we never saw him but helping and talking with the hypocrites. Allah Messenger ﷺ replied; No doubt; whoever says. None has the right to be worshipped but Allah; and by that he wants the pleasures of Allah; then Allah will save him from Hell. Mahmud added; I told the above narration to some people; one of whom was Abu Ayoub ; the companion of Allah Messenger ﷺ in the battle in which he Abu Ayoub died and Yazid Bin Muawiya was their leader in Roman Territory. Abu Ayoub denounced the narration and said; I doubt that Allah Messenger ﷺ ever said what you have said. I felt that too much; and I vowed to Allah that if I remained alive in that holy battle; I would go to Medina and ask Itban Bin Malik if he was still living in the Masjid of his people. So when he returned; I assumed Ihram for Hajj or Umra and then I proceeded on till I reached Medina. I went to Bani Salim and Itban Bin Malik; who was by then an old blind man; was leading his people in the prayer. When he finished the prayer; I greeted him and introduced myself to him and then asked him about that narration. SahihAlBukhari-017-001-1455Narrated Ibn Abbas: I used to teach Quran to Abdulrahman Bin Auf. When Umar performed his last Hajj; Abdulrahman said to me at Mina; Would that you had seen Chief of the believers today! A man came to him and said; So-and-so has said; If Chief of the Believers died; we will give the oath of allegiance to such-and-such person; Umar said; I will get up tonight and warn those who want to usurp the people rights. I said; Do not do so; for the season of Hajj gathers the riffraff mob who will form the majority of your audience; and I am afraid that they will not understand the meaning of your saying properly and may spread an incorrect statement everywhere. You should wait till we reach Medina; the place of migration and the place of the Sunna the Prophet Traditions. There you will meet the companions of Allah Messenger ﷺ from the Muhajirin and the Ansar who will understand your statement and place it in its proper position Umar said; By Allah; I shall do so the first time I stand to address the people in Medina. When we reached Medina; Umar in a Friday Khutba-sermon said; No doubt; Allah sent Muhammad with the Truth and revealed to him the Book Quran ; and among what was revealed; was the Verse of AlRajm stoning adulterers to death. SahihAlBukhari-017-001-1798Narrated AlHarith Bin Suwaid: Abdullah Bin Masud related to us two narrations: One from the Prophet ﷺ and the other from himself; saying: A believer sees his sins as if he were sitting under a mountain which; he is afraid; may fall on him; whereas the wicked person considers his sins as flies passing over his nose and he just drives them away like this. Abu Shihab the sub-narrator moved his hand over his nose in illustration. Ibn Masud added : Allah Messenger ﷺ said; Allah is more pleased with the repentance of His slave than a man who encamps at a place where his life is jeopardized; but he has his riding beast carrying his food and water. He then rests his head and sleeps for a short while and wakes to find his riding beast gone. He starts looking for it and suffers from severe heat and thirst or what Allah wished him to suffer from. He then says; I will go back to my place. SahihAlBukhari-017-001-1911Narrated Anas Bin Malik: that he was a boy of ten at the time when the Prophet ﷺ emigrated to Medina. He added: I served Allah Apostle for ten years the last part of his life time and I know more than the people about the occasion whereupon the order of AlHijab was revealed to the Prophet. Ubai b n Kaab used to ask me about it. It was revealed for the first time during the marriage of Allah Messenger ﷺ with Zainab bint Jahsh. In the morning; the Prophet ﷺ was a bride-groom of her and he Invited the people; who took their meals and went away; but a group of them remained with Allah Messenger ﷺ and they prolonged their stay. Allah Messenger ﷺ got up and went out; and I too; went out along with him till he came to the lintel of Aisha dwelling place. Allah Messenger ﷺ thought that those people had left by then; so he returned; and I too; returned with him till he entered upon Zainab and found that they were still sitting there and had not yet gone. The Prophet ﷺ went out again; and so did I with him till he reached the lintel of Aisha dwelling place; and then he thought that those people must have left by then; so he returned; and so did I with him; and found those people had gone. I would not like to have gold equal to Uhud mountain for me; unless nothing of it; not even a single Dinar remains of it with me; for more than one day or three days; except that single Dinar which I will keep for repaying debts. He said; Those who have much wealth in this world will be the least rewarded in the Hereafter except those who do like this and like this i.e.; spend their money in charity. Then he ordered me; Remain at your place and do not leave it; O Abu Dhar; till I come back. He went away till he disappeared from me. Then I heard a voice and feared that something might have happened to Allah Messenger ﷺ ; and I intended to go to find out but I remembered the statement of Allah Messenger ﷺ that I should not leave; my place; so I kept on waiting and after a while the Prophet ﷺ came ; and I said to him; O Allah Messenger ﷺ ; I heard a voice and I was afraid that something might have happened to you; but then I remembered your statement and stayed there. The Prophet ﷺ said; That was Gabriel who came to me and informed me that whoever among my followers died without joining others in worship with Allah; would enter Paradise. I said; O Allah Messenger ﷺ ! Even if he had committed illegal sexual intercourse and theft? SahihAlBukhari-017-001-1994Narrated Abdullah Bin Amir Bin Rabia: Umar Bin AlKhattab left for Sham; and when he reached a placed called Sargh; he came to know that there was an outbreak of an epidemic of plague in Sham. Then Abdulrahman Bin Auf told him that Allah Messenger ﷺ said; If you hear the news of an outbreak of an epidemic plague in a certain place; do not enter that place: and if the epidemic falls in a place while you are present in it; do not leave that place to escape from the epidemic. SahihAlBukhari-017-001-2145Narrated Abu Dhar: While I was walking with the Prophet ﷺ in the Harra of Medina; Uhud came in sight. The Prophet ﷺ said; O Abu Dhar! I said; Labbaik; O Allah Messenger ﷺ ! He said; I would not like to have gold equal to this mountain of Uhud; unless nothing of it; not even a single Dinar of it remains with me for more than three days; except something which I will keep for repaying debts. I would have spent all of it distributed it amongst Allah Slaves like this; and like this; and like this. The Prophet ﷺ pointed out with his hand towards his right; his left and his back while illustrating it. He proceeded with his walk and said; The rich are in fact the poor little rewarded on the Day of Resurrection except those who spend their wealth like this; and like this; and like this; to their right; left and back; but such people are few in number. Then he said to me; Stay at your place and do not leave it till I come back. Then he proceeded in the darkness of the night till he went out of sight; and then I heard a loud voice; and was afraid that something might have happened to the Prophet ﷺ.1 intended to go to him; but I remembered what he had said to me; i.e. Dont leave your place till I come back to you; so I remained at my place till he came back to me. I said; O Allah Messenger ﷺ ! I heard a voice and I was afraid. So I mentioned the whole story to him. He said; Did you hear it? I replied; Yes. He said; It was Gabriel who came to me and said; Whoever died without joining others in worship with Allah; will enter Paradise. I asked Gabriel ; Even if he had committed theft or committed illegal sexual intercourse? SahihAlBukhari-017-001-2268Narrated Anas: Um the mother of Haritha came to Allah Messenger ﷺ after Haritha had been martyred on the Day of the battle of Badr by an arrow thrown by an unknown person. She said; O Allah Messenger ﷺ ! You know the position of Haritha in my heart i.e. how dear to me he was ; so if he is in Paradise; I will not weep for him; or otherwise; you will see what I will do. The Prophet ﷺ said; Are you mad? Is there only one Paradise? There are many Paradises; and he is in the highest Paradise of Firdaus. SahihAlBukhari-017-001-2402Narrated Abdullah Bin Abbas: Umar Bin AlKhattab departed for Sham and when he reached Sargh; the commanders of the Muslim army; Abu Ubaida Bin AlJarrah and his companions met him and told him that an epidemic had broken out in Sham. Umar said; Call for me the early emigrants. So Umar called them; consulted them and informed them that an epidemic had broken out in Sham. Those people differed in their opinions. Some of them said; We have come out for a purpose and we do not think that it is proper to give it up; while others said to Umar ; You have along with you. other people and the companions of Allah Messenger ﷺ so do not advise that we take them to this epidemic. Umar said to them; Leave me now. Then he said; Call the Ansar for me. I called them and he consulted them and they followed the way of the emigrants and differed as they did. He then said to them; Leave me now; and added; Call for me the old people of Quraish who emigrated in the year of the Conquest of Mecca. I called them and they gave a unanimous opinion saying; We advise that you should return with the people and do not take them to that place of epidemic. So Umar made an announcement; I will ride back to Medina in the morning; so you should do the same. Abu Ubaida Bin AlJarrah said to Umar ; Are you running away from what Allah had ordained? Umar said; Would that someone else had said such a thing; O Abu Ubaida! Yes; we are running from what Allah had ordained to what Allah has ordained. Dont you agree that if you had camels that went down a valley having two places; one green and the other dry; you would graze them on the green one only if Allah had ordained that; and you would graze them on the dry one only if Allah had ordained that? At that time Abdulrahman Bin Auf; who had been absent because of some job; came and said; I have some knowledge about this. I have heard Allah Messenger ﷺ saying; If you hear about it an outbreak of plague in a land; do not go to it; but if plague breaks out in a country where you are staying; do not run away from it. There was peace during those days and this place was inhabited by the Jews. They parted company for their respective needs. Abdullab Bin Sahl was killed; and his dead body was found in a tank. His companion Muhayisa buried him and came to Medina; and the brothers of the slain Abdulrahman Bin Sahl. and Muhayisa and Huwayisa told Allah Messenger ﷺ the case of Abdullah and the place where he had been murdered. Bushair reported on the authority of one who had seen Allah Messenger ﷺ that he had said to them: You take fifty oaths and you are entitled to blood-wit of one slain among you or your companion. They said: Messenger of Allah; we neither saw with our own eyes this murder nor were we present there. Thereupon Allah Messenger is reported to have said : Then the Jews will exonerate themselves by taking fifty oaths. They said: Allah Messenger; how can we accept the oath of unbelieving people? SahihMuslim-017-001-17792It has been narrated through a different chain of transmitters on the authority of Abu AlZubair who heard Jabir being questioned as to whether the Prophet ﷺ took the oath of fealty at Dhu AlHulaifa. SahihMuslim-017-001-18085It has been narrated on the authority of Anas that when the news of the advance of Abu Sufyan at the head of a force reached him. the Messenger of Allah ﷺ held consultations with his Companions. The narrator said: Abu Bakr spoke expressing his own views ; but he the Holy Prophet did not pay heed to him. Then spoke Umar expressing his views ; but he the Holy Prophet did not pay heed to him too. Then Saad Bin Ubada stood up and said: Messenger of Allah; you want us to speak. By God in Whose control is my life; if you order us to plunge our horses into the sea; we would do so. If you order us to goad our horses to the most distant place like Bark AlGhimad; we would do so. The narrator said: Now the Messenger of Allah ﷺ called upon the people for the encounter. So they set out and encamped at Badr. Soon the water-carriers of the Quraish arrived. Among them was a black slave belonging to Banu AlHajjaj. The Companions of the Messenger of Allah ﷺ caught him and interrogated him about Abu Sufyan and his companions. He said: I know nothing about Abu Sufyan; but Abu Jahl; Utba; Shaiba and Umaya Bin Khalaf are there. When he said this; they beat him. Then he said: All right; I will tell you about Abu Sufyan. They would stop beating him and then ask him again about Abu Sufyan. He would again say; I know nothing about Abu Sufyan; but Abu Jahl. Utba; Shaiba and Umaya Bin Khalaf are there. When he said this; they beat him likewise. The Messenger of Allah ﷺ was standing in prayer. When he saw this he finished his prayer and said: By Allah in Whose control is my life; you beat him when he is telling you the truth; and you let him go when he tells you a lie. The narrator said: Then the Messenger of Allah ﷺ said: This is the place where so and so would be killed. SahihMuslim-017-001-18088It has been narrated on the authority of Abdullah Bin Rabah who said: We came to Muawiya Bin Abu Sufyan as a deputation and Abu Huraira was among us. Each of us would prepare food for his companions turn by turn for a day. Accordingly when it was my turn I said: Abu Huraira; it is my turn today. So they came to my place. The food was not yet ready; so I said to Abu Huraira: I wish you could narrate to us a tradition from the Messenger of Allah ﷺ until the food was ready. Complying with my request Abu Huraira said: We were with the Messenger of Allah ﷺ on the day of the Conquest of Mecca. He appointed Khalid Bin Walid as commander of the right flank; AlZubair as commander of the left flank; and Abu Ubaida as commander of the foot-soldiers who were to advance to the interior of the valley. He then said: Abu Huraira; call the Ansar to me. So I called out to them and they came hurriedly. He said: O ye Assembly of the Ansaar; do you see the ruffians of the Quraish? They said: Yes. He said: See; when you meet them tomorrow; wipe them out. He hinted at this with his hand; placing his right hand on his left and said: You will meet us at AlSafa. Abu Huraira continued : Whoever was seen by them that day was put to death. The Messenger of Allah ﷺ ascended the mount of AlSafa. The Ansar also came there and surrounded the mount. Then came Abu Sufyan and said: Messenger ot Allah; the Quraish have perished. No member of the Quraish tribe will survive this day. The Messenger of Allah ﷺ said: Who enters the house of Abu Safyin will be safe; who lays down arms will be safe; who locks his door will be safe. some of the Ansar said: After all the man has been swayed by tenderness towards his family and love for his city. At this; Divine inspiration descended upon the Messenger of Allah ﷺ. He said: You were saying that the man has been swayed by tenderness towards his family and love for his city. Do you know what my name is? I am Muhammad; the bondman of God and His Messenger. He repeated this thrice. I left my native place for the take of Allah and joined you. So I will live with you and die with you. Now the Ansar said: By God; we said that only out of our greed for Allah and His Messenger. SahihMuslim-017-001-18095It has been narrated on the authority of Bara who said: When the Prophet ﷺ was checked from going to the Kaba; the people of Mecca made peace with himon the condition that he would be allowed to enter Mecca next year and stay there for three days; that he would not enter the city except with swords in their sheaths and arms encased in their covers; that he would not take eway with him anyone from its dwellers; nor would he prevent anyone from those with him to stay on in Mecca if he so desired. He said to Ali: Write down the terms settled between us. So Ali wrote : In the name of Allah; most Gracious and most Merciful. This is what Muhammad; the Messenger of Allah; has settled with the Meccans ; The polytheists said to him: If we knew that thou art the Messenger of of Allah; we would follow you. But write: Muhammad Bin Abdullah. So he told Ali to strike out these words. Ali said: No; by Allah; I will not strike them out. The Messenger of Allah ﷺ said: Show me their place on the parchment. So he Ali showed him their place and he the Holy Prophet struck them out; and Ali wrote: Ibn Abdullah. According to the terms of the treaty; next year the Prophet ﷺ stayed there for three days When it was the third day; they said to Ali: This is the last day according to the terms of your companion. So tell him to leave. Ali informed the Prophet ﷺ accordingly. He said: Yes; and left the city. SahihMuslim-017-001-18123It has been narrated on the authority of Usama Bin Zaid that the Prophet ﷺ rode a donkey. It had on it a saddle under which was a mattress made at Fadak a place near Medina. Behind him he seated Usama. He was going to the street of Banu Harith AlKhazraj to inquire after the health of Saad Bin Ubada This happened before the Battle of Badr. He proceeded until he passed by a mixed company of people in which were Muslims; polytheists; idol worshippers and the Jews and among them were Abdullah Bin Ubay and Abdullah Bin Rawaha. When the dust raised by the hoofs of the animal spread over the company; Abdullah Bin Ubay covered his nose with his mantle and said: Do not scatter the dust over us Not minding this remark ; the Prophet ﷺ greeted them; stopped; got down from his animal; invited them to Allah; and recited to them the Quran. Abdullah Bin Ubay said: O man; if what you say is the truth; the best thing for you would be not to bother us with it in our assemblies. Get back to your place. Whoso comes to you from us; tell him all this. Abdullah Bin Rawaha said: Come to us in our gatherings; for we love to hear it. The narrator says: At this ; the Muslims; the polytheists and the Jews began to rebuke one another until they were determined to come to blows. The Prophet ﷺ continued to pacify them. When they were pacified ; he rode his animal and came to Saad Bin Ubida. He said: Sad; havent you heard what Abu Hubab meaning Abdullah Bin Ubay has said? He has said so and so. Saad said: Messenger of Allah; forgive and pardon. God has granted you a sublime position; but so far as he is concerned the people of this settlement had-decided to make him their king by making him wear a crown and a turban in token thereof ; but God has circumvented this by the truth He has granted you. This has made him jealous and his jealousy must have prompted the behaviour that you have witnessed. SahihMuslim-017-001-18438It is narrated on the authority of Itban Bin Malik that he came to Medina and said: Something had gone wrong with my eyesight. I; therefore; sent a message to the Holy Prophet : Verily it is my ardent desire that you should kindly grace my house with your presence and observe prayer there so; that I should make that corner a place of worship. He said: The Prophet ﷺ came there; and those amongst the Companions whom Allah willed also accompanied him. He entered my place and offered prayer at my residence and his Companions began to talk amongst themselves and this conversation centered round hypocrites ; and then the conspicuous one; Malik Bin Dukhshum was made the target and they wished that he the Holy Prophet should curse him and he should die or he should meet some calamity. In the meanwhile the Messenger of Allah may peace and blessings be upon him completed his prayer and said: Does Malik Bin Dukhshum not testify the fact that there is no god but Allah and verily I am the messenger of Allah. They replied: He makes a profession of it no doubt but does not do it out of sincere heart. He the Holy Prophet said: He who testifies that there is no god but Allah and I am the messenger of Allah would not enter Hell or its flames would not consume him. Then it falls prostrate and remains there until it is asked: Rise up and go to the place whence you came; and it goes back and continues emerging out from its rising place and then glides till it reaches its place of rest under the Throne and falls prostrate and remains in that state until it is asked: Rise up and return to the place whence you came; and it returns and emerges out from it rising place and the it glides in such a normal way that the people do not discern anything unusual in it till it reaches its resting place under the Throne. Then it would be said to it: Rise up and emerge out from the place of your setting; and it will rise from the place of its setting. The Messenger of Allah ﷺ said. Do you know when it would happen? He said: Verily Allah hallowed be He and High is not blind of one eye. Behold; but the Masih AlDajjal is blind of right eye as if his eye is like a swollen grape; and the Messenger of Allah ﷺ said: I was shown in a dream in the night that near the Kabah there was a man fair-complexioned; fine amongst the white-complexioned men that you ever saw; his locks of hair were falling on his shoulders. He was a man whose hair were neither too curly nor too straight; and water trickled down from his head. He was placing his bands on the shoulders of two persons and amidst them was making a circuit around the Kabah. I said: Who is he? They replied: AlMasih son of Mary. And I saw behind him a man with intensely curly hair; blind of right eye. Amongst the persons I have ever seen Ibn Qatan has the greatest resemblance with him. He was making a circuit around the Kabah by placing both his hands on the shoulders of two persons. I said: Who is he? SahihMuslim-017-001-18914Anas Bin Malik reported: We were along with Umar between Mecca and Medina that we began to look for the new moon. And I was a man with sharp eye- sight; so I could see it; but none except me saw it. I began to say to Umar: Dont you see it? But he would not see it. Thereupon Umar said: I would soon be able to see it when it will shine more brightly. I lay upon bed. He then made a mention of the people of Badr to us and said: Allah Messenger ﷺ showed us one day before the actual battle the place of death of the people participating in the Battle of Badr and he was saying: This would be the place of death of so and so tomorrow; if Allah wills. Umar said: By Him Who sent him with truth; they did not miss the places of their death which Allah Messenger ﷺ had pointed for them. Then they were all thrown in a well one after another. Allah Messenger ﷺ then went to them and said: O; so and so; the son of so and so; O so and so; the son of so and so; have you found correct what Allah and His Messenger had promised you? I have; however; found absolutely true what Allah had promised with me. Umar said: Allah Messenger; how are you talking with the bodies without soul in them. SahihMuslim-017-001-19020Ubadah Bin Walid Bin Samit reported: I and my father set out in search of knowledge to a tribe of the Ansar before their death i. e. before the Companions of the Prophet left the world and I was the first to meet Abu Yasar; a Companion of Allah Messenger ﷺ and there was a young man with him who carried the record of letters with him and there was a mantle prepared by the tribe of Maafiri upon him. And his servant too had a Maafiri mantle over him. My father said to him: My uncle; I see the signs of anger or that of agony on your face. He said: Yes; such and such person; the son of so and so; of the tribe of Harami owed me a debt. I went to his family; extended salutations and said: Where is he? They said: He is not here. Then came out to me his son who was at the threshold of his youth. I said to him: Where is your father? He said: No sooner did he hear your sound than he hid himself behind my mother bedstead. I said to him: Walk out to me; for I know where you are. He came out. I said to him: What prompted you to hide yourself from me? He said: By God; whatever I would say to you would not be a lie. By Allah; I fear that I should tell a lie to you and in case of making promise with you I should break it; as you are the Companion of Allah Messenger ﷺ. The fact is that I was hard up in regard to money. I said: Do you adjure by Allah? He said: I adjure by Allah. I said: Do you adjure by Allah? He said: I adjure by Allah. I said: Do you adjure by Allah? He said: I adjure by Allah. Then he brought his promissory note and he wrote off the debt with his hand and said: Make payment when you find yourself solvent enough to pay me back; if you are not; then there is no liability upon you. These two eyes of mine saw; and he AbuI-Yasar placed his fingers upon his eyes and these two ears of mine heard and my heart retained; and he pointed towards his heart that Allah Messenger ﷺ said: He who gives time to one who is financially hard up in the payment of debt or writes off his debt; Allah will provide him His shadow. I said to him: My uncle; if you get the cloak of your servant and you give him your two clothes; or take his two clothes of Maafir and give him your cloak; then there would be one dress for you and one for him. He wiped my head and said: O Allah; bless the son of my brother. O; son of my brother; these two very eyes of mine saw and these two ears of mine listened to and this heart of mine retained this; and he pointed towards the heart that Allah Messenger ﷺ said: Feed them the servants and clothe them the servants what you wear; and if I give him the goods of the world; it is easy for me than this that he should take my virtues on the Day of Resurrection. We went on till we came to Jabir Bin Abdullah in the Masjid and he was busy in observing prayer in one cloth which he had joined at its opposite ends. I made my way through the people till I sat between him and the Qibla and I said: May Allah have mercy upon you. Do you observe prayer with one cloth on your body whereas your mantle is lying at your side? He pointed me with his hand towards my breast just like this and he separated his fingers and bent them in the shape of a bow. And he said : I thought that a fool like you should come to me so that he should see me as I do and he should then also do like it. Allah Messenger ﷺ came to us in this very Masjid and he had in his hand the twig of the palm-tree and he saw mucus towards the Qibla of the Masjid and he erased it with the help of the twig. He then came to us and said: Who amongst you likes that Allah should turn His face away from him? We were afraid. He then again said: Who amongst you likes that Allah should turn His face away from him? We were afraid. He again said: Who amongst you likes that Allah should turn His face away from him? We said: Allah Messenger; none of us likes it. And he said: If one amongst you stands for prayer; Allah; the Exalted and Glorious; is before him he should not spit in front of him; or on his right side; but should spit on his left side beneath his left foot and if he is impelled to do so all of a sudden in spite of himself he should then spit in his cloth and fold it in some part of it. and he further said: Bring some sweet-smelling thing. A young man who belonged to our tribe stood up; went and brought scent in his palm. Allah Messenger ﷺ took that and applied it to the end of that twig and then touched the place where there had been mucus. Jabir said: This is why you should apply scent to your Masjids. It is reported on the same authority: We set out along with Allah Messenger ﷺ on an expedition of Batn Buwat. He the Holy Prophet was in search of AlMajdi Bin Amr AlJuhani. We had so meagre equipment that five. six or seven of us had one camel to ride and so we mounted it turn by turn. Once there wan. the turn of an Ansari to ride upon the camel. He made it kneel down to ride over it and after having. mounted it ; he tried to raise it up but it hesitated. So he said. May there be curse of Allah upon you! Thereupon Allah Messenger ﷺ said: Who is there to curse his camel? He said: Allah Messenger; it is I. Thereupon he said: Get down from the camel and let us not have in our company the cursed one. Dont curse your own selves; nor your children. nor your belongings. There is the possibility that your curse may synchronies with the time when Allah is about to confer upon you what you demand and thus your prayer may be readily responded. It is reported on the same authority: We set out on an expedition along with Allah Messenger ﷺ until it was evening; and we had been near a. water reservoir of Arabia. Allah Messenger ﷺ said: Who would be the person who would go ahead and set right the reservoir and drink water himself and serve us with it? Jabir said: I stood up and said: Allah Messenger; it is I who am ready to do that. Thereupon Allah Messenger ﷺ said: Who is the person to accompany Jabir? And then Jabbar Bin Sakhr stood up. So we went to that well and poured in that tank a bucket or two of water and plastered it with clay and then began to fill it with water until it was filled to the brim. Allah Messenger ﷺ was the first who appeared before us; and he said: Do you both permit me to drink water out of it? We said: Yea; Allah Messenger. He led his camel to drink water and it drank. He then pulled its rein and it stretched its legs and began to urinate. He then took it Aasi de and made it kneel down at another place and then came to the tank and performed ablution. I then got up and performed ablution like the ablution of Allah Messenger ﷺ ; and Jabbar Bin Sakhr went in order to relieve himself and Allah Messenger ﷺ got up to observe prayer and there was a mantle over me. I tried to invert its ends but it was too short to cover my body easily. It had its borders. I then inverted it the mantle and drew its opposite ends and then tied them at my neck. I then came and stood upon the left side of Allah Messenger ﷺ. He caught hold of me and made me go round behind him; until he made me stand on his right side. Then Jabbar Bin Sakhr came. He performed ablution and then came and stood on the left side of Allah Messenger ﷺ. Then Allah Messenger ﷺ caught hold of our hands together; pushed us back and made us stand behind him. Then Allah Messenger ﷺ began to look upon me with darting looks; but I did not perceive that. After that I became aware of it and he pointed with the gesture of his hand that I should wrap my loin-cloth. When Allah Messenger ﷺ had finished the prayer; he said: Jabir! I said: Allah Messenger; at thy beck and call. He said: When the cloth around you is inadequate; then tie the opposite ends but when it is small; tie it over the lower body. Jabir reported: We set out on an expedition with Allah Messenger ﷺ and the only means of sustenance for every person amongst us was only one date for a day and we used to chew it. And we struck the leaves with the help of our bow and ate them until the sides of our mouths were injured. It so happened one day that a person was overlooked and not given a date. We carried that person and bore witness to the fact that he had not been given that date so he was offered that and he got up and received that. Jabir reported: We set out on an expedition along with Allah Messenger ﷺ until we got down at a spacious valley and Allah Messenger ﷺ went to relieve himself. I followed him with a bucket full of water and Allah Messenger ﷺ looked about and he found no privacy but two trees at the end of the valley and Allah Messenger may. ﷺ went to one of them and took hold of one of its twigs and said: Be thou under my control by the permission of Allah; and so it came under his control like the camel who has its nosestring in the hand of its rider; and then he came to the second tree and took hold of a twig and said: Be thou under my control with the permission of Allah; and it came under his control; and when he came in the middle of the two trees he joined together the two twigs and said: join with the permission of Allah. Jabir said: I was afraid lest Allah Messenger ﷺ should be aware of my nearness and go still farther. And Muhammad Bin Abbad has used the word faitabd and I began to talk to myself. And as I saw; I suddenly found Allah Messenger ﷺ before me and the two trees were separated and each one of them was standing at its place. I saw Allah Messenger ﷺ standing for a short time; nodding his head towards right and left. Ismail pointed towards the right and left with the help of his head in order to demonstrate how the Prophet had pointed. Then he the Holy Prophet came to me and said: Jabir did you see my place where I was standing? I said: Allah Messenger; yes. He then said: Then you should go to those two trees and cut a twig from each of them and go to that place with them where I was standing and stand there where I was standing and place a twig on the right and a twig on the left. Jabir said: I set out and took hold of a stone and broke it and sharpened it and then I came to those trees and cut a twig from each one of them. I then came dragging them until I stood at the place where Allah Messenger ﷺ had been standing and placed a twig on the right and a twig on the left. Then I met him and said: Allah Messenger; I have done that; but kindly explain to me the reason for it. Thereupon he said: I passed by two graves the occupants of which had been undergoing torment. I liked to make intercession for them so that the might be relieved of this torment y as long as these twigs remain fresh. Jabir said: We came back to the camp of the army and Allah Messenger ﷺ said: Jabir; call people for per- forming Ablution. I cried: Come and perform Ablution; come and perform Ablution; come and perform Ablution. I said: Allah Messenger; there is not even a drop of water in the army camp; and there. was a person who used to cool the water for Allah Messenger ﷺ in the old water-skin which kept hanging by the twig. He asked me to go to such and such Ansari and ask him to see if there was any water in that skin. I went to him and cast a glance in it but did not find anything but a drop in the mouth of that water-skin and if I were to draw that; the water-skins;. dried part would suck it up. I came to Allah Messenger ﷺ and said: Allah Messenger; I have not found anything in it but a drop of water in the mouth of the water-skin and now if I were to draw that; it would be absorbed. He said: Go and bring that to me. I brought that to him. He took hold of it -and began to utter something which I could not understand and then pressed it with his hand and gave that to me and said: Jabir; announce for the tub to be brought. So I announced that the tub of the army be brought. It was brought accordingly and I placed it before him the Holy Prophet. Thereupon Allah Messenger ﷺ placed his hands in the tub like this: with his fingers stretched out; and then he placed his fingers at the bottom of the tub and said: Jabir; take it that waters-skin and pour water over me; by reciting Bismillah; and I poured water and I said: Bismillah; and found water sprouting out between the fingers of Allah Messenger ﷺ. Then that tub gushed forth until it was filled up and the Messenger ﷺ said: Jabir; make an announcement to the effect: He who needs water should take that. Jabir said: The people came and got water until they were all satiated. I said: Is there anyone left who wants to get it? And Allah Messenger ﷺ then lifted up his hand from that tub and it was still full. Then the people made a complaint to Allah Messenger ﷺ about hunger and he said: May Allah provide you food! We came to the bank of the ocean and the ocean was tossing and it threw out a big animal and we lit fire and cooked it and took it until we had eaten to our heart content. Jabir said: I and such and such five persons entered Its socket and nobody could see us until we had come out; and we took hold of one of its ribs and twisted it into a sort of arch; then we called the tallest of the persons of the army and the hugest of the camels of the army and it had the big saddle over it; and it could easily pass through it without the rider having need to bend down.The Chapter on Standing For Prayers And Ablution in HodHood Indexing, Chapter on 18 in Sahih Muslim
SahihMuslim-017-001-19021AlBara Bin Azib reported that Abu Bakr AlSiddiq came to the residence of my father Azib and bought a haudaj from him and said to Azib: Send your son to my residence to carry this haudaj ; and my father said to me: Carry it for him. So I carried it and there went along with him with Abu Bakr my father in order to fetch its price and he Azib said to Abu Bakr: Abu Bakr; narrate to me what you both did on the night when you set out on a journey along with Allah Messenger ﷺ. He said: We set out during the night and went on walking until it was noon; and the path was vacant and so none passed by that until there appeared prominently before us a large rock. It had its shade and the rays of the sun did not reach that place. So we got down at that place. I then went to the rock and levelled the ground with my hands at the place where the Prophet ﷺ would take rest under its shade. I then set the bedding and said: Allah Messenger; go to sleep and I shall keep a watch around you. I went out and watched around him. There we saw a shepherd moving towards that rock with his flock and he intended what we intended i. e. taking rest. I met him and said to him: Young boy; to which place do you belong? He said: I am a person from Medina. I said; is there any milk in the udders of your sheep and goats? He said: Yes. He took hold of a goat; and I said to him: Clean the udder well so that it should be free from hair; dust and impurity. I saw AlBara striking his hand upon the other to give an indication how he did that. He milked the goat for me in a wooden cup which he had with him and I had with me a bucket in which I kept water for drinking and for performing ablution. I came to Allah Apostle ﷺ and did not like to awaken him from sleep but he was accidentally startled from the sleep. I poured water upon the milk till It was cold and I said: Allah Messenger; take this milk. He then took It and I was delighted and he the Holy Prophet said: Is now not the time to march on? I said: Of course. So he marched on after the sun had passed the meridian and Suraqa Bin Malik pursued us and we had been walking on soft; level ground. I said: Allah Messenger; we are about to be overtaken by them. Thereupon he said: Be not grieved. Verily; Allah is with us. Then Allah Messenger ﷺ cursed him and his horse sank into the earth. I think he also said: I know you have hurled curse upon me. So supplicate Allah for me and I take an oath that I shall turn everyone away who would come in search of you. So he Allah Messenger supplicated Allah and he was rescued and he came back and to everyone he met; he said: I have combed all this side. He brought his goods and placed them by my luggage and I said: It is intense heat. Would you not place that under that tree? And he did that. Then there appeared before us a flock of sheep. He went and brought a cup of milk and said: Abu Said; drink that. I said it is intense heat and the milk is also hot whereas the fact was that I did not like to drink from his hands or to take it from his hand and he said: Abu Said; I think that I should take a rope and suspend it by the tree and then commit suicide because of the talks of the people; and he further said. Abu Saeed he who is ignorant of the saying of Allah Messenger ﷺ he is to be pardoned ; but O people of Ansar; is this hadith of Allah Messenger ﷺ concealed from you whereas you have the best knowledge of the hadith of Allah Messenger ﷺ amongst people? Did Allah Messenger ﷺ not say that he Dajjal would be a non believer whereas I am a believer? Did Allah Messenger ﷺ not say he would be barren and no child would be born to him; whereas I have left my children in Medina? Did Allah Messenger may peace upon him not say: He would not get into Medina and Mecca whereas I have been coming from Medina and now I intend to go to Mecca? Abu Saeed said: I was about to accept the excuse put forward by him. Then he said: I know the place where he would be born and where he is now. Then he departed when the sun had set and took Usamah Bin Zaid as a companion rider; and he was motioning with his hand as was his custom; and the people were striking their camels on the right and the left to try and catch them; so he said: O you people! Be calmm. Then he came to Jama and performed the two Prayer there combined. When the morning came; he went to Quzah and stood there and said: This is Quzah; and it is a place of standing; and all of Jama is a place for standing. Then he departed until he arrived at Wadi Muhassir. Then he stuck his camel and she trotted until he passed the valley. Then he stopped and took AlFadl as a companion rider and went to the Jamrah to stone it. Then he went to AlManhar and said: This is AlManhar; and all of Mina is a place for sacrifice. A young girl from Khatham came to ask him for a verdict; she said: Indeed my father is an elderly man who has lived until Allah has made Hajj obligatory; so would he be rewarded if I perform Hajj for him? He said: Perform Hajj for your father. He said: And he turned the neck of AlFadl. So AlAbbas said: O Messenger of Allah! Why did you turn the neck of your cousin? He said: I saw a young man and a young woman; and they were not safe from Shaitan. A man came to him and said; O Messenger of Allah! I performed Tawaf AlIfadah before shaving. He said: Shave; and there is no harm - or: Clip and there is no harm He said: Someone else came and said: O Messenger of Allah! I did the sacrifice before stoning. So he said: Stone; and there is no harm. He said: Then he went to the House Kabah to perform Tawaf around it; then he went to Zamzam and said: O tribe of Abd AlMuttalib! SunanAlTermithi-017-001-9018Narrated Aisha: I have not seen anyone closer in conduct; way; and manners to that of the Messenger of Allah in regards to standing and sitting; than Fatimah the daughter of the Messenger of Allah ﷺ. She said Whenever she would enter upon the Prophet ﷺ he would stand to her and kiss her; and he would sit her in his sitting place. Whenever the Prophet ﷺ entered upon her she would stand from her seat; and kiss him and sit him in her sitting place. So when the Prophet ﷺ fell sick and Fatimah entered; she bent over and kissed him. Then she lifted her head and cried; then she bent over him and she lifted her head and laughed. So I said: I used to think that this one was from the most intelligent of our women; but she is really just one of the women. So when the Prophet ﷺ died; I said to her: Do you remember when you bent over the Prophet ﷺ and you lifted your head and cried; then you bent over him; then you lifted your head and laughed. What caused you to do that? She said: Then; I would be the one who spreads the secrets. He ﷺ told me that he was to die from his illness; so I cried. Then he told me that I would be the quickest of his family to meet up with him. So he called for water; performed Ablution and rinsed out his mouth; then he poured it into a vessel and said to us: Leave; and when you return to your land; demolish your church; and sprinkle this water on that place; and take it as a Masjid. We said: Our land is far away and it is very hot; the water is far away and it is very hot; the water will dry up. He said: Add more water to it; for that will only make it better. So we left and when we came to our land we demolished our church; then we sprinkled the water on that place and took it as a Masjid; and we called the Adhan in it. The monk was a man from Tay; and when he heard the Adhan; he said: It is a true call. SunanAbuDawoud-017-001-25013Narrated Abu Huraira: Abu Nadrah reported: An old man of Tufawah said to me: I was a guest of Abu Huraira at Medina. I did not find any one of the companions of the Prophet ﷺ more devoted to worship and more hospitable than Abu Huraira. One day I was with him when he was sitting on his bed. He had a purse which contained pebbles or kernels. A black slave-girl of his was sitting below. Counting them he was glorifying Allah. When the pebbles or the kernels in the purse were finished; she gathered them and put them again in the purse; and gave it to him. He said: Should I not tell you about me and about the Messenger of Allah ﷺ ? I said: Yes. He said: Once when I was laid up with fever in the Masjid; the Messenger of Allah ﷺ came and entered the Masjid; and said: Who saw the youth of AlDaws. He said this three times. A man said: Messenger of Allah; there he is; laid up with fever on one side of the Masjid. He moved; walking forward till he reached me. He placed his hand on me. He had a kind talk with me; and I rose. He then began to walk till he reached the place where he used to offer his prayer. He paid his attention to the people. There were two rows of men and one row of women; or two rows of women and one row of men the narrator is doubtful. He then said: If Satan makes me forget anything during the prayer; the men should glorify Allah; and the women should clap their hands. The Messenger of Allah ﷺ then prayed and he did not forget anything during the prayer. He said: Be seated in your places; be seated in your places. The narrator; Mousa; added the word here. He then praised Allah and exalted Him; and said: Now to our topic. The agreed version begins: He then said: Is there any man among you who approaches his wife; closes the door; covers himself with a curtain; and he is concealed with the curtain of Allah? They replied: Yes. He said: later he sits and says: I did so-and-so; I did so-and-so. The people kept silence. He then turned to the women and said to them : Is there any woman among you who narrates it? They kept silence. Then a girl fell on one of her knees. The narrator; Muammil; said in his version: a buxom girl. She raised her head before the Messenger of Allah ﷺ so that he could see her and listen to her. She said: Messenger of Allah; they the men describe the secrets of intercourse and they the women also describe the secrets of intercourse to the people. He said: Do you know what the similitude is? He said: The likeness of this act is the likeness of a female Satan who meets the male Satan on the roadside; he fulfils his desire with her while the people are looking at him. Beware! The perfume of men is that whose smell becomes visible and its colour does not appear. Beware! The perfume of women is that whose colour becomes visible and whose smell is not obvious. Abu Dawud said: From here I remembered this tradition from Muammil and Mousa: Beware! No man should lie with another man; no woman should lie with another woman except with one child or father. He also mentioned a third which I have forgotten. This has been mentioned in the version of Mousaddad; but I do not remember it as precisely as I like. SunanAbuDawoud-017-001-25372Narrated Abu Ayash AlZuraqi: We accompanied the Messenger of Allah ﷺ at Usfan; and Khalid Ibn AlWalid was the chief of unbelievers. We offered the noon prayer. Thereupon; the unbelievers said: We suffered from negligence; we became careless. We should have attacked them while they were praying. Thereupon the verse was revealed; relating to the shortening of the prayer in time of danger between the noon and afternoon prayer. When the time of the afternoon prayer came; the Messenger of Allah ﷺ stood facing the qiblah; and the unbelievers were standing in front of him. The people stood in a row behind the Messenger of Allah ﷺ and there was another row behind this row. The Messenger of Allah ﷺ bowed and all of them bowed. He then prostrated and also the row near him prostrated. The other people in the second row remained standing and stood guard over them. When they performed two prostrations and stood up; those who were behind them prostrated. The people in the front row near him then stepped backward taking the place of the people in the second row and the second row took the place of the first row. The Messenger of Allah ﷺ then bowed and all of them bowed together. Then he and the row near him prostrated themselves. The other people in the second row remained standing and stood guard over them. When the Messenger of Allah ﷺ and the row near him i.e. the front row were seated; the people in the second row behind them prostrated themselves. Then all of them were seated. He the Prophet then uttered the salutation upon all of them. He prayed in his manner at Usfan as well as at the territory of Banu Sulaym.Abu Dawud said: This tradition has been narrated by Ayoub and Hisham from Abu AlZubair on the authority of Jabir to the same effect from the Prophet ﷺ. Similarly; this has been transmitted by Dawud Bin Husain from Ikrimah; on the authority of Ibn Abbas. This has also been reported by Abd AlMalik; from Ata from Jabir in like manner. This has also been narrated by Qatadah from AlHasan from Hittan on the authority of Abu Mousa in a similar way. Similarly; this has been reported by Ikrimah Bin Khalid from Mujahid from the Prophet ﷺ. This has also been reported by Hisham Bin Urwah from his father from the Prophet ﷺ. One section of people stood in the row of prayer along with the Messenger of Allah ﷺ and the other section remained standing in front of the enemy. He led those who were with him in one rakah and remained standing in his place and they completed the second rakah by themselves. Then they turned away and arrayed before the enemy. Thereafter the other section came and he led them in the rakah which remained from his prayer. He then remained sitting in his place and they completed their one rakah by themselves. SunanAbuDawoud-017-001-25829Sufyan said according to one chain ; and Abu AlSalit said according to another chain : A man wrote to Umar Bin Abd AlAziz asking him about Divine decree. He wrote to him: To begin with; I enjoin upon you to fear Allah; to be moderate in obeying His Command; to follow the sunnah practice of His Prophet ﷺ and to abandon the novelties which the innovators introduced after his Sunnah has been established and they were saved from its trouble i.e. novelty or innovation ; so stick to Sunnah; for it is for you; if Allah chooses; a protection ; then you should know that any innovation which the people introduced was refuted long before it on the basis of some authority or there was some lesson in it; for the Sunnah was introduced by the people who were conscious of the error; slip; foolishness; and extremism in case of the sunnah was opposed. So accept for yourself what the people in the past had accepted for themselves; for they had complete knowledge of whatever they were informed; and by penetrating insight they forbade to do prohibited acts ; they had more strength than us to disclose the matters of religion ; and they were far better than us by virtue of their merits. If right guidance is what you are following; then you outstriped them to it. And if you say whatever the novelty occurred after them was introduced by those who followed the way other then theirs and disliked them. It is they who actually outstripped; and talked about it sufficiently; and gave a satisfactory explanation for it. Below them there is no place for exhaustiveness; and above them there is no place for elaborating things. Some people shortened the matter more than they had done; and thus they turned away from them ; and some people raised the matter more than they had done; and thus they exaggerated. They were on right guidance between that. You have written to me asking about confession of Divine decree; you have indeed approached a person who is well informed of it; with the will of Allah. I know what whatever novelty people have brought in; and whatever innovation people have introduced are not more manifest and more established than confession of Divine decree. The ignorant people i.e. the Arabs before Islam in pre-Islamic times have mentioned it ; they talked about it in their speeches and in their poetry. They would console themselves for what they lost; and Islam then strengthened it i.e. belief in Divine decree. The Messenger of Allah ﷺ did not mention it in one or two traditions; but the Muslims heard it from him; and they talked of it from him; and they talked of it during his lifetime and after his death. They did so out of belief and submission to their Lord and thinking themselves weak. There is nothing which is not surrounded by His knowledge; and not counted by His register and not destined by His decree. Despite that; it has been strongly mentioned in His Book: from it they have derived it; and from it they have and so ? they also read in it what you read; and they knew its interpretation of which you are ignorant. After that they said: All this is by writing and decreeing. Distress has been written down; and what has been destined will occur ; what Allah wills will surely happen; and what He does not will will not happen. We have no power to harm or benefit ourselves. MuwataMalik-017-001-34693Yahya related to me from Malik from Yahya Ibn Said from Abdulrahman Ibn AlQasim that Aslam; the mawla of Umar Ibn AlKhattab informed him that he had visited Abdullah Ibn Ayash AlMakhzumi. He saw that he had some nabidh with him and he was at that moment on the way to Makka. Aslam said to him; Umar Ibn AlKhattab loves this drink. Abdullah Ibn Ayash therefore carried a great drinking bowl and brought it to Umar Ibn AlKhattab and placed it before him. Umar brought it near to him and then raised his head. Umar said; This drink is good; so he drank some of it and then passed it to a man on his right. When Abdullah turned to go; Umar Ibn AlKhattab called him and asked; Are you the person who says that Makka is better than Madina? Abdullah said; I said that it was the Haram of Allah; and His place of security; and His House was in it. Umar said; I am not saying anything about the House of Allah or His Haram. Then Umar repeated Are you the person who says that Makka is better than Madina? He replied; I said that it was the Haram of Allah and His place of security; and His House was in it. MuwataMalik-017-001-34799Yahya related to me from Malik that Abuz-Zinad informed him that a governor of Umar Ibn Abd AlAziz took some people in battle and had not killed any of them. He wanted to cut off their hands or kill them; so he wrote to Umar Ibn Abd AlAziz about that Umar Ibn Abd AlAziz wrote to him; Better to take less than that. Yahya said that he heard Malik say; What is done among us about a person who steals the goods of people which are placed under guard in the markets; and their owners put them in their containers and store them together is that if anyone steals any of that from where it is kept; and its value reaches that for which cutting off the hand is obliged; his hand must be cut off; whether or not the owner of the goods is with his goods and whether it is night or day. Malik said about some one who stole something for which cutting off the hand was obliged and then what he stole was found with him and he returned it to its owner; His hand is cut off. Malik said; If someon says; How can his hand be cut off when the goods have been taken from him and returned to their owner?; it is because he is in the same position as the wine drinker when the smell of the wine is found on his breath and he is not drunk. He is flogged with the hadd. The hadd is imposed for drinking wine even if it does not make the man intoxicated. That is because he drank it to become intoxicated. It is the same as that with cutting off the hand of the thief for theft when it is taken from him; even if he has not profited from it and it was returned to its owner. When he stole it; he stole it to take it away. Malik said that if some people came to a house and robbed it together; and then they left with a sack or box or a board or basket or the like of that which they carried together; and when they took it out of its guarded place; they carried it together; and the price of what they took reached that for which cutting off the hand was obliged; and that was three dirhams and upwards; each of them had his hand cut off. If each of them takes out something by himself; whoever of them takes out something whose value reaches three dirhams and upwards must have his hand cut off. If any of them takes out something whose value does not reach three dirhams; he does not have his hand cut off. Yahya said that Malik said; What is done among us is that when a man house is locked and he is the only one living in it; cutting off the hand is not obliged against the one who steals something from it until he takes it out of the house completely. That is because all of the house is a place of custody. If someone other than him lives in the house and each of them locks his door; and it is a place of custody for each of them; whoever steals anything from the apartments of that house must have his hand cut off when he leaves the apartment and goes into the main house. He has removed it from its place of custody to another place and he must have his hand cut off. Malik said; What is done in our community about a slave who steals from the property of his master is that if he is not in service and among those trusted in the house and he enters secretly and steals from his master something that for which cutting off the hand is obliged; his hand is not cut off. It is like that with a slave-girl when she steals from her master property. Her hand is not cut off. Malik then spoke about a slave who was not in service and not one of those trusted in the house; and he entered secretly and stole from the property of his master wife that for which cutting off the hand was obliged. He said; His hand is cut off. It is like that with the wife slave-girl when she does not serve her or her husband nor is she trusted in the house and she enters secretly and steals from her mistress property that for which cutting off the hand is obliged. Her hand is not cut off. It is like that with the wife slave-girl who is not in her service and is not trusted in the house and she enters secretly and steals from the property of her mistress husband something for which cutting off the hand is obliged. Her hand is cut off. It is like that with the man who steals from his wife goods or the wife who steals from her husband goods something for which cutting off the hand is obliged. If the thing which one of them steals from his spouse property is in a room other than the room which they both lock for themselves; or it is in a place of custody in a room other than the room which they are in; whichever of them steals something for which cutting off the hand is obliged; their hand should be cut off. Malik spoke about a small child and a foreigner who does not speak clearly. He said; If they are robbed of something from its place of custody or from under a lock; the one who stole it has his hand cut off. If the property is outside of its place of custody or locked room when it is stolen ; the one who robbed them does not have his hand cut off. It is then in the position of sheep stolen from the mountain and uncut fruit hanging on the trees Malik said; What is done among us about a person who robs graves is that if what he takes from the grave reaches what cutting off the hand is obliged for; his hand is cut off. That is because the grave is a place of custody for what is in it just as houses are a place of custody for what is in them. MuwataMalik-017-001-34877Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab and Abu Salama Ibn Abdulrahman from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; The wound of an animal is of no account and no compensation is due for it. The well is of no account and no compensation is due for it. The mine is of no account and no compensation is due for it and a fifth is due for buried treasures. Alkanz: see Book 17. Malik said; Everyone leading an animal by the halter; driving it; and riding it is responsible for what the animal strikes unless the animal kicks out without anything being done to it to make it kick out. Umar Ibn AlKhattab imposed the blood-money on a person who was exercising his horse. Malik said; It is more fitting that a person leading an animal by the halter; driving it; or riding it incur a loss than a person who is exercising his horse. See hadith 4 of this book. Malik said; What is done in our community about a person who digs a well on a road or ties up an animal or does the like of that on a road used by muslims; is that since what he has done is included in that which he is not permitted to do in such a place; he is liable for whatever injury or other thing arises from that action. The blood-money of that which is less than a third of the full blood- money is owed from his own personal property. Whatever reaches a third or more; is owed by his tribe. Any such things that he does which he is permitted to do on the muslims road are something for which he has no liability or loss. Part of that is a hole which a man digs to collect rain; and the beast from which the man alights for some need and leaves standing on the road. There is no penalty against anyone for this. Malik spoke about a man who went down a well; and another man followed behind him; and the lower one pulled the higher one and they fell into the well and both died He said; The tribe of the one who pulled him in is responsible for the blood-money. Malik spoke about a child whom a man ordered to go down into a well or to climb a palm tree and he died as a result. He said; The one who ordered him is liable for whatever befalls him; be it death or something else. Malik said; The way of doing things in our community about which there is no dispute is that women and children are not obliged to pay blood-money together with the tribe in the blood-moneys which the tribe must pay. The blood-money is only obligatory for a man who has reached puberty. Malik said that the tribe could bind themselves to the blood-money of mawali if they wished. If they refused; they were people of the diwan or were cut off from their people. In the time of the Messenger of Allah; may Allah bless him and grant him peace; people paid the blood-money to each other as well as in the time of Abu Bakr AlSiddiq before there was a diwan. The diwan was in the time of Umar Ibn AlKhattab. No one other than one people and the ones holding the wala paid blood- money for one because the wala was not transferable and because the Prophet; may Allah bless him and grant him peace; said; The wala belongs to the one who sets free. Malik said; The wala is an established relationship. Malik said; What is done in our community about animals that are injured is that the person who causes the injury pays whatever of their value has been diminished. Malik said about a man condemned to death and one of the other hudud befell him; He is not punished for it. That is because the killing overrides all of that; except for slander. The slander remains hanging over the one to whom it was said because it will be said to him; Why do you not flog the one who slandered you? I think that the condemned man is flogged with the hadd before he is killed; and then he is killed. I do not think that any retaliation is inflicted on him for any injury except killing because killing overrides all of that. Malik said; What is done in our community is that when a murdered person is found among the main body of a people in a village or other place; the house or place of the nearest people to him is not responsible. That is because the murdered person can be slain and then cast at the door of some people to shame them by it. No one is responsible for the like of that. Malik said about a group of people who fight with each other and when the fight is broken up; a man is found dead or wounded; and it is not known who did it; The best of what is heard about that is that there is blood-money for him; and the blood-money is against the people who argued with him. MuwataMalik-017-001-35393Yahya related to me from Malik that Yahya Ibn Said said; I vowed to walk; but I was struck by a pain in the kidney; so I rode until I came to Makka. I questioned Ata Ibn Abi Rabah and others; and they said; You must sacrifice an animal. When I came to Madina I questioned the ulama there; and they ordered me to walk again from the place from which I was unable to go on. So I walked. Yahya said that he had heard Malik say; What is done among us regarding someone who makes a vow to walk to the House of Allah; and then cannot do it and so rides; is that he must return and walk from the place from which he was unable to go on. If he cannot walk; he should walk what he can and then ride; and he must sacrifice a camel; a cow; or a sheep if that is all that he can find. Malik; when asked about a man who said to another; I will carry you to the House of Allah; answered; If he intended to carry him on his shoulder; by that he meant hardship and exhaustion to himself; and he does not have to do that. Let him walk by foot and make sacrifice. If he did not intend anything; let him do hajj and ride; and take the man on hajj with him. That is because he said; I will carry you to the house of Allah. If the man refuses to do hajj with him; then there is nothing against him; and what is demanded of him is cancelled. Yahya said that Malik was asked whether it was enough for a man who had made a vow that he would walk to the House of Allah a certain large number of times; or who had forbidden himself from talking to his father and brother; if he did not fulfil a certain vow; and he had taken upon himself; by the oath; something which he was incapable of fulfilling in his lifetime; even though he were to try every year; to fulfil only one or a smaller number of vows by Allah? Malik said; The only satisfaction for that that I know is fulfilling what he has obliged himself to do. MuwataMalik-017-001-35426Yahya related to me from Malik that it reached him that a slave of Abdullah Ibn Umar escaped and one of his horses wandered off; and the idol worshippers seized them. Then the Muslims recaptured them; and they were returned to Abdullah Ibn Umar; before the division of the spoils took place. I heard Malik say about muslim property that had been seized by the enemy; If it is noticed before the distribution; then it is returned to itsowner. Whatever has already been distributed is not returned to anyone. Malik; when asked about a man whose young male slave was taken by the idol worshippers and then the Muslims re-captured him; said; The owner is more entitled to him without having to pay his price or value or having to incur any loss before the distribution takes place. If the distribution has already taken place then I think that the slave belongs to his master for his price if the master wants him back. Regarding an umm walad of a Muslim man who has been taken by the idol worshippers and then recaptured by the Muslims and allotted in the distribution of spoils and then recognised by her master after the distribution; Malik said; She is not to be enslaved. I think that the Imam should pay a ransom for her for her master. If he does not do it; then her master must pay a ransom for her and not leave her. I do not think that she should be made a slave by whoever takes her and intercourse with her is not halal. She is in the position of a free woman because her master would be required to pay compensation if she injured somebody and so she is in the same position as a wife. He must not leave the mother of his son to be enslaved nor may intercourse with her be made halal. Malik was asked about a man who went to enemy territory to pay ransom or to trade; and he bought a free man or a slave; or they were given to him. He said; As for the free man; the price he buys him for is a debt against the man and he is not made a slave. If the captive is given to him freely; he is free and owes nothing unless the man gave something in recompense for him. That is a debt against the free man; the same as if a ransom had been paid for him. As for a slave; his former master can choose to take him back and pay his price to the man who bought him or he can choose to leave him; as he wishes. If he was given to the man; the former master is more entitled to him; and he owes nothing for him unless the man gave something for him in recompense. If you are one of the people of the Garden; then you will be with the people of the Garden; and if you are one of the people of the Fire; then you will be with the people of the Fire. MuwataMalik-017-001-35780Yahya related to me from Malik; from AIqama Ibn Abi AIqama; from his mother; that Aisha; umm Almuminin; used to camp on the plain of Arafa at a place called Namira; and then later she changed to another place called AlArak. She said; Aisha; and those who were with her; would say the talbiya while she was at the place where they were camping; and then; when she had mounted and set out towards the place of standing; she would stop doing so. MuwataMalik-017-001-35801Yahya related to me from Malik that he had heard that Uthman Ibn Affan would sometimes never get down from the animal he was riding on when he was doing umra; until he had returned. Malik said; Umra is a sunna; and we do not know of any muslim who has ever said that it is permissible not to do it. Malik said; I do not think that anyone can do more than one umra in any one year. Malik said that someone doing umra who had sexual intercourse with his wife had to sacrifice an animal and do a second umra; which he had to begin when he had finished the one that he had spoiled. He should go into ihram at the same place where he went into ihram for the umra which he had spoiled; except if he had entered into ihram at a place further away than his miqat. This was because he only had to go into ihram from his miqat. Malik said; Someone who entered Makka to do umra; and does tawaf of the House and say between Safa and Marwa while he is junub; or not in Ablution; and afterwards has intercourse with his wife; and then remembers; should do ghusl; or Ablution; and then go back and do tawaf around the House and say between Safa and Marwa and do another umra and sacrifice an animal. A woman should do the same if her husband has intercourse with her while she is in ihram. Malik said; As for beginning umra at AlTanim; it is not the only alternative. MuwataMalik-017-001-35982Yahya related to me from Malik that Ata Ibn Abdullah AlKhurasani said that an old man from Suq AlBuram in Kufa had related to him that Kaab Ibn Ujra said; The Messenger of Allah; may Allah bless him and grant him peace; came to me while I was blowing under a cooking pot belonging to my companions and my head and beard were full of lice. He took my forehead and said; Shave your hair and fast three days or feed six poor people. The Messenger of Allah; may Allah bless him and grant him peace; was aware that I did not have anything with me to sacrifice. Malik said; concerning paying compensation fidya for the relief of physical discomfort; The custom concerning it is that no one pays compensation until he has done something which makes it obligatory to pay compensation just as making amends kaffara is only done when it has become obligatory for the one who owes it. The person can pay the compensation wherever he wishes; regardless of whether he has to sacrifice an animal or fast or give sadaqa - in Makka or in any other town. Malik said; It is not correct for a person in ihram to pluck out any of his hair or to shave it or cut it until he has left ihram; unless he is suffering from an ailment of the head; in which case he owes the compensation Allah the Exalted has ordered. It is not correct for a person in ihram to cut his nails; or to kill his lice; or to remove them from his head or from his skin or his garment to the ground. If a person in ihram removes lice from his skin or his garment; he must give away the quantity of food that he can scoop up with both hands. Malik said;Anyone who; while in ihram; plucks out hairs from his nose or armpit or rubs his body with a depilatory agent or shaves the hair from around a head wound out of necessity or shaves his neck for the place of the cupping glasses; regardless of whether it is in forgetfulness or in ignorance; owes compensation in all these instances; and he must not shave the place of the cupping glasses. They came to a watering place and Amr Ibn AlAs asked the man who owned it whether wild beasts drank from it.
