Surat AlAhzab Ayah 53Surat AlAhzab-0.4590يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَدْخُلُوا بُيُوتَ النَّبِيِّ إِلَّا أَنْ يُؤْذَنَ لَكُمْ إِلَى طَعَامٍ غَيْرَ نَاظِرِينَ إِنَاهُ وَلَكِنْ إِذَا دُعِيتُمْ فَادْخُلُوا فَإِذَا طَعِمْتُمْ فَانْتَشِرُوا وَلَا مُسْتَأْنِسِينَ لِحَدِيثٍ إِنَّ ذَلِكُمْ كَانَ يُؤْذِي النَّبِيَّ فَيَسْتَحْيِي مِنْكُمْ وَاللَّهُ لَا يَسْتَحْيِي مِنَ الْحَقِّ وَإِذَا سَأَلْتُمُوهُنَّ مَتَاعًا فَاسْأَلُوهُنَّ مِنْ وَرَاءِ حِجَابٍ ذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ وَمَا كَانَ لَكُمْ أَنْ تُؤْذُوا رَسُولَ اللَّهِ وَلَا أَنْ تَنْكِحُوا أَزْوَاجَهُ مِنْ بَعْدِهِ أَبَدًا إِنَّ ذَلِكُمْ كَانَ عِنْدَ اللَّهِ عَظِيمًاO ye who believe! Enter not the Prophet's houses, - until leave is given you, - for a meal, (and then) not (so early as) to wait for its preparation: but when ye are invited, enter; and when ye have taken your meal, disperse, without seeking familiar talk. Such (behaviour) annoys the Prophet: he is ashamed to dismiss you, but Allah is not ashamed (to tell you) the truth. And when ye ask (his ladies) for anything ye want, ask them from before a screen: that makes for greater purity for your hearts and for theirs. Nor is it right for you that ye should annoy Allah's Messenger, or that ye should marry his widows after him at any time. Truly such a thing is in Allah's sight an enormity.

Is not He the Exalted in Power - He Who forgives again and again?
Surat AlBaqara Ayah 230Surat AlBaqara-0.2687فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ فَإِنْ طَلَّقَهَا فَلَا جُنَاحَ عَلَيْهِمَا أَنْ يَتَرَاجَعَا إِنْ ظَنَّا أَنْ يُقِيمَا حُدُودَ اللَّهِ وَتِلْكَ حُدُودُ اللَّهِ يُبَيِّنُهَا لِقَوْمٍ يَعْلَمُونَSo if a husband divorces his wife (irrevocably), He cannot, after that, re-marry her until after she has married another husband and He has divorced her. In that case there is no blame on either of them if they re-unite, provided they feel that they can keep the limits ordained by Allah. Such are the limits ordained by Allah, which He makes plain to those who understand.

When death approaches any of you, (take) witnesses among yourselves when making bequests, - two just men of your own (brotherhood) or others from outside if ye are journeying through the earth, and the chance of death befalls you (thus). If ye doubt (their truth), detain them both after prayer, and let them both swear by Allah: "We wish not in this for any worldly gain, even though the (beneficiary) be our near relation: we shall hide not the evidence before Allah: if we do, then behold! the sin be upon us!"

Truly, in this, is a Message of remembrance to men of understanding.

Surat AlBaqara Ayah 196Surat AlBaqara-0.08687وَأَتِمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ وَلَا تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ بِهِ أَذًى مِنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ فَإِذَا أَمِنْتُمْ فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةٍ إِذَا رَجَعْتُمْ تِلْكَ عَشَرَةٌ كَامِلَةٌ ذَلِكَ لِمَنْ لَمْ يَكُنْ أَهْلُهُ حَاضِرِي الْمَسْجِدِ الْحَرَامِ وَاتَّقُوا اللَّهَ وَاعْلَمُوا أَنَّ اللَّهَ شَدِيدُ الْعِقَابِAnd complete the Hajj or 'umra in the service of Allah. But if ye are prevented (From completing it), send an offering for sacrifice, such as ye may find, and do not shave your heads until the offering reaches the place of sacrifice. And if any of you is ill, or has an ailment in his scalp, (Necessitating shaving), (He should) in compensation either fast, or feed the poor, or offer sacrifice; and when ye are in peaceful conditions (again), if any one wishes to continue the 'umra on to the hajj, He must make an offering, such as he can afford, but if he cannot afford it, He should fast three days during the hajj and seven days on his return, Making ten days in all. This is for those whose household is not in (the precincts of) the Sacred Mosque. And fear Allah, and know that Allah Is strict in punishment.
Surat Ibrahim Ayah 21Surat Ibrahim4.3e-470وَبَرَزُوا لِلَّهِ جَمِيعًا فَقَالَ الضُّعَفَاءُ لِلَّذِينَ اسْتَكْبَرُوا إِنَّا كُنَّا لَكُمْ تَبَعًا فَهَلْ أَنْتُمْ مُغْنُونَ عَنَّا مِنْ عَذَابِ اللَّهِ مِنْ شَيْءٍ قَالُوا لَوْ هَدَانَا اللَّهُ لَهَدَيْنَاكُمْ سَوَاءٌ عَلَيْنَا أَجَزِعْنَا أَمْ صَبَرْنَا مَا لَنَا مِنْ مَحِيصٍThey will all be marshalled before Allah together: then will the weak say to those who were arrogant, "For us, we but followed you; can ye then avail us to all against the wrath of Allah?" They will reply, "If we had received the Guidance of Allah, we should have given it to you: to us it makes no difference (now) whether we rage, or bear (these torments) with patience: for ourselves there is no way of escape."
Surat Ibrahim Ayah 30Surat Ibrahim0.03170وَجَعَلُوا لِلَّهِ أَنْدَادًا لِيُضِلُّوا عَنْ سَبِيلِهِ قُلْ تَمَتَّعُوا فَإِنَّ مَصِيرَكُمْ إِلَى النَّارِAnd they set up (idols) as equal to Allah, to mislead (men) from the Path! Surat AlZumar Ayah 6Surat AlZumar0.07459خَلَقَكُمْ مِنْ نَفْسٍ وَاحِدَةٍ ثُمَّ جَعَلَ مِنْهَا زَوْجَهَا وَأَنْزَلَ لَكُمْ مِنَ الْأَنْعَامِ ثَمَانِيَةَ أَزْوَاجٍ يَخْلُقُكُمْ فِي بُطُونِ أُمَّهَاتِكُمْ خَلْقًا مِنْ بَعْدِ خَلْقٍ فِي ظُلُمَاتٍ ثَلَاثٍ ذَلِكُمُ اللَّهُ رَبُّكُمْ لَهُ الْمُلْكُ لَا إِلَهَ إِلَّا هُوَ فَأَنَّى تُصْرَفُونَHe created you (all) from a single person: then created, of like nature, his mate; and he sent down for you eight head of cattle in pairs: He makes you, in the wombs of your mothers, in stages, one after another, in three veils of darkness. such is Allah, your Lord and Cherisher: to Him belongs (all) dominion. There is no god but He: then how are ye turned away (from your true Centre)?
Surat AlNoor Ayah 43Surat AlNoor0.082102أَلَمْ تَرَ أَنَّ اللَّهَ يُزْجِي سَحَابًا ثُمَّ يُؤَلِّفُ بَيْنَهُ ثُمَّ يَجْعَلُهُ رُكَامًا فَتَرَى الْوَدْقَ يَخْرُجُ مِنْ خِلَالِهِ وَيُنَزِّلُ مِنَ السَّمَاءِ مِنْ جِبَالٍ فِيهَا مِنْ بَرَدٍ فَيُصِيبُ بِهِ مَنْ يَشَاءُ وَيَصْرِفُهُ عَنْ مَنْ يَشَاءُ يَكَادُ سَنَا بَرْقِهِ يَذْهَبُ بِالْأَبْصَارِSeest thou not that Allah makes the clouds move gently, then joins them together, then makes them into a heap? - then wilt thou see rain issue forth from their midst. And He sends down from the sky mountain masses (of clouds) wherein is hail: He strikes therewith whom He pleases and He turns it away from whom He pleases, the vivid flash of His lightning well-nigh blinds the sight.

Allah seeth well whatever ye do.

Surat AlBaqara Ayah 232Surat AlBaqara0.2387وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ إِذَا تَرَاضَوْا بَيْنَهُمْ بِالْمَعْرُوفِ ذَلِكَ يُوعَظُ بِهِ مَنْ كَانَ مِنْكُمْ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ ذَلِكُمْ أَزْكَى لَكُمْ وَأَطْهَرُ وَاللَّهُ يَعْلَمُ وَأَنْتُمْ لَا تَعْلَمُونَWhen ye divorce women, and they fulfil the term of their ('Iddat), do not prevent them from marrying their (former) husbands, if they mutually agree on equitable terms. This instruction is for all amongst you, who believe in Allah and the Last Day. That is (the course Making for) most virtue and purity amongst you and Allah knows, and ye know not.

One day the Prophet ﷺ visited her and she provided him with food and started looking for lice in his head. Then Allah Messenger ﷺ slept and afterwards woke up smiling. Um Haram asked; What makes you smile; O Allah Messenger ﷺ ? He said; Some of my followers were presented before me in my dream as fighters in Allah Cause; sailing in the middle of the seas like kings on the thrones or like kings sitting on their thrones. The narrator Ishaq is not sure as to which expression was correct. Um Haram added; I said; O Allah Messenger ﷺ ! Invoke Allah; to make me one of them; So Allah Messenger ﷺ invoked Allah for her and then laid his head down and slept. Then he woke up smiling again. Um Haram added : I said; What makes you smile; O Allah Messenger ﷺ ? He said; Some people of my followers were presented before me in a dream as fighters in Allah Cause. He said the same as he had said before. I said; O Allah Messenger ﷺ ! Invoke Allah to make me from them. He said; You are among the first ones. One day he went to her house and she offered him a meal; and after that he slept; and then woke up smiling. She Um Haram said; I asked him; What makes you laugh; O Allah Messenger ﷺ ? He said; Some people of my followers were displayed before me as warriors fighting for Allah Cause and sailing over this sea; kings on thrones; or said; like kings on thrones. The narrator; Ishaq is in doubt about it. I Um Haram said; O Allah Apostle! Invoke Allah that He may make me one of them. He invoked Allah for her and then lay his head and slept again and then woke up smiling. I asked; What makes you laugh; O Allah Messenger ﷺ ? He said; Some people of my followers were displayed before me as warriors fighting for Allah Cause and sailing over this sea; kings on the thrones; or said; like kings on the thrones. I Um Haram said; O Allah Messenger ﷺ ! Invoke Allah that He may make me one of them. He said; You will be amongst the first ones. Allah Messenger ﷺ invoked Allah for her and slept again and woke up smiling. Once again Umm Haram asked; What makes you smile; O Allah Messenger ﷺ ? He replied; Some of my followers were presented to me as fighters in Allah Cause; repeating the same dream. Umm Haram said; O Allah Messenger ﷺ ! Invoke Allah that He makes me one of them. He said; You are amongst the first ones. He said: Verily Allah hallowed be He and High is not blind of one eye. Behold; but the Masih AlDajjal is blind of right eye as if his eye is like a swollen grape; and the Messenger of Allah ﷺ said: I was shown in a dream in the night that near the Kabah there was a man fair-complexioned; fine amongst the white-complexioned men that you ever saw; his locks of hair were falling on his shoulders. He was a man whose hair were neither too curly nor too straight; and water trickled down from his head. He was placing his bands on the shoulders of two persons and amidst them was making a circuit around the Kabah. I said: Who is he? They replied: AlMasih son of Mary. And I saw behind him a man with intensely curly hair; blind of right eye. Amongst the persons I have ever seen Ibn Qatan has the greatest resemblance with him. He was making a circuit around the Kabah by placing both his hands on the shoulders of two persons. I said: Who is he? SahihMuslim-017-001-19520Abu Saeed Khudri reported that Muawiya went to a circle in the Masjid and said: What makes you sit here? They said: We are sitting here in order to remember Allah. He said: I adjure you by Allah to tell me whether you are sitting here for this very purpose ? They said: By Allah; we are sitting here for this very purpose. Thereupon; he said: I have not demanded you to take an oath; because of any allegation against you and none of my rank in the eye of Allah Messenger ﷺ is the narrator of so few ahadith as I am. The fact is that Allah Messenger ﷺ went out to the circle of his Companions and said: What makes you sit? They said: We are sitting here in order to remember Allah and to praise Him for He guided us to the path of Islam and He conferred favours upon us. SahihMuslim-017-001-22917Muhammad Bin Abdulrahman reported: A person from Iraq said to him to inquire from Urwa Bin AlZubair for him whether a person who puts on Ihram for Hajj is allowed to put it off or not as he circumambulates the House. And if he says: No; it cant be put off; then tell him that there is a person who makes such an assertion. He Muhammad Bin Abdulrahman then said: I asked him Urwa Bin AlZubair ; where- upon he said: The person who has entered into the state of Ihram for Hajj cannot get out of it unless he has; completed the Hajj I further said to him : What if a person makes that assertion? Thereupon he said: It is indeed unfortunate that he makes such an assertion. That person Iraqi then met me and he asked me and I narrated to him the reply of Urwa ; whereupon he the Iraqi said: Tell him Urwa that a person had informed him that Allah Messenger ﷺ had done that; and why is it that Asma and AlZubair have done like this? He Muhammad Bin Abdulrahman said: I went to him and made a mention of that to him; whereupon he Urwa said: Who is he the Iraqi ? I said: I do not know; whereupon he said: What is the matter that he does not come to me himself and ask me? I suppose he is an Iraqi. I said: I do not know; whereupon he said: He has told a lie. Allah Messenger ﷺ performed Hajj; and Aisha Allah be pleased with her has told me that the first thing with which he commenced the rituals when he arrived at Mecca was that he performed ablution and then circumambulated the Kaba. Then Abu Bakr performed Hajj and the first thing with which he commenced the Hajj as the circumambulation of the Kaba and nothing besides it. So did Umar. Then Uthman performed Hajj and I saw that the first thing with which he commenced the Hajj was the circumambulation of the Kaba and nothing besides it. Then Muawiya and Abdullah Bin Umar did that. Then I performed Hajj with my father AlZubair Bin AlAwam; and the first thing with which he commenced Hajj was the circumambulation of the House. He then did nothing besides it. I then saw the emigrants Muhajirin and the helpers Ansar doing like this and nothing besides it. And the last one whom I saw doing like this was Ibn Umar. And he did not break it the Hajj after performing Umra. And Ibn Umar is with them. Why dont they ask him to testify it ? And none amongst those who had passed away commenced the rituals of Hajj but by circumambulating the Kaba on their first arrival and they did not put off Ihram without completing the Hajj ; and I saw my mother and my aunt commencing their Hajj with the circumambulation of the House; and they did not put off Ihram. My mother informed me that she came and her sister; and AlZubair and so and so for Umra; and when they had kissed the corner the Black Stone; after Sai and circumambulation ; they put off Ihram. And this document which is hanging by the sheath of the sword contains but the ages of the camels; and the nature of the wounds. He Hadrat Ali reported Allah Apostle ﷺ as saying: Medina is sacred from Air to Thaur; So if anyone makes an innovation or accommodates an innovator; the curse of Allah; the angels; and all persons will fall upon him; and Allah will not accept any obligatory or supererogatory act as recompense from them. And the protection granted by the Muslims is one and must be respected by the humblest of them. If anyone makes a false claim to paternity; or being a client of other than his own masters; there is upon him the curse of Allah; the angels; and all the people. Allah will not accept from him any recompense in the form of obligatory acts or supererogatory acts. So Allah will admit him into Paradise. And when He created a man for the Fire; He makes him perform the deeds of the people of the Fire until he dies doing the deeds of the people of the Fire. He said: Some people of my Ummah were shown to me; fighting in the cause of Allah and riding across the sea like kings on thrones; as he had said the first time. I said: O Messenger of Allah; pray to Allah to make me one of them. He said: You will be one of the first. The Messenger of Allah ﷺ said: The five daily prayers: After each prayer one of you glorifies Allah SWT ten times and praises Him ten times and magnifies him ten times; which makes one hundred and fifty on the tongue and one thousand five hundred in the balance. And I saw the Messenger of Allah ﷺ counting them on his hands. And when one of you retires to his bed he says the tasbih thirty-three times and the tahmid thirty-three times and the takbir thirty-four times; that is one hundred on the tongue and one thousand in the balance. The Messenger of Allah; may Allah bless him and grant him peace; said; Allah; the Blessed; the Exalted; created Adam. Then He stroked his back with His right hand; and progeny issued from it. He said; I created these for the Garden and they will act with the behaviour of the people of the Garden. Then He stroked his back again and brought forth progeny from him. He said; I created these for the Fire and they will act with the behaviour of the people of the Fire. A man said; Messenger of Allah! Then of what value are deeds? MuwataMalik-017-001-34806Malik said; The generally agreed-on way of doing things in our community is that any setting-free which a man makes in a bequest that he wills in health or illness can be rescinded by him when he likes and changed when he likes as long as it is not a tadbir. There is no way to rescind a tadbir once he has made it. As for every child born to him by a slave-girl who he wills to be set free but he does not make mudabbara; her children are not freed with her when she is freed. That is because her master can change his will when he likes and rescind it when he likes; and being set free is not confirmed for her. She is in the position of a slave-girl whose master says; If so- and-so remains with me until I die; she is free. i.e. he does not make a definite contract. Malik said; If she fulfils that; that is hers. If he wishes; before that; he can sell her and her child because he has not entered her child into any condition he has made for her. The bequest in setting free is different from the tadbir. The precedent of the sunna makes a distinction between them. Had a bequest been in the position of a tadbir; no testator would be able to change his will and what he mentioned in it of setting free. His property would be tied up and he would not be able to use it. Malik said about a man who made all his slaves mudabbar while he was well and they were his only property; If he made some of them mudabbar before the others; one begins with the first until the third of his property is reached. i.e. their value is matched against the third; and those whose value is covered are free. If he makes the mall mudabbar in his illness; and says in one statement; So-and-so is free. So-and-so is free. So-and-so is free if my death occurs in this illness; or he makes them all mudabbar in one statement; they are matched against the third and one does not begin with any of them before the others. It is a bequest and they have a third of his property divided between them in shares. Then the third of his property frees each of them according to the extent of his share. No single one of them is given preference when that all occurs in his illness. Malik spoke about a master who made his slave a mudabbar and then he died and the only property he had was the mudabbar slave and the slave had property. He said; A third of the mudabbar is freed and his property remains in his possession. Malik said about a mudabbar whose master gave him a kitaba and then the master died and did not leave any property other than him; A third of him is freed and a third of his kitaba is reduced; and he owes two-thirds. Malik spoke about a man who freed half of his slave while he was ill and made irrevocable his freeing half of him or all of him; and he had made another slave of his mudabbar before that. He said; One begins with the slave he made mudabbar before the one he freed while he was ill. That is because the man cannot revoke what he has made mudabbar and cannot follow it with a matter which will rescind it. When this mudabbar is freed; then what remains of the third goes to the one who had half of him freed so as to complete his setting-free entirely in the third of the property of the deceased. MuwataMalik-017-001-34817Malik related to me that he heard Ibn Shihab say; The precedent of the sunna is that when a slave is freed; his property follows him. Malik said; One thing which makes clear that the property of a slave follows him when he is freed is that when the contract mukatab is written for his freedom; his property follows him even if he did not stipulate it. That is because the bond of kitaba is the bond of wala when it is complete. The property of a slave and a mukatab is not treated in the same way as any children they may have. Their children are only treated in the same way as their own slaves; not in the same way as their property. This is because the sunna; in which there is no dispute; is that when a slave is freed; his property follows him and his children do not follow him; and when a mukatab writes the contract for his freedom; his property follows him and his children do not follow him. Malik said; One thing which makes that clear is that when a slave or a mukatab are bankrupt; their property is taken but the mothers of their children and their children are not taken because they are not their property. Malik said; Another thing which makes it clear is that when a slave is sold and the person who buys him stipulates the inclusions of his property; his children are not included in his property. Malik said; There is no harm in the two parties in a qirad helping each other by way of a favour when it is acceptable to them both. Malik said; There is no harm in the investor of the capital buying some of the goods from the agent in the qirad if that is acceptable and without conditions. Malik spoke about an investor making a qirad loan to a man and his slave; to be used by both. He said; That is permitted; and there is no harm in it because the profit is property for his slave; and the profit is not for the master until he takes it from him. MuwataMalik-017-001-35082Yahya related to me from Malik from Nafi that Abdullah Ibn Umar said that there was no harm in a man making an advance to another man for food; with a set description and price until a set date; as long as it was not in crops; or dates which had not begun to ripen. Malik said; The way of doing things among us concerning someone who makes an advance for foodstuffs at a known rate until a stated date; and the date arrives and he finds that there is not enough of what he was sold with the seller to fulfill his order; and so he revokes the sale; is that he must only take back the silver; gold; or price which he paid exactly. He does not buy anything else from the man for the same price until he has got back what he paid. That is because if he took something else besides the price which he paid him or exchanged it for goods other than the goods which he bought from him; it would be selling food before getting delivery of it. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; forbade selling food before getting delivery of it. Malik said that it was not good if the buyer regretted his purchase and asked the seller to revoke the sale for him and he would not press him immediately for what he had paid. The people of knowledge forbade that. That was because when the food was made ready for the buyer by the seller; the buyer deferred his due from the seller in order that he might revoke the sale for him. That was the sale of food with delayed terms before taking delivery of the food. Malik said; The explanation of that is that when the date of delivery comes and the buyer dislikes the food; the seller takes by it money to be paid later and so it is not revocation. Revocation is that in which neither the buyer nor the seller is increased. When increase occurs by deferment of payment for a time period; or by anything which increases one of them over the other or anything which gives one of them profit; it is not revocation. When either of them do that; revocation becomes a sale. There is an indulgence for revocation; partnership; and transfer; as long as i ncrease; decrease; or deferment does not come into them. If increase; decrease; or deferment comes into it; it becomes a sale. Whatever makes a sale halal makes it halal and whatever makes a sale haram makes it haram. Malik said; If someone pays in advance for Syrian wheat; there is no harm if he takes a load after the term falls due. Malik said; It is the same with whoever advances for any kind of thing. There is no harm in him taking better than whatever he has made an advance for or worse than it after the agreed delivery date. The explanation of that is that if; for instance; a man advances for a certain weight of wheat. There is no harm if he decides to take some barley or Syrian wheat. If he has made an advance for good dates; there is no harm if he decides to take poor quality dates. If he paid in advance for red raisins; there is no harm if he takes black ones; when it happens after the agreed delivery date; and when the measure of what he takes is like the measure of what he paid for in advance.The Chapter on Financial Transaction And Food in HodHood Indexing, The Book of Drinks in Muwata Malik
MuwataMalik-017-001-35119Malik said there was no harm if a man who sold some drapery and excluded some garments by their markings; stipulated that he chose the marked ones from that. If he did not stipulate that he would choose from them when he made the exclusion; I think that he is partner in the number of drapery goods which were purchased from him. That is because two garments can be alike in marking and be greatly different in price. Malik said; The way of doing things among us is that there is no harm in partnership; transferring responsibility to an agent; and revocation when dealing with food and other things; whether or not possession was taken; when the transaction is with cash; and there is no profit; loss; or deferment of price in it. If profit or loss or deferment of price from one of the two enters any of these transactions; it becomes sale which is made halal by what makes sale halal; and made haram by what makes sale haram; and it is not partnership; transferring responsibility to an agent; or revocation. Malik spoke about some one who bought drapery goods or slaves; and the sale was concluded; then a man asked him to be his partner and he agreed and the new partner paid the whole price to the seller and then something happened to the goods which removed them from their possession. Malik said; The new partner takes the price from the original partner and the original partner demands from the seller the whole price unless the original partner stipulated on the new partner during the sale and before the transaction with the seller was completed that the seller was responsible to him. If the transaction has ended and the seller has gone; the pre-condition of the original partner is void; and he has the responsibility. Malik spoke about a man who asked another man to buy certain goods to share between them; and he wanted the other man to pay for him and he would sell the goods for the other man. Malik said; That is not good. When he says; Pay for me and I will sell it for you; it becomes a loan which he makes to him in order that he sell it for him and if those goods are destroyed; or pass; the man who paid the price will demand from his partner what he put in for him. This is part of the advance which brings in profit. Malik said; If a man buys goods; and they are settled for him; and then a man says to him; Share half of these goods with me; and I will sell them all for you; that is halal; there is no harm in it. This is not done in the case of female slaves. It is feared about that that it will lead to making halal what is not halal; so it is not good. The explanation of what is disapproved of in that; is that a man borrow a slave-girl and have intercourse with her as seems proper to him. Then he returns her to her owner. That is not good and it is not halal. MuwataMalik-017-001-35165Yahya related to me from Malik from Hisham Ibn Urwa that his father; Urwa Ibn AlZubair made an aqiqa for his male and female children of a sheep each. Malik said; What we do about the aqiqa is that if someone makes an aqiqa for his children; he gives a sheep for both male and female. The aqiqa is not obligatory but it is desirable to do it; and people continue to come to us about it. If someone makes an aqiqa for his children; the same rules apply as with all sacrificial animals - one-eyed; emaciated; injured; or sick animals must not be used; and neither the meat or the skin is to be sold. MuwataMalik-017-001-35348Yahya related to me from Malik from Ibn Shihab; and he had heard from AlQasim Ibn Muhammad that they said; When a free man marries a slave-girl and consummates the marriage; she makes him muhsan. Malik said; All of the people of knowledge I have seen said that a slave-girl makes a free man muhsan when he marries her and consummates the marriage. Malik said; A slave makes a free woman muhsana when he consummates a marriage with her and a free woman only makes a slave muhsan when he is freed and he is her husband and has had sexual relations with her after he has been set free. If he parts from her before he is free; he is not a muhsan unless he marries her after having been set free and he consummates the marriage. Malik said; When a slave-girl is married to a free man and then he separates from her before she is set free; his marriage to her does not make her muhsana. She is not muhsana until she has married after she has been set free and she has had intercourse with her husband. That gives her ihsan. If she is the wife of a freeman and then she is set free while she is his wife before he separates from her; the man makes her muhsana if he has intercourse with her after she has been set free. MuwataMalik-017-001-35400Yahya related to me from Malik from Suhayl Ibn Abi Salih from his father from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; Whoever makes an oath and then sees that something else would be better than it; should do kaffara for his oath and do what is better. Yahya said that he heard Malik say; Anyone who says that he has a vow but does not mention the name of Allah; is still obliged to make the kaffara for an oath if he breaks it. Malik said; Emphasis is when a man swears one thing several times; repeating the oath in his speech time after time. For instance; the statement; By Allah; I will not decrease it from such-and-such; sworn three times or more. The kaffara of that is like the kaffara of one oath. If a man swears; I will not eat this food or wear these clothes or enter this house; that is all in one oath; and he is only obliged to do one kaffara. It is the same for a man who says to his wife; You are divorced if I clothe you in this garment or let you go to the Masjid; and it is one entire statement in the normal pattern of speech. If he breaks any of that oath; divorce is necessary; and there is no breaking of oath after that in whatever he does. There is only one oath to be broken in that. Malik said; What we do about a woman who makes a vow without her husband permission is that she is allowed to do so and she must fulfill it; if it only concerns her own person and will not harm her husband. This made him very anxious; and so he sent his wife to the Prophet; may Allah bless him and grant him peace; to ask him about that for him. She went in and saw Umm Salamah; the wife of the Prophet; may Allah bless him and grant him peace; and mentioned the matter to her; and Umm Salamah told her that the Messenger of Allah; may Allah bless him and grant him peace; used to kiss while he was fasting. So she went back and told her husband that; but it only made him find fault all the more and he said; We are not like the Messenger of Allah; may Allah bless him and grant him peace. Allah makes permissible for the Messenger of Allah; may Allah bless him and grant him peace; whatever He wishes. His wife then went back to Umm Salamah and found the Messenger of Allah; may Allah bless him and grant him peace; with her. The Messenger of Allah; may Allah bless him and grant him peace; said; What the matter with this woman?; and Umm Salamah told him. The Messenger of Allah; may Allah bless him and grant him peace; said; Didnt you tell her that I do that myself? and she said; I told her; and she went to her husband and told him; but it only made him find fault all the more and say; We are not like the Messenger of Allah; may Allah bless him and grant him peace. Allah makes permissible for His Messenger; may Allah bless him and grant him peace; whatever He wishes. MuwataMalik-017-001-35722Yahya related to me from Malik that he had asked Ibn Shihab about the word of Allah; the Majestic; the Mighty; O you who accept; when the call is made for the prayer on the day of jumua; make haste to the remembrance of Allah. Surat 62 ayat 9. Ibn Shihab said; Umar Ibn AlKhattab used to recite; When the call is made for the prayer on the day of jumua; go to the remembrance of Allah. Malik said; Making haste in the Book of Allah is only deed and action. Allah the Blessed; the Exalted; says and when he turns away; he acts in the land Surat 2 ayat 205 ; and He; the Exalted; said; and as for the one who comes to you acting with fear Surat 80 ayat 8 ; and He said; then he turned his back; and acted Surat 79 ayat 22 ;and He said; Your deeds are diverse Surat 92 ayat 4. Malik said; Thus making haste which Allah mentions in His Book is not running on the feet or exertion. MuwataMalik-017-001-35982Yahya related to me from Malik that Ata Ibn Abdullah AlKhurasani said that an old man from Suq AlBuram in Kufa had related to him that Kaab Ibn Ujra said; The Messenger of Allah; may Allah bless him and grant him peace; came to me while I was blowing under a cooking pot belonging to my companions and my head and beard were full of lice. He took my forehead and said; Shave your hair and fast three days or feed six poor people. The Messenger of Allah; may Allah bless him and grant him peace; was aware that I did not have anything with me to sacrifice. Malik said; concerning paying compensation fidya for the relief of physical discomfort; The custom concerning it is that no one pays compensation until he has done something which makes it obligatory to pay compensation just as making amends kaffara is only done when it has become obligatory for the one who owes it. The person can pay the compensation wherever he wishes; regardless of whether he has to sacrifice an animal or fast or give sadaqa - in Makka or in any other town. Malik said; It is not correct for a person in ihram to pluck out any of his hair or to shave it or cut it until he has left ihram; unless he is suffering from an ailment of the head; in which case he owes the compensation Allah the Exalted has ordered. It is not correct for a person in ihram to cut his nails; or to kill his lice; or to remove them from his head or from his skin or his garment to the ground. If a person in ihram removes lice from his skin or his garment; he must give away the quantity of food that he can scoop up with both hands. Malik said;Anyone who; while in ihram; plucks out hairs from his nose or armpit or rubs his body with a depilatory agent or shaves the hair from around a head wound out of necessity or shaves his neck for the place of the cupping glasses; regardless of whether it is in forgetfulness or in ignorance; owes compensation in all these instances; and he must not shave the place of the cupping glasses. MuwataMalik-017-001-36165Yahya related to me from Malik from Nafi that the slave girls of Abdullah Ibn Umar used to wash his feet and bring him a mat of palm leaves while they were menstruating. Malik was asked whether a man who had women and slavegirlscould have intercourse with all of them before he did ghusl. He said; There is no harm in a man having intercourse with two of his slave girls before he does ghusl. It is disapproved of; however; to go to a freewoman on another day. There is no harm in making love first to one slave girl and then to another when one is junub. Malik was asked about a man who was junub and water was put down for him to do ghusl with.Then he forgot and put his finger into it to find out whether it was hot or cold.
