They said: "What affair is this of ours?" Say thou: "Indeed, this affair is wholly Allah's." They hide in their minds what they dare not reveal to thee. They say (to themselves): "If we had had anything to do with this affair, We should not have been in the slaughter here." Say: "Even if you had remained in your homes, those for whom death was decreed would certainly have gone forth to the place of their death"; but (all this was) that Allah might test what is in your breasts and purge what is in your hearts. For Allah knoweth well the secrets of your hearts.

This day have those who reject faith given up all hope of your religion: yet fear them not but fear Me. This day have I perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion. But if any is forced by hunger, with no inclination to transgression, Allah is indeed Oft-forgiving, Most Merciful.

But We will show the Unbelievers the truth of all that they did, and We shall give them the taste of a severe Penalty.

SahihAlBukhari-017-001-025Narrated Sahl Bin Saad AlSaidi: The news about the differences amongst the people of Bani Amr Bin Auf reached Allah Messenger ﷺ and so he went to them along with some of his companions to effect a reconciliation between them. Allah Messenger ﷺ was delayed there; and the time of the prayer was due. Bilal went to Abu Bakr and said to him; Allah Messenger ﷺ has been delayed there and the time of prayer is due. So will you lead the people in prayer? Abu Bakr said; Yes; if you wish. Bilal pronounced the Iqama and Abu Bakr; went forward and said Takbir for the people. In the meantime Allah Messenger ﷺ came crossing the rows of the praying people and stood in the first row and the people started clapping. Abu Bakr; would never glance sideways in his prayer but when the people clapped much he looked back and ﷺ Allah Messenger ﷺ. Allah Messenger ﷺ beckoned him to carry on the prayer. Abu Bakr raised his hands and thanked Allah; and retreated till he reached the first row. Allah Messenger ﷺ went forward and led the people in the prayer. When he completed the prayer he faced the people and said; O people! Why did you start clapping when something unusual happened to you in the prayer? Clapping is only for women. So whoever amongst you comes across something in the prayer should say; Subhan-Allah for there is none who will not turn round on hearing him saying Subhan-Allah. O Abu Bakr! What prevented you from leading the people in the prayer when I beckoned you to do so? SahihAlBukhari-017-001-102Narrated Abdullah Bin Umar: I saw Allah Messenger ﷺ delaying the Maghrib prayer till he offered it along with the Isha prayer whenever he was in a hurry during the journey. Salim narrated; Ibn Umar used to do the same whenever he was in a hurry during the journey. And Salim added; Ibn Umar used to pray the Maghrib and Isha prayers together in AlMuzdalifa. Salim said; Ibn Umar delayed the Maghrib prayer because at that time he heard the news of the death of his wife Safiya bint Abi Ubaid. I said to him; The prayer is due. He said; Go on. Again I said; The prayer is due. He said; Go on; till we covered two or three miles. Then he got down; prayed and said; I saw the Prophet ﷺ praying in this way; whenever he was in a hurry during the journey. Abdullah bin Umar added; Whenever the Prophet was in a hurry; he used to delay the Maghrib prayer and then offer three rakat of the Maghrib and perform Taslim; and after waiting for a short while; Iqama used to be pronounced for the Isha prayer when he would offer two rakat and perform Taslim. SahihAlBukhari-017-001-1356Narrated Hudhaifa: Allah Messenger ﷺ related to us; two prophetic narrations one of which I have seen fulfilled and I am waiting for the fulfillment of the other. The Prophet ﷺ told us that the virtue of honesty descended in the roots of men hearts from Allah and then they learned it from the Quran and then they learned it from the Sunna the Prophet traditions. The Prophet ﷺ further told us how that honesty will be taken away: He said: Man will go to sleep during which honesty will be taken away from his heart and only its trace will remain in his heart like the trace of a dark spot; then man will go to sleep; during which honesty will decrease further still; so that its trace will resemble the trace of blister as when an ember is dropped on one foot which would make it swell; and one would see it swollen but there would be nothing inside. People would be carrying out their trade but hardly will there be a trustworthy person. It will be said; in such-and-such tribe there is an honest man; and later it will be said about some man; What a wise; polite and strong man he is! Though he will not have faith equal even to a mustard seed in his heart. When he had finished the prayer; he addressed the people and said; O people! Why did you start clapping when something happened to you in the prayer? Clapping is for women. Whenever one is confronted with something unusual in the prayer one should say; Sub Han Allah. Then the Prophet looked towards Abu Bakr and asked; What prevented you from leading the prayer when I beckoned you to carry on? SahihAlBukhari-017-001-1979Narrated Abu Huraira: Allah Messenger ﷺ said; On the Day of Resurrection the Kanz Treasure or wealth of which; Zakat has not been paid of anyone of you will appear in the shape of a huge bald headed poisonous male snake and its owner will run away from it; but it will follow him and say; I am your Kanz. The Prophet ﷺ added; By Allah; that snake will keep on following him until he stretches out his hand and let the snake swallow it. Allah Messenger ﷺ added; If the owner of camels does not pay their Zakat; then; on the Day of Resurrection those camels will come to him and will strike his face with their hooves. Some people said: Concerning a man who has camels; and is afraid that Zakat will be due so he sells those camels for similar camels or for sheep or cows or money one day before Zakat becomes due in order to avoid payment of their Zakat cunningly! He has not to pay anything. The Prophet ﷺ went to them along with some of his companions in order to make peace between them. The time for the prayer became due but the Prophet ﷺ did not turn up; Bilal pronounced the Adhan i.e. call for the prayer but the Prophet ﷺ did not turn up; so Bilal went to Abu Bakr and said; The time for the prayer is due and the Prophet ﷺ i detained; would you lead the people in the prayer? Abu Bakr replied; Yes; you wish. So; Bilal pronounced the Iqama of the prayer and Abu Bakr went ahead to lead the prayer ; but the Prophet came walking among the rows till he joined the first row. The people started clapping and they clapped too much; and Abu Bakr used not to look hither and thither in the prayer; but he turned round and saw the Prophet ﷺ standing behind him. The Prophet ﷺ beckoned him with his hand to keep on praying where he was. Abu Bakr raised his hand and praised Allah and then retreated till he came in the first row; and the Prophet ﷺ went ahead and lead the people in the prayer. When the Prophet ﷺ finished the prayer; he turned towards the people and said; O people! When something happens to you during the prayer; you start clapping. Really clapping is permissible for women only. If something happens to one of you in his prayer; he should say: Subhan Allah; Glorified be Allah ; for whoever hears him saying so will direct his attention towards him. O Abu Bakr! What prevented you from leading the people in the prayer when I beckoned to you to continue ? There were some marks of the rainfall during the night. At the conclusion of prayer he turned towards people and observed: Do you know what your Lord has said? They replied: Allah and His Messenger know best. Upon this he the Holy Prophet remarked: He Allah said: Some of My bondsmen entered the morning as My believers and some as unbelievers. SahihMuslim-017-001-19466Abdullah reported that Umm Habiba; the wife of Allah Apostle ﷺ ; said: 0 Allah; enable me to derive benefit from my husband; the Messenger of Allah ﷺ ; and from my father Abu Sufyan and from my brother Muawiya. Allah Apostle ﷺ said: You have asked from Allah about durations of life already set; and the length of days already allotted and the sustenances the share of which has been fixed. Allah would not do anything earlier before its due time; or He would not delay anything beyond its due time. He the narrator further said: Mention was made before him about monkeys; and Misar one of the narrators said: I think that the narrator also made a mention of the swine; which had suffered metamorphosis. Thereupon he the Holy Prophet said: Verily; Allah did not cause the race of those which suffered metamorphosis to grow or they were not survived by young ones. The Messenger of Allah ﷺ made a long recital of the Quran and then pronounced takbir and then observed a long ruku. He then raised his head and said: Allah listened to him who praised Him: our Lord; praise is due to Thee. He then again stood up and made a long recital; which was less than the first recital. He pronounced takbir and observed a long ruku; and it was less than the first one. He again said: Allah listened to him who praised Him; our Lord; praise is due to Thee. Abu Tahir; one of the narrators made no mention of: He then prostrated himself. He did like this in the second rakah; till he completed four rakahs and four prostrations and the sun became bright before he deported. He then stood up and addressed people; after lauding Allah as He deserved; and then said: The sun and the moon are two signs among the signs of Allah These do not eclipse either on the death of anyone or on his birth. So when you see them; hasten to prayer. He also said this: Observe prayer till Allah dispels the anxiety of this extraordinary phenomenon from you. The Messenger of Allah ﷺ said: I saw in my place everything which you have been promised. I even saw myself desiring to pluck a bunch of grapes from Paradise and it was at the time when you saw me moving forward. And I saw Hell and some of its parts crushing the others; when you saw me moving back; and I saw in it Ibn Luhay and he was the person who made the camels loiter about. He the Holy Prophet said: If any owner of the camel does not pay what is due on him; and of his due in that camel is also to milk it on the day when it comes down to water. When the Day of Resurrection comes a soft sandy plain would be set for him; as extensive as possible; he will find that not a single young one is missing; and they will trample him with their hoofs and bite him with their mouths. As often as the first of them passes him; the last of them would be made to return during a day the extent of which would be fifty thousand years; until judgment is pronounced among servants and he sees whether his path is to take him to Paradise or to Hell. It was again said: Messenger of Allah; what about cows cattle and sheep? He said: It any owner of the cattle and sheep does not pay what is due on them; when the Day of Resurrection comes a soft sandy plain would be spread for them; he will find none of them missing; with twisted horns; without horns or with a broken horn; and they will gore him with their horns and trample him with their hoofs. As often as the first of them passes him the last of them would be made to return to him during a day the extent of which would be fifty thousand years; until judgment would be pronounced among the servants. And he would be shown his path-path leading him to Paradise or to Hell. It was said: Messenger of Allah; what about the horse? Upon this he said: The horses are of three types. To one than these are a burden; and to another man these are a covering; and still to another man these are a source of reward. The one for whom these are a burden is the person who rears them in order to show off; for vainglory and for opposing the Muslims; so they are a burden for him. The one for whom these are a covering is the person who rears them for the sake of Allah but does not forget the right of Allah concerning their backs and their necks; and so they are a covering for him. As for those which bring reward these refer to the person who rears them for the sake of Allah to be used for Muslims and he puts them in meadow and field. And whatever thing do these eat from that meadow and field would be recorded on his behalf as good deeds; as would also the amount of their dung and urine. And these would not break their halter and prance a course or two without having got recorded the amount of their hoof marks and their dung as a good deed on his behalf on behalf of their owner. And their master does not bring them past a river from which they drink; though he did not intend to quench their thirst; but Allah would record for him the amount of what they drink on his behalf as deeds. And no owner of the goats and sheep who does not pay what is due on them would be spared of punishment but many more would come on the Day of Resurrection and he the owner would be made to sit on a soft sandy ground and they would gore him with their horns and trample him under their hooves. And there would be more among this flock of sheep and goat without horns or with broken horns. And no owner of the treasure who does not pay its due but his treasure would come on the Day of Resurrection like a bald snake and would pursue him with its mouth open; and when it would come near he would run away from it; and he would be called thus: Take your treasure which you concealed; for I do not need it. When he would find no way out he would put his hand in its mouth and it would gnaw it like a he-camel. Abu AlZubair said: We heard Ubaid Bin Umair saying this. We then asked Jabir Bin Abdullah about this. And he also said like Ubaid Bin Umair; Abu AlZubair said: I heard Ubaid Bin Umair saying: A man said: Messenger of Allah; what is due on camels? He said: In times of hardship or in times of ease; they will come on the Day of Resurrection as energetic; fat and lively as they ever were. He will be laid face down in a flat arena for them and they will trample him with their hooves. When the last of them has passed; the first of them will return; on a day that is as long as fifty thousand years; until judgment is passed among the people; and he realizes his end. Any man who has cattle and does not pay what is due on them in drought or in plenty; they will come on the Day of Resurrection as energetic; fat and lively as they ever were. He will be laid face down in a flat arena for them; and they will trample him with their cloven hooves. When the last of them has passed the first of them will return; on a day that is as long as fifty thousand years; until judgment is passed among the people and he realizes his end. Any man who has sheep and does not pay what is due on them in drought or in plenty; they will come on the Day or Resurrection as energetic; fat and lively as they ever were. He will be laid face down in a flat arena for them and they will trample him with their cloven hooves; and each horned one will gore him with its horn; and there will be none among them with twisted or broken horns. SunanAlNasai-017-001-14717It was narrated from Anas Bin Malik that Abu Bakar wrote to them: This is the obligation of Sadaqah which the Messenger of Allah enjoined upon the Muslims; as Allah ; the Mighty and Sublime; commanded the Messenger of Allah.Whoever is asked for it in the manner explained in the letter of Abu Bakar ; let him give it; and whoever is asked for more than that; let him not give it. When there are less than twenty-five camels; for every five camels; one sheep is to be given. If the number reaches twenty five; then a Bint Makhad a one-year old camel is due; up to thirty-five. If a Bint Makhad is not available; then a Bin Labun a two-year old male camel. If the number reaches thirty-six; then a Bint Labun a two-yer-old camel is due; up to forty-five. If the number reaches forty-six; then a Hiqqqah a three-year-old camel that has been bred from a stallion camel is due; up to sixty. If the number reaches sixty-one; then a Jadhah a four-year-old camel is due; up to seventy-six; then two Bint Labuns two-year-old camels0 are due; up to ninety. If the number reaches ninety-one; then two Hiqqahs three-year-old camels that have been bred from stallion camels are due; up to one hundred and twenty. If there are more than one hundred and twenty; then for every forty a Bint Labun; and for every fifty a Hiqqah. In the event that a person does not have a camel of the age specified according to the Hiaqah regulations; then if a person owes a Jadhah as Sadaqah but he does not have a Jadhah; then a Hiqqah should be accepted from him; and he should give two sheep along with it if they are available; or twenty Dirhams; If he owes a Hiqqah as Sadaqah and he does not have Hiqqah but he has a Jadhah; then if should be accepted from him; and the Zakah collector should give him twenty Dirhams; or two sheep if they are available. If a person owes a Hiqqah as Sadaqah and he does not have one; but he has a Bint Labun; it should be accepted from him; and he should give two sheep along with it if they are available; or twenty Dirhams. If a person owes a Bint Labun as Sadaqah but he only has a Hiqaah; then it should be accepted from him and the Zakah collector should give him twenty Dirhams; or two sheep. If a person owes a Bint Labun as Sadaqah but he only has a Bint Makhad; then it should be accepted from him; and he should be accepted from him; and he should give two sheep along with it if they are available; or twenty Dirhams. If a person owes a Bint Makhad as Sadaqah but he only has a Bint Labun; a male; it should be accepted from him; and he does not have to give anything else along with it. If a person has only four camels he does not have to give anything unless their owner wants to. With regard to the Sadaqah on grazing sheep; if there are forty; then one sheep is due upon them; up to one hundred and twenty. If there is one more; then two sheep are due; up to two hundred. If there is one more; then three sheep are due; up to three hundred. If there are more than that; then for every hundred; one sheep is due. No feeble; defective or male sheep should be taken as Sadaqah unless the Zakah collector wishes. Do not combine separate flocks or separate combined flocks for fear of Sadaqah. Each partner who has a share in a combined flock should pay the Sadaqah in proportion to his shares. If a man flock is one less than forty sheep; then nothing is due from them; unless their owner wishes. I sat in front of Abdullah Bin Umar and Ibn Abbas; and the women wept. Ibn Umar said: Why dont you tell them not to weep? For I heard the Messenger of Allah say: The deceased is punished due to some of his family weeping for him. Ibn Abbas said: Umar used to narrate something like that. I went out with Umar and when we got to on uninhabited area; he saw a caravan beneath a tree. He said: See whose caravan this is. I went and I found Suhaib and his family. I came back to him and said: O Commander of the Believers! This is Suhaib and his family. He said: Bring Suhaib to me. When we entered AlMadinah; Umar was attacked and Suhaib sat by him; weeping and saying; O my brother; O my brother. Umar said: O Suhaib; do not weep; for I heard the Messenger of Allah say: The deceased is punished due to some of the weeping of his family for him. He said: I mentioned that to Aisha and she said: By Allah you are not narrating this Hadith from two liars who have disbelieved; but sometimes you mishear. And no bearer of burdens shall bear another burden. Abu Bak replied I swear by Allah that I will certainly fight with those who make a distinction between prayer and zakat; for zakat is what is due from property. I swear by Allah that if they were to refuse me a rope of camel or a female kid; according to another version which they used to pay the Messenger of Allah; I will fight with them over the refusal of it. He said: That one is not worthy of milking and riding. Here is another camel which is young; grand and fat. So take it. I said to him: I shall not take an animal for which I have not been commanded. The Messenger of Allah ﷺ is here near to you. If you like; go to him; and present to him what you presented to me. Do that; if he accepts it from you; I shall accept it; if he rejects it; I shall reject it. He said: I shall do it. He accompanied me and took with him the camel which he had presented to me. We came to the Messenger of Allah ﷺ. He said to him: Prophet of Allah; your messenger came to me to collect zakat on my property. By Allah; neither the Messenger of Allah nor his messenger has ever seen my property before. I gathered my property camels ; and he estimated that a camel in her second year would be payable by me. But that has neither milk nor is it worth riding. So I presented to him a grand young camel for acceptance as zakat. But he has refused to take her. Look; she is here; I have brought her to you; Messenger of Allah. Take her. The Messenger of Allah ﷺ said: That is what is due from you. If you give voluntarily a better animal Allah will give a reward to you for it. We accept her from you. She is here; Messenger of Allah; I have brought her to you. So take her. He drank water and came out. Suddenly he saw a dog panting and eating soil due to thirst. The man said to himself This dog must have reached the same condition due to thirst as I had reached. So he went down into the well; filled his sock with water; held it with his mouth and came up. He supplied water to the dog. Allaah appreciated this and forgave him. MuwataMalik-017-001-34745Yahya said that Malik said; When the relatives of the deceased accept the blood-money then it is inherited according to the Book of Allah. Daughters of the dead man inherit and so do sisters; and whichever women would inherit from him ordinarily. If the women do not take all his inheritance; then what remains goes to the agnatic relations who most deserve to inherit from him in conjunction with the women. Malik said; When one of the heirs of a man killed by mistake attempts to take his due from the blood-money while his companions are absent; he may not do that; and he has no right to any of the blood-money; however large or small; unless the qasama has been completed by him. If he swears fifty oaths then he has the right to his portion of the blood-money. That is because the blood-money is not established as due without there being fifty oaths; and the blood- money is not established as due unless the responsibility for the blood is established. If any one of the heirs comes after that he swears a number of the oaths commensurate with his fraction of the inheritance and takes his right until all the heirs exact their complete right. If a maternal uncle comes he has one sixth and must swear one sixth of the fifty oaths. So whoever swears may take his due from the blood-money and whoever abstains annuls his right. If one of the heirs is absent or is a child who has not reached puberty; those who are present swear fifty oaths and if the one who was absent comes after that or the child reaches puberty; they swear. and they swear according to their due of the blood-money and according to their shares of inheritance from it. MuwataMalik-017-001-34877Yahya related to me from Malik from Ibn Shihab from Said Ibn AlMusayab and Abu Salama Ibn Abdulrahman from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; The wound of an animal is of no account and no compensation is due for it. The well is of no account and no compensation is due for it. The mine is of no account and no compensation is due for it and a fifth is due for buried treasures. Alkanz: see Book 17. Malik said; Everyone leading an animal by the halter; driving it; and riding it is responsible for what the animal strikes unless the animal kicks out without anything being done to it to make it kick out. Umar Ibn AlKhattab imposed the blood-money on a person who was exercising his horse. Malik said; It is more fitting that a person leading an animal by the halter; driving it; or riding it incur a loss than a person who is exercising his horse. See hadith 4 of this book. Malik said; What is done in our community about a person who digs a well on a road or ties up an animal or does the like of that on a road used by muslims; is that since what he has done is included in that which he is not permitted to do in such a place; he is liable for whatever injury or other thing arises from that action. The blood-money of that which is less than a third of the full blood- money is owed from his own personal property. Whatever reaches a third or more; is owed by his tribe. Any such things that he does which he is permitted to do on the muslims road are something for which he has no liability or loss. Part of that is a hole which a man digs to collect rain; and the beast from which the man alights for some need and leaves standing on the road. There is no penalty against anyone for this. Malik spoke about a man who went down a well; and another man followed behind him; and the lower one pulled the higher one and they fell into the well and both died He said; The tribe of the one who pulled him in is responsible for the blood-money. Malik spoke about a child whom a man ordered to go down into a well or to climb a palm tree and he died as a result. He said; The one who ordered him is liable for whatever befalls him; be it death or something else. Malik said; The way of doing things in our community about which there is no dispute is that women and children are not obliged to pay blood-money together with the tribe in the blood-moneys which the tribe must pay. The blood-money is only obligatory for a man who has reached puberty. Malik said that the tribe could bind themselves to the blood-money of mawali if they wished. If they refused; they were people of the diwan or were cut off from their people. In the time of the Messenger of Allah; may Allah bless him and grant him peace; people paid the blood-money to each other as well as in the time of Abu Bakr AlSiddiq before there was a diwan. The diwan was in the time of Umar Ibn AlKhattab. No one other than one people and the ones holding the wala paid blood- money for one because the wala was not transferable and because the Prophet; may Allah bless him and grant him peace; said; The wala belongs to the one who sets free. Malik said; The wala is an established relationship. Malik said; What is done in our community about animals that are injured is that the person who causes the injury pays whatever of their value has been diminished. Malik said about a man condemned to death and one of the other hudud befell him; He is not punished for it. That is because the killing overrides all of that; except for slander. The slander remains hanging over the one to whom it was said because it will be said to him; Why do you not flog the one who slandered you? I think that the condemned man is flogged with the hadd before he is killed; and then he is killed. I do not think that any retaliation is inflicted on him for any injury except killing because killing overrides all of that. Malik said; What is done in our community is that when a murdered person is found among the main body of a people in a village or other place; the house or place of the nearest people to him is not responsible. That is because the murdered person can be slain and then cast at the door of some people to shame them by it. No one is responsible for the like of that. Malik said about a group of people who fight with each other and when the fight is broken up; a man is found dead or wounded; and it is not known who did it; The best of what is heard about that is that there is blood-money for him; and the blood-money is against the people who argued with him. MuwataMalik-017-001-34917Yahya said that he heard Malik speak about two men who had a pledge between them. One of them undertook to sell his pledge; and the other one had asked him to wait a year for his due. He said; If it is possible to divide the pledge; and the due of the one who asked him to wait will not be decreased; half the pledge which is between them is sold for him and he is given his due. If it is feared that his right will be decreased; all the pledge is sold; and the one who undertook to sell his pledge is given his due from that. If the one who asked him to wait for his due is pleased in himself; half of the price is paid to the pledger. If not; the pledgee is made to take an oath that he only asked him to wait so that he could transfer my pledge to me in its form. Then he is given his due immediately. MuwataMalik-017-001-34931Yahya said that he heard Malik say; The way of doing things generally agreed upon in our community in the case of a man who dies and has sons and one of them claims; My father confirmed that so-and- so was his son; is that the relationship is not established by the testimony of one man; and the confirmation of the one who confirmed it is only permitted as regards his own share in the division of his father property. The one testified for is only given his due from the share of the testifier. Malik said; An example of this is that a man dies leaving two sons; and 600 dinars. Each of them takes 300 dinars. Then one of them testifies that his deceased father confirmed that so-and-so was his son. The one who testifies is obliged to give 100 dinars to the one thus connected. This is half of the inheritance of the one thought to be related; had he been related. If the other confirms him; he takes the other 100 and so he completes his right and his relationship is established. His position is similar to that of a woman who confirms a debt against her father or her husband and the other heirs deny it. She must pay to the person whose debt she confirms; the amount according to her share of the full debt; had it been confirmed against all the heirs. If the woman inherits an eighth; she pays the creditor an eighth of his debt. If a daughter inherits a half; she pays the creditor half of his debt. Whichever women confirm him; pay him according to this. Malik said; If a man testimony is in agreement with what the woman testified to; that so- and-so had a debt against his father; the creditor is made to take an oath with one witness and he is given all his due. This is not the position with women because a man testimony is allowed and the creditor must take an oath with the testimony of his witness; and take all his due. If he does not take an oath; he only takes from the inheritance of the one who confirmed him according to his share of the debt; because he confirmed his right and the other heirs denied it. MuwataMalik-017-001-35116Malik related to me that Zayd Ibn Aslam said; Usury in the Aljahiliya was that a man would give a loan to a man for a set term. When the term was due; he would say; Will you pay it off or increase me? If the man paid; he took it. If not; he increased him in his debt and lengthened the term for him. Malik said; The disapproved of way of doing things about which there is no dispute among us; is that a man should give a loan to a man for a term; and then the demander reduce it and the one from whom it is demanded pay it in advance. To us that is like someone who delays repaying his debt after it is due to his creditor and his creditor increases his debt. Malik said; This is nothing else but usury. No doubt about it. Malik spoke about a man who loaned one hundred dinars to a man for two terms. When it was due; the person who owed the debt said to him; Sell me some goods; whose price is one hundred dinars in cash for one hundred and fifty on credit. Malik said; This transaction is not good; and the people of knowledge still forbid it. Malik said; This is disapproved of because the creditor himself gives the debtor the price of what the man sells him; and he defers repayment of the hundred of the first transaction for the debtor for the term which is mentioned to him in the second transaction; and the debtor increases him with fifty dinars for his deferring him. That is disapproved of and it is not good. It also resembles the hadith of Zayd Ibn Aslam about the transactions of the people of the Aljahiliya. When their debts were due; they said to the person with the debt; Either you pay in full or you increase it. The siblings by the mother had their rights. The rest was inherited by the former masters of the mother if she was a freed slave. If she was a free woman by origin; she inherited her due and the siblings by the mother inherited their due; and the rest went to the Muslims. Malik said; I heard the same as that from Sulayman Ibn Yasar. MuwataMalik-017-001-35574Yahya said that Malik said; The position with us concerning a man who has zakat to pay on one hundred camels but then the zakat collector does not come to him until zakat is due for a second timeand by that time all his camels have died except five; is that the zakat collector assesses from the five camels the two amounts of zakat that are due from the owner of the animals; which in this case is only two sheep; one for each year. This is because the only zakat which an owner of livestock has to pay is what is due from him on the day that the zakat is actually assessed. His livestock may have died or it may have increased; and the zakat collector only assesses the zakat on what he actually finds on the day he makes the assessment. MuwataMalik-017-001-35977Malik said; I still hear that when a person in ihram kills an ostrich; a camel is due. Malik said; I think that for an ostrich egg; one tenth of the price of a camel is due in the same way that there is a newly-born male or female slave for the unborn child of a free woman. The value of the newly-born slave is fifty dinars; and that is one-tenth of what the blood-money for the mother would be. Birds from the eagle family; eagles or falcons or vultures count as game for which a price is paid just as a price is paid for any game which a person in ihram kills. For everything for which a penalty is paid; the assessment is the same; whether the animal is old or young.
