And those who are firmly grounded in knowledge say: "We believe in the Book; the whole of it is from our Lord:" and none will grasp the Message except men of understanding. | |

But the (Wrath of) Allah came to them from quarters from which they little expected (it), and cast terror into their hearts, so that they destroyed their dwellings by their own hands and the hands of the Believers, take warning, then, O ye with eyes (to see)! | |

| SahihAlBukhari-017-001-1208 | Narrated Abu Huraira: While we were with Allah Messenger ﷺ a bedouin got up and said; O Allah Messenger ﷺ ! Settle my case according to Allah Book Laws. Then his opponent got up and said; O Allah Messenger ﷺ ! He has said the truth! Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. There was also written in it: The asylum pledge of protection granted by any Muslims is one and the same; even a Muslim of the lowest status is to be secured and respected by all the other Muslims; and whoever betrays a Muslim in this respect by violating the pledge will incur the curse of Allah; the angels; and all the people; and Allah will not accept his compulsory or optional good deeds. So while I was sitting with them. Uthman Messenger came to me. They said; Allah has put you to trial. I set out and when I reached Uthman; he said; What is your advice which you mentioned a while ago? I recited Tashahhud and added; Allah has sent Muhammad and has revealed the Holy Book i.e. Quran to him. You O Uthman! were amongst those who responded to the call of Allah and His Apostle and had faith in him. And you took part in the first two migrations to Ethiopia and to Medina ; and you enjoyed the company of Allah Messenger ﷺ and learned his traditions and advice. Now the people are talking much about AlWalid Bin Uqba and so it is your duty to impose on him the legal punishment. Uthman then said to me; O my nephew! Did you ever meet Allah Messenger ﷺ ? I said; No; but his knowledge has reached me as it has reached the virgin in her seclusion. Uthman then recited Tashahhud and said; No doubt; Allah has sent Muhammad with the Truth and has revealed to him His Holy Book i.e. Quran and I was amongst those who responded to the call of Allah and His Apostle and I had faith in Muhammad Mission; and I had performed the first two migrations as you have said; and I enjoyed the company of Allah Messenger ﷺ and gave the pledge of allegiance to him. By Allah; I never disobeyed him and never cheated him till Allah caused him to die. Then Allah made Abu Bakr Caliph; and by Allah; I was never disobedient to him; nor did I cheat him. You send an army and I would send an army five times greater than that. Fight against those who disobey you along with those who obey you. The inmates of Paradise are three: One who wields authority and is just and fair; one who Is truthful and has been endowed with power to do good deeds. He exhorted us to hold fast to the Book of Allah and then said: The second are the members of my household I remind you of your duties to the members of my family. I said to her: If your family so desires; I am prepared to make them the full payment in one instalment; and thus secure freedom for you; but the right of inheritance will vest in me; if I do so. She Barira made a mention of that to her family; but they refused except on the condition that the right of inheritance would vest in them. She came to me and made mention of if She Aisha said: I scolded her. She Barira said: By Allah; it is not possible they will never agree to it. And as she was saying it; Allah messenger ﷺ heard; and he asked me; I informed him and he said: Buy her and emancipate her; and let the right of inherit- ance vest in them; for they cannot claim it rightfully since the right of inherritance vests with one who emancipates the slave; therefore; these people have no right to lay such false claims. It was said: It was a gift to us from so and so. So the Messenger of Allah s.a.w said: O Abu Huraira I said: I am here O Messenger of Allah! He said: Go to the people of AlSuffah to invite them. - Now; they were the guests of the people of Islam; they had nothing of people nor wealth to rely upon. Whenever some charity was brought to him; he would send it to them without using any of it. And when a gift was given to him s.a.w ; he would send for them to participate and share with him in it. I became upset about that; and I said to myself : What good will this bowl be among the people of AlSuffah and I am the one bringing it to them? Then he ordered me to circulate it among them So I wondered what of it would reach me from it; and I hoped that I would get from it what would satisfy me. But I would certainly not neglect to obey Allah and obey His Messenger; so I went to them and invited them. When they entered upon him they sat down. He said: Abu Huraira; take the bowl and give it to them. So I gave it to a man who drank his fill; then he gave it to another one; until it ended up with the Messenger of Allah s.a.w ; and all of the people had drank their fill. The Messenger of Allah s.a.w took the bowl; put it on his hand;then raised his head. He smiled and said: Abu Huraira; drink. So I drank; then he said: Drink. One of them said: O Messenger of Allah; pass judgment between us according to the Book of Allah. The other; who was wiser; said: Yes; O Messenger of Allah; and allow me to speak. He said: My son was a laborer serving this man; and he committed Zina with his wife. They told me that my son was to be stoned to death; but I ransomed him with one hundred sheep and a slave girl of mine. Then I asked the people of knowledge; who told me that my son was to be given one hundred lashes and exiled for a year; and that his the mans wife was to be stoned to death. The Messenger of Allah SAWSYMOBOL said: By the One in Whose hand is my soul; I will pass judgment between you according to the Book of Allah. As for your sheep and your slave girl; take them back. | SunanAlNasai-017-001-14951 | It was narrated that Aisha said: Barirah made a contract that she would be freed in return for nine Awaq; one Uqiyah to be paid each year. She came to Aisha asking for help and she said: No; not unless they agree to accept the sum in one payment; and that the Wala will go to me. Barirah went and spoke to her masters but they insisted that the Wala should be for them. She came to Aisha and the Messenger of Allah came; and she told her what her masters had said. She said: No; by Allah; not unless Wala is to me. The Messenger of Allah said: What is this? She said: O Messenger of Allah; Barirah came to me and asked me to help her with her contract of manumission; and I said no; not unless they agree to accept the sum in one payment; and that the Wala will be for me. She mentioned that to her masters and they insisted that the Wala should be for them. The Messenger of Allah said: Buy her; and stipulate that the Wala is for the one who sets the slave free. Then he stood up and addressed the people and said: What is the matter with people who stipulate conditions that are not in the Book of Allah; the Mighty and Sublime? They say: I set so-and-so free but the Wala will be to me. Every condition that is not in the Book of Allah; the Mighty and Sublime; is a false condition; even if there are a hundred conditions. And the Messenger of Allah gave her the choice with regard to her husband who was still a slave; and she chose herself. | SunanAbuDawoud-017-001-25003 | Narrated Abdullah Ibn Abbas: Ibn Umar misunderstood the Quranic verse; So come to your tilth however you will -may Allah forgive him. The fact is that this clan of the Ansar; who were idolaters; lived in the company of the Jews who were the people of the Book. They the Ansar accepted their superiority over themselves in respect of knowledge; and they followed most of their actions. The people of the Book i.e. the Jews used to have intercourse with their women on one side alone i.e. lying on their backs. This was the most concealing position for the vagina of the women. This clan of the Ansar adopted this practice from them. But this tribe of the Quraysh used to uncover their women completely; and seek pleasure with them from in front and behind and laying them on their backs. When the muhajirun the immigrants came to Medina; a man married a woman of the Ansar. He began to do the same kind of action with her; but she disliked it; and said to him: We were approached on one side i.e. lying on the back ; do it so; otherwise keep away from me. This matter of theirs spread widely; and it reached the Messenger of Allah ﷺ. So Allah; the Exalted; sent down the Quranic verse: Your wives are a tilth to you; so come to your tilth however you will; i.e. from in front; from behind or lying on the back. | SunanAbuDawoud-017-001-25970 | Narrated AlBara Ibn Azib: We went out with the Messenger of Allah ﷺ accompanying the bier of a man of the Ansar. When we reached his grave; it was not yet dug. So the Messenger of Allah ﷺ sat down and we also sat down around him as if birds were over our heads. He had in his hand a stick with which he was scratching the ground. He then raised his head and said: Seek refuge with Allah from the punishment in the grave. He said it twice or thrice. The version of Jabir adds here: He hears the beat of their sandals when they go back; and at that moment he is asked: O so and so! Who is your Lord; what is your religion; and who is your Prophet? Hannad version says: Two angels will come to him; make him sit up and ask him: Who is your Lord? He will reply: My Lord is Allah. They will ask him: What is your religion? He will reply: My religion is Islam. They will ask him: What is your opinion about the man who was sent on a mission among you? He will reply: He is the Messenger of Allah ﷺ. They will ask: Who made you aware of this? He will reply: I read Allah Book; believed in it; and considered it true; which is verified by Allah words: Allah Book; believed in it; and considered it true; which is verified by Allah words: Allah establishes those who believe with the word that stands firm in this world and the next. The agreed version reads: Then a crier will call from Heaven: My servant has spoken the truth; so spread a bed for him from Paradise; clothe him from Paradise; and open a door for him into Paradise. So some of its air and perfume will come to him; and a space will be made for him as far as the eye can see. He also mentioned the death of the infidel; saying: His spirit will be restored to his body; two angels will come to him; make him sit up and ask him: Who is your Lord? He will reply: Alas; alas! I do not know. They will ask him: What is your religion? He will reply: Alas; alas! I do not know. They will ask: Who was the man who was sent on a mission among you? He will reply: Alas; alas! He then questioned the people; and AlMughirah Ibn Shubah said: I had been present with the Messenger of Allah ﷺ when he gave grandmother a sixth. Abu Bakr said: Is there anyone with you? Muhammad Ibn Maslamah stood and said the same as AlMughirah Ibn Shubah had said. So Abu Bakr made it apply to her. One of them said; Messenger of Allah! Judge between us by the Book of Allah! The other said; and he was the wiser of the two; Yes; Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. Then he raised his hands to the sky and said; O Allah! I have become old and my strength has weakened. My flock is scattered. Take me to You with nothing missed out and without having neglected anything. Then he went to Madina and addressed the people. He said; People! Sunan have been laid down for you. Obligations have been placed upon you. You have been left with a clear way unless you lead people astray right and left. He struck one of his hands on the other and then said; Take care lest you destroy the ayat of stoning so that one will say; We do not find two hadds in the Book of Allah. | MuwataMalik-017-001-34824 | Malik related to me that he had heard that Abdullah Ibn Umar was asked whether a slave could be bought on the specific condition that it was to be used to fulfil the obligation of freeing a slave; and he said; No. Malik said; That is the best of what I have heard on the obligation of freeing slaves. Someone who has to set a slave free because of an obligation on him; may not buy one on the condition that he sets it free because if he does that; whatever he buys is not completely a slave because he has reduced its price by the condition he has made of setting it free. Malik added; There is no harm; however; in someone buying a person expressly to set him free. Malik said; The best of what I have heard on the obligation of freeing slaves is that it is not permitted to free a christian or a jew to fulfil it; and one does not free a mukatab or a mudabbar or an umm walad or a slave to be freed after a certain number of years; or a blind person. There is no harm in freeing a christian; jew; or magian voluntarily; because Allah; the Blessed; the Exalted; said in His Book; either as a favour then or by ransom; Surat 47 ayat 4 The favour is setting free. Malik said; As for obligations of freeing slaves which Allah has mentioned in the Book; one only frees a mumin slave for them. Malik said; It is like that in feeding poor people for kaffara. Aisha said; If your people agree that I pay it all to them for you; and that if I pay it; your wala is mine; then I will do it. Barira went to her masters and told them that and they didnt agree. She came back from her masters while the Messenger of Allah; may Allah bless him and grant him peace; was sitting. She said to Aisha; I offered that to them and they refused me unless they had the wala. The Messenger of Allah; may Allah bless him and grant him peace; heard that and asked her about it Aisha told him and the Messenger of Allah; may Allah bless him and grant him peace; said; Take her and stipulate that the wala is yours; for the wala is for the one who sets free. So Aisha did that and then the Messenger of Allah; may Allah bless him and grant him peace; stood up in front of the people; and praised Allah and gave thanks to Him. Abu Bakr said to her; You have nothing in the Book of Allah; and I do not know that you have anything in the sunna of the Messenger of Allah; may Allah bless him and grant him peace. Go away therefore; until I have questioned the people. i.e.the Companions. He questioned the people; and AlMughira Ibn Shuba said; I was present with the Messenger of Allah; may Allah bless him and grant him peace; when he gave the grandmother a sixth. | MuwataMalik-017-001-35151 | Malik said; The generally agreed on way of doing things among us in which there is no dispute and which I saw the people of knowledge in our citydoing; is that the child of the half-sibling by the mother; the paternal grandfather; the paternal uncle who is the maternal half- brother of the father; the maternal uncle; the great-grandmother who is the mother of the mother father; the daughter of the full- brother; the paternal aunt; and the maternal aunt do not inherit anything by their kinship. Malik said; The woman who is the furthest relation of the deceased of those who were named in this book; does not inherit anything by her kinship; and women do not inherit anything apart from those that are named in the Quran. Allah; the Blessed; the Exalted; mentioned in His Book the inheritance ofthe mother from her children; the inheritance of the daughters from their father; the inheritance of the wife from her husband; the inheritance of the full sisters; the inheritance of the half-sisters by the father and the inheritance of the half-sisters by the mother. The grandmother is made an heir by the example of the Prophet; may Allah bless him and grant him peace; made about her. | MuwataMalik-017-001-35594 | Yahya related to me from Malik that he had heard that Umar Ibn Abd AlAziz wrote to his governors telling them to relieve any people who payed the jizya from paying the jizya if they became muslims. Malik said; The sunna is that there is no jizya due from women or children of people of the Book; and that jizya is only taken from men who have reached puberty. The people of dhimma and the magians do not have to pay any zakat on their palms or their vines or their crops or their livestock. This is because zakat is imposed on the muslims to purify them and to be given back to their poor; whereas jizya is imposed on the people of the Book to humble them. As long as they are in the country they have agreed to live in; they do not have to pay anything on their property except the jizya. If; however; they trade in muslim countries; coming and going in them; a tenth is taken from what they invest in such trade. This is because jizya is only imposed on them on conditions; which they have agreed on; namely that they will remain in their own countries; and that war will be waged for them on any enemy of theirs; and that if they then leave that land to go anywhere else to do business they will haveto pay a tenth. Whoever among them does business with the people of Egypt; and then goes to Syria; and then does business with the people of Syria and then goes to Iraq and does business with them and then goes on to Madina; or Yemen; or other similar places; has to pay a tenth. People of the Book and magians do not have to pay any zakat on any of their property; livestock; produce or crops. The sunna still continues like that. They remain in the deen they were in; and they continue to do what they used to do. If in any one year they frequently come and go in muslim countries then they have to pay a tenth every time they do so; since that is outside what they have agreed upon; and not one of the conditions stipulated for them. Surat 62 ayat 9. Ibn Shihab said; Umar Ibn AlKhattab used to recite; When the call is made for the prayer on the day of jumua; go to the remembrance of Allah. Malik said; Making haste in the Book of Allah is only deed and action. Allah the Blessed; the Exalted; says and when he turns away; he acts in the land Surat 2 ayat 205 ; and He; the Exalted; said; and as for the one who comes to you acting with fear Surat 80 ayat 8 ; and He said; then he turned his back; and acted Surat 79 ayat 22 ;and He said; Your deeds are diverse Surat 92 ayat 4. Malik said; Thus making haste which Allah mentions in His Book is not running on the feet or exertion.
