SahihMuslim-017-001-17524Abu Mousa AlAshari reported: I came to Allah Apostle ﷺ along with a group of Asharites requesting to give us a mount. He the Holy Prophet said: By Allah; I cannot provide you with a mount; and there is nothing with me which I should give you as a ride. He the narrator said: We stayed there as long as Allah willed. Then there were brought to him to the Holy Prophet camels. He the Holy Prophet then ordered to give us three white humped camels; We started and said or some of us said to the others : Allah will not bless us. We came to Allah Messenger ﷺ begging him to provide us with riding camels. He swore that he could not provide us with a mount; but later on he provided us with that. They some of the Prophet Companions came and informed him about this rankling of theirs ; whereupon he said: It was not I who provided you with a mount; but Allah has provided you with that. He Abu Masa said: Come on; for I saw Allah Messenger ﷺ eating it fowl meat ; whereupon that person said: I saw it eating something of filth and rubbish and I found it repugnant and took an oath that I would never eat that. He Abu Muds said: Come; so that I would narrate to you about that the incident pertaining to vow. And he narrated thus : I came to Allah Messenger ﷺ along with a group of people belonging to the tribe of Ashari; asking him to provide us with riding camels. He the Holy Prophet said: By Allah; I cannot provide you with riding animals. And there is nothing with me with which I can provide you a mount. We stayed for some time there as Allah willed; and there was brought to Allah Messenger ﷺ booty of camels. He called us and commanded that we should be given five white humped camels. As we were about to go back; some of us said to the other: As we made Allah Messenger ﷺ forget oath; there would be no blessing for us in his gift. We went back to him and said: Allah Messenger; we came to you to provide us with riding animals and you took an oath that you would never equip us with mounts and then you have provided us with the riding beasts Allah Messenger; have you forgotten? Thereupon he said: I swear by Allah that if Allah so wills; I shall not swear an oath; and then consider something else to be better than it without making atonement for my oath and doing the thing that is better. SunanAbuDawoud-017-001-24690Narrated Aisha; Ummul Muminin: Zurarah Ibn Awuf a said that Aisha was asked about the midnight prayer of the Messenger of Allah ﷺ. She said: He used to offer his night prayer in congregation and then return to his family in his house and pray four rakahs. Then he would go to his bed and sleep; but the water for his ablution was placed covered near his head and his tooth-stick was also kept there until Allah awakened him at night. He then used the tooth-stick; performed ablution perfectly then came to the place of prayer and would pray eight rakahs; in which he would recite Surah AlFatihah; and a surah from the Quran as Allah willed. He would not sit during any of them but sit after the eighth rakah; and would not utter the salutation; but recite the Quran during the ninth rakah. Then he would sit and supplicate as long as Allah willed; and beg Him and devote his attention to Him; He would utter the salutation once in such a loud voice that the inmates of the house were almost awakened by his loud salutation. He would then recite Surah AlFatihah while sitting; bow while sitting; and then recite the Quran during the second rakah; and would bow and prostrate while sitting. He would supplicate Allah as long as He willed; then utter the salutation and turn away. This amount of prayer of the Messenger of Allah ﷺ continued till he put a weight. During that period he retrenched two rakahs from nine and began to pray six and seven rakahs standing and two rakahs sitting. This continued till he died. The Chapter on Bowing In Prayers And Alquran in HodHood Indexing, Chapter on On The Night Prayer in Sunan Abu Dawoud

I bear witness that I heard the Messenger of Allah ﷺ say: Allah; the Exalted; has made five prayers obligatory. If anyone performs ablution for them well; offers them at their right time; and observes perfectly their bowing and submissiveness in them; it is the guarantee of Allah that He will pardon him; if anyone does not do so; there is no guarantee for him on the part of Allah; He may pardon him if He wills; and punish him if He wills. The Chapter on Bowing In Prayers And Alquran in HodHood Indexing, Chapter on Preserving The Prayer Times in Sunan Abu Dawoud

The speech dearest to me is the one which is true; so choose one of the two either the captives or the property. They said We choose our captives. The Apostle of Allaah ﷺ stood up; extolled Allaah and then said To proceed; your brethren have come repentant I have considered that I should return their captives to them; so let those of you who are willing to release the captives act accordingly; but those who wish to hold on to what they have till we give them some of the first booty Allaah gives us may do so. The people said We are willing for that to release their captives ; Apostle of Allaah. The Apostle of Allaah ﷺ said We cannot distinguish between those of you who have granted that and those who have not ; so return till your headmen may tell us about your affair. MuwataMalik-017-001-34886Malik related to me from Abdullah Ibn Abi Bakr Ibn Hazm that Amr Ibn Sulaym AlZuraqi informed his father that it had been said to Umar Ibn AlKhattab; There is here an adolescent boy who has not yet reached puberty. He is from the Ghassan tribe and his heir is in AlAsh Sham. He has property. Here he only has the daughter of one of his paternal uncles. Umar Ibn AlKhattab instructed; Let him leave her a bequest. He willed her a property called the well of Jusham. Malik added; That property was sold for 30;000 dirhams; and the daughter of the paternal uncle to whom he willed it was the mother of Amr Ibn Sulaym AlZuraqi. The Chapter on Contracts And Disputes In Properties And Money in HodHood Indexing, The Book of Hair in Muwata Malik
MuwataMalik-017-001-34887Malik related to me from Yahya Ibn Said from Abu Bakr Ibn Hazm that a boy from Ghassan was dying in Madina while his heir was in Syria. That was mentioned to Umar Ibn AlKhattab. It was said to him; So-and-so is dying. Shall he make a bequest? He said; Let him make a bequest. Yahya Ibn Said said that Abu Bakr had said; He was a boy of ten or twelve years. Yahya said; He willed the well of Jusham; and his people sold it for 30;000 dirhams. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community is that a simpleton; an idiot; or a lunatic who recovers at times; can make wills if they have enough of their wits about them to recognise what they will. Someone who has not enough wits to recognise what he wills; and is overcome in his intellect; cannot make a bequest. The Chapter on Worship And Forbidden Acts in HodHood Indexing, The Book of Hair in Muwata Malik
MuwataMalik-017-001-34888Malik related to me from Ibn Shihab from Amir Ibn Sad Ibn Abi Waqqas that his father said; The Messenger of Allah; may Allah bless him and grant him peace; came to me to treat me for a pain which became hard to bear in the year of the farewell hajj. I said; Messenger of Allah; you can see how far the pain has reached me. I have property and only my daughter inherits from me. Shall I give two thirds of my property as sadaqa? The Messenger of Allah; may Allah bless him and grant him peace; said; No. I said; Half? He said; No. Then the Messenger of Allah; may Allah bless him and grant him peace; said; A third; and a third is a lot. Leaving your heirs rich is better than leaving them poor to beg from people. You never spend anything on maintenance desiring the Face of Allah by it; but that you are rewarded for it; even what you appoint for your wife. Sad said; Messenger of Allah; will I be left here in Makka after my companions have departed for Madina? The Messenger of Allah; may Allah bless him and grant him peace; said; If you are left behind; and do sound deeds you will increase your degree and elevation by them. Perhaps you will be left behind so that some people may benefit by you and others may be harmed by you. O Allah! complete their hijra for my companions; and do not turn them back on their heels. The unfortunate one is Said Ibn Khawla. The Messenger of Allah; may Allah bless him and grant him peace; was distressed on his account for he had died at Makka. Yahya said that he heard Malik speak about a man who willed a third of his property to a man and said as well; My slave will serve so-and-so another man for as long as he lives; then he is free; then that was looked into; and the slave was found to be a third of the property of the deceased. Malik said; The service of the slave is evaluated. Then the two of them divide it between them. The one who was willed a third takes his third; as a share; and the one who was willed the service of the slave takes what was evaluated for him of the slave service. Each of them takes; from the service of the slave or from his wage if he has a wage; according to his share. If the one who was given the service of the slave for as long as he lived dies; then the slave is freed. Yahya said that he heard Malik speak about someone who willed his third and said So-and-so has such- and-such; and so-and-so has such-and-such; naming some of his property; and his heirs protested that it was more than a third. Malik said; The heirs then have an option between giving the beneficiaries their full bequests and taking the rest of the property of the deceased; or between dividing among the beneficiaries the third of the property of the deceased and surrendering to them their third. If they wish; their rights in it reach as far as they reach. The Chapter on Slave As A Property in HodHood Indexing, The Book of Hair in Muwata Malik
