In what ye leave, their share is a fourth, if ye leave no child; but if ye leave a child, they get an eighth; after payment of legacies and debts. If the man or woman whose inheritance is in question, has left neither ascendants nor descendants, but has left a brother or a sister, each one of the two gets a sixth; but if more than two, they share in a third; after payment of legacies and debts; so that no loss is caused (to any one). Thus is it ordained by Allah; and Allah is All-knowing, Most Forbearing.

For parents, a sixth share of the inheritance to each, if the deceased left children; if no children, and the parents are the (only) heirs, the mother has a third; if the deceased Left brothers (or sisters) the mother has a sixth. (The distribution in all cases ('s) after the payment of legacies and debts. Ye know not whether your parents or your children are nearest to you in benefit. These are settled portions ordained by Allah; and Allah is All-knowing, Al-wise.
Surat AlMumtahanah Ayah 10Surat AlMumtahanah0.1991يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا جَاءَكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ اللَّهُ أَعْلَمُ بِإِيمَانِهِنَّ فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلَا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لَا هُنَّ حِلٌّ لَهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ وَآتُوهُمْ مَا أَنْفَقُوا وَلَا جُنَاحَ عَلَيْكُمْ أَنْ تَنْكِحُوهُنَّ إِذَا آتَيْتُمُوهُنَّ أُجُورَهُنَّ وَلَا تُمْسِكُوا بِعِصَمِ الْكَوَافِرِ وَاسْأَلُوا مَا أَنْفَقْتُمْ وَلْيَسْأَلُوا مَا أَنْفَقُوا ذَلِكُمْ حُكْمُ اللَّهِ يَحْكُمُ بَيْنَكُمْ وَاللَّهُ عَلِيمٌ حَكِيمٌO ye who believe! When there come to you believing women refugees, examine (and test) them: Allah knows best as to their Faith: if ye ascertain that they are Believers, then send them not back to the Unbelievers. They are not lawful (wives) for the Unbelievers, nor are the (Unbelievers) lawful (husbands) for them. But pay the Unbelievers what they have spent (on their dower), and there will be no blame on you if ye marry them on payment of their dower to them. But hold not to the guardianship of unbelieving women: ask for what ye have spent on their dowers, and let the (Unbelievers) ask for what they have spent (on the dowers of women who come over to you). Such is the command of Allah: He judges (with justice) between you. And Allah is Full of Knowledge and Wisdom.
Surat AlTaubah Ayah 99Surat AlTaubah0.37113وَمِنَ الْأَعْرَابِ مَنْ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ وَيَتَّخِذُ مَا يُنْفِقُ قُرُبَاتٍ عِنْدَ اللَّهِ وَصَلَوَاتِ الرَّسُولِ أَلَا إِنَّهَا قُرْبَةٌ لَهُمْ سَيُدْخِلُهُمُ اللَّهُ فِي رَحْمَتِهِ إِنَّ اللَّهَ غَفُورٌ رَحِيمٌBut some of the desert Arabs believe in Allah and the Last Day, and look on their payments as pious gifts bringing them nearer to Allah and obtaining the prayers of the Messenger. Aye, indeed they bring them nearer (to Him): soon will Allah admit them to His Mercy: for Allah is Oft-forgiving, Most Merciful.

Umar said to him; Havent I been told that you do certain jobs for the people but when you are given payment you refuse to take it? Abdullah added: I said; Yes. Umar said; Why do you do so? I said; I have horses and slaves and I am living in prosperity and I wish that my payment should be kept as a charitable gift for the Muslims. Umar said; Do not do so; for I intended to do the same as you do. Allah Messenger ﷺ s used to give me gifts and I used to say to him; Give it to a more needy one than me. Once he gave me some money and I said; Give it to a more needy person than me; whereupon the Prophet ﷺ said; Take it and keep it in your possession and then give it in charity. In this altercation their voices became loud; until Allah Messenger ﷺ heard them; while he was in the house; so Allah Messenger ﷺ came out towards them; and he lifted the curtain of his apartment and he called upon Kaab Bin Malik and said: O Ka Bin He said: At thy beck and call; Allah Messenger. He pointed out with the help of his hand to remit half of the loan due to him. SahihMuslim-017-001-18229Kaab Bin Malik reported that he made a demand for the payment of the debt that Ibn Abu Hadrad owed to him. And as she was saying it; Allah messenger ﷺ heard; and he asked me; I informed him and he said: Buy her and emancipate her; and let the right of inherit- ance vest in them; for they cannot claim it rightfully since the right of inherritance vests with one who emancipates the slave; therefore; these people have no right to lay such false claims. And I did so. She Aisha said: Then Allah Messenger ﷺ delivered a sermon in the evening. He extolled Allah and praised Him with what He deserves; and then said afterwards;: What has happened to the people that they lay down conditions which are not found in the Book of Allah? And the condition which is not found in the Book of Allah is invalid; even if its number is one hundred. The Book of Allah is more true than any other deed and the condition laid down by Allah is more binding than any other condition. What has happened to the people among you that someone among you says: Emancipate so and so; but the right of inheritance vests in me? SunanAlNasai-017-001-14951It was narrated that Aisha said: Barirah made a contract that she would be freed in return for nine Awaq; one Uqiyah to be paid each year. She came to Aisha asking for help and she said: No; not unless they agree to accept the sum in one payment; and that the Wala will go to me. Barirah went and spoke to her masters but they insisted that the Wala should be for them. She came to Aisha and the Messenger of Allah came; and she told her what her masters had said. She said: No; by Allah; not unless Wala is to me. The Messenger of Allah said: What is this? She said: O Messenger of Allah; Barirah came to me and asked me to help her with her contract of manumission; and I said no; not unless they agree to accept the sum in one payment; and that the Wala will be for me. She mentioned that to her masters and they insisted that the Wala should be for them. The Messenger of Allah said: Buy her; and stipulate that the Wala is for the one who sets the slave free. Then he stood up and addressed the people and said: What is the matter with people who stipulate conditions that are not in the Book of Allah; the Mighty and Sublime? They say: I set so-and-so free but the Wala will be to me. Every condition that is not in the Book of Allah; the Mighty and Sublime; is a false condition; even if there are a hundred conditions. And the Messenger of Allah gave her the choice with regard to her husband who was still a slave; and she chose herself. He said: Wait till I receive the sadaqah and I shall order it to be given to you. He then said : Begging; Qabisah; is allowable only to one of three classes: a man who has become a guarantor for a payment to whom begging is allowed till he gets it; after which he must stop begging ; a man who has been stricken by a calamity and it destroys his property to whom begging is allowed till he gets what will support life or he said; what will provide a reasonable subsistence ; and a man who has been smitten by poverty; about whom three intelligent members of his people confirm by saying: So and so has been smitten by poverty; to such a person begging is allowed till be gets what will support life or he said; what will provide a reasonable subsistence ; after which he must stop begging. MuwataMalik-017-001-34978Malik related to me that he heard Rabia Ibn Abi Abdulrahman and others mention that AlFurafisa Ibn Umar AlHanafi had a mukatab who offered to pay him all of his kitaba that he owed. AlFurafisa refused to accept it and the mukatab went to Marwan Ibn AlHakam who was the amir of Madina and brought up the matter. Marwan summoned AlFurafisa and told him to accept. He refused. Marwan then ordered that the payment be taken from the mukatab and placed in the treasury. He said to the mukatab Go; you are free. When AlFurafisa saw that; he took the money. Malik said; What is done among us when a mukatab pays all the instalments he owes before their term; is that it is permitted to him. The master cannot refuse him that. That is because payment removes every condition from the mukatab as well as service and travel. The setting free of a man is not complete while he has any remaining slavery; and neither would his inviolability as a free man be complete and his testimony permitted and inheritance obliged and such things in that situation. His master must not make any stipulation of service on him after he has been set free. Malik said that it was permitted for a mukatab who became extremely ill and wanted to pay his master all his instalments because his heirs who were free would then inherit from him and he had no children with him in his kitaba; to do so; because by that he completed his inviolability as a free man; his testimony was permitted; and his admission of what he owed of debts to people was permitted. His bequest was permitted as well. MuwataMalik-017-001-35009Yahya said that Malik said; The generally agreed on way of doing things among us about an investor who pays qirad money to an agent to buy goods; and the agent then sells the goods for a price to be paid later; and has a profit in the transaction; then the agent dies before he has received payment; is that if his heirs want to take that money; they have their father stipulated portion from the profit. That is theirs if they are trustworthy to take the payment. If they dislike to collect it from the debtor and they refer him to the investor; they are not obliged to collect it and there is nothing against them and nothing for them by their surrendering it to the investor. If they do collect it; they have a share of it and expenses like their father had. They are in the position of their father. If they are not trustworthy to do so; they can bring someone reliable and trustworthy to collect the money. If he collects all the capital and all the profit; they are in the position of their father. Malik spoke about an investor who paid qirad money to a man provided that he used it and was responsible for any delayed payment for which he sold it. He said; This is obligatory on the agent. This is because the only zakat which an owner of livestock has to pay is what is due from him on the day that the zakat is actually assessed. His livestock may have died or it may have increased; and the zakat collector only assesses the zakat on what he actually finds on the day he makes the assessment.
