Give your verdict according to Allah Laws in our case. Then his opponent got up and said; He has told the truth; O Allah Messenger ﷺ ! Decide his case according to Allah Laws. My son was a laborer working for this person; and he committed illegal sexual intercourse with his wife; and the people told me that my son should be stoned to death; but I offered one-hundred sheep and a slave girl as a ransom for him. Then I asked the religious learned people; and they told me that my son should be flogged with one-hundred stripes and be exiled for one year. The Prophet ﷺ said; By Him in Whose Hand my soul is; I will judge you according to Allah Laws. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you; O Unais! Go to the wife of this man and if she confesses ; stone her to death. No doubt; the people are talking much about AlWalid. Uthman said; Did you receive your knowledge directly from Allah Messenger ﷺ ? I said; No; but his knowledge did reach me and it reached even to a virgin in her seclusion. Uthman said; And then Allah sent Muhammad with the Truth and I was amongst those who followed Allah and His Apostle and I believed in what ever he i.e. the Prophet was sent with; and participated in two migrations; as you have said; and I enjoyed the company of Allah Messenger ﷺ and gave the pledge of allegiance him. By Allah! I never disobeyed him; nor did I cheat him till Allah took him unto Him. Then I treated Abu Bakr and then Umar similarly and then I was made Caliph. So; dont I have rights similar to theirs? I said; Yes. He said; Then what are these talks reaching me from you people? Now; concerning what you mentioned about the question of AlWalid; Allah willing; I shall deal with him according to what is right. The people were speaking against the latter for what he had done. I seek Refuge with Allah from you. So I went away. When I finished my prayer; I sat with AlMiswar and Ibn Abu Yaghutb and talked to both of them of what I had said to Uthman and what he had said to me. They said; You have done your duty. So while I was sitting with them. Uthman Messenger came to me. They said; Allah has put you to trial. I set out and when I reached Uthman; he said; What is your advice which you mentioned a while ago? I recited Tashahhud and added; Allah has sent Muhammad and has revealed the Holy Book i.e. Quran to him. You O Uthman! were amongst those who responded to the call of Allah and His Apostle and had faith in him. And you took part in the first two migrations to Ethiopia and to Medina ; and you enjoyed the company of Allah Messenger ﷺ and learned his traditions and advice. Now the people are talking much about AlWalid Bin Uqba and so it is your duty to impose on him the legal punishment. Uthman then said to me; O my nephew! Did you ever meet Allah Messenger ﷺ ? I said; No; but his knowledge has reached me as it has reached the virgin in her seclusion. Uthman then recited Tashahhud and said; No doubt; Allah has sent Muhammad with the Truth and has revealed to him His Holy Book i.e. Quran and I was amongst those who responded to the call of Allah and His Apostle and I had faith in Muhammad Mission; and I had performed the first two migrations as you have said; and I enjoyed the company of Allah Messenger ﷺ and gave the pledge of allegiance to him. By Allah; I never disobeyed him and never cheated him till Allah caused him to die. Then Allah made Abu Bakr Caliph; and by Allah; I was never disobedient to him; nor did I cheat him. Then Umar became Caliph; and by Allah; I was never disobedient to him; nor did I cheat him. Then I became Caliph. Have I not then the same rights over you as they had over me? I replied in the affirmative. Uthman further said; The what are these talks which are reaching me from you? SunanAlNasai-017-001-12275It was narrated from Amr Bin Shuaib; from his father; that his grandfather Abdullah Bin Amr; that a man from Muzainah came to the Messenger of Allah and said: O Messenger of Allah; what do you think about a sheep stolen from the pasture? He said: The thief must pay double and be punished. There is no cutting off of the hand for stealing livestock; except what which has been put in the pen; if its value is equal to that of a shield; in which case the thiefs hand is to be cut off. If its value is not equal to that of a shield; then he should pay a penalty of twice its value and be flogged as a punishment. He said: O Messenger of Allah! What do you think about fruit on the tree? He said: The thief must pay double and be punished. The Prophet ﷺ said: She will get the dower; for you made her vagina lawful for you. The child will be your slave. When she has begotten a child ; flog her according to the version of AlHasan. The version of Ibn AbusSari has: You people; flog her; or said: inflict hard punishment on him.Abu Dawud said: This tradition has been transmitted by Qatadah from Saad Bin Yazid on the authority of Ibn AlMusayab in a similar way. This tradition has been narrated by Yahya Bin Abi Kathir from Yazid Bin Nuaim from Saeed Bin AlMusayab; and Ata AlKhurasani narrated it from Saeed Bin AlMusayab ; they all narrated this tradition from the Prophet ﷺ omitting the link of the Companion i.e. a mursal tradition. The version of Yahya Bin Abi Kathir has: Basrah Bin Aktham married a woman. I swear by Allaah; I shall ask the Apostle of Allaah ﷺ about it. On the next day he came to the Apostle of Allaah ﷺ and said If a man finds a man along with wife and declares about her adultery you will flog him. So; the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet ﷺ said Do not do that. Bust she refused and did so i.e.; invoked curses. If he does it again a third or a fourth time; kill him. A man who had drunk wine was brought to him and he gave him lashes. He was again brought to him; and he flogged him. He was again brought to him and he flogged him. He was again brought to him and he flogged him. The punishment of killing for drinking was repealed; and a concession was allowed.Sufyan said: AlZuhri transmitted this tradition when Mansur Bin AlMutamir amd Mukhawal Bin Rashid were present with him. MuwataMalik-017-001-34785Malik related to me from Zurayq Ibn Hakim AlAyli that a man called Misbah asked his son for help and he thought him unnecessarily slow. When the son came; his father said to him; O fornicator. Zurayq said; So the son asked me to help him against the father. When I wanted to flog him; his son said; By Allah; if you flog him; I will acknowledge that I have committed fornication. When he said that; the situation was confused for me; so I wrote about it to Umar Ibn Abd AlAziz who was the governor at that time; and I mentioned it to him. Umar wrote me to permit his pardon. Zurayq said; I wrote to Umar Ibn Abd AlAziz also; What do you think about a man who is slandered or his parents are slandered and both or only one of them are dead? He said; Umar wrote to me; If he forgives; his pardon is permitted for himself. If his parents are slandered and one or both of them are dead; take the judgement of the Book of Allah for it unless he wants to veil it. Yahya said; I heard Malik say; That is because the slandered man might fear that if that is unveiled about him; a clear proof might be established. MuwataMalik-017-001-34786Malik related to me from Hisham Ibn Urwa that his father said that there was only one hadd against a man who slandered a group of people. Malik said; If they are on separate occasions there is still only one hadd against him. Malik related to me from Ab AlRijal Muhammad Ibn Abdulrahman Ibn Haritha Ibn AlNuman AlAnsari; then from the Banun-Najar from his mother Amra bint Abdulrahman that two men cursed each other in the time of Umar Ibn AlKhattab. One of them said to the other; By Allah; my father is not an adulterer and my mother is not an adulteress. Umar Ibn AlKhattab asked advice about that. One person said; He has praised his father and mother. Another said; His father and mother have praise other than this. We think that he is to be flogged with the hadd. So Umar flogged him with the hadd of eighty lashes. Malik said; There is no hadd in our view except for slander; denial or insinuation; in which one sees that the speaker intends by that denial or slander. Then the hadd is completely imposed on the one who said it. Malik said; What is done in our community when a man denies that another man is from his father; is that he deserves the hadd. MuwataMalik-017-001-34903Yahya said from Malik that he heard from Sulayman Ibn Yasar and others that when they were asked whether the testimony of a man flogged for a hadd crime was permitted; they said; Yes; when repentance tawba appears from him. Malik related to me that he heard Ibn Shihab being asked about that and he said the like of what Sulayman Ibn Yasar said. Malik said; That is what is done in our community. It is by the word of Allah; the Blessed; the Exalted; And those who accuse women who are muhsan; and then do not bring four witnesses; flog them with eighty lashes; and do not accept any testimony of theirs ever. They indeed are evil-doers; save those who turn in tawba after that and make amends. Allah is Forgiving; Merciful.
