SunanAlNasai-017-001-14850It was narrated that Qubaisah Bin Mukhariq said: I undertook a financial responsibility; then I came to the Prophet and asked him for help concerning that. He said: Hold on; o Qubaisah! When we get some charity we will give you some. Then the Messenger of Allah said: O Qubaisah; charity is not permissible except for one of three: A man who undertakes a financial responsibility; so it is permissible for him to be given charity until he finds means to make him independent and to suffice him; a man who was stricken by calamity and his wealth was destroyed; so it is permissible for him to ask for help until he has enough to keep him going; them he should refrain from asking; and a man who is stricken with poverty and three wise men from among his own people testily that so-and-so is in desperate need; then it is permissible for him to ask for help until he finds means to make him independent and to suffice him. Should he kill him and then be killed by you; or how should he act? Ask the Apostle of Allaah ﷺ Aasi m; for me about it. Aasi m then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What Aasi m heard from the Apostle of Allaah ﷺ fell heavy on him. When Aasi m returned to his family Uwaimr came to him and asked Aasi m What did the Apostle of Allaah ﷺ say to you? Aasi m replied You did not do good to me. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon Uwaimir said I swear by Allaah; I shall not leave until I ask him about it. So; Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people. He said Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you; or how should he act? The Apostle of Allaah ﷺ said A revelation has been sent down about you and your wife so go away and bring her. Sahl said So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. He kept on praying until the verses regarding invoking curses lian came down As for those who accuse their wives but have no witnesses except themselves. So; the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. Then it comes down to the earth and its gates are locked against it. Then it goes right and left; and if it finds no place of entrance it returns to the thing which was cursed; and if it finds no place of entrance it returns to the thing which was cursed; and if it deserves what was said it enters it ; otherwise it returns to the one who uttered it.Abu Dawud said : Marwan Bin Muhammad said: He is Rabah Bin AlWalid who heard from him nimran. MuwataMalik-017-001-34525Yahya related to me from Malik from Abuz-Zinad from AlAraj from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; Shaytan ties three knots at the back of your head when you sleep; and he seals the place of each knot with You have a long night ahead; so sleep. If you wake up and remember Allah; a knot is untied. If you do Ablution; a knot is untied. He said; Memorize the characteristics of the object found; then publicise it for a year. If the owner comes; give it to him. If not; then it is your business. He said; What about lost sheep; Messenger of Allah? He said; They are yours; your brother or the wolfs. He said; And the lost camel? He said; It none of your concern. It has its water and its feet. It will reach water and eat trees until its owner finds it.The Chapter on Live Stock Ablution After Eating Meat in HodHood Indexing, The Book of The Description of the Prophet may Allah Bless Him and Grant Him Peace in Muwata Malik
MuwataMalik-017-001-34963Yahya said that he heard Malik say; What is done in our community about a slave who finds something and uses it before the term which is set for finds has been reached; and that is a year; is that it is against his person. Either his master gives the price of what his slave has used; or he surrenders his slave to them as compensation. If he withheld it until the term was reached which is set for finds and he used it; it is a debt against him which follows him and it is not against his person and there is nothing against his master in it.The Chapter on Slave As A Property in HodHood Indexing, The Book of The Description of the Prophet may Allah Bless Him and Grant Him Peace in Muwata Malik
MuwataMalik-017-001-35121Malik related to me from Yahya Ibn Said from Abu Bakr Ibn Muhammad Ibn Amr Ibn Hazm from Umar Ibn Abdal-Aziz from Abu Bakr Ibn Abdulrahman Ibn AlHarith Ibn Hisham from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; If anyone goes bankrupt; and a man finds his own property intact with him; he is more entitled to it than anyone else. Malik spoke about a man who sold a man wares; and the buyer went bankrupt. He said; The seller takes whatever of his goods he finds. If the buyer has sold some of them and distributed them; the seller of the wares is more entitled to them than the creditors. What the buyer has distributed does not prevent the seller from taking whatever of it he finds. It is the seller right if he has received any of the price from the buyer and he wants to return it to take what he finds of his wares; and in what he does not find; he is like the creditors. Malik spoke about some one who bought spun wool or a plot of land; and then did some work on it; like building a house on the plot of land or weaving the spun wool into cloth. Then he went bankrupt after he had bought it; and the original owner of the plot said; I will take the plot and whatever structure is on it. Malik said; That structure is not his. However; the plot and what is in it that the buyer has improved is appraised. Then one sees what the price of the plot is and how much of that value is the price of the structure. They are partners in that. The owner of the plot has as much as his portion; and the creditors have the amount of the portion of the structure. Malik said; The explanation of that is that the value of it all is fifteen hundred dirhams. The value of the plot is five hundred dirhams; and the value of the building is one thousand dirhams. The owner of the plot has a third; and the creditors have two-thirds. Malik said; It is like that with spinning and other things of the same nature in these circumstances and the buyer has a debt which he cannot pay. This is the behaviour in such cases. Malik said; As for goods which have been sold and which the buyer does not improve; but those goods sell well and have gone up in price; so their owner wants them and the creditors also want to seize them; then the creditors choose between giving the owner of the goods the price for which he sold them and not giving him any loss and surrendering his goods to him. If the price of the goods has gone down; the one who sold them has a choice. If he likes; he can take his goods and he has no claim to any of his debtor property; and that is his right. If he likes; he can be one of the creditors and take a portion of his due and not take his goods. That is up to him. Malik said about someone who bought a slave-girl or animal and she gave birth in his possession and the buyer went bankrupt; The slave-girl or the animal and the offspring belong to the seller unless the creditors desire it. In that case they give him his complete due and they take it.The Chapter on Financial Transaction And Lands in HodHood Indexing, The Book of Blood Money in Muwata Malik
MuwataMalik-017-001-35222Yahya related to me from Malik from Ibn Shihab that Sahl Ibn Sad AlSaidi told him that Uwaymir AlAjlani came to Aasi m Ibn Adi AlAnsari and said to him; Aasi m! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should.he do? Aasi m! ask the Messenger of Allah; may Allah bless him and grant him peace; about that for me. Aasi m asked the Messenger of Allah; may Allah bless him and grant him peace; about it. The Messenger of Allah; may Allah bless him and grant him peace; was revolted by the questions and reproved them until what he heard from the Messenger of Allah; may Allah bless him and grant him peace. was intolerable for Aasi m. When Aasi m returned to his people; Uwaymir came to him and said; Aasi m! what did the Messenger of Allah; may Allah bless him and grant him peace; say to you? Aasi m said to Uwaymir; You didnt bring me any good. The Messenger of Allah; may Allah bless him and grant him peace; was revolted by the question which I asked him. Uwaymir said; By Allah! I will not stop until I ask him about it! Uwaymir stood up and went to the Messenger of Allah; may Allah bless him and grant him peace; in the middle of the people and said; Messenger of Allah! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself; or what should he do? The Messenger of Allah; may Allah bless him and grant him peace; said; Something has been sent down about you and your wife; so go and bring her. Sahl continued; They mutually cursed one another in the presence of the Messenger; may Allah bless him and grant him peace; and I was present with the people. When they finished cursing each other; Uwaymir said; I shall have lied about her; Messenger of Allah; if I keep her; and pronounced the divorce three times before the Messenger of Allah; may Allah bless him and grant him peace; ordered him to do it. Malik said that Ibn Shihab said; That was how the sunna of a couple mutually cursing each other was established lian. The Chapter on Peace And Ablution in HodHood Indexing, The Book of Marriage in Muwata Malik
MuwataMalik-017-001-35574Yahya said that Malik said; The position with us concerning a man who has zakat to pay on one hundred camels but then the zakat collector does not come to him until zakat is due for a second timeand by that time all his camels have died except five; is that the zakat collector assesses from the five camels the two amounts of zakat that are due from the owner of the animals; which in this case is only two sheep; one for each year. This is because the only zakat which an owner of livestock has to pay is what is due from him on the day that the zakat is actually assessed. His livestock may have died or it may have increased; and the zakat collector only assesses the zakat on what he actually finds on the day he makes the assessment. If more than one payment of zakat is due from the owner of the livestock; he still only has to pay zakat according to what the zakat collector actually finds in his possession; and if his livestock has died; or several payments of zakat are due from him and nothing is taken until all his livestock has died; or has been reduced to an amount below that on which he has to pay zakat; then he does not have to pay any zakat; and there is no liability on him for what has died or for the years that have passed. The Chapter on Zakat Of Live Stock in HodHood Indexing, The Book of Itikaf in Ramadan in Muwata Malik
