SahihAlBukhari-017-001-1302Narrated AlMiswar Bin Makhrama: The group of people whom Umar had selected as candidates for the Caliphate gathered and consulted each other. Abdulrahman said to them; I am not going to compete with you in this matter; but if you wish; I would select for you a caliph from among you. So all of them agreed to let Abdulrahman decide the case. So when the candidates placed the case in the hands of Abdulrahman the people went towards him and nobody followed the rest of the group nor obeyed any after him. So the people followed Abdulrahman and consulted him all those nights till there came the night we gave the oath of allegiance to Uthman. AlMiswar bin Makhrama added: Abdulrahman called on me after a portion of the night had passed and knocked on my door till I got up; and he said to me; I see you have been sleeping! By Allah; during the last three nights I have not slept enough. Go and call AlZubair and Sad. So I called them for him and he consulted them and then called me saying; Call Ali for me. I called Ali and he held a private talk with him till very late at night; and then Al; got up to leave having had much hope to be chosen as a Caliph but Abdulrahman was afraid of something concerning Ali. Abdulrahman then said to me; Call Uthman for me. I called him and he kept on speaking to him privately till the Muadh-dhin put an end to their talk by announcing the Adhan for the Fajr prayer. When the people finished their morning prayer and that six men group gathered near the pulpit; Abdulrahman sent for all the Muhajirin emigrants and the Ansar present there and sent for the army chief who had performed the Hajj with Umar that year. When all of them had gathered; Abdulrahman said; None has the right to be worshipped but Allah; and added; Now then; O Ali; I have looked at the people tendencies and noticed that they do not consider anybody equal to Uthman; so you should not incur blame by disagreeing. Then Abdulrahman said to Uthman ; I gave the oath of allegiance to you on condition that you will follow Allah Laws and the traditions of Allah Apostle and the traditions of the two Caliphs after him. SahihAlBukhari-017-001-2402Narrated Abdullah Bin Abbas: Umar Bin AlKhattab departed for Sham and when he reached Sargh; the commanders of the Muslim army; Abu Ubaida Bin AlJarrah and his companions met him and told him that an epidemic had broken out in Sham. Umar said; Call for me the early emigrants. So Umar called them; consulted them and informed them that an epidemic had broken out in Sham. Those people differed in their opinions. Some of them said; We have come out for a purpose and we do not think that it is proper to give it up; while others said to Umar ; You have along with you. other people and the companions of Allah Messenger ﷺ so do not advise that we take them to this epidemic. Umar said to them; Leave me now. Then he said; Call the Ansar for me. I called them and he consulted them and they followed the way of the emigrants and differed as they did. He then said to them; Leave me now; and added; Call for me the old people of Quraish who emigrated in the year of the Conquest of Mecca. I called them and they gave a unanimous opinion saying; We advise that you should return with the people and do not take them to that place of epidemic. So Umar made an announcement; I will ride back to Medina in the morning; so you should do the same. Abu Ubaida Bin AlJarrah said to Umar ; Are you running away from what Allah had ordained? Umar said; Would that someone else had said such a thing; O Abu Ubaida! Yes; we are running from what Allah had ordained to what Allah has ordained. Dont you agree that if you had camels that went down a valley having two places; one green and the other dry; you would graze them on the green one only if Allah had ordained that; and you would graze them on the dry one only if Allah had ordained that? At that time Abdulrahman Bin Auf; who had been absent because of some job; came and said; I have some knowledge about this. I have heard Allah Messenger ﷺ saying; If you hear about it an outbreak of plague in a land; do not go to it; but if plague breaks out in a country where you are staying; do not run away from it. SahihAlBukhari-017-001-6582Narrated Aisha: Fatima the daughter of the Prophet ﷺ sent someone to Abu Bakr when he was a caliph ; asking for her inheritance of what Allah Messenger ﷺ had left of the property bestowed on him by Allah from the Fai i.e. booty gained without fighting in Medina; and Fadak; and what remained of the Khumus of the Khaibar booty. On that; Abu Bakr said; Allah Messenger ﷺ said; Our property is not inherited. Whatever we leave; is Sadaqa; but the family of the Prophet Muhammad can eat of this property. By Allah; I will not make any change in the state of the Sadaqa of Allah Messenger ﷺ and will leave it as it was during the lifetime of Allah Messenger ﷺ ; and will dispose of it as Allah Messenger ﷺ used to do. So Abu Bakr refused to give anything of that to Fatima. So she became angry with Abu Bakr and kept away from him; and did not task to him till she died. She remained alive for six months after the death of the Prophet. When she died; her husband Ali; buried her at night without informing Abu Bakr and he said the funeral prayer by himself. When Fatima was alive; the people used to respect Ali much; but after her death; Ali noticed a change in the people attitude towards him. So Ali sought reconciliation with Abu Bakr and gave him an oath of allegiance. Ali had not given the oath of allegiance during those months i.e. the period between the Prophet death and Fatima death. Ali sent someone to Abu Bakr saying; Come to us; but let nobody come with you; as he disliked that Umar should come; Umar said to Abu Bakr ; No; by Allah; you shall not enter upon them alone Abu Bakr said; What do you think they will do to me? By Allah; I will go to them So Abu Bakr entered upon them; and then Ali uttered Tashah-hud and said to Abu Bakr ; We know well your superiority and what Allah has given you; and we are not jealous of the good what Allah has bestowed upon you; but you did not consult us in the question of the rule and we thought that we have got a right in it because of our near relationship to Allah Messenger ﷺ. Thereupon Abu Bakr eyes flowed with tears. And when Abu Bakr spoke; he said; By Him in Whose Hand my soul is to keep good relations with the relatives of Allah Messenger ﷺ is dearer to me than to keep good relations with my own relatives. But as for the trouble which arose between me and you about his property; I will do my best to spend it according to what is good; and will not leave any rule or regulation which I saw Allah Messenger ﷺ following; in disposing of it; but I will follow. On that Ali said to Abu Bakr; I promise to give you the oath of allegiance in this after noon. So when Abu Bakr had offered the Zuhr prayer; he ascended the pulpit and uttered the Tashah-hud and then mentioned the story of Ali and his failure to give the oath of allegiance; and excused him; accepting what excuses he had offered; Then Ali got up and praying to Allah for forgiveness; he uttered Tashah-hud; praised Abu Bakr right; and said; that he had not done what he had done because of jealousy of Abu Bakr or as a protest of that Allah had favored him with. Ali added; But we used to consider that we too had some right in this affair of rulership and that he i.e. Abu Bakr did not consult us in this matter; and therefore caused us to feel sorry. On that all the Muslims became happy and said; You have done the right thing. SahihMuslim-017-001-18043It is narrated on the authority of Urwa Bin AlZubair who narrated from Aisha that she informed him that Fatima; daughter of the Messenger of Allah ﷺ ; sent someone to Abu Bakr to demand from him her share of the legacy left by the Messenger of Allah ﷺ from what Allah had bestowed upon him at Medina and Fadak and what was left from one-filth of the income annually received from Khaibar. Abu Bakr said: The Messenger of Allah ﷺ said: We prophets do not have any heirs; what we leave behind is to be given in charity. The household of the Messenger of Allah ﷺ will live on the income from these properties; but; by Allah; I will not change the charity of the Messenger of Allah ﷺ from the condition in which it was in his own time. I will do the same with it as the Messenger of Allah may peace be upun him himself used to do. So Abu Bakr refused to hand over anything from it to Fatima who got angry with Abu Bakr for this reason. She forsook him and did not talk to him until the end of her life. She lived for six months after the death of the Messenger of Allah ﷺ. When she died; her husband. Ali Bin Abu Talib; buried her at night. He did not inform Abu Bakr about her death and offered the funeral prayer over her himself. During the lifetime of Fatima; All received special regard from the people. After she had died; he felt estrangement in the faces of the people towards him. So he sought to make peace with Abu Bakr and offer his allegiance to him. He had not yet owed allegiance to him as Caliph during these months. He sent a person to Abu Bakr requesting him to visit him unaccompanied by anyone disapproving the presence of Umar. Umar said to Abu Bakr: BY Allah; you will not visit them alone. Abu Bakr said: What will they do to me? By Allah; I will visit them. And he did pay them a visit alone. All recited Tashahhud as it is done in the beginning of a religious sermon ; then said: We recognise your moral excellence and what Allah has bestowed upon you. We do not envy the favour i. e. the Catiphate which Allah nas conferred upon you; but you have done it assumed the position of Caliph alone without consulting us ; and we thought we had a right to be consulted on account of our kinship with the Messenger of Allah ﷺ. He continued to talk to Abu Bakr in this vein until the latter eyes welled up with tears. Then Abd Bakr spoke and said: By Allah; in Whose Hand is my life; the kinship of the Messenger of Allah ﷺ is dearer to me than the kinship of my own people. As regards the dispute that has arisen between you and me about these properties; I have not deviated from the right course and I have not given up doing about them what the Messenger of Allah ﷺ used to do. So Ali said to Abu Bakr: This aftetnoon is fixed for swearing allegiance to you. So when Abu Bakr had finished his Zuhr prayer; he ascended the pulpit and recited Tashahhud; and described the status of Ali; his delay in swearing allegiance and the excuse which lie had offered to him for this delay. After this he asked for God forgiveness. Then Ali Bin Abu Talib recited the Tashahhud. extolled the merits of Abu Bakr and said that his action was nott prompted by any jealousy of Abu Bakr on his part or his refusal to accept the high position which Allah had conferred upon him; adding: But we were of the opinion that we should have a share in the government; but the matter had been decided without taking us into confidence; and this displeased us. Hence the delay in offering allegiance. The Muslims were pleased with this explanation and they said: You have done the right thing. SahihMuslim-017-001-21515Jabir Bin Abdullah Allah be pleased with them reported: Abu Bakr Allah be pleased with him came and sought permission to see Allah Messenger ﷺ. He found people sitting at his door and none amongst them had been granted permission; but it was granted to Abu Bakr and he went in. Then came Umar and he sought permission and it was granted to him; and he found Allah Apostle ﷺ sitting sad and silent with his wives around him. He Hadrat Umar said: I would say something which would make the Prophet ﷺ laugh; so he said: Messenger of Allah; I wish you had seen the treatment meted out to the daughter ofKhadija when you asked me some money; and I got up and slapped her on her neck. Allah Messenger mav ﷺ laughed and said: They are around me as you see; asking for extra money. Abu Bakr Allah be pleased with him then got up went to Aisha Allah be pleased with her and slapped her on the neck; and Umar stood up before Hafsa and slapped her saying: You ask Allah Messenger ﷺ which he does not possess. They said: By Allah; we do not ask Allah Messenger ﷺ for anything he does not possess. Then he withdrew from them for a month or for twenty-nine days. Then this verse was revealed to him: Prophet: Say to thy wives... for a mighty reward xxxiii. 28. He then went first to Aisha Allah be pleased with her and said: I want to propound something to you; Aisha; but wish no hasty reply before you consult your parents. She said: Messenger of Allah; what is that? He the Holy Prophet recited to her the verse; whereupon she said: Is it about you that I should consult my parents; Messenger of Allah? Nay; I choose Allah; His Messenger; and the Last Abode; but I ask you not to tell any of your wives what I have said He replied: Not one of them will ask me without my informing her. MuwataMalik-017-001-34982Malik said; If people are together in one kitaba; their master cannot free one of them without consulting his companions who are with him in the kitaba and obtaining their consent. If they are young; however; their consultation means nothing and it is not permitted to them. That is because a man might work for all the people and he might pay their kitaba for them to complete their freedom. Their master approaches the one who will pay for them and their rescue from slavery is through him. He frees him and so makes those who remain unable to pay. He does it intending benefit and increase for himself. It is not permitted for him to do that to those of them who remain. The Messenger of Allah; may Allah bless him and grant him peace; said; There must be no harm nor return of harm. This is the most severe harm. MuwataMalik-017-001-35113Malik related to me that he had heard that Abdullah Ibn Masud used to relate that the Messenger of Allah; may Allah bless him and grant him peace; said; When two parties dispute about a business transaction; the seller word is taken; or they make an agreement among themselves. Malik spoke about someone who sold goods to a man; and said at the contracting of the sale; I will sell to you provided I consult so-and-so. If he is satisfied; the sale is permitted. If he dislikes it; there is no sale between us. They made the transaction on that basis. Then the buyer regretted before the seller consulted the person. Malik said; That sale is binding on them according to what they described. The buyer has no right of withdrawal; and it is binding on him; if the person whom the seller stipulated to him; permits it. Malik said; The way of doing things among us about a man who buys goods from another and they differ about the price; and the seller says; I sold them to you for ten dinars; and the buyer says; I bought them from you for five dinars; is that it is said to the seller; If you like; give them to the buyer for what he said. If you like; swear by Allah that you only sold your goods for what you said. If he swears it is said to the buyer; Either you take the goods for what the seller said; or you swear by Allah that you bought them only for what you said. If he swears; he is free to return the goods.
