Abu Bakr wept; and we were astonished at his weeping caused by what the Prophet ﷺ mentioned as to a Slave of Allah who had been offered a choice; we learned later on that Allah Messenger ﷺ himself was the person who was given the choice; and that Abu Bakr knew best of all of us. Allah Messenger ﷺ added; The person who has favored me most of all both with his company and wealth; is Abu Bakr. If I were to take a Khalil other than my Lord; I would have taken Abu Bakr as such; but what relates us is the Islamic brotherhood and friendliness. SahihAlBukhari-017-001-4947Narrated Urwa Bin AlZubair: That he had asked Aisha about the meaning of the Statement of Allah: If you fear that you shall not Be able to deal justly With the orphan girls; then Marry Other women of your choice Two or three or four. 4.3 She said; O my nephew! This is about the orphan girl who lives with her guardian and shares his property. Her wealth and beauty may tempt him to marry her without giving her an adequate Mahr bridal-money which might have been given by another suitor. So; such guardians were forbidden to marry such orphan girls unless they treated them justly and gave them the most suitable Mahr; otherwise they were ordered to marry any other woman. Aisha further said; After that verse the people again asked the Prophet about the marriage with orphan girls ; so Allah revealed the following verses:- They ask your instruction Concerning the women. Say: Allah Instructs you about them And about what is Recited unto you In the Book; concerning The orphan girls to whom You give not the prescribed portions and yet whom you Desire to marry... 4.127 What is meant by Allah Saying:- And about what is Recited unto you is the former verse which goes:- If you fear that you shall not Be able to deal justly With the orphan girls; then Marry other women of your choice. 4.3 Aisha said; Allah saying in the other verse:-Yet whom you desire to marry 4.127 means the desire of the guardian to marry an orphan girl under his supervision when she has not much property or beauty in which case he should treat her justly. SahihMuslim-017-001-20706Aisha; the wife of Allah Apostle ﷺ ; reported that he used to say: Never a prophet dies in a state that he is not made to see his abode in Paradise; and then given a choice. Aisha said that when Allah Messenger ﷺ was about to leave the world; his head was over her thigh and he had fallen into swoon three times. When he felt relief his eyes were fixed at the ceiling. He then said: O Allah; along with the high companions i. e. along with the Apostles who live in the most elevated place of the Paradise. On hearing these words ; I then said to myself He is not going to opt us and I remembered a hadith which he had narrated to us as he was healthy and in which he said: No prophet dies until he sees his abode in Paradise; he is then given a choice. SunanAlTermithi-017-001-8805Narrated Ibn Abi Mualla: from his father: The Messenger of Allah ﷺ gave a Khutbah one day and said: Indeed there is a man whose Lord has given him the choice between living in this life as long as he wishes to live; and eating from this life as much as he wishes to eat; and between meeting his Lord. He said: So Abu Bakr cried. The Companions of the Prophet ﷺ said: Are you not amazed at this old man; when the Messenger of Allah ﷺ mentioned a righteous man whose Lord gave him the choice between this life or meeting his Lord; and he chose meeting his Lord. He said: But Abu Bakr was the most knowledgeable one of them regarding what the Messenger of Allah ﷺ had said. So Abu Bakr said: Rather we will ransom our fathers and wealth for you.; So the Messenger of Allah ﷺ said: There is no one among people more beneficial to us Amanna Ilaina in his companionship; or generous with his wealth than Ibn Abi Quhafah. And; if I were to take a Khalil; I would have taken Ibn Abi Quhafah as a Khalil. So he chose what is with Him. So Abu Bakr said: We will ransom our fathers and mothers for you O Messenger of Allah! He said: So we were amazed. Then the people said: Look at this old man. The Messenger of Allah ﷺ informs about a worshiper whom Allah gave the choice; between Him giving him from the bounty of this life as much as he wishes; and between that which is with Allah; and he says: We will ransom our fathers and mothers for you? But the Messenger of Allah ﷺ was the one given the choice; and Abu Bakr was the most knowledgeable of it among them. So the Prophet ﷺ said: From those who were most beneficial to me among the people in their companionship and their wealth was Abu Bakr. And if I were to take a Khalil; I would would have taken Abu Bakr as a Khalil. But rather; the brotherhood of Islam. SunanAlNasai-017-001-14551Urwah Bin AlZubair narrated that he asked Aisha about the saying of Allah; the Mighty and Sublime: And if you fear that you shall not be able to deal justly with the orphan girls then marry other women of your choice. She said: O son of my sister; this refers to a female orphan who is in the care of her guardian; and her wealth is joined to his; and he is attracted to her wealth and her beauty. So her guardian wants to marry her without being fair with regard to her dowry; and without giving her what someone else would give her. So they were forbidden to marry them unless they were fair to them and gave them the highest possible dowry that is customarily given; and they were commanded to marry other women of their choice. Urwah said: Aisha said: Then later on; Allah; the Mighty and Sublime; revealed concerning them: They ask your legal instruction concerning women; say: Allah instructs you about them; and about what is recited unto you in the Book concerning the orphan girls whom you give not the prescribed portions and yet whom you desire to marry. Aisha said: What Allah; Most High; mentioned here that is recited in the Book is the first Verse in which it says: And if you fear that you shall not be able to deal justly with orphan girls then marry other women of your choice. Aisha said: What is referred to in the other Verse -and yet whom you desire to marry- is the desire of one of you not to marry orphan girl who is under his care if she is lacking in wealth and beauty. SunanAlNasai-017-001-14951It was narrated that Aisha said: Barirah made a contract that she would be freed in return for nine Awaq; one Uqiyah to be paid each year. She came to Aisha asking for help and she said: No; not unless they agree to accept the sum in one payment; and that the Wala will go to me. Barirah went and spoke to her masters but they insisted that the Wala should be for them. She came to Aisha and the Messenger of Allah came; and she told her what her masters had said. She said: No; by Allah; not unless Wala is to me. The Messenger of Allah said: What is this? She said: O Messenger of Allah; Barirah came to me and asked me to help her with her contract of manumission; and I said no; not unless they agree to accept the sum in one payment; and that the Wala will be for me. She mentioned that to her masters and they insisted that the Wala should be for them. The Messenger of Allah said: Buy her; and stipulate that the Wala is for the one who sets the slave free. Then he stood up and addressed the people and said: What is the matter with people who stipulate conditions that are not in the Book of Allah; the Mighty and Sublime? They say: I set so-and-so free but the Wala will be to me. Every condition that is not in the Book of Allah; the Mighty and Sublime; is a false condition; even if there are a hundred conditions. And the Messenger of Allah gave her the choice with regard to her husband who was still a slave; and she chose herself. MuwataMalik-017-001-35110Yahya related to me; that Malik said; The generally agreed on way of doing things among us about a man buying cloth in one city; and then taking it to another city to sell as a murabaha; is that he is not reckoned to have the wage of an agent; or any allowance for ironing; folding; straightening; expenses; or the rent of a house. As for the cost of transporting the drapery; it is included in the basic price; and no share of the profit is allocated to it unless the agent tells all of that to the investor. If they agree to share the profits accordingly after knowledge of it; there is no harm in that. Malik said; As for bleaching; tailoring; dyeing; and such things; they are treated in the same way as drapery. The profit is reckoned in them as it is reckoned in drapery goods. So if he sells the drapery goods without clarifying the things we named as not getting profit; and if the drapery has already gone; the transport is to be reckoned; but no profit is given. If the drapery goods have not gone the transaction between them is null and void unless they make a new mutual agreement on what is to be permitted between them. Malik spoke about an agent who bought goods for gold or silver; and the exchange rate on the day of purchase was ten dirhams to the dinar. He took them to a city to sell murabaha; or sold them where he purchased them according to the exchange rate of the day on which he sold them. If he bought them for dirhams and he sold them for dinars; or he bought them for dinars and he sold them for dirhams; and the goods had not gone then he had a choice. If he wished; he accepted to sell the goods and if he wished; he left them. If the goods had been sold; he had the price for which the salesman bought them; and the salesman was reckoned to have the profit on what they were bought for; over what the investor gained as profit. Malik said; If a man sells goods worth one hundred dinars for one hundred and ten; and he hears after that they are worth ninety dinars; and the goods have gone; the seller has a choice. If he likes; he has the price of the goods on the day they were taken from him unless the price is more than the price for which he was obliged to sell them in the first place; and he does not have more than that - and it is one hundred and ten dinars. If he likes; it is counted as profit against ninety unless the price his goods reached was less than the value. He is given the choice between what his goods fetch and the capital plus the profit; which is ninety-nine dinars. Malik said; If someone sells goods in murabaha and he says; It was valued at one hundred dinars to me. Then he hears later on; that it was worth one hundred and twenty dinars; the customer is given the choice. If he wishes; he gives the salesman the value of the goods on the day he took them; and if he wishes; he gives the price for which he bought them according to the reckoning of what profit he gives him; as far as it goes; unless that is less than the price for which he bought them; for he should not give the owner of the goods a loss from the price for which he bought them because he was satisfied with that. MuwataMalik-017-001-35213ahya related to me from Malik from Nafi that Abdullah Ibn Umar said that a female slave who was the wife of a slave and then was set free; had the right of choice as long as he did not have intercourse with her. Malik said; If her husband has intercourse with her and she claims that she did not know; she still has the right of choice. If her husband said; But I only gave her the right of choice in one; he had none of that. That was the best of what he had heard.
