SahihAlBukhari-017-001-3394Narrated Aisha: Fatima sent somebody to Abu Bakr asking him to give her her inheritance from the Prophet ﷺ from what Allah had given to His Apostle through Fai i.e. booty gained without fighting. She asked for the Sadaqa i.e. wealth assigned for charitable purposes of the Prophet ﷺ at Medina; and Fadak; and what remained of the Khumus i.e.; one-fifth of the Khaibar booty. Abu Bakr said; Allah Messenger ﷺ said; We Prophets ; our property is not inherited; and whatever we leave is Sadaqa; but Muhammad Family can eat from this property; i.e. Allah property; but they have no right to take more than the food they need. SahihAlBukhari-017-001-3993Narrated Aisha: mother of the believers After the death of Allah Apostle Fatima the daughter of Allah Messenger ﷺ asked Abu Bakr AlSiddiq to give her; her share of inheritance from what Allah Messenger ﷺ had left of the Fai i.e. booty gained without fighting which Allah had given him. Abu Bakr said to her; Allah Apostle said; Our property will not be inherited; whatever we i.e. prophets leave is Sadaqa to be used for charity. Fatima; the daughter of Allah Messenger ﷺ got angry and stopped speaking to Abu Bakr; and continued assuming that attitude till she died. Fatima remained alive for six months after the death of Allah Messenger ﷺ. She used to ask Abu Bakr for her share from the property of Allah Messenger ﷺ which he left at Khaibar; and Fadak; and his property at Medina devoted for charity. Abu Bakr refused to give her that property and said; I will not leave anything Allah Messenger ﷺ used to do; because I am afraid that if I left something from the Prophet tradition; then I would go astray. Later on Umar gave the Prophet property of Sadaqa at Medina to Ali and Abbas; but he withheld the properties of Khaibar and Fadak in his custody and said; These two properties are the Sadaqa which Allah Apostle used to use for his expenditures and urgent needs. Now their management is to be entrusted to the ruler. SahihAlBukhari-017-001-6582Narrated Aisha: Fatima the daughter of the Prophet ﷺ sent someone to Abu Bakr when he was a caliph ; asking for her inheritance of what Allah Messenger ﷺ had left of the property bestowed on him by Allah from the Fai i.e. booty gained without fighting in Medina; and Fadak; and what remained of the Khumus of the Khaibar booty. On that; Abu Bakr said; Allah Messenger ﷺ said; Our property is not inherited. Whatever we leave; is Sadaqa; but the family of the Prophet Muhammad can eat of this property. By Allah; I will not make any change in the state of the Sadaqa of Allah Messenger ﷺ and will leave it as it was during the lifetime of Allah Messenger ﷺ ; and will dispose of it as Allah Messenger ﷺ used to do. So Abu Bakr refused to give anything of that to Fatima. So she became angry with Abu Bakr and kept away from him; and did not task to him till she died. She remained alive for six months after the death of the Prophet. When she died; her husband Ali; buried her at night without informing Abu Bakr and he said the funeral prayer by himself. When Fatima was alive; the people used to respect Ali much; but after her death; Ali noticed a change in the people attitude towards him. So Ali sought reconciliation with Abu Bakr and gave him an oath of allegiance. Ali had not given the oath of allegiance during those months i.e. the period between the Prophet death and Fatima death. Ali sent someone to Abu Bakr saying; Come to us; but let nobody come with you; as he disliked that Umar should come; Umar said to Abu Bakr ; No; by Allah; you shall not enter upon them alone Abu Bakr said; What do you think they will do to me? By Allah; I will go to them So Abu Bakr entered upon them; and then Ali uttered Tashah-hud and said to Abu Bakr ; We know well your superiority and what Allah has given you; and we are not jealous of the good what Allah has bestowed upon you; but you did not consult us in the question of the rule and we thought that we have got a right in it because of our near relationship to Allah Messenger ﷺ. Thereupon Abu Bakr eyes flowed with tears. And when Abu Bakr spoke; he said; By Him in Whose Hand my soul is to keep good relations with the relatives of Allah Messenger ﷺ is dearer to me than to keep good relations with my own relatives. But as for the trouble which arose between me and you about his property; I will do my best to spend it according to what is good; and will not leave any rule or regulation which I saw Allah Messenger ﷺ following; in disposing of it; but I will follow. On that Ali said to Abu Bakr; I promise to give you the oath of allegiance in this after noon. So when Abu Bakr had offered the Zuhr prayer; he ascended the pulpit and uttered the Tashah-hud and then mentioned the story of Ali and his failure to give the oath of allegiance; and excused him; accepting what excuses he had offered; Then Ali got up and praying to Allah for forgiveness; he uttered Tashah-hud; praised Abu Bakr right; and said; that he had not done what he had done because of jealousy of Abu Bakr or as a protest of that Allah had favored him with. Ali added; But we used to consider that we too had some right in this affair of rulership and that he i.e. Abu Bakr did not consult us in this matter; and therefore caused us to feel sorry. On that all the Muslims became happy and said; You have done the right thing. SahihMuslim-017-001-17722It has been narrated on the authority of Abu Humaid AlSaidi who said: The Messenger of Allah ﷺ appointed a man from the Asad tribe who was called Ibn Lutbiya in charge of Sadaqa i. e. authorised hign to receive Sadaqa from the people on behalf of the State. When he returned with the collictions ; he said: This is for you and this is mine as it was presented to me as a gift. The narrator said: The Messenger of Allah may peace be upod him stood on the pulpit and praised God and extolled Him. Then he said: What about a State official whom I give an assignment and who comes and says: This is for you and this has been presented to me as a gift? Why didnt he remain in the house of his father or the house of his mother so that he could observe whether gifts were presented to him or not. By the Being in Whose Hand is the life of Muhammad; any one of you will not take anything from it but will bring it on the Day of Judgment; carrying on his neck a camel that will be growling; or a cow that will be bellowing or an ewe that will be bleating. Then he raised his hands so that we could see the whiteness of his armpits. SahihMuslim-017-001-17957Amir Bin Saad reported on the authority of his father Saad Bin Abi Waqqas : Allah Messenger ﷺ visited me in my illness which brought me near death in the year of Hajjat AlWada Farewell Pilgrimage. I said: Allah Messenger; you can well see the pain with which I am afflicted and I am a man possessing wealth; and there is none to inherit me except only one daughter. Should I give two-thirds of my property as Sadaqa? He said: No. I said: Should I give half of my property as Sadaqa? He said: No. He further said: Give one-third in charity and that is quite enough. To leave your heirs rich is better than to leave them poor; begging from people; that you would never incur an expense seeking therewith the pleasure of Allah; but you would be rewarded therefor; even for a morsel of food that you put in the mouth of your wife. I said: Allah Messenger. would I survive my companions? He the Holy Prophet said: If you survive them; then do such a deed by means of which you seek the pleasure of Allah; but you would increase in your status in religion and prestige; you may survive so that people would benefit from you; and others would be harmed by you. The Holy Prophet further said: Allah; complete for my Companions their migration; and not cause them to turn back upon their heels. Saad Bin Khaula is; however; unfortunate. SahihMuslim-017-001-17963Humaid Bin Abdulrahman AlHimyari reported from three of the sons of Saad all of whom reported from their father that Allah Apostle ﷺ visited Saad as he was ill in Mecca. He Sad wept. He the Holy Prophet said: What makes you weep? He said: I am afraid I may die in the land from where I migrated as Saad Bin Khaula had died. Thereupon Allah Apostle ﷺ said: O Allah; grant health to Sad. O Allah; grant health to Sad. He repeated it three times. He Sad said: Allah Messenger; I own a large property and I have only one daughter as my inheritor. Should I not will away the whole of my property? He the Holy Prophet said: No. He said: Should I not will away; two-thirds of the property? he the Holy Prophet said: No. He Sad again said: Should I not will away half of my property ? He said: No. He Sad said: Then one-third? Thereupon he the Holy Prophet said: Yes ; one-third; and one-third is quite substanial. And what you spend as charity from your property is Sadaqa and flour spending on your family is also Sadaqa; and what your wife eats from your property is also Sadaqa; and that you leave your heirs well off or he said: prospreous is better than to leave them poor and begging from people. SahihMuslim-017-001-17972Ibn Umar reported: Umar acquired a land at Khaibar. He came to Allah Apostle ﷺ and sought his advice in regard to it. He said: Allah Messenger; I have acquired land in Khaibar. I have never acquired property more valuable for me than this; so what do you command me to do with it? Thereupon he Allah Apostle said: If you like; you may keep the corpus intact and give its produce as Sadaqa. So Umar gave it as Sadaqa declaring that property must not be sold or inherited or given away as gift. And Umar devoted it to the poor; to the nearest kin; and to the emancipation of slaves; aired in the way of Allah and guests. There is no sin for one; who administers it if he eats something from it in a reasonable manner; or if he feeds his friends and does not hoard up goods for himself. He the narrator said: I narrated this hadith to Muhammad; but as I reached the words without hoarding for himself out of it. he Muhammad said: without storing the property with a view to becoming rich. SahihMuslim-017-001-21954Zainab; the wife of Abdullah Bin Masud ; reported that the Messenger of Allah ﷺ said: 0 women; give sadaqa even though it be some of your jewellery. She returned to Abdullah and said: You are a person with empty hands; whereas the Messenger of Allah ﷺ has commanded us to give sadaqa; so better go to him and ask and if this will suffice for me; otherwise I shall give it to someone else. Abdullah said to me his wife : You better go yourself. So I went and there was another woman of the Ansar at the door of the Messenger of Allah ﷺ having the same porpose as I had. Now Allah Messenger ﷺ was invested with awe so we did not like to knock. Then Bilal came out and we said to him: Go to the Messenger of Allah ﷺ and inform him that there are two women at the door asking him whether it will serve them to give sadaqa to their spouses and to orphans who are under their charge; but do not inform him who we are. Bilal went to the Messenger of Allah ﷺ and asked him what these women had instructed him to ask. The Messenger of Allah ﷺ asked him who these women were. He Bilal said: They are women from Ansar and Zainab. Upon this the Messenger of Allah ﷺ said: Which of the Zainabs? He said: The wife of Abdullah. SahihMuslim-017-001-21969Saeed Bin Abu Burda reported on the authority of his grandfather that the Messenger of Allah ﷺ said: Giving of Sadaqa is essential for every Muslim. It was said to him : What do you say of him who does not find the means to do so? He said: Let him work with both his hands; thus doing benefit to himself and give Sadaqa. MuwataMalik-017-001-34390Yahya related to me from Malik from Abdullah Ibn Abi Bakr from his father that the Messenger of Allah; may Allah bless him and grant him peace; gave a man from the Banu Abd AlAshal charge over some sadaqa. When he came to ask him for some camels from the sadaqa; the Messenger of Allah; may Allah bless him and grant him peace; was so angry that the anger showed in his face. One way in which anger could be recognised in his face was that his eyes became red. Then he said; This man has asked me for what is not good for me or him. If I refuse it; I hate to refuse. If I give it to him; I will give him what is not good for me or him. The man said; Messenger of Allah! MuwataMalik-017-001-34956Yahya said that he heard Malik say; The way of doing things in our community about which there is no dispute; is that if a man gives sadaqa to his son - sadaqa which the son takes possession of or which is in the father keeping and the father has had his sadaqa witnessed; he cannot take back any of it because he cannot reclaim any sadaqa. Yahya said that he heard Malik say; The generally agreed-on way of doing things in our community in the case of someone who gives his son a gift or grants him a gift which is not sadaqa is that he can take it back as long as the child does not start a debt; which people claim from him; and which they trust him for on the strength of the gift his father has given him. The father cannot take back anything from the gift after debts are started against it. MuwataMalik-017-001-34967Malik related to me from Said Ibn Amr Shurahbil Ibn Said Ibn Sad Ibn Ubada from his father that his father said; Sad Ibn Ubada went out with the Messenger of Allah; may Allah bless him and grant him peace; in one of his raids and his mother was dying in Madina. Someone said to her; Leave a testament. She said; In what shall I leave a testament? The property is Sad property. Then she died before Sad returned. When Sad Ibn Ubada returned; that was mentioned to him. Sad said; Messenger of Allah! Will it help her if I give sadaqa for her? MuwataMalik-017-001-34983Malik said about a man who had his slave in a kitaba and then the mukatab died and left his umm walad; and there remained for him some of his kitaba to pay and he left what would pay it; The umm walad is a slave since the mukatab was not freed until he died and he did not leave children that were set free by his paying what remained; so that the umm walad of their father was freed by their being set free. Malik said about a mukatab who set free a slave of his or gave sadaqa with some of his property and his master did not know that until he had set the mukatab free; That has been performed by him and the master does not rescind it. If the master of the mukatab knows before he sets the mukatab free; he can reject that and not permit it. Malik said about a man saying to his wife; You are divorced; and every woman I marry is divorced; or that all his property would be sadaqa if he did not do such-and-such; and he broke his oath: As for his wives; it is divorce as he said; and as for his statement; Every woman I marry is divorced; if he did not name a specific woman; tribe; or land; or such; it is not binding on him and he can marry as he wishes. Abdullah Ibn Abi Bakr said; I mentioned that to Amra bint Abdulrahman and she affirmed that he had spoken the truth as she had heard Aisha; the wife of the Prophet; may Allah bless him and grant him peace; say; Some people from the desert came at the time of the sacrifice in the time of the Messenger of Allah; may Allah bless him and grant him peace; so the Messenger of Allah; may Allah bless him and grant him peace; said; Store up for three days; and give what is left over as sadaqa. She said that afterwards some one said to the Messenger of Allah; may Allah bless him and grant him peace; that people had been accustomed to make use of their sacrificial animals; melting the fat and curing the skins. The Messenger of Allah; may Allah bless him and grant him peace; said; What about that? They said; You have forbidden the meat of sacrificial animals after three days. The Messenger of Allah; may Allah bless him and grant him peace; said; I only forbade you for the sake of the people who were coming to you. Eat; give sadaqa and store up. This is good! Whoever is among the people of prayer; is called from the gate of prayer. Whoever is among the people of jihad is called from the gate of jihad. MuwataMalik-017-001-35524Yahya related to me from Malik that he had heard that Said Ibn AlMusayab was asked whether a man who had vowed to fast a month could fast voluntarily; and Said said; He should fulfil his vow before he does any voluntary fasting. Malik said; I have heard the same thing from Sulayman Ibn Yasar. Malik said; If someone dies with an unfulfilled vow to free a slave or to fast or to give sadaqa or to give away a camel; and makes a bequest that his vow should be fulfilled from his estate; then the sadaqa or the gift of the camel are taken from one third of his estate. Preference is given to it over other bequests; except things of a similar nature; because by his vow it has become incumbent on him; and this is not the case with something he donates voluntarily. They vows and voluntary donations are settled from a limited one-third of his estate; and not from the whole of it; since if the dying man were free to dispose of all of his estate; he might delay settling what had become incumbent on him i.e. his vows ; so that when death came and the estate passed into the hands of his heirs; he would have bequeathed such things i.e. his vows that were not claimed by anyone like debts. If that i.e. to dispose freely of his property were allowed him; he would delay these things i.e. his vows until when he was near death; he would designate them and they might take up all of his estate.
