SahihAlBukhari-017-001-1437Narrated Sahl Bin Saad AlSaidi: Uwaimir AlAjlani came to Aasi m Bin Adi and said; If a man found another man with his wife and killed him; would you sentence the husband to death in Qisas; i.e.; equality in punishment ? O Aasi m! Please ask Allah Messenger ﷺ about this matter on my behalf. Aasi m asked the Prophet ﷺ but the Prophet disliked the question and disapproved of it. Aasi m returned and informed Uwaimir that the Prophet disliked that type of question. Uwaimir said; By Allah; I will go personally to the Prophet. Uwaimir came to the Prophet ﷺ when Allah had already revealed Quranic Verses in that respect ; after Aasi m had left the Prophet ﷺ. So the Prophet ﷺ said to Uwaimir; Allah has revealed Quranic Verses regarding you and your wife. The Prophet ﷺ then called for them; and they came and carried out the order of Lian. Then Uwaimir said; O Allah Messenger ﷺ ! Now if I kept her with me; I would be accused of telling a lie. So Uwaimir divorced her although the Prophet ﷺ did not order him to do so. Later on this practice of divorcing became the tradition of couples involved in a case of Lian. The Prophet ﷺ said to the people. Wait for her! If she delivers a red short small child like a Wahra a short red animal. then I will be of the opinion that he Uwaimir has told a lie but if she delivered a black big-eyed one with big buttocks; then I will be of the opinion that he has told the truth about her. Ultimately she gave birth to a child that proved the accusation. SahihAlBukhari-017-001-1614Narrated Ibn Abbas: Lian was mentioned in the presence of the Prophet; Aasi m Bin Adi said a statement about it; and when he left; a man from his tribe came to him complaining that he had seen a man with his wife. Aasi m said; I have been put to trial only because of my statement. So he took the man to the Prophet ﷺ and the man told him about the incident. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn Abbas in the gathering; Was that the same lady about whom the Prophet ﷺ said; If I were to stone any lady for committing illegal sexual intercourse to death without witnesses; I would have stoned that lade to death? Allah Messenger ﷺ disliked to hear the problem which I asked him about. Uwaimir said; By Allah; I will not leave the matter till I ask him about it. So Uwaimir proceeded till he came to Allah Messenger ﷺ who was in the midst of the people and said; O Allah Messenger ﷺ ! If a man finds with his wife another man; should he kill him; whereupon you would kill him in Qisas : or otherwise; what should he do? Allah Messenger ﷺ said; Allah has revealed something concerning the question of you and your wife. Go and bring her here. So they both carried out the judgment of Lian; while I was present among the people as a witness. When both of them had finished; Uwaimir said; O Allah Messenger ﷺ ! If I should now keep my wife with me; then I have told a lie. Then he pronounced his decision to divorce her thrice before Allah Apostle ordered him to do so. SahihAlBukhari-017-001-3176Narrated Ibn Juraij: Ibn Shihab informed me of Lian and the tradition related to it; referring to the narration of Sahl Bin Sad; the brother of Bani Saidi He said; An Ansari man came to Allah Messenger ﷺ and said; O Allah Apostle! If a man saw another man with his wife; should he kill him; or what should he do? So Allah revealed concerning his affair what is mentioned in the Holy Quran about the affair of those involved in a case of Lian. The Prophet ﷺ said; Allah has given His verdict regarding you and your wife. So they carried out Lian in the Masjid while I was present there. When they had finished; the man said; O Allah Messenger ﷺ ! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Allah Messenger ﷺ ordered him; when they had finished the Lian process. So he divorced her in front of the Prophet ﷺ. Ibn Shihab added; After their case; it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then; and later on her son was called by his mother name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him. Ibn Shihab said that Sahl Bin Saad AsSaidi said that the Prophet ﷺ said in the above narration ; If that lady delivers a small red child like a lizard; then the lady has spoken the truth and the man was a liar; but if she delivers a child with black eyes and huge lips; then her husband has spoken the truth. He said: Hilal Bin Umaya Allah be pleased with him accused his wife with the charge of fornication with Sharik Bin Sahma; the brother of AlBarab Malik from the side of his mother. And he was the first person who invoked curse lian in Islam. He in fact invoked curse upon her. Allah Messenger ﷺ said: See to her if she gives birth to a white-complexioned child having dark hair and bright eyes; he must be the son of Hilal Bin Umaya; and if she gives birth to a child with dark eyelids; curly hair and lean shanks; he must be the offspring of Sharik Bin Sahma. SunanAlTermithi-017-001-10055Narrated Saeed Bin Jubair: I was asked about those who were involved in the case of Lian and if they are to be separated; during the leadership of mousab Bin AlZubair. I did not know what to say. So I went to the house of Abdullah Bin Umar and I sought permission to enter. I was told he was taking a nap; but he heard me taking and he said: Is it Ibn Jubair? Enter. You would not have come except for a need. He said: So I entered and found him laying on a saddlecloth from his mount. I said: O Abu Abdulrahman Are those involved in Lian separated? He said: Glorious is Allah! Yes. The first who asked about hat was so-and-so the son of so-and-so. He came to the Prophet ﷺ and said O Messenger of Allah! If one of us saw his wife committing adultery; what should he do? If he were to say anything; his statement would be a horrible matter; and if he were to remain silent; his silence about the matter would be horrible. He said: So the Prophet ﷺ remained silent and did not answer him. Afterwards he came to the Prophet ﷺ and said: The one who asked you about it has been tried by it. So Allah revealed these Ayat from Surat AlNur: And those who accuse their wives and have no witnesses except themselves; let the testimony of one of them be four testimonies by Allah 24:6-10 - until the end of those Ayat. He said: So he called for the man and recited the Ayat to him and admonished him; reminded him; and he told him: Indeed the punishment of the world is less than the punishment of the Hereafter. So he said: Nay! By the One Who sent you with the Truth! I did not lie about her. Then he ﷺ did the same with the woman; admonishing her and reminding her and he told her: Indeed the punishment of the world is less than the punishment of the Hereafter. She said: Nay! By the One Who sent you with the Truth! He is not telling the truth. He said: So he started with the man: He testified four times; by Allah that he is one of the truthful; and the fifth time that the curse of Allah be upon him if he was one of the liars. Then the same with the woman: She testified four times by Allah; that he was one of the liars; and the fifth time that the wrath of Allah be upon her if he was one of the truthful. SunanAlNasai-017-001-14966It was narrated from Sahl Bin Sad; from Aasi m Bin Adiy who said: Uwaimir; a man from Banu Ajlan; came and said: O Aasi m; what do you think if a man sees another man with his wife; should he kill him and be killed in retaliation; or what should he do? O Aasi m; ask the Messenger of Allah about that for me. So Aasi m asked the Messenger of Allah about that; and the Messenger of Allah disapproved of the question and criticized the asking of too many questions. Then Uwaimir came to him and said: What happened; O Aasi m? Aasi m said to Uwaimir: What happened?! You have not brought me any good. The Messenger of Allah disapproved of the question I asked. Uwaimir said: By Allah; I will go and ask the Messenger of Allah. So he went to the Messenger of Allah and asked him. The Messenger of Allah said: Allah the Mighty and Sublime has revealed something concerning you and your wife; so bring her here. Sahl said: I was among the people in the presence of the Messenger of Allah and he brought her and they engaged in the procedure of Lian. He said: O Messenger of Allah; by Allah! If I keep her I would have been telling lies about her. The Messenger of Allah conducted the procedure of Lian between them; then he said: Look and see; if she produces a child who is white; with straight hair and Qadiya eyes; then he belongs to Hilal Bin Umayah; and if she produces a child who has dark lines around his eyes; curly hair and narrow calves; then he belongs to Sharik Bin AlSahma. SunanAlNasai-017-001-14969It was narrated that Anas Bin Malik said: The first Lian in Islam was when Hilal Bin Umayah accused Sharik Bin AlSahma of committing adultery with his wife. He came to the Prophet and told him about that. The Prophet said: Bring four witnesses; otherwise you will feel the Hadd punishment on your back. And he repeated that several times. Hilal said to him: By Allah; O Messenger of Allah! Allah; the Mighty and Sublime; knows that I am telling the truth; and Allah; the Mighty and Sublime; will certainly reveal to you that which will spare my back from the whip. While they were like that; the Verse of Lian was revealed to him: As to those who accuse their wives. He called Hilal and he bore witness four times by Allah that he was telling the truth; and the fifth time he invoked the curse of Allah upon him if he were lying. Then he called the woman and she bore witness four times by Allah that he was lying. When it came to the fourth or fifth time; the Messenger of Allah said: Stop her; for it will inevitably bring the punishment of Allah upon the liar. She hesitated until we thought that she was going to confess; then she said: I will not dishonor my people today. Then she went ahead with the oath. The Messenger of Allah said: Wait and see. If she produces a child who is white; with straight hair and Qadiya eyes; then he belongs to Hilal Bin Umayah; but if she produces a child who is dark with curly hair; of average size and with narrow calves; then he belongs to Sharik Bin AlSahma. She produced a child who was dark with curly hair; of average size and with narrow calves. I did not know what to say; so I got up and went to the house of Ibn Umar and said: O Abu Abdulrahman should the two who engage in Lian be separated? He said: Yes; Subhan Allah! The first one who asked about that was so-and-so the son of so-and-so who said: O Messenger of Allah; what do you think if a man among us sees his wife committing immoral actions; and if he speaks of it; he will be speaking of a grave matter; but if he keeps quiet; he will be keeping quiet about a grave matter? He did not answer him; then after that; he came to him and said: I was tried with the matter that I asked you about; so Allah; the Mighty and Sublime; revealed these Verses in Surat AlNur.: And for those who accuse their wives until he reached: And the fifth testimony should be that the Wrath of Allah be upon her if he her husband speaks the truth. So he started with the man; exhorting him; reminding him; and telling him that the punishment in this world was less severe than the punishment in the Hereafter. He said: By the One Who sent you with the truth; I am not lying. Then he turned to the woman and exhorted her and reminded her. She said: By the One Who sent you with the truth; he is lying. So he started with the man; and he bore witness four times by Allah that he was telling the truth; and the fifth time he invoked the curse of Allah upon himself if he was lying. Then he turned to the woman and she bore witness four times by Allah that he was lying; and the fifth time she invoked the wrath of Allah upon herself if he was telling the truth. He said: You are not entitled to any wealth. MuwataMalik-017-001-34835Malik related to me that he had heard that Said Ibn AlMusayab was asked who had the wala of the children whom a slave had by a free woman. Said said; If their father dies and he is a slave who was not set free; their wala belongs to the mawali of their mother. Malik said; That is like the child of a woman who is a mawla who has been divorced by lian; the child is attached to the mawali of his mother and they are his mawali. If he dies; they inherit from him. If he commits a crime; they pay the blood-money for him. If his father acknowledges him; he is given a kinship to him and his wala goes to the mawali of his father. They are his heirs; they pay his blood-money and his father is punished with the hadd-punishment. Malik said; It is like that with a free-born woman divorced by lian. If her husband who curses her by lian does not acknowledge her child; the child is dealt with in the same way except that the rest of his inheritance after the inheritance of his mother and his brothers from his mother goes to all the muslims as long as he was not given kinship to his father. The child of the lian is attached to the patronage of the mawali of his mother until his father acknowledges him because he does not have a lineage or paternal relations. If his lineage is confirmed; it goes to his paternal relations. Malik said; The generally agreed-on way of doing things among us about a child of a slave by a free woman; while the father of the slave is free; is that the grandfather the father of the slave ; attracts the wala of his son free children by a free woman. They leave their inheritance to him as long as their father is a slave. If the father becomes free; the wala returns to his mawali. If he dies and he is still a slave; the inheritance and the wala go to the grandfather. If the slave has two free sons; and one of them dies while the father is still a slave; the grandfather; the father of the father; attracts the wala and the inheritance. Malik spoke about a slave-girl who was set free while she was pregnant and her husband was a slave and then her husband became free before she gave birth; or after she gave birth. He said; The wala of what is in her womb goes to the person who set the mother free because slavery touched the child before the mother was set free. It is not treated in the same way as a child conceived by its mother after she has been set free because the wala of such a child; is attracted by the father when he is set free. MuwataMalik-017-001-35223Yahya related to me from Malik from Nafic from Abdullah Ibn Umar that a man cursed his wife in the time of the Messenger of Allah; may Allah bless him and grant him peace; and disowned her child. The Messenger of Allah; may Allah bless him and grant him peace; separated them and gave the child to the woman. Malik said; Allah the Blessed; the Exalted; said; The testimony of men who accuse their wives but do not have any witnesses except themselves is to testify by Allah four times that he is being truthful; and a fifth time; that the curse of Allah will be upon him; if he should be a liar. She will avoid punishment if she testifies by Allah four times that he is a liar; and a fifth time; that the wrath of Allah shall be upon her; if he should be telling the truth. Surat 24 ayat 6. Malik said; The sunna with us is that those who curse each other are never to be remarried. If the man calls himself a liar; i.e. takes back his accusation ; he is flogged with the hadd-punishment; and the child is given to him; and his wife can never return to him. There is no doubt or dispute about this sunna among us. Malik said; If a man separates from his wife by an irrevocable divorce by which he cannot return to her; and then he denies the paternity of the child she is carrying; whilst she claims that he is the father; and it is possible by the timing; that he be so; he must curse her; and the child is not recognised as his. Malik said; That is what is done among us; and it is what I have heard from the people of knowledge. Malik said that a man who accused his wife after he had divorced her trebly while she was pregnant; and he had at first accepted being the father but then claimed that he had seen her committing adultery before he separated from her; was flogged with the hadd-punishment; and did not curse her. If he denied the paternity of her child after he had divorced her trebly; and he had not previously accepted it; then he cursed her. Malik said; This is what I have heard. Malik said; The slave is in the same position as the free man as regards making accusations and invoking mutual curses lian. He acts in the lian as the free man acts although there is no hadd applied for slandering a female-slave. Malik said; The muslim slave-girl and the christian and jewish free woman also do lian when a free muslim marries one of them and has intercourse with her. That is because Allah - may He be blessed and Exalted; said in His Book; As for those who accuse their wives; and they are their wives. This is what is done among us. Malik said that a man who did the lian with his wife; and then stopped and called himself a liar after one or two oaths and he had not cursed himself in the fifth one; had to be flogged with the hadd-punishment; but they did not have to be separated. Malik said that if a man divorced his wife and then after three months the woman said; I am pregnant; and he denied paternity; then he had to do lian. Malik said that the husband of a female slave who pronounced the lian on her and then bought her; was not to have intercourse with her; even if he owned her. The sunna which had been handed down about a couple who mutually cursed each other in the lian was that they were never to return to each other.
