Settle his case according to Allah Book Laws. and allow me to speak; He said; My son was a laborer for this man and he committed illegal sexual intercourse with his wife. The people told me that my son should be stoned to death but I ransomed him with one-hundred sheep and a slave girl. Then I asked the religious learned people and they told me that his wife should be stoned to death and my son should receive one-hundred lashes and be sentenced to one year of exile. The Prophet ﷺ said; By Him in Whose Hands my life is; I will judge between you according to Allah Book Laws : As for the slave girl and the sheep; they are to be returned; and as for your son; he shall receive onehundred lashes and will be exiled for one year. You; O Unais! addressing a man from Bani Aslam; Go tomorrow morning to the wife of this man and if she confesses; then stone her to death. My companion; saw an onager while I was busy Mending my shoes. They did not Inform me of the onager but they wished that I would see it Suddenly I looked and saw the onager Then I headed towards my horse; saddled it and rode; but I forgot to take the lash and the spear. So I said to them my companions ; Give me the lash and the spear. But they said; No; by Allah we will not help you in any way to hunt it I got angry; dismounted; took it the spear and the lash ; rode the horse chased the onager and wounded it Then I brought it when it had dyed. My companions started eating of its cooked meat; but they suspected that it might be unlawful to eat of its meat while they were in a state of Ihram Then I proceeded further and I kept one of its forelegs with me. When we met Allah Apostle we asked him about that. He said; Have you some of its meat with you? SahihMuslim-017-001-21207Abdullah reported: We were on the night of Friday staying in the Masjid when a person from the Ansar came there and said: If a person finds hiswoman along with a man; and he speaks about it; you would lash him; and if he kills; you will kill him; and if he keeps quiet he shall have to consume anger. By Allah; I will definitely ask about him from Allah Mescenger ﷺ. On the following day he came to Allah Messenger ﷺ and asked him thus: If a man were to find with his wife a man and if he were to talk about it; you would lash him; and if he killed; you would kill him; and if he were to keep quiet. he would consume anger; whereupon he the Holy Prophet said: Allah; solve this problem ; and he began to supplicate before Him ; and then the verses pertaining to lian were revealed: Those who accuse their wives and have no witnesses except themselves xxiv. 6. The person was then put to test according to these verses in the presence of the people. There came he and his wife in the presence of Allah Messenger ﷺ ; and they invoked curses in order to testify their claim. The man swore four times in the name of Allah that he was one of the truthful and then invoked curse for the fifth time saying: Let there be curse of Allah upon him if he were among the liars. Then she began to invoke curse. He said: My son was a laborer serving this man; and he committed Zina with his wife. They told me that my son was to be stoned to death; but I ransomed him with one hundred sheep and a slave girl of mine. Then I asked the people of knowledge; who told me that my son was to be given one hundred lashes and exiled for a year; and that his the mans wife was to be stoned to death. SunanAbuDawoud-017-001-26641Abu Huraira and Zaid Bin Khalid AlJuhani said: Two men brought a dispute before the Messenger of Allah ﷺ. One of them said: Pronounce judgement between us in accordance with Allahs Book; Messenger of Allah! The other who had more understanding said: Yes; Messenger of Allah! Pronounce judgement between us in accordance with Allahs Book; and allow me to speak. He the Prophet said: Speak; He then said: My son who was a hired servant with this man committed fornication with his wife; and when I was told that my son must be stoned to death; I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned; they told me that my son should receive a hundred lashes and be banished for a year; and that stoning to death applied only to mans wife. The apostle of Allah ﷺ replied: By him in whose hand my soul is; I shall certainly pronounce judgment between you in accordance with Allahs Book. Your sheep and your slave girl must be returned to you; and your son shall receive a hundred lashes and be banished for a year. And he commanded Unias AlAslami go to that mans wife; and if she confessed; he should stone her to death. SunanAbuDawoud-017-001-26676Hudayn Ibn AlMundhir AlRuqashi; who was Abu Sasan; said: I was present with Uthman Ibn Affan when AlWalid Ibn Uqbah was brought to him. Humran and another man bore witness against him for drinking wine. One of them testified that he had seen him drinking wine; and the other testified that he had seen him vomiting it. Uthman said: He could not vomit it; unless he did not drink it. He said to Ali: Inflict the prescribed punishment on him. Ali said to AlHasan: Inflict the prescribed punishment on him. AlHasan said: He who has enjoyed its pleasure should also bear its burden. So Ali said to Abdullah Ibn Jafar: Inflict the prescribed punishment on him. He took a whip and struck him with it while Ali was counting. When he reached struck forty lashes ; he said: It is sufficient. The Prophet ﷺ gave forty lashes. I think he also said: And Abu Bakr gave forty lashes; and Uthman eighty. This is all sunnah standard practice. SunanAbuDawoud-017-001-26685Narrated Abdulrahman Ibn Azhar: I saw the Messenger of Allah ﷺ on the morning of the conquest of Mecca when I was a young boy. He was walking among the people; seeking the camp of Khalid Ibn AlWalid. A man who had drunk wine was brought before him and he ordered them to beat him. So they beat him with what they had in their hands. Some struck him with whips; some with sticks and some with sandals. The Messenger of Allah ﷺ threw some dust on his face. When a man who had drunk wine was brought before Abu Bakr; he asked them i.e. the people about the number of beatings which they gave him. They numbered it forty. So Abu Bakr gave him forty lashes. When Umar came to power; Khalid Ibn AlWalid wrote to him: The people have become addicted to drinking wine and they look down upon the prescribed punishment and its penalty. He said: They are with you; ask them. The immigrants who embraced Islam in the beginning were with him. He asked them and they agreed on the fact that a drunkard should be given eighty lashes. Ali said: When a man drinks wine; he tells lies. Ali Ibn Abi Talib said to him; We think that you flog him for it with eighty lashes. MuwataMalik-017-001-34772Malik related to me from Ibn Shihab from Ubaydullah Ibn Abdullah Ibn Utba Ibn Masud that Abu Huraira and Zayd Ibn Khalid AlJuhani informed him that two men brought a dispute to the Messenger of Allah; may Allah bless him and grant him peace. One of them said; Messenger of Allah! Judge between us by the Book of Allah! The other said; and he was the wiser of the two; Yes; Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak. He said; Speak. He said; My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning; and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year; and they informed me that the woman deserved to be stoned. The Messenger of Allah; may Allah bless him and grant him peace; said; By him in whose Hand myself is; I will judge between you by the Book of Allah. As for your sheep and slave girl; they should be returned to you. Your son should have one hundred lashes and be exiled for a year. He ordered Unays AlAslami to go to the wife of the other man and to stone her if she confessed. MuwataMalik-017-001-34784Malik related to me from Abuz-Zinad that he said; Umar Ibn Abd AlAziz flogged a slave with eighty lashes for slander. Abuz-Zinad said; I asked Abdullah Ibn Amir Ibn Rabia about that.
