SahihAlBukhari-017-001-2863Narrated Aisha: Some Muslim men emigrated to Ethiopia whereupon Abu Bakr also prepared himself for the emigration; but the Prophet ﷺ said to him ; Wait; for I hope that Allah will allow me also to emigrate. Abu Bakr said; Let my father and mother be sacrificed for you. Do you hope that emigration ? The Prophet said; Yes. So Abu Bakr waited to accompany the Prophet ﷺ and fed two camels he had on the leaves of AlSamur tree regularly for four months One day while we were sitting in our house at midday; someone said to Abu Bakr; Here is Allah Messenger ﷺ ; coming with his head and a part of his face covered with a cloth-covering at an hour he never used to come to us. Abu Bakr said; Let my father and mother be sacrificed for you; O Prophet ! An urgent matter must have brought you here at this hour. The Prophet ﷺ came and asked the permission to enter; and he was allowed. The Prophet ﷺ entered and said to Abu Bakr; Let those who are with you; go out. Abu Bakr replied; There is no stranger ; they are your family. Let my father be sacrificed for you; O Allah Apostle! The Prophet ﷺ said; I have been allowed to leave Mecca. Abu Bakr said; I shall accompany you; O Allah Messenger ﷺ ; Let my father be sacrificed for you! The Prophet ﷺ said; Yes; Abu Bakr said; O Allah Messenger ﷺ s! Let my father be sacrificed for you. Take one of these two shecamels of mine The Prophet ﷺ said. I will take it only after paying its price. So we prepared their baggage and put their journey food In a leather bag. And Asma bint Abu Bakr cut a piece of her girdle and tied the mouth of the leather bag with it. That is why she was called Dhatan- Nitaqaln. Then the Prophet ﷺ and Abu Bakr went to a cave in a mountain called Thour and remained there for three nights. Abdullah Bin Abu Bakr. who was a young intelligent man. used to stay with them at night and leave before dawn so that in the morning; he would he with the Quraish at Mecca as if he had spent the night among them. If he heard of any plot contrived by the Quraish against the Prophet and Abu Bakr; he would understand it and return to inform them of it when it became dark. Amir Bin Fuhaira; the freed slave of Abu Bakr used to graze a flock of milch sheep for them and he used to take those sheep to them when an hour had passed after the Isha prayer. They would sleep soundly till Amir Bin Fuhaira awakened them when it was still dark. He said: Recognise well its bag and the strap by which it is tied then make announcement of that for a year. If its owner comes within this time return that to him ; otherwise it is yours. He again said: What about the lost goat? Thereupon he the Holy Prophet said: It is yours or for your brother; or for the wolf. He said: What about the lost camel? Thereupon he said: You have nothing to do with it; it has a leather bag along with it; and its shoes also. SahihMuslim-017-001-17220Salama Bin Kuhail reported: I heard Sowaid Bin Ghafala say: I went out; and also Zaid Bin Suhan and Salman Bin Rabia for Jihad; and I found a whip and took it up. They said to me: Leave it. I said: No. but I will make announcement of it and if its owner comes then I will return that ; otherwise I will use it; and I refused them. When we returned from Jihad. by a good fortune for me; I performed Pilgrimage. I came to Medina and met Ubay Bin Kaab and related to him the affair of the whip and their opinion the opinion of Zaid Bin Suhan and Salman Bin Rabia about it i. e. I should throw it. Thereupon he said: I found a money bag during the lifetime of Allah Messenger ﷺ which contained one hundred dinars. I came to him along with it; and he said: Make an announcement of it for one year; so I announced it; but did not find anyone who could claim it after recognising it. I again came to him and he said: Make announcement for one year. So I made announcement of it; but I found none who could recognise it. I came to him he said: Make announcement of it for one year. I made announcement of that but did not find one who could recognise it; whereupon he said: Preserve in your mind its number; its bag and its strap; and if its owner comes then return that to him ; otherwise make use of it. So I made use of that. SunanAlNasai-017-001-12024It was narrated that Ibn Abbas said: The first instance of Qasamah during the Aljahiliyah involved a man from Banu Hashim who was employed by a man from Quraish; from another branch of the tribe. He went out with him; driving his camels and another man from Banu Hashim passed by them. The leather rope of that man bag broke; so he said to the hired worker : Help me by giving me a rope with which to tie the handle of my bag; lest the camels run away from me. So he gave him a rope and he tied his gab with it. When they halted; all the camels legs were hobbled except one camel. The one who had hired him said: Why is his camel; out of all of them; not hobbled? He said: There is no rope for it. He said: Where is its rope? He said: A man from Banu Hashim passed by and the leather rope of his bag had broken; and he asked me to help him; he said: Help me by giving me a rope with which to tie the handle of my bag lest the camels run away from me; so I gave him a rope. He struck him with a stick; which led to his death.Then a man from Yemen passed by him the man from Banu Hashim; the man from Banu Hashim; just before he died and he the Hashimi man said: Are you going to attend the Pilgrimage? He said: I do not think I will attend it; but perhaps I will attend it. He said: Will you convey a message from me once in your lifetime? He said: Yes. He said: If you attend the pilgrimage; then call out; O family of Quraish! If they respond; then call out; O family of Hashim! If they respond; then ask for Abu Talib; and tell him that so and so killed me for a rope. Then the hired worker died. When the one who had hired him cam; Abu Talib went to him and said: What happened to our companion? He said: He fell sick and I took good care of him; but he died; so I stopped and buried him. He said: He deserved that from you. Some time passed; then the Yemeni man who had been asked to convey the message arrived at the time of the pilgrimage. He said: O family of Quraish! And they said: Here is Quraish. He said: O family of Banu Hashim! They said: Here is Banu Hashim. He said Where is Abu Talib? He said: Here is Abu Talib. He said: so and so asked me to convey a message to you; that so and so killed him for a camel rope. Abu Talib went to him and said Choose one of three alternatives that we are offering you. If you wish; you may give us one hundred camels; because you killed our companion by mistake: or if you wish; fifty of your men may swear an oath that you did not kill him; or if you wish; we will kill you in retaliation. He went to his people and told them about that; and they said: We will swear the oath. Then a woman from Banu Hashim; who was married to one of their men and had born him a child; came to Abu Talib and said: O Abu Talib; I wish that my son; who is one of these fifty men; should be excused from having to take the oath.; So the excused him. Then one of the men came to him and said: O Abu Talib; you want fifty men to take the oath in lieu of one hundred camels; which means that each man may give two camels instead; so here are two camels; take them from me; and do not make me take the oath. So he accepted them; and did not make him take the oath. Then forty-eight men came and took the oath. They used to give as much honey as zakat as they gave to the Messenger of Allah ﷺ. He said She pulled the grinding stone with her hand so much that it affected her hand; she carried water in a water bag so much so that it affected the upper portion of her chest; she swept the house so much so that her clothes became dirty. The Prophet ﷺ acquired some slaves. So I said Would that you go to your father and ask him for a slave. She then came to him and found some people with him talking to him. She therefore returned. Next day she came again. He asked her ; what was your need? But she kept silence. So I said; I inform you; Apostle of Allaah ﷺ. She pulled grinding stone so much that it affected her hand; she carried water bag so much so that it affected the upper portion of her chest. When the slaves were brought to you I asked her to come to you and to ask you for a slave to save her from the exertion she is suffering. He said Fear Allaah; Fathimah and perform the duty of your Lord and do the work of your family. When you go to bed say Glory be to Allaah thirty three times; Praise be to Allaah thirty three times; Allaah is Most Great thirty four times. This is hundred times. That will be better for you than a servant. MuwataMalik-017-001-35111Malik spoke about what was done among them in the case of a group of people who bought goods; drapery or slaves; and a man heard about it and said to one of the group; I have heard the description and situation of the drapery goods you bought from so-and-so. Shall I give you such-and-such profit to take over your portion? This person agreed; and the man gave him the profit and became a partner in his place. When he looked at the purchase; he saw that it was ugly and found it too expensive. Malik said; It is obliged on him and there is no choice in it for him if he bought it according to a list of contents and the description was well-known. Malik spoke about a man who had drapery goods sent to him; and salesmen came to him and he read to them his list of contents and said; In each bag is such-and-such a wrap from Basra and such-and-such a light wrap from Sabir. Their size is such-and-such; and he named to them types of drapery goods by their sort; and he said; Buy them from me according to this description. They bought the bags according to what he described to them; and then they bought them and found them too expensive and regretted it. Malik said; The sale is binding on them; if the goods agree with the list of contents on which he sold them. Malik said; This is the way of doing things which people still use today.
