And then he said O Hakim This property is like a sweet fresh fruit whoever takes it without greediness he is blessed in it and whoever takes it with greediness he is not blessed in it and he is like a person who eats but is never satisfied and the upper giving hand is better than the lower receiving hand
  8. Narrated Urwa AlZubair said I met Ubaida Bin Saeed Bin AlAs on the day of the battle of Badr and he was covered with armor so much that only his eyes were visible

  10. Jabir narrated that the Prophet said Whichever man is given a lifelong gift for himself and his offspring then it belongs to the one whom it was given it does not return to the one who gave it for he has given a gift which shall be included in the inheritance

  12. Narrated Ibn Abi Mualla from his father The Messenger of Allah gave a Khutbah one day and said Indeed there is a man whose Lord has given him the choice between living in this life as long as he wishes to live and eating from this life as much as he wishes to eat and between meeting his Lord

The Messenger of Allah informs about a worshiper whom Allah gave the choice between Him giving him from the bounty of this life as much as he wishes and between that which is with Allah and he says We will ransom our fathers and mothers for you But the Messenger of Allah was the one given the choice and Abu Bakr was the most knowledgeable of it among them
  14. She said So my companions gathered with Umm Salamah and they said O Umm Salamah The people give their gifts on Aishah day and we desire good as Aishah desires so tell the Messenger of Allah to order the people to give their gifts to him no matter where he is
  15. Then of them are some who wrong themselves and of them are some who follow a middle course and of them are some who are by Allah Leave foremost in good deeds

  17. Qatadah said AlZuhri said A lifelong gift is when it is stipulated that it is for the one to whom it is given and his descendants but if his descendants were not mentioned then the condition is valid and it reverts to the one who gave it
  18. He said Is it a gift or charity If it was a gift it would be for the sake of the Messenger of Allah and to have their needs met and if it was charity then it would be in the cause of Allah
  19. It was narrated from Amr Bin Shuaib from his father that his grandfather said The Messenger of Allah said No one should take back his gift except a father taking back a gift from his son
  20. Tawus said I used to hear the boys say O you who goes back to his vomit But I did not realize that the Messenger of Allah had said this as a parable until we heard that he used to say The likeness of the one who gives a gift then takes it back is that of the dog which eats its vomit
  21. Then they asked him and he gave them then when he had ran out he said Whatever I have of good I will never keep it from you but whoever wants to refrain from asking Allah the Mighty and Sublime will help him to do so and whoever wants to be patient Allah will help him to be patient

It was narrated from Yazid Bin Abi Habib that Muhammad Bin Muslim AlZuhri wrote to him mentioning that Ubaidullah Bin Abdullah told him that Zufar Bin Aws Bin AlHadathan AlNasri told him that Abu AlSanabil Bin Bakak Bin AlSabbaq said to Subaiah AlAslamiyah It is not permissible for you to get married until four months and ten days the longer of the two periods have passed

  66. However when someone settles witha mukatab with the permission of his partner and then the mukatab isunable to pay it is preferable that the one who broke with him returnwhat he has taken from the mukatab for the severance and he can haveback his portion of the mukatab

Malik spokeabout a mukatab who was shared between two men and one of them made asettlement with him for half of what was due to him with thepermission of his partner and then the one who retained possession ofthe slave took less than what his partner settled with him for and themukatab was unable to pay
  68. Malikspoke about a mukatab whose master made a settlement with him and sethim free and what remained of his severance was written against him asdebt then the mukatab died and people had debts against him
  69. Malik said According to the waythings are done among us there is no harm if a man gives a kitaba tohis slave and settles with him for gold and reduces what he is owed ofthe kitaba provided that only the gold is paid immediately

Malik said The way of doing things about whichthere is no dispute among us is that when a mukatab is injured insome way which entails blood money or one of the mukatab s childrenwho is written with him in the kitaba is injured their blood money isthe blood money of slaves of their value and what is appointed tothem as their blood money is paid to the master who has the kitaba andhe reckons that for the mukatab at the end of his kitaba and there isa reduction for the blood money that the master has taken for theinjury
  71. If what remains of his kitaba is one thousand dirhams and theblood money for his injury is one thousand dirhams he is freestraightaway
