Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs. If it is a man that dies, leaving a sister but no child, she shall have half the inheritance: If (such a deceased was) a woman, who left no child, Her brother takes her inheritance: If there are two sisters, they shall have two-thirds of the inheritance (between them): if there are brothers and sisters, (they share), the male having twice the share of the female. Thus doth Allah make clear to you (His law), lest ye err. And Allah hath knowledge of all things.

In what ye leave, their share is a fourth, if ye leave no child; but if ye leave a child, they get an eighth; after payment of legacies and debts. If the man or woman whose inheritance is in question, has left neither ascendants nor descendants, but has left a brother or a sister, each one of the two gets a sixth; but if more than two, they share in a third; after payment of legacies and debts; so that no loss is caused (to any one). Thus is it ordained by Allah; and Allah is All-knowing, Most Forbearing.

For parents, a sixth share of the inheritance to each, if the deceased left children; if no children, and the parents are the (only) heirs, the mother has a third; if the deceased Left brothers (or sisters) the mother has a sixth. (The distribution in all cases ('s) after the payment of legacies and debts. Ye know not whether your parents or your children are nearest to you in benefit. These are settled portions ordained by Allah; and Allah is All-knowing, Al-wise.

But if ye enter houses, salute each other - a greeting of blessing and purity as from Allah. Thus does Allah make clear the signs to you: that ye may understand.

SahihAlBukhari-017-001-1691Narrated Huzail Bin Shirahbil: Abu Mousa was asked regarding the inheritance of a daughter; a son daughter; and a sister. He said; The daughter will take one-half and the sister will take one-half. If you go to Ibn Masud; he will tell you the same. Ibn Masud was asked and was told of Abu Mousa verdict. Ibn Masud then said; If I give the same verdict; I would stray and would not be of the rightly-guided. The verdict I will give in this case; will be the same as the Prophet ﷺ did; i.e. one-half is for daughter; and one-sixth for the son daughter; i.e. both shares make two-thirds of the total property; and the rest is for the sister. He said; Even if she were not my step-daughter; she would be unlawful for me to marry as she is my foster niece. I and Abu Salama were suckled by Thuwaiba. So you should not present to me your daughters or your sisters in marriage. Narrated Urwa:Thuwaiba was the freed slave girl of Abu Lahb whom he had manumitted; and then she suckled the Prophet. When Abu Lahb died; one of his relatives saw him in a dream in a very bad state and asked him; What have you encountered? SahihAlBukhari-017-001-416Narrated Ayoub : Hafsa bint Seereen said; On Id we used to forbid our girls to go out for Id prayer. A lady came and stayed at the palace of Bani Khalaf and I went to her. She said; The husband of my sister took part in twelve holy battles along with the Prophet ﷺ and my sister was with her husband in six of them. My sister said that they used to nurse the sick and treat the wounded. Once she asked; O Allah Messenger ﷺ ! If a woman has no veil; is there any harm if she does not come out on Id day ? The Prophet ﷺ said; Her companion should let her share her veil with her; and the women should participate in the good deeds and in the religious gatherings of the believers. Hafsa added; When Um-Atiya came; I went to her and asked her; Did you hear anything about so-and-so? Um-Atiya said; Yes; let my father be sacrificed for the Prophet ﷺ. And whenever she mentioned the name of the Prophet ﷺ she always used to say; Let my father be sacrificed for him. He said; Virgin mature girls staying often screened or said; Mature girls and virgins staying often screened-Aiyub is not sure as which was right and menstruating women should come out on the Id day. But the menstruating women should keep away from the Mousalla. And all the women should participate in the good deeds and in the religious gatherings of the believers. Hafsa said; On that I said to Um-Atiya; Also those who are menstruating? Um-Atiya replied; Yes. SahihAlBukhari-017-001-4160Narrated Abu Huraira: Abraham did not tell a lie except on three occasion. Twice for the Sake of Allah when he said; I am sick; and he said; I have not done this but the big idol has done it. The third was that while Abraham and Sarah his wife were going on a journey they passed by the territory of a tyrant. Someone said to the tyrant; This man i.e. Abraham is accompanied by a very charming lady. So; he sent for Abraham and asked him about Sarah saying; Who is this lady? Abraham said; She is my sister. Abraham went to Sarah and said; O Sarah! There are no believers on the surface of the earth except you and I. This man asked me about you and I have told him that you are my sister; so dont contradict my statement. The tyrant then called Sarah and when she went to him; he tried to take hold of her with his hand; but his hand got stiff and he was confounded. He asked Sarah. Pray to Allah for me; and I shall not harm you. So Sarah asked Allah to cure him and he got cured. He tried to take hold of her for the second time; but his hand got as stiff as or stiffer than before and was more confounded. He again requested Sarah; Pray to Allah for me; and I will not harm you. Sarah asked Allah again and he became alright. He then called one of his guards who had brought her and said; You have not brought me a human being but have brought me a devil. The tyrant then gave Hajar as a girl-servant to Sarah. Sarah came back to Abraham while he was praying. Abraham; gesturing with his hand; asked; What has happened? She replied; Allah has spoiled the evil plot of the infidel or immoral person and gave me Hajar for service. SahihAlBukhari-017-001-4479Narrated Anas: My uncle Anas Bin AlNadr was absent from the Battle of Badr. He said; O Allah Messenger ﷺ ! I was absent from the first battle you fought against the pagans. By Allah if Allah gives me a chance to fight the pagans; no doubt. Allah will see how bravely I will fight. On the day of Uhud when the Muslims turned their backs and fled; he said; O Allah! I apologize to You for what these i.e. his companions have done; and I denounce what these i.e. the pagans have done. Then he advanced and Saad Bin Muadh met him. He said O Saad Bin Muadh ! By the Lord of AlNadr; Paradise! I am smelling its aroma coming from before the mountain of Uhud; Later on Saad said; O Allah Apostle! I cannot achieve or do what he i.e. Anas Bin AlNadr did. We found more than eighty wounds by swords and arrows on his body. We found him dead and his body was mutilated so badly that none except his sister could recognize him by his fingers. We used to think that the following Verse was revealed concerning him and other men of his sort: Among the believers are men who have been true to their covenant with Allah.......... 33.23 His sister AlRubbaya broke a front tooth of a woman and Allah Messenger ﷺ ordered for retaliation. On that Anas bin AlNadr said; O Allah Messenger ﷺ ! By Him Who has sent you with the Truth; my sister tooth shall not be broken. Then the opponents of Anas sister accepted the compensation and gave up the claim of retaliation. SahihAlBukhari-017-001-5486Narrated Abu Huraira: The Prophet ﷺ said; The Prophet ﷺ Abraham emigrated with Sarah and entered a village where there was a king or a tyrant. The king was told that Abraham had entered the village accompanied by a woman who was one of the most charming women. So; the king sent for Abraham and asked; O Abraham! Who is this lady accompanying you? Abraham replied; She is my sister i.e. in religion. Then Abraham returned to her and said; Do not contradict my statement; for I have informed them that you are my sister. By Allah; there are no true believers on this land except you and 1. Then Abraham sent her to the king. When the king got to her; she got up and performed ablution; prayed and said; O Allah! If I have believed in You and Your Apostle; and have saved my private parts from everybody except my husband; then please do not let this pagan overpower me. On that the king fell in a mood of agitation and started moving his legs. Seeing the condition of the king; Sarah said; O Allah! If he should die; the people will say that I have killed him. The king regained his power; and proceeded towards her but she got up again and performed ablution; prayed and said; O Allah! If I have believed in You and Your Apostle and have kept my private parts safe from all except my husband; then please do not let this pagan overpower me. She the woman sister said; We used to treat the wounded; look after the patients and once I asked the Prophet; Is there any harm for any of us to stay at home if she doesnt have a veil? It was rare that some food was presented to the Prophet ﷺ and it was not mentioned or named. While Allah Messenger ﷺ was about to stretch forth his hand towards the lizard; a woman from amongst the women present there informed the Messenger of Allah ﷺ what they had presented to him. There opon he said: No; but it is not found in the land of my people; and I feel that I have no liking for it. When she visited him the tyrant king came he could help but stretch his hand towards her and his hand was tied up. He said: Supplicate to Allah so that He may release my hand and I will do no harm to you. She did that and the man repeated the same highhandedness and his hand was again tied up more tightly than on the first occasion. He said the same thing to her again; and she again did that supplicated ; but he repeated the same highhandedness and his hands were tied up more tightly than on the previous occasion. He then again said: Supplicate your Lord so that He may set my hand free; by Allah I shall do no harm to you. She did and his hand was freed. Then he called the person who had brought her and said to him: You have brought to me the satan and you have not brought to me a human being; so turn them out from my land; and he gave Hajar as a gift to her. She returned along with Hajar and when Ibrahim ﷺ saw her; he said: How have you returned? She said: With full safety have I returned. Allah held the hand of that debauch and he gave me a maid-servant. I said: Messenger of Allah; may I not bequeath one-third of my property to my sisters? He replied: Do good. I asked: Half? He replied: Do good. He then went out and left me; and said: I do not think; Jabir; you will die of this disease. Allah has revealed verses and described the share of your sisters. He appointed two-thirds for them. Jabir used to say: This verse was revealed about me: They ask thee for a legal decision. They replied: The daughter gets half and the full gets half. The son daughter gets nothing. Go to Ibn Masud and you will find that he agrees with me. So the man came to him and informed him about their opinion. He said: I would then be in error and not be one of those who are rightly guided. MuwataMalik-017-001-34553Malik related to me from Abdulrahman Ibn Abdullah Ibn Abdulrahman Ibn Abi Sasaca that Sulayman Ibn Yasar said; The Messenger of Allah; may Allah bless him and grant him peace; entered the house of Maimuna bint AlHarith and there was a lizard in which there were eggs to eat. Abdullah Ibn Abbas and Khalid Ibn AlWalid were with him. He said; From where did you get this? She replied; My sister; Huzayla bint AlHarith; gave it to me. He then told Abdullah Ibn Abbas and Khalid to eat. They said; Wont you eat; Messenger of Allah? He said; There are those who visit me from Allah. Maimuna said; Messenger of Allah; shall we give you some milk to drink which we have? He said; Yes. When he drank; he said; From where did you get this? She said; My sister; Huzayla gave it to me. The Messenger of Allah; may Allah bless him and grant him peace; said; Do you see your slave-girl whom you asked me for permission to free? Give her to your sister and bring her to your maternal relatives to take care of her. MuwataMalik-017-001-34952Malik related to me from Ibn Shihab from Urwa Ibn AlZubair that Aisha; the wife of the Prophet; may Allah bless him and grant him peace; said; Abu Bakr AlSiddiq gave me palm trees whose produce was twenty awsuq from his property at AlGhaba. When he was dying; he said; By Allah; little daughter; there is no one I would prefer to be wealthy after I die than you. There is no one it is more difficult for me to see poor after I die than you. I gave you palm-trees whose produce is twenty awsuq. Had you cut them and taken possession of them; they would have been yours; but today they are the property of the heirs; and they are your two brothers and your two sisters; so divide it according to the Book of Allah. Aisha continued; I said; My father! By Allah; even if it had been more; I would have left it. There is only Asma. Who is my other sister? Abu Bakr replied; What is in the womb of Kharija? Kharija was the wife of Abu Bakr brother from the Ansar. MuwataMalik-017-001-35026Yahya related to me from Malik from Ibn Shihab that he was asked about the suckling of an older person. He said; Urwa Ibn AlZubair informed me that Abu Hudhayfa Ibn Utba Ibn Rabia; one of the companions of the Messenger of Allah; may Allah bless him and grant him peace; who was present at Badr; adopted Salim who is called Salim; the mawla of Abu Hudhayfa as the Messenger of Allah; may Allah bless him and grant him peace; adopted Zayd Ibn Haritha. He thought of him as his son; and Abu Hudhayfa married him to his brother sister; Fatima bint AlWalid Ibn Utba Ibn Rabia; who was at that time among the first emigrants. She was one of the best unmarried women of the Quraysh. When Allah the Exalted sent down in His Book what He sent down about Zayd Ibn Haritha; Call them after their true fathers. That is more equitable in the sight of Allah. If you do not know who their fathers were then they are your brothers in the deen and your mawali; Surat 33 ayat 5 people in this position were traced back to their fathers. When the father was not known; they were traced to their mawla. Sahla bint Suhayl who was the wife of Abu Hudhayfa; and one of the tribe of Amr Ibn Luay; came to the Messenger of Allah; may Allah bless him and grant him peace; and said; Messenger of Allah! We think of Salim as a son and he comes in to see me while I am uncovered. We only have one room; so what do you think about the situation? The Messenger of Allah; may Allah bless him and grant him peace; said; Give him five drinks of your milk and he will be mahram by it. She then saw him as a foster son. Aisha umm Almuminin took that as a precedent for whatever men she wanted to be able to come to see her. She ordered her sister; Umm Kulthum bint Abi Bakr AlSiddiq and the daughters of her brother to give milk to whichever men she wanted to be able to come in to see her. The rest of the wives of the Prophet; may Allah bless him and grant him peace; refused to let anyone come in to them by such nursing. They said; No! By Allah! We think that what the Messenger of Allah; may Allah bless him and grant him peace; ordered Sahla bint Suhayl to do was only an indulgence concerning the nursing of Salim alone. No! By Allah! No one will come in upon us by such nursing! MuwataMalik-017-001-35139Malik said; The generally agreed on way of doing things among us is that full siblings do not inherit anything with sons nor anything with grandsons through a son; nor anything with the father. They do inherit with the daughters and the granddaughters through a son when the deceased does not leave a paternal grandfather. Any property that is left over; they are in it as paternal relations. One begins with the people who are allotted fixed shares. They are given their shares. If there is anything left over after that; it belongs to the full siblings. They divide it between themselves according to the Book of Allah; whether they are male or female. The male has a portion of two females. If there is nothing left over; they have nothing. If the deceased does not leave a father or a paternal grandfather or children or male or female grandchildren through a son; a single full sister gets a half. If there are two or more full sisters; they get two thirds. If there is a brother with them; sisters; whether one or more; do not have a fixed share. One begins with whoever shares in the fixed shares. They are given their shares. Whatever remains after that goes to the full siblings. The male has the portion of two females except in one case; in which the full siblings have nothing. They share in this case the third of the half-siblings by the mother. That case is when a woman dies and leaves a husband; a mother; half- siblings by her mother; and full siblings. The husband has a half. The mother has one sixth. The half-siblings by the mother have a third. Nothing is left after that; so the full siblings share in this case with the half-siblings by the mother in their third. The male has the portion of two females in as much as all of them are siblings of the deceased by the mother. They inherit by the mother. That is because Allah; the Blessed; the Exalted; said in His Book; If a man or a woman has no direct heir and he has a brother or a sister; each one of the two gets a sixth. If there are more than that; they share equally in the third. Surat 4 ayat 12. MuwataMalik-017-001-35143Yahya related to me from Malik that he had heard that Sulayman Ibn Yasar said; Umar Ibn AlKhattab; Uthman Ibn Affan; andZayd Ibn Thabit gave the grandfather a third with full siblings. Malik said; The generally agreed on way of doing things among us and what I have seen the people of knowledge in our city doing is that the paternal grandfather does not inherit anything at all with the father. He is given a sixth as a fixed share with the son and the grandson through a son. Other than that; when the deceased does not leave a mother or a paternal aunt; one begins with whoever has a fixed share; and they are given their shares. If there is a sixth of the property left over; the grandfather is given a sixth as a fixed share. Malik said; When someone shares with the grandfather and the full siblings in a specified share; one begins with whoever shares with them of the people of fixed shares. They are given their shares. What is left over after that belongs to the grandfather and the full siblings. Then one sees which is the more favourable of two alternatives for the portion of the grandfather. Either a third is allotted to him and the siblings to divide between them; and he gets a share as if he were one of the siblings; or else he takes a sixth from all the capital. Whichever is the best portion for the grandfather is given to him. What is left after that; goes to the full siblings. The male gets the portion of two females except in one particular case. The division in this case is different from the preceding one. This case is when a woman dies and leaves a husband; mother; full sister and grandfather. The husband gets a half; the mother gets a third; the grandfather gets a sixth; and the full sister gets a half. The sixth of the grandfather and the half of the sister are joined and divided into thirds. The male gets the share of two females. Therefore; the grandfather has two thirds; and the sister has one third. Malik said; The inheritance of the half-siblings by the father with the grandfather when there are no full siblings with them; is like the inheritance of the full siblings in the same situation. The males are the same as their males and the females are the same as their females. When there are both full siblings and half-siblings by the father; the full siblings include in their number the number of half-siblings by the father; to limit the inheritance of the grandfather; i.e.; if there was only one full sibling with the grandfather. They would share; after the allotting of the fixed shares; the remainder of the inheritance between them equally. If there were also two half-siblings by the father; their number is added to the division of the sum; which would then be divided four ways. A quarter going to the grandfather and three-quarters going to the full siblings who annex the shares technically allotted to the half-siblings by the father. They do not include the number of half-siblings by the mother; because if there were only half-siblings by the father they would not inherit anything with the grandfather and all the capital would belong to the grandfather; and so the siblings would not get anything after the portion of the grandfather. It belongs to the full siblings more than the half-siblings by the father; and the half-siblings by the father do not get anything with them unless the full siblings consist of one sister. If there is one full sister; she includes the grandfather with the half-siblings by her father in the division; however many. Whatever remains for her and these half-siblings by the father goes to her rather than them until she has had her complete share; which is half of the total capital. If there is surplus beyond half of all the capital in what she and the half-siblings by the father acquire it goes to them. The male has the portion of two females. MuwataMalik-017-001-35147Yahya related to me from Malik from Zayd Ibn Aslam that Umar Ibn AlKhattab asked the Messenger of Allah; may Allah bless him and grant him peace; about someone who died without parents or offspring; and the Messenger of Allah; may Allah bless him and grant him peace; said to him; The ayat which was sent down in the summer at the end of the Surat AlNisa Surat 4 is enoughfor you. Malik said; The generally agreed on way of doing things among us; in which there is no dispute; and which I saw the people of knowledge in our city doing; is that the person who leaves neither parent or offspring can be of two types. As for the kind described in the ayat which was sent down at the beginning of the Surat AlNisa in which Allah; the Blessed; the Exalted! said; If a man or a woman has no direct heir; but has a brother or a sister by the mother; each of the two has a sixth. If there are more than that; they share equally in a third. Surat 4 ayat 12 This heirless one does not have heirs among his mother siblings since there are no children or parents. As for the other kind described in the ayat which comes at the end of the Surat AlNisa; Allah; the Blessed; the Exalted; said in it; They will ask you for a decision. Say; Allah gives you a decision about the indirect heirs. If a man perishes having no children; but he has a sister; she shall receive a half of what he leaves; and he is her heir if she has no children. If there are two sisters; they shall receive two-thirds of what he leaves. If there are brothers and sisters; the male shall receive the portion of two females. Allah makes clear to you that you might not go astray. Allah has knowledge of everything Surat 4 ayat 176. Malik said; If this person without direct heirs parents or children has siblings by the father; they inherit with the grandfather from the person without direct heirs. The grandfather inherits with the siblings because he is more entitled to the inheritance than them. That is because he inherits a sixth with the male children of the deceased when the siblings do not inherit anything with the male children of the deceased. How can he not be like one of them when he takes a sixth with the children of the deceased? How can he not take a third with the siblings while the brother sons take a third with them? The grandfather is the one who overshadows the half-siblings by the mother and keeps them from inheriting. He is more entitled to what they have because they are omitted for his sake. If the grandfather did not take that third; the half-siblings by the mother would take it and would take what does not return to the half-siblings by the father.
