So we sat with him and my father started talking to him saying; O Abu Barza! Dont you see in what dilemma the people has fallen? The first thing heard him saying I seek reward from Allah for myself because of being angry and scornful at the Quraish tribe. O you Arabs! You know very well that you were in misery and were few in number and misguided; and that Allah has brought you out of all that with Islam and with Muhammad till He brought you to this state of prosperity and happiness which you see now; and it is this worldly wealth and pleasures which has caused mischief to appear among you. SahihAlBukhari-017-001-395Narrated Abu Saeed AlKhudri: The Prophet ﷺ used to proceed to the Mousalla on the days of Eid AlFitr and Eid AlAdha; the first thing to begin with was the prayer and after that he would stand in front of the people and the people would keep sitting in their rows. Then he would preach to them; advise them and give them orders; i.e. Khutba. And after that if he wished to send an army for an expedition; he would do so; or if he wanted to give and order; he would do so; and then depart. The people followed this tradition till I went out with Marwan; the Governor of Medina; for the prayer of Eid AlAdha or Eid AlFitr. When we reached the Mousalla; there was a pulpit made by Kathir Bin AlSalt. Marwan wanted to get up on that pulpit before the prayer. I got hold of his clothes but he pulled them and ascended the pulpit and delivered the Khutba before the prayer. I said to him; By Allah; you have changed the Prophet tradition. He replied; O Abu Said! Gone is that which you know. I said; By Allah! What I know is better than what I do not know. SahihAlBukhari-017-001-7141Narrated Yousif Bin Mahak: Marwan had been appointed as the governor of Hijaz by Muawiya. He delivered a sermon and mentioned Yazid Bin Muawiya so that the people might take the oath of allegiance to him as the successor of his father Muawiya. Then Abdulrahman Bin Abu Bakr told him something whereupon Marwan ordered that he be arrested. But Abdulrahman entered Aisha house and they could not arrest him. She brought this dispute before Marwan Bin AlHakam. Saeed said: How could I take a part of her land; after what I heard from Allah Messenger may peace be uponhim ? He Marwan said: What did you hear from Allah Messenger ﷺ ? He said: I heard Allah Messenger ﷺ say: He who wrongly took a span of land would be made to wear around his neck seven earths. Marwan said: I do not ask any evidence from you after this. He Said said: O Allah; make her blind if she has told a lie and kill her in her own land. SahihMuslim-017-001-21528Ubaidullah Bin Abdullah Bin Utba reported that Amr Bin Hafs Bin AlMughira set out along with Ali Bin Abi Talib Allah be pleased with him to the Yemen and sent to his wife the one pronouncement of divorce which was still left from the irrevocable divorce; and he commanded AlHarith Bin Hisham and Ayash Bin Abu Rabia to give her maintenance allowance. They said to her: By Allah; there is no maintenance allowance for you; except in case you are pregnant. She came to Allah Apostle may peace he upon him and mentioned their opinion to him; whereupon he said: There is no maintenance allowance for you. Then she sought permission to move to another place ; and he the Holy Prophet permitted her. She said: Allah Messenger; where should I go ? He said: To the house of Ibn Umm Maktum and; as he is blind; she could put off her garmeqts in his presence and he would not see her. And when her Idda was over. Allah Apostle ﷺ married her to Usama Bin Zaid. Marwan the governor of Medina sent Qabisa Bin Dhuwaib in order to ask her about this hadith; and she narrated it to him; whereupon Marwan said: We have not heard this hadith but from a woman. We would adopt a safe path where we found the people. Fatima said that when these words of; Marwan were conveyed to her. There is between me and you the word of Allah; the Exalted and Majestic: Do not turn them out of their houses. SahihMuslim-017-001-22225Abu Bakr he is Abu Bakr Bin Abdulrahman Bin Harith reported: I heard Abu Huraira Allah be pleased with him narrating that he who is overtaken by dawn in a state of seminal emission should not observe fast. I made a mention of it to Abdulrahman Bin Harith i. e. to his father but he denied it. Abdulrahman went and I also went along with him till we came toAisha and Umm Salamah Allah be pleased with both of them and Abdulrahman asked them about it. Both of them said: At times it so happened that the Messenger of Allah ﷺ woke up in the morning in a state of junub but without seminal emission in a dream and observed fast He the narrator said: We then proceeded till we went to Marwan and Abdulrahman made a mention of it to him. Upon this Marwan said: I stress upon you with an oath that you better go to Abu Huraira and refer to him what is said about it. So we came to Abu Huraira and Abu Bakr had been with us throughout and Abdulrahman made a mention of it to him; whereupon Abu Huraira said: Did they the two wives of the Holy Prophet tell you this? He replied: Yes Upon this Abu Huraira said: They have better knowledge. Abu Huraira then attributed that what was said about it to Fadl Bin Abbas and said: I heard it from Fadl and not from the Messenger of Allah ﷺ. Abu Huraira then retracted from what he used to say about it. SahihMuslim-017-001-23600Abu Salih AlSamman reported: I narrate to you what I heard and saw from Abu Saeed AlKhudri: One day I was with Abu Saeed and he was saying prayer on Friday turning to a thing which concealed him from the people when a young man from Banu Muait came there and he tried to pass in front of him; he turned him back by striking his chest. He looked about but finding no other way to pass except in front of Abu Said; made a second attempt. He Abu Said turned him away by Striking his chest more vigorously than the first stroke. SunanAlNasai-017-001-13220Usaid Bin AlZubair AlAnsari; who was one of Banu Harithah narrated that: there was the governor of AlYamamah; and Marwan wrote to him saying that Muawiyah had written to him; saying that any man who had something stolen from him had more right to it wherever he found it. Then Marwan wrote saying that to me Usaid. I wrote to Marwan saying that the Prophet had ruled that if the one who bought it from the one who stole it is ot guilty of anything and did not realize that it was stolen goods ; then the owner has the choice: If he wishes; he may buy it from the one who bought it from the thief; or if he wishes he may go after the thief. SunanAlNasai-017-001-14427Narrated Ubaidullah Bin Abdullah Bin Utbah: It was narrated from Ubaidullah Bin Abdullah Bin Utbah that during the reign of Marwan; Abdullah Bin Amr Bin Uthman; who was a young man; issued a final divorce to the daughter of Saeed Bin Zaid; whose mother was Bint Qais. Her maternal aunt; Fatimah bint Qais; sent word to her telling her to move from the house of Abdullah Bin Amr. Marwan heard of that and he sent word to the daughter of Saeed; telling her to go back to her home; and asking her why she had moved from her home before her Iddah was over? She sent word to him telling him that her maternal aunt had told her to do that. Fatimah bint Qais said that she had been married to Abu Amr Bin Hafs; and when the Messenger of Allah appointed Ali Bin Abi Talib as governor of Yemen; he went out with him and sent word to her that she was divorced with the third Talaq. He told AlHarith Bin Hisham and Ayash Bin Abi Raiah to spend on her. She sent word to AlHarith and Ayash asking them what her husband had told them to spend on her; and they said: By Allah; she has no right to any maintenance from us; unless she is pregnant; and she cannot come into our home without our permission. She said that she came to the Messenger of Allah and told him about that; and he stated that they were correct. Fatimah said: Where should I move to; O Messenger of Allah? He said: Move to the home of Ibn Umm Maktum; the blind man whom Allah; the Mighty and Sublime; named in His Book. Fatimah said: So I observed my Iddah there. He was a man who has lost his sight; so I used to take off my garments in his house; until the Messenger of Allah married me to Usamah Bin Zaid. Marwan criticized her for that and said: I have never heard this Hadith from anyone before you. SunanAlNasai-017-001-15054Ubaidullah Bin Abdullah Bin Utbah narrated that Abdullah Bin Amr Bin Uthman divorced the daughter of Saeed Bin Zaid -whose mother was Hamnah bint Qais- irrevocably. Her maternal aunt Fatimah bint Qais told her to move from the house of Abdullah Bin Amr. Marwan heard of that; so he sent word to her; telling her to go back to her home until her Iddah was over. She sent a word to him telling him that her maternal aunt Fatimah had issued a Fatwa to that effect; and she told her that the Messenger of Allah had issued a Fatwa to her; telling her to move when Abu Amr Bin Hafs AlMakhzumi divorced her. Marwan sent Qabisah Bin Dhuaib to Fatimah to ask her about that. She said that she had been married to Abu Amr when the Messenger of Allah appointed Ali Bin Abi Talib as governor of Yemen; and he went out with him; then he sent word to her divorcing her; and that was the final divorce for her. He told her to ask AlHarith Bin Hisham and Ayash for her provisions that her husband had allocated for her. They said: By Allah; she is not entitled to any provision. So; she sent to AlHarith Bin Hisham and Ayash asking them for the provisions from us unless she is pregnant; and she has no right to live in our house unless we permit her. Fatimah said that she went to the Messenger of Allah and told him about that and he said that they had told the truth. She said: I said: Where shall I move to; O Messenger of Allah? He said: Move to the house of Ibn Umm Maktum -who was the blind man; concerning whom Allah rebuked him in His Book. I moved to his house; and I used to take off my outer garments. SunanAbuDawoud-017-001-25129Ubaid Allah said Marwan sent someone Qabisah to Fatimah and asked her about the case. She said that she was the wife of Abu Hafs. The Prophet ﷺ appointed Ali as governor in a certain part of Yemen. Her husband also proceeded with him. From there he sent a message to her pronouncing one divorce that had yet remained. He commanded Ayash Bin Abi Rabiah and AlHarith Bin Hisham to provide maintenance to her. They said By Allah there is no sustenance for her except in case she is pregnant. She came to the Prophet ﷺ who said There is no sustenance for you except in case you are pregnant. She then asked permission to shift from her house and he gave her permission. She asked Where should I shift. Apostle of Allaah ﷺ ? The Apostle of Allaah ﷺ said to Ibn Umm Maktum. He was blind. She would undress herself and he could not see her. She lived there till her waiting period passed. The Prophet ﷺ married her to Usamah. Qabisah then returned to Marwan and narrated that to him. Marwan said We did not hear this tradition except from a woman; so we shall follow the reliable practice on which we found the people. When this reached Fatimah she said between me and you is the Book of Allah. Allaah the exalted said Divorce them for their waiting period... Thou knowest not it may be that Allaah will afterward bring some new thing to pass. She said What a new thing will emerge after triple divorce.Abu Dawud said A similar tradition has been narrated by Yunus on the authority of AlZuhri. Marwan said according to Sulayman version : Abdulrahman forced me. Marwan said according to the version of AlQasim : Did not the case of Fatimah daughter of Qays reach you? Aisha replied: There would be no harm to you if you did not make mention of the tradition of Fatimah. SunanAbuDawoud-017-001-26584Narrated Rafi Ibn Khadij: Muhammad Ibn Yahya Ibn Hibban said: A slave stole a plant of a palm-tree from the orchard of a man and planted it in the orchard of his master. The owner of the plant went out in search of the plant and he found it. He solicited help against the slave from Marwan Ibn AlHakam who was the Governor of Medina at that time. Marwan confined the slave and intended to cut off his hand. The slave master went to Rafi Ibn Khadij and asked him about it. He told him that he had heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. The man then said: Marwan has seized my slave and wants to cut off his hand. I wish you to go with me to him and tell him that which you have heard from the Messenger of Allah ﷺ. So Rafi Ibn Khadij went with him and came to Marwan Ibn AlHakam. Rafi said to him: I heard the Messenger of Allah ﷺ say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. SunanAbuDawoud-017-001-29243Narrated Umar Ibn Abd AlAziz: AlMughirah Ibn Shubah said: Umar Ibn Abd AlAziz gathered the family of Marwan when he was made caliph; and he said: Fadak belonged to the Messenger of Allah ﷺ ; and he made contributions from it; showing repeated kindness to the poor of the Banu Hashim from it; and supplying from it the cost of marriage for those who were unmarried. Fatimah asked him to give it to her; but he refused. That is how matters stood during the lifetime of the Messenger of Allah ﷺ till he passed on i.e. died. When Abu Bakr was made ruler he administered it as the Prophet ﷺ had done in his lifetime till he passed on. Then when Umar Ibn AlKhattab was made ruler he administered it as they had done till he passed on. Then it was given to Marwan as a fief; and it afterwards came to Umar Ibn Abd AlAziz. Umar Ibn Abd AlAziz said: I consider I have no right to something which the Messenger of Allah ﷺ refused to Fatimah; and I call you to witness that I have restored it to its former condition; meaning in the time of the Messenger of Allah ﷺ.Abu Dawud said: When Umar Bin Abd AlAziz was made caliph its revenue was forty thousand dinars; and when he died its revenue was four hundred dinars. MuwataMalik-017-001-34800Yahya related to me from Malik from Yahya Ibn Said from Muhammad Ibn Yahya Ibn Habban that a slave stole a small palm from a man garden and planted it in the garden of his master. The owner of the palm went out looking for the palm and found it. He asked for help against the slave from Marwan Ibn AlHakam. Marwan jailed the slave and wanted to cut off his hand. The master of the slave rushed off to Rafi Ibn Khadij and asked him about it. Rafi informed him that he heard the Messenger of Allah; may Allah bless him and grant him peace; say; The hand is not cut off for fruit or palm pith. The man said; Marwan Ibn AlHakam has taken a slave of mine and wants to cut off his hand. I would like you to go with me to him so you can tell him what you heard from the Messenger of Allah; may Allah bless him and grant him peace. So; Rafi went with him to Marwan Ibn AlHakam. He said; Did you arrest a slave for this? He said; Yes. He said; What will you do with him? He said; I want to cut off his hand. They went to Marwan Ibn AlHakam who was the Amir of Madina. Marwan decided that Zayd Ibn Thabit must take an oath on the mimbar. Zayd Ibn Thabit said; I swear to it where I am. Marwan said; No; by Allah! only in the place of sorting out claims i.e. the mimbar. Zayd Ibn Thabit began to take an oath that his right was true; and he refused to take an oath near the mimbar. MuwataMalik-017-001-34978Malik related to me that he heard Rabia Ibn Abi Abdulrahman and others mention that AlFurafisa Ibn Umar AlHanafi had a mukatab who offered to pay him all of his kitaba that he owed. AlFurafisa refused to accept it and the mukatab went to Marwan Ibn AlHakam who was the amir of Madina and brought up the matter. Marwan summoned AlFurafisa and told him to accept. He refused. Marwan then ordered that the payment be taken from the mukatab and placed in the treasury. He said to the mukatab Go; you are free. When AlFurafisa saw that; he took the money. Malik said; What is done among us when a mukatab pays all the instalments he owes before their term; is that it is permitted to him. The master cannot refuse him that. That is because payment removes every condition from the mukatab as well as service and travel. The setting free of a man is not complete while he has any remaining slavery; and neither would his inviolability as a free man be complete and his testimony permitted and inheritance obliged and such things in that situation. His master must not make any stipulation of service on him after he has been set free. Malik said that it was permitted for a mukatab who became extremely ill and wanted to pay his master all his instalments because his heirs who were free would then inherit from him and he had no children with him in his kitaba; to do so; because by that he completed his inviolability as a free man; his testimony was permitted; and his admission of what he owed of debts to people was permitted. His bequest was permitted as well. Aisha said; It is not as Abu Huraira says Abdulrahman Do you dislike what the Messenger of Allah; may Allah bless him and grant him peace; used to do?; and Abdulrahman said; No; by Allah.
