In that case there is no blame on either of them if they re-unite, provided they feel that they can keep the limits ordained by Allah. Such are the limits ordained by Allah, which He makes plain to those who understand.

And O ye Believers! turn ye all together towards Allah, that ye may attain Bliss.

When there come to you believing women refugees, examine (and test) them: Allah knows best as to their Faith: if ye ascertain that they are Believers, then send them not back to the Unbelievers. They are not lawful (wives) for the Unbelievers, nor are the (Unbelievers) lawful (husbands) for them. But pay the Unbelievers what they have spent (on their dower), and there will be no blame on you if ye marry them on payment of their dower to them. But hold not to the guardianship of unbelieving women: ask for what ye have spent on their dowers, and let the (Unbelievers) ask for what they have spent (on the dowers of women who come over to you). Such is the command of Allah: He judges (with justice) between you. And Allah is Full of Knowledge and Wisdom.

This instruction is for all amongst you, who believe in Allah and the Last Day. That is (the course Making for) most virtue and purity amongst you and Allah knows, and ye know not.

Nor is it lawful for them to hide what Allah Hath created in their wombs, if they have faith in Allah and the Last Day. And their husbands have the better right to take them back in that period, if they wish for reconciliation. And women shall have rights similar to the rights against them, according to what is equitable; but men have a degree (of advantage) over them. And Allah is Exalted in Power, Wise.

SahihAlBukhari-017-001-1614Narrated Ibn Abbas: Lian was mentioned in the presence of the Prophet; Aasi m Bin Adi said a statement about it; and when he left; a man from his tribe came to him complaining that he had seen a man with his wife. Aasi m said; I have been put to trial only because of my statement. So he took the man to the Prophet ﷺ and the man told him about the incident. The man husband was of yellow complexion; thin; and of lank hair; while the man whom he had accused of having been with his wife; was reddish brown with fat thick legs and fat body. The Prophet ﷺ said; O Allah! Reveal the truth. Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn Abbas in the gathering; Was that the same lady about whom the Prophet ﷺ said; If I were to stone any lady for committing illegal sexual intercourse to death without witnesses; I would have stoned that lade to death? SahihAlBukhari-017-001-1709Narrated AlAswad: Aisha bought Barira in order to manumit her; but her masters stipulated that her Wala after her death would be for them. Aisha said; O Allah Messenger ﷺ ! I have bought Barira in order to manumit her; but her masters stipulated that her Wala will be for them. The Prophet ﷺ said; Manumit her as the Wala is for the one who manumits the slave ; or said; The one who pays her price. Then Aisha bought and manumitted her. After that; Barira was given the choice by the Prophet to stay with her husband or leave him. She said; If he gave me so much and so much money I would not stay with him. AlAswad added: Her husband was a free man. The sub-narrator added: The series of the narrators of AlAswad statement is incomplete. SahihAlBukhari-017-001-1991Narrated Abu Haraira: Allah Messenger ﷺ said; A lady slave should not be given in marriage until she is consulted; and a virgin should not be given in marriage until her permission is granted. Then Allah revealed: And those of you who die and leave wives should bequeath for their wives a year maintenance and residence without turning them out; but if they leave; there is no blame on you for what they do of themselves; provided it is honorable i.e. lawful marriage 2.240 Mujahid said: Allah has ordered that a widow has the right to stay for seven months and twenty days with her husband relatives through her husband will and testament so that she will complete the period of one year of Iddah. But the widow has the right to stay that extra period or go out of her husband house as is indicated by the statement of Allah: But if they leave there is no blame on you;... 2.240 Ibn Abbas said: The above Verse has cancelled the order of spending the period of the Iddah at her late husband house; and so she could spend her period of the Iddah wherever she likes. And Allah says: Without turning them out. SahihAlBukhari-017-001-3212Narrated Saeed Bin Jubair: I said to Ibn Umar; If a man accuses his wife of illegal sexual intercourse what is the judgment ? He said; Allah Prophet separated the couple of Bani Ajlan when the husband accused his wife for an illegal sexual intercourse. SahihAlBukhari-017-001-3517Narrated Urwa Bin AlZubair: Aisha; the wife of the Prophet ﷺ told him that there were four types of marriage during Pre-Islamic period of Ignorance. One type was similar to that of the present day i.e. a man used to ask somebody else for the hand of a girl under his guardianship or for his daughter hand; and give her Mahr and then marry her. The second type was that a man would say to his wife after she had become clean from her period. Send for so-and-so and have sexual intercourse with him. Her husband would then keep awy from her and would never sleep with her till she got pregnant from the other man with whom she was sleeping. When her pregnancy became evident; he husband would sleep with her if he wished. Her husband did so i.e. let his wife sleep with some other man so that he might have a child of noble breed. Such marriage was called as AlIstibda. Another type of marriage was that a group of less than ten men would assemble and enter upon a woman; and all of them would have sexual relation with her. If she became pregnant and delivered a child and some days had passed after delivery; she would sent for all of them and none of them would refuse to come; and when they all gathered before her; she would say to them; You all know waht you have done; and now I have given birth to a child. So; it is your child so-and-so! naming whoever she liked; and her child would follow him and he could not refuse to take him. The fourth type of marriage was that many people would enter upon a lady and she would never refuse anyone who came to her. Those were the prostitutes who used to fix flags at their doors as sign; and he who would wished; could have sexual intercourse with them. If anyone of them got pregnant and delivered a child; then all those men would be gathered for her and they would call the Qaif persons skilled in recognizing the likeness of a child to his father to them and would let the child follow the man whom they recognized as his father and she would let him adhere to him and be called his son. The man would not refuse all that. SahihAlBukhari-017-001-3577Narrated Aisha: Eleven women sat at a place and promised and contracted that they would not conceal anything of the news of their husbands. The first one said; My husband is like the meat of a slim weak camel which is kept on the top of a mountain which is neither easy to climb; nor is the meat fat; so that one might put up with the trouble of fetching it. The second one said; I shall not relate my husband news; for I fear that I may not be able to finish his story; for if I describe him; I will mention all his defects and bad traits. The third one said; My husband; the too-tall! if I describe him and he hears of that he will divorce me; and if I keep quiet; he will keep me hanging neither divorcing me nor treating me as a wife. The fourth one said; My husband is moderate in temper like the night of Tihama: neither hot nor cold; I am neither afraid of him; nor am I discontented with him. The fifth one said; My husband; when entering the house is a leopard sleeps a lot ; and when going out; is a lion boasts a lot. He does not ask about whatever is in the house. The sixth one said; If my husband eats; he eats too much leaving the dishes empty ; and if he drinks he leaves nothing; if he sleeps he sleeps he rolls himself alone in our blankets ; and he does not insert his palm to inquire about my feelings. The seventh one said; My husband is a wrong-doer or weak and foolish. All the defects are present in him. He may injure your head or your body or may do both. The eighth one said; My husband is soft to touch like a rabbit and smells like a Zarnab a kind of good smelling grass. The ninth one said; My husband is a tall generous man wearing a long strap for carrying his sword. His ashes are abundant i.e. generous to his guests and his house is near to the people who would easily consult him. The tenth one said; My husband is Malik possessor ; and what is Malik? Malik is greater than whatever I say about him. He is beyond and above all praises which can come to my mind. Most of his camels are kept at home ready to be slaughtered for the guests and only a few are taken to the pastures. When the camels hear the sound of the lute or the tambourine they realize that they are going to be slaughtered for the guests. The eleventh one said; My husband is Abu Zar and what is Abu Zar i.e.; what should I say about him ? He has given me many ornaments and my ears are heavily loaded with them and my arms have become fat i.e.; I have become fat. And he has pleased me; and I have become so happy that I feel proud of myself. He found me with my family who were mere owners of sheep and living in poverty; and brought me to a respected family having horses and camels and threshing and purifying grain. Whatever I say; he does not rebuke or insult me. When I sleep; I sleep till late in the morning; and when I drink water or milk ; I drink my fill. The mother of Abu Zar and what may one say in praise of the mother of Abu Zar? Her saddle bags were always full of provision and her house was spacious. As for the son of Abu Zar; what may one say of the son of Abu Zar? His bed is as narrow as an unsheathed sword and an arm of a kid of four months satisfies his hunger. As for the daughter of Abu Zar; she is obedient to her father and to her mother. She has a fat well-built body and that arouses the jealousy of her husband other wife. As for the maid slave girl of Abu Zar; what may one say of the maid slavegirl of Abu Zar? She does not uncover our secrets but keeps them; and does not waste our provisions and does not leave the rubbish scattered everywhere in our house. The eleventh lady added; One day it so happened that Abu Zar went out at the time when the milk was being milked from the animals; and he saw a woman who had two sons like two leopards playing with her two breasts. On seeing her he divorced me and married her. Thereafter I married a noble man who used to ride a fast tireless horse and keep a spear in his hand. He gave me many things; and also a pair of every kind of livestock and said; Eat of this ; O Umm Dharr; and give provision to your relatives. She added; Yet; all those things which my second husband gave me could not fill the smallest utensil of Abu Zars. SahihAlBukhari-017-001-416Narrated Ayoub : Hafsa bint Seereen said; On Id we used to forbid our girls to go out for Id prayer. A lady came and stayed at the palace of Bani Khalaf and I went to her. She said; The husband of my sister took part in twelve holy battles along with the Prophet ﷺ and my sister was with her husband in six of them. My sister said that they used to nurse the sick and treat the wounded. Once she asked; O Allah Messenger ﷺ ! If a woman has no veil; is there any harm if she does not come out on Id day ? The Prophet ﷺ said; Her companion should let her share her veil with her; and the women should participate in the good deeds and in the religious gatherings of the believers. Hafsa added; When Um-Atiya came; I went to her and asked her; Did you hear anything about so-and-so? Um-Atiya said; Yes; let my father be sacrificed for the Prophet ﷺ. And whenever she mentioned the name of the Prophet ﷺ she always used to say; Let my father be sacrificed for him. He said; Virgin mature girls staying often screened or said; Mature girls and virgins staying often screened-Aiyub is not sure as which was right and menstruating women should come out on the Id day. But the menstruating women should keep away from the Mousalla. And all the women should participate in the good deeds and in the religious gatherings of the believers. Hafsa said; On that I said to Um-Atiya; Also those who are menstruating? Um-Atiya replied; Yes. SahihMuslim-017-001-20714Aisha reported that one day there sat together eleven women making an explicit promise amongst themselves that they would conceal nothing about their spouses. The first one said: My husband is a sort of the meat of a lean camel placed at the top of a hill; which it is difficult to climb up; nor the meat is good enough that one finds in oneself the urge to take it away from the top of that mountain. The second one said: My husband is so bad that I am afraid I would not be able to describe his faults-both visible and invisible completely. The third one said: My husband is a long-statured fellow i. e. he lacks intelligence. If I give vent to my feelings about him; he would divorce me; and if I keep quiet I would be made to live in a state of suspense neither completely abandoned by him nor entertained as wife. The fourth one said: My husband is like the night of Tihama the night of Hijaz and Mecca ; neither too cold nor hot; neither there is any fear of him nor grief. The fifth one said: My husband is like a leopard as he enters the house; and behaves like a lion when he gets out; and he does not ask about that which he leaves in the house. The sixth one said: So far as my husband is concerned; he eats so much that nothing is left back and when he drinks he drinks that no drop is left behind. And when he lies down he wraps his body and does not touch me so that he may know my grief. The seventh one said: My husband is heavy in spirit; having no brightness in him; impotent; suffering from all kinds of conceivable diseases; heaving such rough manners that he may break my head or wound my body; or may do both. The eighth one said: My husband is as sweet as the sweet-smelling plant; and as soft as the softness of the hare. The ninth one said: My husband is the master of a lofty building; long-statured; having heaps of ashes at his door and his house is near the meeting place and the inn. The tenth one said: My husband is Malik; and how fine Malik is; much above appreciation and praise of mine. He has many folds of his camel; more in number than the pastures for them. When they the camels hear the sound of music they become sure that they are going to be slaughtered. The eleventh one said: My husband is Abu Zara. How fine Abu Zara is! He has suspended in my ears heavy ornaments and fed me liberally that my sinews and bones are covered with fat. So he made me happy. He found me among the shepherds living in the side of the mountain; and he made me the owner of the horses; camels and lands and heaps of grain and he finds no fault with me. I sleep and get up in the morning at my own sweet will and drink to my heart content. The mother of Abu Zara; how fine is the mother of Abu Zara! Her bundles are heavily packed or receptacles in her house are filled to the brim and the house quite spacious. So far as the son of Abu Zara is concerned; his bed is as soft as a green palm-stick drawn forth from its bark; or like a sword drawn forth from its scabbard; and whom just an arm of a lamb is enough to satiate. So far as the daughter of Abu Zara is concerned; how fine is the daughter of Abu Zara; obedient to her father; obedient to her mother; wearing sufficient flesh and a source of jealousy for her co-wife. As for the slave-girl of Abu Zara; how fine is she; she does not disclose our affairs to others outside the four walls of the house. She does not remove our wheat; or provision; or take it forth; or squander it; but she preserves it faithfully as a sacred trust. And she does not let the house fill with rubbish. One day Abu Zara went out of his house when the milk was churned in the vessels; that he met a woman; having two children like leopards playing with her pomegranates chest under her vest. He divorced me Umm Zara and married that woman whom Abu Zara met on the way. I Umm Zara later on married another person; a chief; who was an expert rider; and a fine archer: he bestowed upon me many gifts and gave me one pair of every kind of animal and said: Umm Zara; make use of everything you need and send forth to your parents but the fact is that even if I combine all the gifts that he bestowed upon me; they stand no comparison to the least gift of Abu Zara. SahihMuslim-017-001-21175Hisham Bin Urwa narrated a hadith like this with the same chain of trans- mitters except with this change that in the hadith transmitted on the authority of jartr the words are : Her Bariras husband was a slave; so Allah Messenger ﷺ gave her the option either to retain her matrimonial relation with her husband or sever it off. She opted to break off and secure freedom for her even from the matrimonial alliance. And if he were free he would not have given her the option. Umm Habiba sent for a perfume having yellowness in it or something else like it; and she applied it to a girl and then rubbed it on her cheeks and then said: By Allah; I need no perfume but for the fact that I heard Allah Messenger ﷺ say on the pulpit: It is not permissible for a woman believing in Allah and the Hereafter to mourn for the dead beyond three days; but in case of the death of the husband it is permissible for four months and ten days. Zainab said: I then visited Zainab hint Jahsh Allah be pleased with her when her brother died and she sent for perfume and applied it and then said: By Allah; I dont feel any need for the perfume but that I heard Allah Messenger ﷺ say on the pulpit: It is not permissible for a woman believing in Allah and the Hereafbler to mourn the dead beyond three days except in case of her husband for whom she can mourn for four months and ten days. Zainab Allah be pleased with her said: I heard my mother Umm Salamah Allah be pleased with her as saying: A woman came to Allah Messenger ﷺ and said: Allah Messenger. I have a daughter whose husband has died and there has developed some trouble in her eye; should we apply collyrium to it? Thereupon Allah Messenger ﷺ said: No repeating it twice or thrice; saying only; NO all the time. Then he said: It is only four mouths and ten days; whereas in the preIslamic period none of you threw away the dung until one year had passed. Humaid said: I said to Zainab: What is this throwing of dung until a year is passed? Zainab said: When the husband of a woman died; she went into a hut and put on her worst clothes; and did not apply perfume or something like it until a year was over. Then an animal like a donkey; or a goat; or a bird was brought to her and she rubbed her hand over it; and it so happened that one on which she rubbed her hand died. Her husband had gone out searching for his runaway slaves; and when he was in Turaf AlQadum he caught up with them and they killed him. SunanAbuDawoud-017-001-25111Aisha wife of the Prophet ﷺ said Marriage in pre Islamic times was of four kinds. One of them was the marriage contracted by the people today. A man asked another man to marry his relative sister or daughter to him. He fixed the dower and married her to him. Another kind of marriage was that a man asked his wife when she became pure from menstruation to send fro so and so and have sexual intercourse with him. Her husband kept himself aloof and did not have intercourse with her till It became apparent that she was pregnant from the man who had intercourse with her. When it was manifest that she was pregnant; her husband approached her if he liked. This marriage was called istibda to utilize man for intercourse for a noble birth. A third kind of marriage was that a group of people less than ten in number entered upon a woman and had intercourse with her. When she conceived gave birth to a child and a number of days passed after her delivery; she sent for them. No one of them could refuse to attend and they gathered before her. She said to them You have realized your affair. I have now given birth to a child. And this is your son. O so and so. She called the name of anyone of them she liked and the child was attributed to him. A fourth kind of marriage was that many people gathered together and entered upon a woman who did not prevent anyone who came to her. They were prostitutes. They hoisted flags at their doors which served as a sign for the one who intended to enter upon them. When she became pregnant and delivered the child ; they got together before her and called for the experts of tracing relationship from physical features. They attributed the child to whom they considered and it was given to him. The child was called his son and he could not deny. She asked for some yellow perfume containing saffron khaluq or something else. Then she applied it to a girl and touched her cheeks. She said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Zaynab said: I also visited Zaynab; daughter of Jahsh; when her brother died. She asked for some perfume and used it upon herself. She then said: I have no need of perfume; but I heard the Messenger of Allah ﷺ say when he was on the pulpit: It is not lawful for a woman who believes in Allah and the Last Day to observe mourning for one who has died; more than three nights; except for four months and ten days in the case of a husband. Zaynab said: I heard my mother; Umm Salamah; say: A woman came to the Messenger of Allah ﷺ and said: Messenger of Allah; the husband of my daughter has died; and she is suffering from sore eyes; may we put antimony in her eyes? The Messenger of Allah ﷺ said: No. He said this twice or thrice. Each time he said: No. The Messenger of Allah ﷺ said: The waiting period is now four months and ten days. In pre-Islamic days one of you used to throw away a piece of dung at the end of a year. Humayd said: I asked Zaynab: What do you mean by throwing away a piece of dung at the end of a year. Zaynab replied: When the husband of a woman died; she entered a small cell and put on shabby clothes; not touching perfume or any other thing until a year passed. Then an animal such as donkey or sheep or bird was provided for her. She rubbed herself with it. The animal with which she rubbed herself rarely survived. She then came out and was given a piece of dung which she threw away. SunanAbuDawoud-017-001-29506Narrated Abu Saeed AlKhudri: A woman came to the Prophet ﷺ while we were with him. She said: Messenger of Allah; my husband; Safwan Ibn AlMuattal; beats me when I pray; and makes me break my fast when I keep a fast; and he does not offer the dawn prayer until the sun rises. He asked Safwan; who was present; about what she had said. He replied: Messenger of Allah; as for her statement he beats me when I pray; she recites two surahs during prayer and I have prohibited her to do so. He the Prophet said: If one surah is recited during prayer ; that is sufficient for the people. Safwan continued: As regards her saying he makes me break my fast; she dotes on fasting; I am a young man; I cannot restrain myself. The Messenger of Allah ﷺ said on that day: A woman should not fast except with the permission of her husband. Safwan said: As for her statement that I do not pray until the sun rises; we are a people belonging to a class; and that our profession of supplying water is already known about us. We do not awake until the sun rises. MuwataMalik-017-001-34849Yahya related to me from Malik that he heard Ibn Shihab say; The precedent of the sunna when a man injures a woman is that he must pay the blood- money for that injury and there is no retaliation against him. Malik said; That is an accidental injury; when a man strikes a woman and hits with a blow what he did not intend; for instance; if he struck her with a whip and cut her eye open and the like of that. Malik said about a woman who has a husband and children who are not from her paternal relatives or her people; that since he is from another tribe; there is no blood-money against her husband for her criminal action; nor any against her children if they are not from her people; nor any against her maternal brothers when they are not from her paternal relations or her people. These are entitled to her inheritance but only the paternal relations have paid blood-money from since the time of the Messenger of Allah; may Allah bless him and grant him peace. Until today it is like that with the mawla of a woman. MuwataMalik-017-001-34928Malik related to me from Yazid Ibn Abdullah Ibn AlHadi from Muhammad Ibn Ibrahim Ibn AlHarith AlTaymi from Sulayman Ibn Yasar from Abdullah Ibn Abi Umaya that a woman husband died; and she did the idda of four months and ten days. Then she married when she was free to marry. She stayed with her husband for four and a half months; then gave birth to a fully developed child. Her husband went to Umar Ibn AlKhattab and mentioned that to him; so Umar called some of the old women of the Aljahiliya and asked them about that. One of the women said; I will tell you what happened with this woman. When her husband died; she was pregnant by him; but then the blood flowed from her because of his death and the child became dry in her womb. When her new husband had intercourse with her and the water reached the child; the child moved in the womb and grew. Umar Ibn AlKhattab believed her and separated them until she had completed her idda. The inheritance of a wife from a husband who does not leave children or grandchildren through sons is a quarter. If he leaves children or grandchildren through sons; male or female; the wife has an eighth after bequests and debts. That is because Allah; the Blessed; the Exalted! said in His Book; You have a half of what your wives leave if they have no children. If they have children; you have a fourth of what they leave after bequests and debts. They have a fourth of what you leave if you have no children. If her husband said; But I only gave her the right of choice in one; he had none of that. That was the best of what he had heard. MuwataMalik-017-001-35219Yahya related to me from Malik from Nafi from a mawla of Safiya bint Abi Ubayd that she gave all that she possessed to her husband as compensation for her divorce from him; and Abdullah Ibn Umar did not disapprove of that. Malik said that divorce was ratified for a woman who ransomed herself from her husband; when it was known that her husband was detrimental to her and was oppressive for her; and it was known that he wronged her; and he had to return her property to her. Malik added; This is what I have heard; and it is what is done among us. Malik said that a woman who ransomed herself could not return to her husband except by a new marriage. If someone married her and then separated from her before he had intercourse with her; there was no idda against her from the recent marriage; and she rested on her first idda. Malik said; That is the best that I have heard on the matter. Malik said; If; when a woman offers to compensate her husband; he divorces her straightaway; then that compensation is confirmed for him. MuwataMalik-017-001-35227Yahya related to me from Malik from Yahya Ibn Said that Bukayr Ibn Abdullah AlAshajj informed him that Muawiya Ibn Abi Ayash AlAnsari told him that he was sitting with Abdullah Ibn AlZubair and Aasi m Ibn Umar Ibn AlKhattab when Muhammad Ibn Iyas Ibn AlBukayr came up to them and said; A man from the desert has divorced his wife three times before consummating the marriage; what do you think? Abdullah Ibn AlZubair said This is something about which we have no statement. Go to Abdullah Ibn Abbas and Abu Huraira. I left them with Aisha. Ask them and then come and tell us. He went and asked them. Ibn Abbas said to Abu Huraira; Give an opinion; Abu Huraira! A difficult one has come to you. Abu Huraira said; One pronouncement separates her and three makes her haram until she has married another husband. Ibn Abbas said the like of that. MuwataMalik-017-001-35242Yahya related to me from Malik from Yahya Ibn Said from Said Ibn AlMusayab that Umar Ibn AlKhattab said; The woman who loses her husband and does not know where he is; waits for four years; then she does idda for four months; and then she is free to marry. Malik said; If she marries after her idda is over; regardless of whether the new husband has consummated the marriage or not; her first husband has no means of access to her. Malik said; That is what is done among us and if her husband reaches her before she has remarried; he is more entitled to her. Malik said that he had seen people disapproving of someone who said that one of the people of knowledge attributed to Umar Ibn AlKhattab that he said; Her first husband chooses when he comes either her bride-price or his wife. Malik said; I have heard that Umar Ibn AlKhattab; speaking about a woman whose husband divorced her while he was absent from her; and then he took her back and the news of his taking her back had not reached her; while the news of his divorcing her had; and so she had married again; said; Her first husband who divorced her has no means of access to her whether or not the new husband has consummated the marriage. MuwataMalik-017-001-35262Yahya related to me from Malik from Ibn Shihab that Said Ibn AlMusayab said; The idda of the woman who bleeds constantly is a year. Malik said; What is done among us about a divorced woman whose periods stop when her husband divorces her is that she waits nine months. If she has not had a period in them; she has an idda of three months. If she has a period before the end of the three months; she accepts the period. If another nine months pass without her having a period; she does an idda of three months. If she has a second period before the end of those three months; she accepts the period. If nine months then pass without a period; she does an idda of three months. If she has a third period; the idda of the period is complete. If she does not have a period; she waits three months; and then she is free to marry. Her husband can return to her before she becomes free to marry unless he made her divorce irrevocable. Malik said; The sunna with us is that when a man divorces his wife and has the option to return to her; and she does part of her idda and then he returns to her and then parts from her before he has had intercourse with her; she does not add to what has passed of her idda. Her husband has wronged himself and erred if he returned to her and had no need of her. Malik said; What is done among us is that if a woman becomes a muslim while her husband is a kafir and then he becomes muslim; he is entitled to her as long as she is in her idda. If her idda is finished; he has no access to her. If he remarries her after the end of her idda; however; that is not counted as divorce. One was young and the other was old. She preferred the young man and so the older man said; You are not free to marry yet. Her family were away and he hoped that when her family came; they would give her to him. MuwataMalik-017-001-35280Yahya related to me from Malik from Said Ibn Ishaq Ibn Kaab Ibn Ujra from his paternal aunt; Zaynab bint Kaab Ibn Ujra that AlFuraya bint Malik Ibn Sinan; the sister of Abu Said AlKhudri; informed her that she went to the Messenger of Allah; may Allah bless him and grant him peace; and asked to be able to return to her people among the Banu Khudra since her husband had gone out in search of some of his slaves who had run away and he had caught up with them near AlQudum; which is 6 miles from Madina ; and they had killed him. She said; I asked the Messenger of Allah; may Allah bless him and grant him peace; if I could return to my people in the Banu Khudra; as my husband had not left me in a dwelling which belonged to him; and had left me no maintenance. The Messenger of Allah; may Allah bless him and grant him peace; said;Yes. So I left. When I was in the courtyard; the Messenger of Allah; may Allah bless him and grant him peace; called me or summoned me; and I answered him. He said; What did you say? If she has been set free and he can return to her; and she does not choose to separate after she has been set free; and he dies while she is in the idda from the divorce; she does the idda of a free woman whose husband has died; four months and ten days. That is because the idda of widowhood befell her while she was free; so her idda is the idda of a free woman. My daughter husband died; and her eyes are troubling her; can she put kohl on them? The Messenger of Allah; may Allah bless him and grant him peace; said; No two or three times. Then he said; It is only four months and ten days. In the Aljahiliya; none of you threw away the piece of dung until a year had passed. Humayd Ibn Nafi said; I asked Zaynab to explain what throwing away the piece of dung at the end of a year meant. Zaynab said; In the Aljahiliya when a woman husband died; she went into a small tent and dressed in the worst of clothes. She did not touch perfume or anything until a year had passed. Then she was brought an animal - a donkey; a sheep; or a bird; and she would break her idda with it; by rubbing her body against it taftaddu. Rarely did she break her idda with anything by rubbing herself against it but that it died. Then she would come out and would be given a piece of dung. She would throw it away and then return to whatever she wished of perfumes or whatever. MuwataMalik-017-001-35302Yahya related to me from Malik from Nafic that Saffiya bint Abi Ubayd suffered from an eye-complaint while she was in mourning for her husband; Abdullah Ibn Umar. She did not apply kohl until her eyes almost had ramas a dry white secretion in the corners of the eye. Malik said; A woman whose husband has died should anoint her eyes with olive oil and sesame oil and the like of that since there is no perfume in it. Malik said; A woman in mourning for her husband should not put on any jewellery - rings; anklets; or such- like; neither should she dress in any sort of colourful; striped garment unless it is coarse. MuwataMalik-017-001-35303108 Yahya related to me from Malik that he had heard that the Messenger of Allah; may Allah bless him and grant him peace; visited Umm Salamah while she was in mourning for Abu Salama and she had put aloes on her eyes. He said; What is this; Umm Salama? She said; It is only aloes; Messenger of Allah. He said; Put it on at night and wipe it off in the daytime. Malik said; The mourning of a young girl who has not yet had a menstrual period takes the same form as the mourning of one who has had a period. She avoids what a mature woman avoids if her husband dies. Malik said; A slave-girl mourns her husband when he dies for two months and five nights like her idda. Malik said; An umm walad does not have to mourn when her master dies; and a slave-girl does not have to mourn when her master dies.
