She said; Yes. She brought out some loaves of barley and took out a veil belonging to her; and wrapped the bread in part of it and put it under my arm and wrapped part of the veil round me and sent me to Allah Messenger ﷺ. I went carrying it and found Allah Messenger ﷺ in the Masjid sitting with some people. When I stood there; Allah Messenger ﷺ asked; Has Abu Talha sent you? I said; Yes. He asked; With some food? I said; Yes Allah Apostle then said to the men around him; Get up! He set out accompanied by them and I went ahead of them till I reached Abu Talha and told him of the Prophet visit. Abu Talha said; O Um Sulaim! Allah Messenger ﷺ is coming with the people and we have no food to feed them. She said; Allah and His Apostle know better. So Abu Talha went out to receive Allah Messenger ﷺ. Allah Apostle came along with Abu Talha. Allah Messenger ﷺ said; O Um Sulaim! Bring whatever you have. She brought the bread which Allah Messenger ﷺ ordered to be broken into pieces. Um Sulaim poured on them some butter from an oilskin. Then Allah Messenger ﷺ recited what Allah wished him to recite; and then said; Let ten persons come to share the meal. Ten persons were admitted; ate their fill and went out. Then he again said; Let another ten do the same. They were admitted; ate their fill and went out. Then he again said; Let another ten persons do the same. SahihAlBukhari-017-001-3930Narrated Abdulrahman Bin Abi Bakr: The companions of Suffa were poor people. The Prophet ﷺ once said; Whoever has food enough for two persons; should take a third one from among them ; and whoever has food enough for four persons; should take a fifth or a sixth or said something similar. Abu Bakr brought three persons while the Prophet ﷺ took ten. And Abu Bakr with his three family member who were I; my father and my mother the sub-narrator is in doubt whether Abdulrahman said; My wife and my servant who was common for both my house and Abu Bakr house. Abu Bakr took his supper with the Prophet ﷺ and stayed there till he offered the Isha prayers. He returned and stayed till Allah Messenger ﷺ took his supper. After a part of the night had passed; he returned to his house. His wife said to him; What has detained you from your guests? He said; Have you served supper to them? She said; They refused to take supper until you come. They i.e. some members of the household presented the meal to them but they refused to eat I went to hide myself and he said; O Ghunthar! He invoked Allah to cause my ears to be cut and he rebuked me. He then said to them : Please eat! and added; I will never eat the meal. By Allah; whenever we took a handful of the meal; the meal grew from underneath more than that handful till everybody ate to his satisfaction; yet the remaining food was more than the original meal. Abu Bakr saw that the food was as much or more than the original amount. He called his wife; O sister of Bani Firas! She said; O pleasure of my eyes. The food has been tripled in quantity. Abu Bakr then started eating thereof and said; It i.e. my oath not to eat was because of Sa all. He took a handful from it; and carried the rest to the Prophet. So that food was with the Prophet ﷺ. There was a treaty between us and some people; and when the period of that treaty had elapsed; he divided US into twelve groups; each being headed by a man. Allah knows how many men were under the command of each leader. Anyhow; the Prophet ﷺ surely sent a leader with each group. They brought it and the Prophet ﷺ invoked Allah and asked for His Blessings for it. SahihMuslim-017-001-17526Ayub said: We were sitting in the company of Abu Mousa that he called for food and it consisted of flesh of fowl. It was then that a person from Banu Tamim visited him. His complexion was red having the resemblance of a slave. He said to him: Come and join me in food. He showed reluctance. He Abu Masa said: Come on; for I saw Allah Messenger ﷺ eating it fowl meat ; whereupon that person said: I saw it eating something of filth and rubbish and I found it repugnant and took an oath that I would never eat that. He Abu Muds said: Come; so that I would narrate to you about that the incident pertaining to vow. And he narrated thus : I came to Allah Messenger ﷺ along with a group of people belonging to the tribe of Ashari; asking him to provide us with riding camels. He the Holy Prophet said: By Allah; I cannot provide you with riding animals. And there is nothing with me with which I can provide you a mount. We stayed for some time there as Allah willed; and there was brought to Allah Messenger ﷺ booty of camels. He called us and commanded that we should be given five white humped camels. As we were about to go back; some of us said to the other: As we made Allah Messenger ﷺ forget oath; there would be no blessing for us in his gift. We went back to him and said: Allah Messenger; we came to you to provide us with riding animals and you took an oath that you would never equip us with mounts and then you have provided us with the riding beasts Allah Messenger; have you forgotten? Thereupon he said: I swear by Allah that if Allah so wills; I shall not swear an oath; and then consider something else to be better than it without making atonement for my oath and doing the thing that is better. SahihMuslim-017-001-18088It has been narrated on the authority of Abdullah Bin Rabah who said: We came to Muawiya Bin Abu Sufyan as a deputation and Abu Huraira was among us. Each of us would prepare food for his companions turn by turn for a day. Accordingly when it was my turn I said: Abu Huraira; it is my turn today. So they came to my place. The food was not yet ready; so I said to Abu Huraira: I wish you could narrate to us a tradition from the Messenger of Allah ﷺ until the food was ready. Complying with my request Abu Huraira said: We were with the Messenger of Allah ﷺ on the day of the Conquest of Mecca. He appointed Khalid Bin Walid as commander of the right flank; AlZubair as commander of the left flank; and Abu Ubaida as commander of the foot-soldiers who were to advance to the interior of the valley. He then said: Abu Huraira; call the Ansar to me. So I called out to them and they came hurriedly. He said: O ye Assembly of the Ansaar; do you see the ruffians of the Quraish? They said: Yes. He said: See; when you meet them tomorrow; wipe them out. He hinted at this with his hand; placing his right hand on his left and said: You will meet us at AlSafa. Abu Huraira continued : Whoever was seen by them that day was put to death. The Messenger of Allah ﷺ ascended the mount of AlSafa. The Ansar also came there and surrounded the mount. Then came Abu Sufyan and said: Messenger ot Allah; the Quraish have perished. No member of the Quraish tribe will survive this day. The Messenger of Allah ﷺ said: Who enters the house of Abu Safyin will be safe; who lays down arms will be safe; who locks his door will be safe. some of the Ansar said: After all the man has been swayed by tenderness towards his family and love for his city. At this; Divine inspiration descended upon the Messenger of Allah ﷺ. He said: You were saying that the man has been swayed by tenderness towards his family and love for his city. Do you know what my name is? I am Muhammad; the bondman of God and His Messenger. He repeated this thrice. I left my native place for the take of Allah and joined you. So I will live with you and die with you. Now the Ansar said: By God; we said that only out of our greed for Allah and His Messenger. SahihMuslim-017-001-20768Abdullah Bin Samit reported that Abu Dharr said: We set out from our tribe Ghafir who look upon the prohibited months as permissible months. I and my brother Unais and our mother stayed with our maternal uncle who treated us well. The men of his tribe fell jealous and they said: When you are anay from your house; Unais commits adultery with your wife. Our -naternal uncle came and he accused us of the sin which was conveyed to him. I said: You have undone the good you did to us. We cannot stay with you after this. We came to our camels and loaded our luggage. Our maternal uncle began to weep covering himself with a piece of cloth. We proceeded on until we encamped by the side of Mecca. Unais cast lot on the camels we had and an equal number above that. They both went to a Kahin and he made Unais win and Unais came with our camels and an equal number along with them. He Abu Dharr said: My nephew; I used to observe prayer three years before my meeting with Allah Messenger ﷺ. I said: For whom did you say prayer? He said: For Allah. I said: To which direction did you turn your face for observing prayer ? He said: I used to turn my face as Allah has directed me to turn my face. I used to observe the night prayer at the time of the end of night and I fell down in prostration like the mantle until the sun rose over me. Unais said: I have a work in Mecca; so you better stay here. Unais went until he came to Mecca and he came to me late. I said: What did you do? He said: I met a person in Mecca who is on your religion and he claims that verily it is Allah Who has sent him. I said: What do the people say about him? He said: They say that he is a poet or a Kahin or a magician. Unais who was himself one of the poets said. I have heard the words of a Kahin but his words in no way resemble his words. And 1 also compared his words to the verses of poets but such words cannot be uttered by any poet. By Allah; he is truthful and they are liars. Then I said: you stay here; until I go; so that I should see him. He said: I came to Mecca and I selected an insignificant person from amongst them and said to him: Where is he whom you call AlSabi? He pointed out towards me saying: He is Sabi. Thereupon the people of the valley attacked me with sods and bows until I fell down unconscious. I stood up after havin. regained my consciousness and I found as if I was a red idol. I came to Zamzarn and washed blood from me and drank water from it and listen; O son of my brother; I stayed there for thirty nights or days and there was no food for me but the water of Zamzarn. And I became so bulky that there appeared wrinkles upon my stomach; and I did not feel any hunger in my stomach. It was during this time that the people of Mecca slept in the moonlit night and none was there to eircumambulate the House but only two women who had been invoking the name of Isafa; and Naila the two idols. They came to me while in their circuit and I said: Marry one with the other; but they did not dissuade from their invoking. They came to me and I said to them: Insert wood in the idols private parts. I said this to them in such plain words as I could not express in metaphorical terms. These women went away crying and saying: Had there been one amongst our people he would have taught a lesson to you for the obscene words used for our idols before us. These women met Allah Messenger ﷺ and Abu Bakr who had also been coming down the hill. He asked them: What has happened to you? They said: There is Sabi; who has hidden himself between the Kaba and its curtain. He said: What did he say to you? They said: He uttered such words before us as we cannot express. Allah Messenger ﷺ came and he kissed the Black Stone and circumambulated the House along with his Companion and then observed prayer; and when he had finished his prayer; Abu Dharr said: I was the first to greet him with the salutation of peace and uttered these words in this way; Allah Messen- ger; may there be peace upon you; whereupon he said: It may be upon you too and the mercy of Allah. He then said: Who are you? I said: From the tribe of Ghifar. He leaned his hand and placed his finger on his forehead and I said to myself: Perhaps he has not liked it that I belong to the tribe of Ghifar. I attempted to catch hold of his hand but his friend who knew about him more than I dissuaded me f rom doing so. He then lifted his head and said: Since how long have you been here? I said: I have been here for the last thirty nights or days. He said: Who has been feeding you? I said: There has been no food for me but the water of Zamzam. I have grown so bulky that there appear wrinkles upon my stomach and I do not feel any hunger. He said: It is blessed water and it also serves as food. Thereupon Abu Bakr said: Allah Messenger; let me serve as a host to him for tonight; and then Allah Messenger ﷺ proceeded forth and so did Abu Bakr and I went along with them. Abu Bakr opened the door and then he brought for us the raisins of Taif and that was the first food which I ate there. Then I stayed as long as I had to stay. I then came to Allah Messenaer ﷺ and he said: I have been shown the land abound- ing in trees and I think it cannot be but that of Yathrib that is the old name of Medina. You are a preacher to your people on my behalf. I hope Allah would benefit them through you and He would reward you. I came to Unais and he said: What have you done? I said: I have done that I have embraced Islam and I have testified to the prophethood of Allah Messenger. He said: I have no aversion for your religion and I also embrace Islam and testify to the prophethood of Muhammad. Then both of us came to our mother and she said: I have no aversion for your religion and I also embrace Islam and testify to the prophethood of Muhammad. We then loaded our camels and came to our tribe Ghifir and half of the tribe embraced Islam and their chief was Aimi Bin Rahada Ghifirl and he was their leader and hall of the tribe said: We will embrace Islam when Allah Messenger may p;. ace be upon him would come to Medina; and when Allah Messenger ﷺ came to Medina the remaining half also embraced Islam. Then a tribe Aslam came to the Prophet ﷺ and said: Allah Messenger; we also embrace Islam like our brothers who have embraced Islam. And they also embraced Islam. SunanAlTermithi-017-001-10190Zaid Bin Arqam said: We were participating in a battle along with the Messenger of Allah; and there were some people from the Bedouins with us. So we all rushed toward some water and the Bedouins raced us to it. One of the Bedouins beat his companions to it and he tried to obstruct the pond; he placed rocks around it and he put a leather sheet over it until his companions came. He said: A man among the Ansar reached the Bedouin and he dropped the reigns of his camel to drink; but the Bedouin would not allow him. So he started removing the barriers around the water; but the Bedouin raised a stick beating the Ansari man on the head; and smashed it. He went to Abdullah Bin Ubay; the head of the hypocrite; to inform him he was in fact one of his companions. So Abdullah Bin Ubay became enraged; the he said: Do not spend anything on whoever is with Muhammad until they depart. Meaning the Bedouins. They were preparing food for the Messenger of Allah. So Abdullah said: When they depart from Muhammad; then bring Muhammad some food; and let him and whoever is with him eat it. Then he said to his companions: If we return to AlMadinah; indeed the more honorable will expel therefrom the meaner. Zaid said: And I was riding behind the Messenger of Allah; and I had heard Abdullah Bin Ubay; so I informed my uncle who went to tell the Messenger of Allah. He sent a message to him Abdullah but he took an oath and denied it. He said: So the Messenger of Allah accepted what he said and did not believe me. So my uncle came to me and said: You only wanted the Messenger of Allah to hate you; and the Muslims to say that you lied. He said: I suffered such worry as has not been suffered by anyone else. He said: Later while I was on the move with the Messenger of Allah on a journey; my mind was relieved of worry; since the Messenger of Allah came to me and rubbed my ear and smiled in my face. I would never be happier than with that as long as the world remained. Then Abu Bakr caught up to me; and said: What did the Messenger of Allah say to you? I said: He did not say anything to me; he only rubbed my ear and smiled in my face. He said: Receive the good news! Then Umar caught up with me and I said the same to him as I had said to Abu Bakr. MuwataMalik-017-001-34718Yahya related to me from Malik from Abuz-Zinad from AlAraj from Abu Huraira that the Messenger of Allah; may Allah bless him and grant him peace; said; The food of two is enough for three; and the food of three is enough for four. The Book of Purity in Muwata Malik
MuwataMalik-017-001-34730Yahya related to me from Malik from Muhammad Ibn Amr Ibn Halhala that Humayd Ibn Malik Ibn Khuhaym said; I was sitting with Abu Huraira on his land at AlAqiq. Some people rode out from Madina to call upon Abu Huraira. He told me to go to his mother; sending his greetings and asking her to prepare some food. Humayd continued; She set down three loaves on a plate and some oil and salt. Then she put it on my head and I carried it to them. When I set it before them; Abu Huraira said; Allah is greater and added; Praise be to Allah who has filled us with bread after our food had previously been only water and dates; as the people did not touch any of the food. When they left; he said; O son of my brother; be good to your sheep and wipe the mucus from them and clean their pen. Pray in their quarter for they are among the animals of the Garden. By He in Whose Hand my self is; a time is about to come upon people when a small group of sheep will be more beloved to their owner than the house of Marwan. The Chapter on Live Stock And Sheep Grazing in HodHood Indexing, The Book of Purity in Muwata Malik
MuwataMalik-017-001-34921Yahya said that he heard Malik say; What is done in our community about someone who consumed an animal without the permission of its owner; is that he must pay its price on the day he consumed it. He is not obliged to replace it with a similar animal nor does he compensate the owner with any kind of animal. He must pay its price on the day it was consumed; and giving the value is more equitable in compensation for animals and goods. Yahya said that he heard Malik say about someone who consumes some food without the permission of its owner; He returns to the owner a like weight of the same kind of food. Food is in the position of gold and silver. Gold and silver are returned with gold and silver. The animal is not in the position of gold in that. What distinguishes between them is the sunna and the behaviour which is in force. Yahya said that he heard Malik say; If a man is entrusted with some wealth and then trades with it for himself and makes a profit; the profit is his because he is responsible for the property until he returns it to its owner. The Chapter on Precious Metals And Buying And Selling Gold in HodHood Indexing, The Book of The Evil Eye in Muwata Malik
MuwataMalik-017-001-35008Yahya said that Malik spoke about an agent who had qirad money with him and he spent from it and clothed himself. He said; He cannot give away any of it; and neither a beggar nor anyone else is to be given any of it and he does not pay anyone compensation from it. If he meets some people; and they bring out food and he brings out food; I hope that that will be permitted to him if he does not intend to bestow something on them. If he intends that or what is like that without the permission of the investor; he must get the sanction of the investor for it. If he sanctions it; there is no harm. MuwataMalik-017-001-35078Yahya related to me from Malik that he had heard that a man wanted to buy food from a man in advance. The man who wanted to sell the food to him went with him to the market; and he began to show him heaps; saying; Which one would you like me to buy for you. The buyer said to him; Are you selling me what you do not have? So they came to Abdullah Ibn Umarand mentioned that to him. MuwataMalik-017-001-35082Yahya related to me from Malik from Nafi that Abdullah Ibn Umar said that there was no harm in a man making an advance to another man for food; with a set description and price until a set date; as long as it was not in crops; or dates which had not begun to ripen. Malik said; The way of doing things among us concerning someone who makes an advance for foodstuffs at a known rate until a stated date; and the date arrives and he finds that there is not enough of what he was sold with the seller to fulfill his order; and so he revokes the sale; is that he must only take back the silver; gold; or price which he paid exactly. He does not buy anything else from the man for the same price until he has got back what he paid. That is because if he took something else besides the price which he paid him or exchanged it for goods other than the goods which he bought from him; it would be selling food before getting delivery of it. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; forbade selling food before getting delivery of it. Malik said that it was not good if the buyer regretted his purchase and asked the seller to revoke the sale for him and he would not press him immediately for what he had paid. The people of knowledge forbade that. That was because when the food was made ready for the buyer by the seller; the buyer deferred his due from the seller in order that he might revoke the sale for him. That was the sale of food with delayed terms before taking delivery of the food. Malik said; The explanation of that is that when the date of delivery comes and the buyer dislikes the food; the seller takes by it money to be paid later and so it is not revocation. Revocation is that in which neither the buyer nor the seller is increased. When increase occurs by deferment of payment for a time period; or by anything which increases one of them over the other or anything which gives one of them profit; it is not revocation. When either of them do that; revocation becomes a sale. There is an indulgence for revocation; partnership; and transfer; as long as i ncrease; decrease; or deferment does not come into them. If increase; decrease; or deferment comes into it; it becomes a sale. Whatever makes a sale halal makes it halal and whatever makes a sale haram makes it haram. Malik said; If someone pays in advance for Syrian wheat; there is no harm if he takes a load after the term falls due. Malik said; It is the same with whoever advances for any kind of thing. There is no harm in him taking better than whatever he has made an advance for or worse than it after the agreed delivery date. The explanation of that is that if; for instance; a man advances for a certain weight of wheat. There is no harm if he decides to take some barley or Syrian wheat. If he has made an advance for good dates; there is no harm if he decides to take poor quality dates. If he paid in advance for red raisins; there is no harm if he takes black ones; when it happens after the agreed delivery date; and when the measure of what he takes is like the measure of what he paid for in advance. The Chapter on Financial Transaction And Food in HodHood Indexing, The Book of Drinks in Muwata Malik
MuwataMalik-017-001-35085Yahya related to me from Malik that he had heard the same as that from AlQasim Ibn Muhammad from Ibn Muayqib AlDawsi. Malik said; This is the way of doing things among us. Malik said; The generally agreed on way of doing things among us is that wheat is not sold for wheat; dates for dates; wheat for dates; dates for raisins; wheat for raisins; nor any kind of food sold for food at all; except from hand to hand. If there is any sort of delayed terms in the transaction; it is not good. It is haram. Condiments are not bartered except from hand to hand. Malik said; Food and condiments are not bartered when they are the same type; two of one kind for one of the other. A mudd of wheat is not sold for two mudds of wheat; nor a mudd of dates for two mudds of dates; nor a mudd of raisins for two mudds of raisins; nor is anything of that sort done with grains and condiments when they are of one kind; even if it is hand to hand. This is the same position as silver for silver and gold for gold. No increase is halal in the transaction; and only like for like; from hand to hand is halal. Malik said; If there is a clear difference in foodstuffs which are measured and weighed; there is no harm in taking two of one kind for one of another; hand to hand. There is no harm in taking a sa of dates for two sa of wheat; and a sa of dates for two sa of raisins; and a sa of wheat for two sa of ghee. If the two sorts in the transaction are different; there is no harm in two for one or more than that from hand to hand. If delayed terms enter into the sale; it is not halal. Malik said; It is not halal to trade a heap of wheat for a heap of wheat. There is no harm in a heap of wheat for a heap of dates; from hand to hand. That is because there is no harm in buying wheat with dates without precise measurement. Malik said; With kinds of foods and condiments that differ from each other; and the difference is clear; there is no harm in bartering one kind for another; without precise measurement from hand to hand. If delayed terms enter into the sale; there is no good in it. Bartering such things without precise measurement is like buying it with gold and silver without measuring precisely. Malik said; That is because you buy wheat with silver without measuring precisely; and dates with gold without measuring precisely; and it is halal. There is no harm in it. Malik said; It is not good for someone to make a heap of food; knowing its measure and then to sell it as if it had not been measured precisely; concealing its measure from the buyer. If the buyer wants to return that food to the seller; he can; because he concealed its measure and so it is an uncertain transaction. This is done with any kind of food or other goods whose measure and number the seller knows; and which he then sells without measurement and the buyer does not know that. If the buyer wants to return that to the seller; he can return t. The people of knowledge still forbid such a transaction. Malik said; There is no good in selling one round loaf of bread for two round loaves; nor large for small when some of them are bigger than others. When care is taken that they are like for like; there is no harm in the sale; even if they are not weighed. Malik said; It is not good to sell a mudd of butter and a mudd of milk for two mudds of butter. This is like what we described of selling dates when two sa of kabis and a sa of poor quality dates were sold for three sa of ajwa dates after the buyer had said to the seller; Two sa of kabis dates for three sa of ajwa dates is not good; and then he did that to make the transaction possible. The owner of the milk puts the milk with his butter so that he can use the superiority of his butter over the butter of the other party to put his milk in with it. Malik said; Flour for wheat is like for like; and there is no harm in that. That is if he does not mix up anything with the flour and sell it for wheat; like for like. Had he put half a mudd of flour and half of wheat; and then sold that for a mudd of wheat; it would be like what we described; and it would not be good because he would want to use the superiority of his good wheat to put flour along with it. Such a transaction is not good. The Chapter on Food And Dates in HodHood Indexing, The Book of Drinks in Muwata Malik
MuwataMalik-017-001-35086Yahya related to me from Malik that Muhammad Ibn Abdullah Ibn Abi Maryam asked Said Ibn AlMusayab advice. I am a man who buys food with receipts from AlJar. MuwataMalik-017-001-35087Yahya related to me from Malik that he had heard that Muhammad Seereen used to say; Do not sell grain on the ears until it is white. Malik said; If someone buys food for a known price to be delivered at a stated date; and when the date comes; the one who owes the food says; I do not have any food; sell me the food which I owe you with delayed terms. The owner of the food says; This is not good; because the Messenger of Allah; may Allah bless him and grant him peace; forbade selling food until the deal was completed. The one who owes the food says to his creditor; Sell me any kind of food on delayed terms until I discharge the debt to you. This is not good because he gives him food and then he returns it to him. The gold which he gave him becomes the price of that which is his right against him and the food which he gave him becomes what clears what is between them. If they do that; it becomes the sale of food before the deal is complete. Malik spoke about a man who was owed food which he had purchased from a man and this man was owed the like of that food by another man. The one who owed the food said to his creditor; I will refer you to my debtor who owes me the same amount of food as I owe you; so that you may obtain the food which I owe you. Malik said; If the man who had to deliver the food; had gone out; and bought the food to pay off his creditor; that is not good. That is selling food before taking possession of it. If the food is an advance which falls due at that particular time; there is no harm in paying off his creditor with it because that is nota sale. It is not halal to sell food before receiving it in full since the Messenger of Allah; may Allah bless him and grant him peace; forbade that. However; the people of knowledge agree that there is no harm in partnership; transfer of responsibility and revocation in sales of food and other goods. Malik said; That is because the people of knowledge consider it as a favour rendered. They do not consider it as a sale. It is like a man lending light dirhams. He is then paid back in dirhams of full weight; and so gets back more than he lent. That is halal for him and permitted. Had a man bought defective dirhams from him as being the full weight; that would not be halal. Had it been stipulated to him that he lend full weight in dirhams; and then he gave faulty ones; that would not be halal for him.The Chapter on Financial Transaction And Food in HodHood Indexing, The Book of Drinks in Muwata Malik
MuwataMalik-017-001-35088Malik said; Another example of that is that the Messenger of Allah; may Allah bless him and grant him peace; forbade the sale called muzabana and granted an indulgence in the ariya for computing the equivalent in dates. It was distinguished between them that the muzabana-sale was based on shrewdness and trade; and the ariya sale was based on a favour rendered; and there was no shrewdness in it. Malik said; A man must not buy food for a fourth; a third; or a fraction of a dirham on the basis that he be given that food on credit. There is no harm in a man buying food for a fraction of a dirham on credit and then he gives a dirham and takes goods with what remains of his dirham because he gave the fraction he owed as silver; and took goods to make up the rest of his dirham. There is no harm in that transaction. Malik said; There is no harm in a man placing a dirham with another man and then taking from him known goods for a fourth; third; or a known fraction. If there was not a known price on the goods and the man said; I will take them from you for the price of each day; this is not halal because there is uncertainty. It might be less one time; and more another time; and they would not part with a known sale. Malik said; If someone sells some food without measuring precisely and does not exclude any of it from the sale and then it occurs to him to buy some of it; it is not good for him to buy any of it except what it would be permitted for him to exclude from it. That is a third or less. If it is more than a third; it becomes muzabana and is disapproved. He must only purchase from what he would be permitted to exclude; and he is only permitted to exclude a third or less than that. This is the way of doing things in which there is no dispute with us.The Chapter on Financial Transaction And Food in HodHood Indexing, The Book of The Oath of Qasama in Muwata Malik

Anas said; I went with the Messenger of Allah; may Allah bless him and grant him peace; to eat the food. He served barley bread and a soup with pumpkin in it. MuwataMalik-017-001-35425Malik said; I do not see that there is any harm in the Muslims eating whatever food they come across in enemy territory before the spoils are divided. Malik said; I think that any camels; cattle and sheep taken as booty are considered as food which the Muslims can eat in enemy territory. If they could not be eaten until the people had gathered for the division and the spoils had been distributed among them; that would be harmful for the army. I do not see any objection to eating such things within acceptable limits. I do not think; however; that anyone should store up any of it to take back to his family. Malik was asked whether it was proper for a man who obtained food in enemy territory and ate some of it and made provision so that there was some of it left over to keep and eat with his family; or to sell before he had come to his country and make use of its price. He said; If he sells it while he is on a military expedition; I think that he should put its price into the booty of the Muslims. If he takes it back to his country; I see no objection to his eating it and using it if it is a small insignificant thing. The Chapter on Almaghazi And Killing The Enemies And Pagans in HodHood Indexing, The Book of Divorce in Muwata Malik

MuwataMalik-017-001-35820Malik said; Allah; the Blessed and Exalted; says; O you who trust; do not kill game while you are in ihram. Whoever of you kills game intentionally has to pay a forfeit commensurate with what he has killed in cattle which two men from among you shall judge; a sacrificial animal which reaches the Kaba; or else he makes a kaffara of either feeding poor people or the equivalent of that in fasting; so that he may taste the consequences of what he has done. Surat 5 ayat 95. Malik said; Someone who hunts game when he is not in ihram and then kills it while he is in ihram is in the same position as someone who buys game while he is in ihram and then kills it. Allah has forbidden killing it; and so a man who does so has to pay a forfeit for it. The position that we go by in this matter is that a forfeit is assessed for anyone who kills game while he is in ihram. Yahya said that Malik said; The best that I have heard about someone who kills game and is assessed for it is that the game which he has killed is assessed and its value in food is estimated and with that food he feeds each poor man a mudd; or fasts a day in place of each mudd. The number of poor men is considered; and if it is ten then he fasts ten days; and if it is twenty he fasts twenty days; according to how many people there are to be fed; even if there are more than sixty. Malik said; I have heard that a forfeit is assessed for someone who kills game in the Haram while he is not in ihram in the same way that it is assessed for some one who kills game in the Haram while he is in ihram. The Chapter on Killing In The State Of Ihram in HodHood Indexing, The Book of Hajj in Muwata Malik
