But this crime became quite common amongst our aristocratic class. So when we caught hold of any rich person indulging in this offence we spared him; but when we caught hold of a helpless person we imposed the prescribed punishment upon him. We then said: Let us argree on a punishment which we can inflict both upon the rich and the poor. So We decided to blacken the face with coal and flog as a substitute punishment for stoning. Thereupon Allah Messenger ﷺ said: O Allah; I am the first to revive Thy command when they had made it dead. He then commanded and he the offender was stoned to death. Allah; the Majestic and Glorious; sent down this verse : O Messenger; the behaviour of those who vie with one another in denying the truth should not grieve you... up to is vouchsafed unto you; accept it v. 41 2176 It was said by the Jews : Go to Muhammad; it he commands you to blacken the face and award flogging as punishment for adultery ; then accept it; but it he gives verdict for stoning; then avoid it. He said: My son was a laborer serving this man; and he committed Zina with his wife. I ransomed him with one hundred sheep and a servant. It is as if he was told that his son was to be stoned to death but he ransomed him from that. Then I asked some knowledgeable men and they told me that my son was to be given one hundred lashes and exiled for a year. The Messenger of Allah SAWSYMOBOL said to him: By the One in Whose hand is my soul; I will pass judgment between you according to the Book of Allah; the Mighty and Sublime. As for the one hundred sheep and the servant; take them back; and your son is to be given one hundred lashes and exiled for a year. She said: O people of the tents; this porcupine is the one who is taking your prisoners from Makkah to AlMadinah! I headed toward the mountain of AlKhandamah; and eight men came after me. They came and stood over my head; and they urinated; and their urine reached me; but Allah caused them not to see me. Then I went to my companion the prisoner and brought him to AlArak; where I undid his fetters. Then I came to the Messenger of Allah and said: O Messenger of Allah; shall I marry Anaq? He remained silent and did not answer me; then the following was revealed: And the adulteress-fornicator; none marries her except an adulterer-fornicator or an idolater. He said: O Allah; to You be praise for the prostitute. I am going to give some charity. So he went out with his charity and put it in the hand of a rich man. The next morning they started talking about how charity had been given to a rich man. He said: O Allah; th You be praise for the prostitute; the thief and the rich man. Then the message came to him: As for your charity; it is accepted. As for the prostitute; perhaps it will keep her from committing Zina. As for the thief; perhaps it will stop him from stealing. He the narrator said that he went back not far; when he came and said: Allah Messenger; purify me. Allah Apostle ﷺ said as he had said before. When it was the fourth time; Allah Messenger may; ﷺ said: From what am I to purify you? He said: From adultery; Allah Messenger ﷺ asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Allah Messenger ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been divided into two groups about him Maiz. One of them said: He has been undone for his sins had encompassed him; whereas another said: There is no repentance more excellent than the repentance of Maiz; for he came to Allah Apostle ﷺ and placing his hand in his in the Holy Prophets hand said: Kill me with stones. This controversy about Maiz remained for two or three days. Then came Allah Messenger ﷺ to them his Companions as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Maiz Bin Malik. They said: May Allah forgive Maiz Bin Malik. Thereupon Allah Messenger ﷺ said: He Maiz has made such a repentance that if that were to be divided among a people; it would have been enough for all of them. He the narrator said: Then a woman of Ghamid; a branch of Azd; came to him and said: Messenger of of Allah; purify me; whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Maiz. Bin Malik. He the Holy; Prophet said: What has happened to you? She said that she had become pregnant as a result of fornication. He the Holy Prophet said: Is it you who has done that ? She said: Yes. He the Holy Prophet said to her: You will not be punished until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered of the child. He that Ansari came to Allah Apostle ﷺ and said the woman of Ghamid has given birth to a child. He the Holy Prophet said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah Apostle; let the responsibility of his suckling be upon me. She was then stoned to death. SahihMuslim-017-001-17384
2. Abu Huraira and Zaid Bin Khalid AlJuhani said: Two men brought a dispute before the Messenger of Allah ﷺ. One of them said: Pronounce judgement between us in accordance with Allahs Book; Messenger of Allah! The other who had more understanding said: Yes; Messenger of Allah! Pronounce judgement between us in accordance with Allahs Book; and allow me to speak. He the Prophet said: Speak; He then said: My son who was a hired servant with this man committed fornication with his wife; and when I was told that my son must be stoned to death; I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned; they told me that my son should receive a hundred lashes and be banished for a year; and that stoning to death applied only to mans wife. The apostle of Allah ﷺ replied: By him in whose hand my soul is; I shall certainly pronounce judgment between you in accordance with Allahs Book. Your sheep and your slave girl must be returned to you; and your son shall receive a hundred lashes and be banished for a year. And he commanded Unias AlAslami go to that mans wife; and if she confessed; he should stone her to death. She confessed and he stoned her. SunanAbuDawoud-017-001-26641
3. Narrated Abdullah Bin Umar: The jews came to Allah Messenger ﷺ and mentioned to him that a man and a lady among them had committed illegal sexual intercourse. Allah Messenger ﷺ said to them; What do you find in the Torah regarding the Rajam? They replied; We only disgrace and flog them with stripes. Abdullah Bin Salam said to them; You have told a lie the penalty of Rajam is in the Torah. They brought the Torah and opened it. One of them put his hand over the verse of the Rajam and read what was before and after it. Abdullah Bin Salam said to him; Lift up your hand. Where he lifted it there appeared the verse of the Rajam. So they said; O Muhammad! He has said the truth; the verse of the Rajam is in it Torah. Then Allah Messenger ﷺ ordered that the two persons guilty of illegal sexual intercourse be stoned to death; and so they were stoned; and I saw the man bending over the woman so as to protect her from the stones. 4. Abu Huraira reported Allah Messenger ﷺ as saying. Allah fixed the very portion of adultery which a man will indulge in. There would be no escape from it. The adultery of the eye is the lustful look and the adultery of the ears is listening to voluptuous song or talk and the adultery of the tongue is licentious speech and the adultery of the hand is the lustful grip embrace and the adultery of the feet is to walk to the place where he intends to commit adultery and the heart yearns and desires which he may or may not put into effect. This hadith has been transmitted on the authority of Abu Huraira and Zaid Bin Khalid AlJuhani in the same way as transmitted by Malik with this difference tnat there is a doubt whether her sale that of the slave-girl committing adultery was mentioned after the third or the fourth time. 6. Iyad. Bin Himar reported tbat; while Allah Messenger ﷺ was delivering an address; he stated that Allah commanded me The rest of the hadith is the same; and there is an addition in it: Allah revealed to me that we should be humble amongst ourselves and none should show pride upon the others; And it does not behove one to do so; and He also said: There are among you people to follow not caring a bit for their family and property. Qatada said: Abu Abdullah; would this happen? Thereupon he said: Yes. By Allah; I found this in the days of ignorance that a person grazed the goat of a tribe and did not find anyone but their slave-girl and he did not spare her but committed adultery with her. 7. Narrated Ibn Abbas: I have not seen a thing resembling lamam minor sins than what Abu Huraira narrated from the Prophet who said Allah has written for Adam son his share of adultery which he commits inevitably. The adultery of the eyes is the sight to gaze at a forbidden thing ; the adultery of the tongue is the talk; and the inner self wishes and desires and the private parts testify all this or deny it. 8. Narrated Abu Huraira: The Prophet ﷺ said; None spoke in cradle but three: The first was Jesus; the second was ; there a man from Bani Israel called Juraij. While he was offering his prayers; his mother came and called him. He said to himself ; Shall I answer her or keep on praying? He went on praying and did not answer her; his mother said; O Allah! Do not let him die till he sees the faces of prostitutes. So while he was in his hermitage; a lady came and sought to seduce him; but he refused. So she went to a shepherd and presented herself to him to commit illegal sexual intercourse with her and then later she gave birth to a child and claimed that it belonged to Juraij. The people; therefore; came to him and dismantled his hermitage and expelled him out of it and abused him. Juraij performed the ablution and offered prayer; and then came to the child and said; O child! Who is your father? The child replied; The shepherd. After hearing this the people said; We shall rebuild your hermitage of gold; but he said; No; of nothing but mud. The third was the hero of the following story A lady from Bani Israel was nursing her child at her breast when a handsome rider passed by her. She said; O Allah ! Make my child like him. On that the child left her breast; and facing the rider said; O Allah! Do not make me like him. The child then started to suck her breast again. Abu Huraira further said; As if I were now looking at the Prophet ﷺ sucking his finger in way of demonstration. After a while the people passed by; with a lady slave and she i.e. the child mother said; O Allah! Do not make my child like this slave girl !; On that the child left her breast and said; O Allah! Make me like her. When she asked why; the child replied; The rider is one of the tyrants while this slave girl is falsely accused of theft and illegal sexual intercourse. SahihAlBukhari-017-001-4229

Narrated Aisha; Ummul Muminin: The Messenger of Allah ﷺ Said: The blood of a Muslim man who testifies that there is no god but Allah and that Muhammad is Allah Apostle should not lawfully be shed except only for one of three reasons: a man who committed fornication after marriage; in which case he should be stoned; one who goes forth to fight with Allah and His Apostle; in which case he should be killed or crucified or exiled from the land; or one who commits murder for which he is killed. 10. Abu Dharr reported;: I came to the Apostle ﷺ and he was asleep with a white mantle over him. I again came; he was still asleep; I came again and he had awakened. I sat by his side and the Holy Prophet observed: There is none among the bondsmen who affirmed his faith in La illaha ill-Allah there is no God but Allah and died in this state and did not enter Paradise. I Abu Dharr said: Even if he committed adultery and theft? He the Holy Prophet replied: Yes even though he committed adultery and theft. I again said : Even if he committed adultery and theft? He replied: Yes even though he committed adultery and theft. Th Holy Prophet repeated it three times and said for the fourth time: In defiance of Abu Dharr. Abu Dharr then went out and he repeated these words : In defiance of Abu Dharr. SahihMuslim-017-001-18561
