The Prophet ﷺ did so during all his lifetime; and I beseech you by Allah; do you know that? They replied; Yes. Umar then addressed Ali and Abbas; saying; I beseech you both by Allah; do you know that? Both of them replied; Yes. Umar added; Then Allah took His Apostle unto Him. Abu Bakr then said I am the successor of Allah Messenger ﷺ and took over all the Prophet property and disposed of it in the same way as Allah Messenger ﷺ used to do; and you were present then. Then he turned to Ali and Abbas and said; You both claim that Abu Bakr did so-and-so in managing the property; but Allah knows that Abu Bakr was honest; righteous; intelligent; and a follower of what is right in managing it. Then Allah took Abu Bakr unto Him; I said: I am the successor of Allah Messenger ﷺ and Abu Bakr. So I took over the property for two years and managed it in the same way as Allah Messenger ﷺ ; and Abu Bakr used to do. Then you both Ali and Abbas came to me and asked for the same thing! O Abbas! You came to me to ask me for your share from nephew property; and this Ali came to me asking for his wives share from her father property; and I said to you both; If you wish; I will place it in your custody on condition that you both will manage it in the same way as Allah Messenger ﷺ and Abu Bakr did and as I have been doing since I took charge of managing it; otherwise; do not speak to me anymore about it. Then you both said; Give it to us on that condition. So I gave it to you on that condition. Now I beseech you by Allah; did I not give it to them on that condition? The group whom he had been addressing replied; Yes. Umar then addressed Abbas and Ali saying; I beseech you both by Allah; didnt I give you all that property on that condition? They said; Yes. Umar then said; Are you now seeking a verdict from me other than that? By Him with Whose Permission the Heaven and the Earth exists I will not give any verdict other than that till the Hour is established; and if you both are unable to manage this property; then you can hand it back to me; and I will be sufficient for it on your behalf. 3. Narrated Malik Bin Aus Bin AlHadathan: Once I set out to visit Umar bin AlKhattab. And Allah said:- And what Allah has bestowed on His Apostle as Fai Booty from them for which you made no expedition with either cavalry or camelry... Allah is Able to do all things. 59.6 So this property was especially granted to Allah Messenger ﷺ. But by Allah he neither withheld it from you; nor did he keep it for himself and deprive you of it; but he gave it all to you and distributed it among you till only this remained out of it. And out of this property Allah Messenger ﷺ used to provide his family with their yearly needs; and whatever remained; he would spend where Allah Property the revenues of Zakat used to be spent. Allah Messenger ﷺ kept on acting like this throughout his lifetime. Now I beseech you by Allah; do you know that? They said; Yes. Then Umar said to Ali and Abbas; I beseech you by Allah; do you both know that? They said; Yes. Umar added; When Allah had taken His Apostle unto Him; Abu Bakr said; I am the successor of Allah Messenger ﷺ. So he took charge of that property and did with it the same what Allah Messenger ﷺ used to do; and both of you knew all about it then. Then Umar turned towards Ali and Abbas and said; You both claim that Abu Bakr was so-and-so! But Allah knows that he was honest; sincere; pious and right in that matter. Then Allah caused Abu Bakr to die; and I said; I am the successor of Allah Messenger ﷺ and Abu Bakr. So I kept this property in my possession for the first two years of my rule; and I used to do the same with it as Allah Messenger ﷺ and Abu Bakr used to do. Later both of you Ali and Abbas came to me with the same claim and the same problem. O Abbas! You came to me demanding your share from the inheritance of the son of your brother; and he Ali came to me demanding his wives share from the inheritance of her father. So I said to you; If you wish I will hand over this property to you; on condition that you both promise me before Allah that you will manage it in the same way as Allah Messenger ﷺ and Abu Bakr did; and as I have done since the beginning of my rule; otherwise you should not speak to me about it. So you both said; Hand over this property to us on this condition. And on this condition I handed it over to you. I beseech you by Allah; did I hand it over to them on that condition? The group said; Yes. Umar then faced Ali and Abbas and said; I beseech you both by Allah; did I hand it over to you both on that condition? They both said; Yes. Umar added; Do you want me now to give a decision other than that? By Him with Whose permission order both the Heaven and the Earth stand fast; I will never give any decision other than that till the Hour is established! 4. Narrated Malik Bin Aus: While I was at home; the sun rose high and it got hot. Suddenly the messenger of Umar Bin AlKhattab came to me and said; The chief of the believers has sent for you. So; I went along with him till I entered the place where Umar was sitting on a bedstead made of date-palm leaves and covered with no mattress; and he was leaning over a leather pillow. I greeted him and sat down. He said; O Mali! Some persons of your people who have families came to me and I have ordered that a gift should be given to them; so take it and distribute it among them. I said; O chief of the believers! I wish that you order someone else to do it. He said; O man! Take it. While I was sitting there with him; his doorman Yarfa came saying; Uthman; Abdulrahman Bin Auf; AlZubair and Saad Bin Abi Waqqas are asking your permission to see you ; may I admit them? Umar added; When Allah had taken His Prophet unto Him; Abu Bakr said; I am the successor of Allah Messenger ﷺ so; Abu Bakr took over that property and managed it in the same way as Allah Messenger ﷺ used to do; and Allah knows that he was true; pious and rightlyguided; and he was a follower of what was right. Then Allah took Abu Bakr unto Him and I became Abu Bakr successor; and I kept that property in my possession for the first two years of my Caliphate; managing it in the same way as Allah Messenger ﷺ used to do and as Abu Bakr used to do; and Allah knows that I have been true; pious; rightly guided; and a follower of what is right. Now you both i.e. Ah and Abbas came to talk to me; bearing the same claim and presenting the same case; you; Abbas; came to me asking for your share from your nephew property; and this man; i.e. Ali; came to me asking for his wife share from her father property. I told you both that Allah Messenger ﷺ said; Our prophets properties are not to be inherited; but what we leave is Sadaqa to be used for charity. When I thought it right that I should hand over this property to you; I said to you; I am ready to hand over this property to you if you wish; on the condition that you would take Allah Pledge and Convention that you would manage it in the same way as Allah Messenger ﷺ used to; and as Abu Bakr used to do; and as I have done since I was in charge of it. So; both of you said to me ; Hand it over to us; and on that condition I handed it over to you. So; I ask you by Allah; did I hand it over to them on this condition? The group aid; Yes. Then Umar faced Ali and Abbas saying; I ask you by Allah; did I hand it over to you on this condition? They said; Yes. He said; Do you want now to give a different decision? By Allah; by Whose Leave both the Heaven and the Earth exist; I will never give any decision other than that I have already given. Narrated Anas ra : When the Holy Verse: By no means shall you attain AlBirr piety; righteousness; it means here Allah Reward i.e.; Paradise ; unless you spend of that which you love..; V 3:92 was revealed; Abu Talha went to Allah Messenger ﷺ and said; O Allah Messenger ! Allah; the Blessed; the Superior stated in His book: By no means shall you attain Birr; unless you spend of that which you love.... V 3:92 and the most beloved property to me is Bairuha which was a garden where Allah Messenger ﷺ used to go to sit in its shade and drink from its water. I gave it to the Allah and His Messenger ﷺ hoping for Allah Reward in the Hereafter. So; Ao Allah Messenger ! Use it as Allah orders you to use it. Allah Messenger ﷺ said; Bravo! O Abu Talha ; it is fruitful property. We have accepted it from you and now we return it to you. Distribute it amongst you relatives. So; Abu Talha distributed it amongst his relatives; amongst whom were Ubai and Hassan. When Hassan sold his share of that garden to Muawiya; he was asked; How do you see Abu Talha Sadaqa? He replied; Who should not I sell a Sa of date for Sa of money ? The garden was situated on the courtyard of the palace of Bani Jadila built by Muawiya. SahihAlBukhari-017-001-4075

Narrated Ishaq Bin Abdullah Bin AlTalha : I heard Anas Bin Malik saying; Abu Talha had more property of date-palm trees gardens than any other amongst the Ansar in Medina and the most beloved of them to him was Bairuha garden; and it was in front of the Masjid of the Prophet ﷺ. Allah Messenger ﷺ used to go there and used to drink its nice water. Anas added; When these verses were revealed:-By no means shall you Attain righteousness unless You spend in charity of that Which you love. 3.92 Abu Talha said to Allah Messenger ﷺ O Allah Messenger ﷺ ! Allah; the Blessed; the Superior says: By no means shall you attain righteousness; unless you spend in charity of that which you love. And no doubt; Bairuha garden is the most beloved of all my property to me. So I want to give it in charity in Allah Cause. I expect its reward from Allah. O Allah Messenger ﷺ ! Spend it where Allah makes you think it feasible. On that Allah Apostle said; Bravo! It is useful property. I have heard what you have said O Abu Talha ; and I think it would be proper if you gave it to your Kith and kin. Abu Talha said; I will do so; O Allah Apostle. Do you know that Allah Messenger ﷺ said; We Prophets our properties are not to be inherited; and whatever we leave; is to be spent in charity; and he said it about himself? They i.e. Uthman and his company said; He did say it. Umar then turned towards Ali and Abbas and said; I beseech you both; by Allah! Do you know that Allah Messenger ﷺ said this? Then Umar turned towards Ali and Abbas and said; You both remember that Abu Bakr disposed of it in the way you have described and Allah knows that; in that matter; he was sincere; pious; rightly guided and the follower of the right. Then Allah caused Abu Bakr to die and I said; I am the successor of Allah Messenger ﷺ and Abu Bakr. So I kept this property in my possession for the first two years of my rule i.e. Caliphate and I used to dispose of it in the same wa as Allah Messenger ﷺ and Abu Bakr used to do; and Allah knows that I have been sincere; pious; rightly guided an the follower of the right in this matte Later on both of you i.e. Ali and Abbas came to me; and the claim of you both was one and the same; O Abbas! You also came to me. So I told you both that Allah Messenger ﷺ said; Our property is not inherited; but whatever we leave is to be given in charity. Then when I thought that I should better hand over this property to you both or the condition that you will promise and pledge before Allah that you will dispose it off in the same way as Allah Messenger ﷺ and Abu Bakr did and as I have done since the beginning of my caliphate or else you should not speak to me about it. So; both of you said to me; Hand it over to us on this condition. And on this condition I handed it over to you. Do you want me now to give a decision other than that decision ? By Allah; with Whose Permission both the sky and the earth stand fast; I will never give any decision other than that decision till the Last Hour is established. But if you are unable to manage it i.e. that property ; then return it to me; and I will manage on your behalf. The sub-narrator said; I told Urwa Bin AlZubair of this Hadith and he said; Malik Bin Aus has told the truth I heard Aisha; the wife of the Prophet ﷺ saying; The wives of the Prophet ﷺ sent Uthman to Abu Bakr demanding from him their 1/8 of the Fai which Allah had granted to his Apostle. But I used to oppose them and say to them: Will you not fear Allah? Dont you know that the Prophet used to say: Our property is not inherited; but whatever we leave is to be given in charity? The Prophet ﷺ mentioned that regarding himself. He added: The family of Muhammad can take their sustenance from this property. So the wives of the Prophet ﷺ stopped demanding it when I told them of that. So; this property of Sadaqa was in the hands of Ali who withheld it from Abbas and overpowered him. Then it came in the hands ofAlHassan Bin Ali; then in the hands of Husain Bin Ali; and then in the hands of Ali Bin Husain andHassan BinHassan and each of the last two used to manage it in turn; then it came in the hands of Zaid BinHassan and it was truly the Sadaqa of Allah Apostle. It has been narrated by Urwa b AlZubair on the authority of Aisha; wife of the Prophet ﷺ ; that Fatima; daughter of the Messenger of Allah ﷺ ; requested Abu Bakr; after the death of the Messenger of Allah may peace he upon him ; that he should set apart her share from what the Messenger of Allah ﷺ had left from the properties that God had bestowed upon him. Abu Bakr said to her: The Messenger of Allah ﷺ said: We do not have any heirs; what we leave behind is Sadaqa charity. The narrator said: She Fatima lived six months after the death of the Messenger of Allah ﷺ and she used to demand from Abu Bakr her share from the legacy of the Messenger of Allah ﷺ from Khaibar; Fadak and his charitable endowments at Medina. Abu Bakr refused to give her this; and said: I am not going to give up doing anything which the Messenger of Allah ﷺ used to do. I am afraid that it I go against his instructions in any matter I shall deviate from the right course. So far as the charitable endowments at Medina were concerned; Umar handed them over to Ali and Abbas; but Ali got the better of him and kept the property under his exclusive possession. And as far as Khaibar and Fadak were concerned Umar kept them with him; and said: These are the endowments of the Messenger of Allah ﷺ to the Umma. Their income was spent on the discharge of the responsibilities that devolved upon him on the emergencies he had to meet. And their management was to be in the hands of one who managed the affairs of the Islamic State. The narrator said: They have been managed as such up to this day. SahihMuslim-017-001-18045

Narrated Urwa Bin AlZubair: That he had asked Aisha about the meaning of the Statement of Allah: If you fear that you shall not Be able to deal justly With the orphan girls; then Marry Other women of your choice Two or three or four. 4.3 She said; O my nephew! This is about the orphan girl who lives with her guardian and shares his property. Her wealth and beauty may tempt him to marry her without giving her an adequate Mahr bridal-money which might have been given by another suitor. So; such guardians were forbidden to marry such orphan girls unless they treated them justly and gave them the most suitable Mahr; otherwise they were ordered to marry any other woman. Aisha further said; After that verse the people again asked the Prophet about the marriage with orphan girls ; so Allah revealed the following verses:- They ask your instruction Concerning the women. Say: Allah Instructs you about them And about what is Recited unto you In the Book; concerning The orphan girls to whom You give not the prescribed portions and yet whom you Desire to marry... 4.127 What is meant by Allah Saying:- And about what is Recited unto you is the former verse which goes:- If you fear that you shall not Be able to deal justly With the orphan girls; then Marry other women of your choice. 4.3 Aisha said; Allah saying in the other verse:-Yet whom you desire to marry 4.127 means the desire of the guardian to marry an orphan girl under his supervision when she has not much property or beauty in which case he should treat her justly. The guardians were forbidden to marry their orphan girls possessing property and beauty without being just to them; as they generally refrain from marrying them when they are neither beautiful nor wealthy. It has been narrated on the authority of Abu Haraira that the Messenger of Allah ﷺ said: Every wound received by a Muslim in the way of Allah will appear on the Day of Judgment in the same condition as it was when it was inflicted; and would be bleeding profusely. The colour of its discharge will be the colour of blood; but its smell will be the smell of musk. Abdullah Bin Masus said: Allah has cursed the woman who tattoo and the women who have themselves tattooed; the women who add false hair according to the version of Muhammad Bin Isa and the women who pluck hairs from their faces according to the version on Uthman. The agreed version then goes: The women who spaces between their teeth for beauty; changing what Allah has created. When a woman of Banu Asad called Umm Yaqub; who read the Quran according to the version of Uthman heard it; she came to him according to the agreed version and said: I have heard that you have cursed the women who tattoo; those have themselves tattooed; those who add false hair according to the version of Muhammad ; those pluck hairs from their faces; and those who make spaces between their teeth according to the agreed version ; for changing what Allah has created according to the version of Uthman. He said: Why should I not curse those whom the Messenger of Allah ﷺ had cursed and those who were mentioned in Allah Book ? She said: I have read it from cover to cover and have not found in it. He said: I swear by Allah; if you read it; you would have found it. He then read: What the Apostle has brought you accept; and what he has forbidden refrain from it. She said: I find some of these thing in you wife. He said: Enter the house and see. She said: I then entered the house and came out. He asked: What did you see ? She said: I did not see anything. He said: Had it been so; she would have not have been with us. This is according to the version of Uthman. SunanAbuDawoud-017-001-26112
7. Urwah Bin AlZubair narrated that he asked Aisha about the saying of Allah; the Mighty and Sublime: And if you fear that you shall not be able to deal justly with the orphan girls then marry other women of your choice. She said: O son of my sister; this refers to a female orphan who is in the care of her guardian; and her wealth is joined to his; and he is attracted to her wealth and her beauty. So her guardian wants to marry her without being fair with regard to her dowry; and without giving her what someone else would give her. So they were forbidden to marry them unless they were fair to them and gave them the highest possible dowry that is customarily given; and they were commanded to marry other women of their choice. Urwah said: Aisha said: Then later on; Allah; the Mighty and Sublime; revealed concerning them: They ask your legal instruction concerning women; say: Allah instructs you about them; and about what is recited unto you in the Book concerning the orphan girls whom you give not the prescribed portions and yet whom you desire to marry. Aisha said: What Allah; Most High; mentioned here that is recited in the Book is the first Verse in which it says: And if you fear that you shall not be able to deal justly with orphan girls then marry other women of your choice. Aisha said: What is referred to in the other Verse -and yet whom you desire to marry- is the desire of one of you not to marry orphan girl who is under his care if she is lacking in wealth and beauty. So they were forbidden to marry those orphan women to whose wealth they were attracted unless they were fair; because of their desire not to marry those who were lacking in wealth and beauty. 8. It is narrated on the authority of Abu Huraira that the Messenger of Allah ﷺ observed: Verily Allah forgave my people the evil promptings which arise within their hearts as long as they did not speak about them or did not act upon them. SahihMuslim-017-001-18620

10. Narrated Umar: The properties of Bani AlNadir which Allah had transferred to His Apostle as Fai Booty were not gained by the Muslims with their horses and camels. The properties therefore; belonged especially to Allah Messenger ﷺ who used to give his family their yearly expenditure and spend what remained thereof on arms and horses to be used in Allah Cause.
