This day have those who reject faith given up all hope of your religion: yet fear them not but fear Me. This day have I perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion. But if any is forced by hunger, with no inclination to transgression, Allah is indeed Oft-forgiving, Most Merciful.

SahihAlBukhari-017-001-1289Narrated Abu Laila Bin Abdullah Bin Abdulrahman Bin Sahl: Sahl Bin Abi Hathma and some great men of his tribe said; Abdullah Bin Sahl and Muhaiyisa went out to Khaibar as they were struck with poverty and difficult living conditions. Then Muhaiyisa was informed that Abdullah had been killed and thrown in a pit or a spring. Muhaiyisa went to the Jews and said; By Allah; you have killed my companion. The Jews said; By Allah; we have not killed him. Muhaiyisa then came back to his people and told them the story. He; his elder brother Huwaiyisa and Abdulrahman Bin Sahl came to the Prophet and he who had been at Khaibar; proceeded to speak; but the Prophet ﷺ said to Muhaiyisa; The eldest! The eldest! meaning; Let the eldest of you speak. So Huwaiyisa spoke first and then Muhaiyisa. Allah Messenger ﷺ said; The Jews should either pay the blood money of your deceased companion or be ready for war. After that Allah Messenger ﷺ wrote a letter to the Jews in that respect; and they wrote that they had not killed him. Then Allah Messenger ﷺ said to Huwaiyisa; Muhaiyisa and Abdulrahman Can you take an oath by which you will be entitled to take the blood money? They said; No. He said to them ; Shall we ask the Jews to take an oath before you? They replied; But the Jews are not Muslims. So Allah Apostle gave them one-hundred camels as blood money from himself. SahihAlBukhari-017-001-2658Narrated Rafi Bin Khadeej and Sahl Bin Abu Hathma: Abdullah Bin Sahl and Muhaiyisa Bin Masud went to Khaibar and they dispersed in the gardens of the date-palm trees. Abdullah Bin Sahl was murdered. Then Abdulrahman Bin Sahl; Huwaiyisa and Muhaiyisa; the two sons of Masud; came to the Prophet ﷺ and spoke about the case of their murdered friend. Abdulrahman who was the youngest of them all; started talking. The Prophet ﷺ said; Let the older among you speak first. So they spoke about the case of their murdered friend. The Prophet ﷺ said; Will fifty of you take an oath whereby you will have the right to receive the blood money of your murdered man; or said;..your companion. They said; O Allah Messenger ﷺ ! The murder was a thing we did not witness. The Prophet ﷺ said; Then the Jews will release you from the oath; if fifty of them the Jews should take an oath to contradict your claim. They said; O Allah Messenger ﷺ ! They are disbelievers and they will take a false oath. SahihAlBukhari-017-001-2671Narrated Aisha: Allah; the brother of Abu AlQuais asked my permission to enter after the verses of AlHijab veiling the ladies was revealed; and I said; By Allah; I will not admit him unless I take permission of Allah Apostle for it was not the brother of AlQuais who had suckled me; but it was the wife of AlQuais; who had suckled me. Then Allah Messenger ﷺ entered upon me; and I said; O Allah Messenger ﷺ ! The man has not nursed me but his wife has nursed me. He said; Admit him because he is your uncle not from blood relation; but because you have been nursed by his wife ; Taribat Yaminuki. Urwa said; Because of this reason; Aisha used to say: Foster suckling relations render all those things marriages etc. illegal which are illegal because of the corresponding blood relations. SahihAlBukhari-017-001-3825Narrated Sahl Bin Abi Hathma: Abdullah Bin Sahl and Muhaiyisa Bin Masud Bin Zaid set out to Khaibar; the inhabitants of which had a peace treaty with the Muslims at that time. They parted and later on Muhaiyisa came upon Abdullah Bin Sah! and found him murdered agitating in his blood. He buried him and returned to Medina. Abdulrahman Bin Sahl; Muhaiyisa and Huwaiuisa; the sons of Masud came to the Prophet ﷺ and Abdulrahman intended to talk; but the Prophet ﷺ said to him ; Let the eldest of you speak. as Abdulrahman was the youngest:. Abdulrahman kept silent and the other two spoke. The Prophet ﷺ said; If you swear as to who has committed the murder; you will have the right to take your right from the murderer. They said; How should we swear if we did not witness the murder or see the murderer? The Prophet ﷺ said; Then the Jews can clear themselves from the charge by taking Alaska an oath taken by men that it was not they who committed the murder. The!y said; How should we believe in the oaths of infidels? So; the Prophet ﷺ himself paid the blood money of Abdullah. SahihAlBukhari-017-001-3957Narrated Abu Saeed AlKhudri: While we were with Allah Messenger ﷺ who was distributing i.e. some property ; there came Dhu AlKhuwaisira; a man from the tribe of Bani Tamim and said; O Allah Messenger ﷺ ! Do Justice. The Prophet said; Woe to you! Who could do justice if I did not? I would be a desperate loser if I did not do justice. Umar said; O Allah Messenger ﷺ ! Allow me to chop his head off. The Prophet ﷺ said; Leave him; for he has companions who pray and fast in such a way that you will consider your fasting negligible in comparison to theirs. They recite Quran but it does not go beyond their throats i.e. they do not act on it and they will desert Islam as an arrow goes through a victim body; so that the hunter; on looking at the arrow blade; would see nothing on it; he would look at its Risaf and see nothing: he would look at its Na;di and see nothing; and he would look at its Qudhadh 1 and see nothing neither meat nor blood ; for the arrow has been too fast even for the blood and excretions to smear. The sign by which they will be recognized is that among them there will be a black man; one of whose arms will resemble a woman breast or a lump of meat moving loosely. Those people will appear when there will be differences amongst the people. I testify that I heard this narration from Allah Messenger ﷺ and I testify that Ali Bin Abi Talib fought with such people; and I was in his company. He ordered that the man described by the Prophet ﷺ should be looked for. SahihAlBukhari-017-001-4046Narrated Anas Bin Malik: When Allah favored His Apostle with the properties of Hawazin tribe as Fai booty ; he started giving to some Quarries men even up to one-hundred camels each; whereupon some Ansari men said about Allah Messenger ﷺ ; May Allah forgive His Apostle! He is giving to men of Quraish and leaves us; in spite of the fact that our swords are still dropping blood of the infidels When Allah Messenger ﷺ was informed of what they had said; he called the Ansar and gathered them in a leather tent and did not call anybody else along; with them. When they gathered; Allah Messenger ﷺ came to them and said; What is the statement which; I have been informed; and that which you have said? The learned ones among them replied; O Allah Messenger ﷺ ! The wise ones amongst us did not say anything; but the youngsters amongst us said; May Allah forgive His Apostle; he gives the Quarish and leaves the Ansar; in spite of the fact that our swords are still dribbling wet with the blood of the infidels. Allah Messenger ﷺ replied; I give to such people as are still close to the period of Infidelity i.e. they have recently embraced Islam and Faith is still weak in their hearts. Wont you be pleased to see people go with fortune; while you return with Allah Messenger ﷺ to your houses? By Allah; what you will return with; is better than what they are returning with. The Ansar replied; Yes; O Allah Messenger ﷺ ; we are satisfied Then the Prophet ﷺ said to them. You will find after me; others being preferred to you. Then be patient till you meet Allah and meet His Apostle at AlKauthar i.e. a fount in Paradise. SahihAlBukhari-017-001-6470Narrated Aisha: Saad was wounded on the day of Khandaq i.e. Trench when a man from Quraish; called Hibban Bin AlAraqa hit him with an arrow. The man was Hibban Bin Qais from the tribe of Bani Mais Bin Amir Bin Louai who shot an arrow at Saad medial arm vein or main artery of the arm. The Prophet ﷺ pitched a tent for Sad in the Masjid so that he might be near to the Prophet ﷺ to visit. When the Prophet returned from the battle of AlKhandaq i.e. Trench and laid down his arms and took a bath Gabriel came to him while he i.e. Gabriel was shaking the dust off his head; and said; You have laid down the arms? By Allah; I have not laid them down. Go out to them to attack them. The Prophet ﷺ said; Where? Gabriel pointed towards Bani Quraidha. So Allah Messenger ﷺ went to them i.e. Banu Quraidha i.e. besieged them. They then surrendered to the Prophet judgment but he directed them to Saad to give his verdict concerning them. Saad said; I give my judgment that their warriors should be killed; their women and children should be taken as captives; and their properties distributed. Narrated Hisham: My father informed me that Aisha said; Saad said; O Allah! You know that there is nothing more beloved to me than to fight in Your Cause against those who disbelieved Your Apostle and turned him out of Mecca. O Allah! I think you have put to an end the fight between us and them i.e. Quraish infidels. And if there still remains any fight with the Quraish infidels ; then keep me alive till I fight against them for Your Sake. But if you have brought the war to an end; then let this wound burst and cause my death thereby. So blood gushed from the wound. There was a tent in the Masjid belonging to Banu Ghifar who were surprised by the blood flowing towards them. They said; O people of the tent! What is this thing which is coming to us from your side? Behold! Blood was flowing profusely out of Saad wound. SahihAlBukhari-017-001-6612Narrated Ali: Allah Messenger ﷺ sent me; AlZubair and AlMiqdad saying; Proceed till you reach Rawdat Khakh where there is a lady carrying a letter; and take that letter from her. So we proceeded on our way with our horses galloping till we reached the Rawda; and there we found the lady and said to her; Take out the letter. She said; I have no letter. We said; Take out the letter; or else we will take off your clothes. So she took it out of her braid; and we brought the letter to Allah Messenger ﷺ. The letter was addressed from Hatib; Bin Abi Baltaa to some pagans of Mecca; telling them about what Allah Apostle intended to do. Allah Messenger ﷺ said; O Hatib! What is this? Hatib replied; O Allah Apostle! Do not make a hasty decision about me. I was a person not belonging to Quraish but I was an ally to them from outside and had no blood relation with them; and all the Emigrants who were with you; have got their kinsmen in Mecca who can protect their families and properties. So I liked to do them a favor so that they might protect my relatives as I have no blood relation with them. I did not do this to renegade from my religion i.e. Islam nor did I do it to choose Heathenism after Islam. Allah Messenger ﷺ said to his companions. As regards him; he i.e. Hatib has told you the truth. Umar said; O Allah Messenger ﷺ ! Allow me to chop off the head of this hypocrite! The Prophet ﷺ said; He i.e. Hatib has witnessed the Badr battle i.e. fought in it and what could tell you; perhaps Allah looked at those who witnessed Badr and said; O the people of Badr i.e. Badr Muslim warriors ; do what you like; for I have forgiven you. Then Allah revealed the Sura:- O you who believe! Take not my enemies And your enemies as friends offering them Your love even though they have disbelieved in that Truth i.e. Allah; Prophet Muhammad and this Quran which has come to you.... to the end of Verse.... SahihAlBukhari-017-001-6664Narrated Anas Bin Malik: When Allah gave Allah Messenger ﷺ what he gave of the properties of the Hawazin tribe as a war booty; the Prophet ﷺ started giving some men 100 camels each. The Ansar then said; May Allah forgive Allah Messenger ﷺ s as he gives to Quraish and leaves us although our swords are still dribbling with the blood of Quraish. Allah Apostle was informed of their statement; so he sent for the Ansar and gathered them in a leather tent; and did not call anybody else along with them. When they AlI gathered; the Prophet ﷺ got up and said; What is this talk being informed to me about you? The learned men amongst the Ansar said; O Allah Messenger ﷺ ! Our chiefs did not say anything; but some people amongst us who are younger in age said. May Allah forgive Allah Messenger ﷺ as he gives of the booty to Quraish and leaves us though our swords are still dribbling with their blood. The Prophet ﷺ said; I give to these men who have newly deserted heathenism and embraced Islam so as to attract their hearts. Wont you be happy that the people take the wealth while you take the Prophet ﷺ with you to your homes? By Allah; what you are taking is better than whatever they are taking. They i.e. the Ansar said; O Allah Messenger ﷺ ! We are satisfied. The Prophet ﷺ then said to them. You will find others favored over you greatly; so be patient till you meet Allah and His Apostle and I will be at the Tank then. He was from the tribe of Banu Hanifa and was called Thumama Bin Uthal. He was the chief of the people of Yamama. People bound him with one of the pillars of the Masjid. The Messenger of Allah ﷺ came out to see him. He said: O Thumama; what do you think? He replied: Muhammad; I have good opinion of you. If you kill me; you will kill a person who has spilt blood. If you do me a favour; you will do a favour to a grateful person. If you want wealth; ask and you will get what you will demand. The Messenger of Allah may peace be pon him lefthim in this condition for two days; and came to him again and said: What do you think; O Thumama? He replied: What I have already told you. If you do a favour; you will do a favour to a grateful person. If you kill me; you will kill a person who has spilt blood. If you want wealth; ask and you will get what you will demand. The Messenger of Allah ﷺ left him until the next day when he came to him again and said: What do you think; O Thumama? He replied: What I have already told you. If you do me a favour; you will do a favour to a grateful person. If you kill me; you will kill a person who has spilt blood. If you want wealth ask and you will get what you will demand. The Messenger of Allah ﷺ said: Set Thumama free. He went to a palm-grove near the Masjid and took a bath. Then he entered the Masjid and said: I bear testimony to the truth that there is no god but Allah and I testify that Muhammad is His bondman and His messenger. O Muhammad; by Allah; there was no face on the earth more hateful to me than your face; but now your face has become to me the dearest of all faces. By Allah; there was no religion more hateful to me than your religion; but now your religion has become the dearest of all religions to me. By Allah; there was no city more hateful to me than your city; but now your city has become the dearest of all cities to me. Your horsemen captured me when I intended going for Umra. Now what is your opinion in the matter ? The Messenger of Allah ﷺ announced good tidings to him and told him to go on Umra. When he reached Mecca; somebody said to him: Have you changed your religion? He said: No! I have rather embraced Islam with the Messenger of Allah ﷺ. SahihMuslim-017-001-19418Abdullah Bin Masud reported that Allah Messenger ﷺ who is the most truthful of the human beings and his being truthful is a fact said: Verily your creation is on this wise. The constituents of one of you are collected for forty days in his mother womb in the form of blood; after which it becomes a clot of blood in another period of forty days. Then it becomes a lump of flesh and forty days later Allah sends His angel to it with instructions concerning four things; so the angel writes down his livelihood; his death; his deeds; his fortune and misfortune. SahihMuslim-017-001-22072Anas Bin Malik reported that when on the Day of Hunain Allah conferred upon His Apostle ﷺ the riches of Hawazin without armed encounter ; the Messenger of Allah ﷺ set about distributing to some persons of Quraish one hundred camels Upon this they the young people from the Ansar said: May Allah grant pardon to the Messenger of Allah ﷺ that he bestowed these camels upon the people of Quraish; and he ignored us; whereas our swords are still dripping blood. The wise people of the Ansar said: Messenger of Allah; so far as the sagacious amongst us are concerned they have said nothing; but we have amongst us persons of immature age; they said: May Allah grant pardon to the Messenger of Allah ﷺ that he gave to the Quraish and ignored us despite the fact that our swords are besmeared with their blood. Upon this the Messenger of Allah ﷺ said: I give at times material gifts to persons who were quite recently in the state of unbelief; so that I may incline them to truth Dont you feel delighted that people should go with riches; and you should go back to your places with the Messenger of Allah? By Allah; that with which you would return is better than that with which they would return. They said: Yes; Messenger of Allah; we are pleased. The Prophet said too: You would find marked preference in conferring of the material gifts in future; so you should show patience till you meet Allah and His Messenger and I would he at the Haud Kauthar. SahihMuslim-017-001-22093Abu Saeed AlKhudri said that the Messenger of Allah ﷺ made a mention of a sect that would be among his Ummah which would emerge out of the dissension of the people. Their distinctive mark would be shaven heads. They would be the worst creatures or the worst of the creatures. The group who would be nearer to the truth out of the two would kill them. The Apostle of Allah ﷺ gave an example to give their description or he said: A man throws an arrow at the prey or he said at the target ; and sees at its iron head; but finds no sign of blood there ; or he sees at the lowest end; but would not see or find any sign of blood there. He would then see into the grip but would not find anything sticking to it. I found him in the house of my sister Zainab bint Jahsh. I said; O Messenger of Allah! I suffer from a case of severe and excessive blood flow. So what do you order me to do for it; and does this prevent me from fasting and performing Prayer? He said: Tie a cotton rag around yourself and the bIood will go away. I said; It is more than that. He said: Make it tight. I said; It is more than that. He said: Then use a cloth to bind it. I said; it is more than that. It flows too much. So the Prophet said: I will order you to do one of two things; which ever of them you do; it will be acceptable for you. You should know which of them you are able to do. Then he said: This is only a blow from Shaitan. Menstruate for six or seven days; which Allah knows; then perform Ghusl. When you see that you have become pure and clean; then perform Prayer for twenty-three or twenty-four nights and their days. Perform Prayer and fast; and that will be acceptable for you. So do this if you can just as other women who menstruate and become pure during their periods of menstruation and purity. If not; and you are able to delay Zuhr and hasten Asr then perform Ghusl when you have become pure; and pray Zuhr and Asr together. Then delay Maghrib and hasten Isha; then perform Ghusl and combine the two prayers. So do this if you are able. Then perform Ghusl with the dawn and pray. Do this; and fast if you are able to do so. He ﷺ expressed his gratitude to Allah and praised Him; and reminded and exhorted; then he said: Which day is most sacred? Which day is most sacred? Which day is most sacred? He said: So the people said: The day of AlHajj AlAkbar O Messenger of Allah! So he said: Indeed; your blood; your wealth; your honor; is as sacred for you as the sacredness of this day of yours; in this city of yours; in this month of yours. Behold! None commits a crime but against himself; none offends a father for a son; nor a son for a father. Behold! Indeed the Muslim is the brother of the Muslim; so it is not lawful for the Muslim to do anything to his brother; which is not lawful to be done to himself. Behold! All Riba from Aljahiliyah is invalid; for you is the principle of your wealth; but your are not to wrong nor be wronged - except in the case of Riba of AlAbbas Bin Abd AlMuttalib - otherwise it is all invalid. Behold! All retribution regarding cases of blood during Aljahiliyah are invalid. The first case of blood retribution invalidated among those of Aljahiliyah; is the blood of AlHarith Bin Abd AlMuttalib who was nursed among Banu Laith and killed by Hudhail. Behold! I order you to treat women well; for they are but like captives with you; you have no sovereignty beyond this over them; unless they manifest lewdness. If they do that; then abandon their beds; and beat them with a beating that is not painful. Then if they obey you; then there is no cause for you against them beyond that. Behold! There are rights for you upon your women; and rights for your women upon you. As for your rights upon them;then they are not to allow anyone on your bedding whom you dislike; nor to permit anyone whom you dislike in your homes. Behold! He was called Hani Ibn Kulthum Ibn Sharik AlKinani. He greeted Abdullah Ibn Zakariya who knew his rank. Khalid said to us: Abdullah Ibn Abu Zakariya told us: I heard Umm AlDarda say: I heard AbudDarda say: I heard the Messenger of Allah ﷺ say: It is hoped that Allah may forgive every sin; except in the case of one who dies a polytheist; or one who purposely kills a believer. Hani Ibn Kulthum AlRabi then said: I heard Mahmud Ibn AlRabi transmitting a tradition from Ubadah Ibn AlSamit who transmitted from the Messenger of Allah ﷺ who said: If a man kills a believer unjustly; Allah will not accept any action or duty of his; obligatory or supererogatory. Khalid then said to us: Ibn Abu Zakariya transmitted a tradition to us from Umm AlDarda on the authority of AbudDarda from the Messenger of Allah ﷺ who said: A believer will continue to go on quickly and well so long as he does not shed unlawful blood; when he sheds unlawful blood; he becomes slow and heavy-footed. SunanAbuDawoud-017-001-26437Urwah Bin AlZubair said: Fatimah daughter of Abu Hubaish narrated to me that she asked Asma daughter of Abu Bakr ; or Asma narrated to me that Fatimah daughter of Abu Hubaish asked her to question the Messenger of Allah ﷺ. He advised her to refrain from prayer equal to the period she refrained previously. She then should wash herself.1Abu Dawud said: Qatadah narrated it from Urwah Bin AlZubair; from Zainab daughter of Umm Salamah; that Umm Habibah daughter of Jahsh had a prolonged flow of blood. The Prophet ﷺ commanded her to abandon prayer for the period of her menses. She then should take a bath; and offer prayer.Abu Dawud said: Qatadah did not hear anything from Urwah. 2And Ibn Uyainah added in the tradition narrated by AlZuhri from Umrah on the authority of Aishah. The Prophet ﷺ commander her saying: When the menstruation begins; abandon prayer; when it is finished; take a bath and pray.Abu Dawud said: None of the disciple of AlZuhri mentioned these words except AlAwzai; from AlZuhri it has been narrated by Amr Bin AlHarith; AlLaith; Yunus; Ibn Abi Dhib; Mamar; Ibrahim Bin Sad; Sulaiman Bin Kathir; Ibn Ishaq and Sufyan Bin Uyainah; they did not narrate these words.Abu Dawud said: These are the words of the version reported by Hisham Bin Urwah from this father on the authority of Aishah. Abu Dawud said: In this tradition Ibn Uyainah also added the words: He commander her to abandon prayer during her menstrual period. This is a misunderstanding on the part of Ibn Uyainah. Later on he transmitted it to us from his memory: Muhammad Bin Amr reported to us from AlZuhri from Urwah on the authority of Aisha who said: Fatimah used to have her blood flowing. He then reported the tradition conveying the same meaning.Abu Dawud said: Anas Bin Seereen reported from Ibn Abbas about the woman who has a prolonged flow of blood. He said: If she sees thick blood; she should not pray; if she finds herself purified even for a moment; she should was an pray.Makhul said: Menses are not hidden from women. Their blood is black and thick. When it blackness and thickness goes away and there appears yellowness and liquidness; that is the flow of blood from vein. This version adds: She should refrain from prayer during her menstrual period.Hammad Bin Salamah has reported it similarly from Yahya Bin Saeed on the authority of Saeed Bin AlMusayab.Abu Dawud said: Yunus has reported from AlHasan: When the bleeding of a menstruating woman extends beyond the normal period ; she should refrain from prayer ; after her menses are over; for one or two days. Now she becomes the woman who has a prolonged flow of blood AlTaimi reported from Qatadah: If her menstrual period is prolonged by five days; she should pray. AlTaimi said: I kept on reducing the number of days until I reached two days. He said: If the period extends by two days; they will be counted from the menstrual period. SunanAbuDawoud-017-001-26443Narrated Hamnah daughter of Jahsh: Hamnah said my menstruation was great in quantity and severe. So I came to the Messenger of Allah ﷺ for a decision and told him. I found him in the house of my sister; Zaynab; daughter of Jahsh. I said: Messenger of Allah; I am a woman who menstruates in great quantity and it is severe; so what do you think about it? It has prevented me from praying and fasting. He said: I suggest that you should use cotton; for it absorbs the blood. She replied: It is too copious for that. He said: Then take a cloth. She replied: It is too copious for that; for my blood keeps flowing. The Messenger of Allah ﷺ said: I shall give you two commands; whichever of them you follow; that will be sufficient for you without the other; but you know best whether you are strong enough to follow both of them. He added: This is a stroke of the Devil; so observe your menses for six or seven days; Allah alone knows which it should be; then wash. And when you see that you are purified and quite clean; pray during twenty-three or twenty-four days and nights and fast; for that will be enough for you; and do so every month; just as women menstruate and are purified at the time of their menstruation and their purification. But if you are strong enough to delay the noon Zuhr prayer and advance the afternoon Asr prayer; to wash; and then combine the noon and the afternoon prayer; to delay the sunset prayer and advance the night prayer; to wash; and then combine the two prayers; do so: and to wash at dawn; do so: and fast if you are able to do so if possible.The Messenger of Allah ﷺ said: Of the two commands this is more to my liking.1Abu Dawud said: Amr Bin Thabit narrated from Ibn Aqil: Hamnah said: Of the two commands this is the one which is more to my liking.2 In this version these words were not quoted as the statement of the Prophet ﷺ ; it gives it as a statement of Hamnah.Abu Dawud said: Amr Bin Thabit was a Rafidi. This tradition indicates the tradition reported by AlAmash a a statement of Companion; i.e. Aishah. Hafs Bin Ghayath has rejected the tradition transmitted by Habib as the statement of the Prophet. And Asbat also reported it as a statement of Aishah.Abu Dawud said: Ibn Dawud has narrated the first part of this tradition as a statement of the Prophet ; and denied that there was any mention of performing ablution for every prayer. The weakness of the tradition reported by Habib is also indicated by the fact that the version transmuted by AlZuhri from Urwah on the authority of Aisha says that she used to wash herself for every prayer; these words occur in the tradition about the woman who has a flow of blood. This tradition has been reported by Abu AlYaqzan from Adi Bin Thabit from his father from Ali; and narrated by Ammar; the freed salve of Banu Hashim; from Ibn Abbas; and transmitted by Abd AlMalik Bin Maisarah; Bayan; AlMughirah; Firas; on the authority of AlShabi; from Qumair from Aisha; stating: You should perform ablution for every prayer. The version transmitted by Dawud; and Aasi m from AlShabi from Qumair from Aisha has the words: She should take bath only once every day. The version reported by Hisham Bin Urwah from his father has the words: The woman having a flow of blood should perform ablution for every prayer. All these traditions are weak except the tradition reported by Qumair and the tradition reported by Ammar; the freed slave of Banu Hashim; and the tradition narrated by Hisham Bin Urwah on the authority of his father. By Allah; the Messenger of Allah ﷺ got down in the morning. He made his camel kneel down and I came down from the back of his saddle. There was a mark of blood on it saddle and that was the first menstruation that I had. I stuck to the camel and felt ashamed. When the Messenger of Allah ﷺ saw what had happened to me and saw the blood; he said: Perhaps you are menstruating. I said: Yes. He then said: Set yourself right i.e. tie some cloth to prevent bleeding ; then take a vessel of water and put some salt in it; and then wash the blood from the back of the saddle; and then return to your mount. SunanAbuDawoud-017-001-26557Narrated Abdullah Ibn Abbas: A blind man had a slave-mother who used to abuse the Prophet ﷺ and disparage him. He forbade her but she did not stop. He rebuked her but she did not give up her habit. One night she began to slander the Prophet ﷺ and abuse him. So he took a dagger; placed it on her belly; pressed it; and killed her. A child who came between her legs was smeared with the blood that was there. When the morning came; the Prophet ﷺ was informed about it. He assembled the people and said: I adjure by Allah the man who has done this action and I adjure him by my right to him that he should stand up. Jumping over the necks of the people and trembling the man stood up. He sat before the Prophet ﷺ and said: Messenger of Allah! I am her master; she used to abuse you and disparage you. I forbade her; but she did not stop; and I rebuked her; but she did not abandon her habit. I have two sons like pearls from her; and she was my companion. Last night she began to abuse and disparage you. So I took a dagger; put it on her belly and pressed it till I killed her. SunanAbuDawoud-017-001-26669Narrated Ali Ibn Abu Talib: A slave-girl belonging to the house of the Messenger of Allah ﷺ committed fornication. He the Prophet said: Rush up; Ali; and inflict the prescribed punishment on her. I then hurried up; and saw that blood was flowing from her; and did not stop. So I came to him and he said: Have you finished inflicting punishment on her ? I said: I went to her while her blood was flowing. He said: Leave her alone till her bleeding stops; then inflict the prescribed punishment on her. And inflict the prescribed punishment on those whom your right hands possess i.e. slaves.Abu Dawud said: A similar tradition has been transmitted by Abu AlAhwas from Abd AlAla; and also by Shubah from Abd AlAla. MuwataMalik-017-001-34742Yahya said from Malik from Yahya Ibn Said that Bushayr Ibn Yasar informed him that Abdullah Ibn Sahl AlAnsari and Muhayisa Ibn Masud went out to Khaybar; and they separated on their various businesses and Abdullah Ibn Sahl was killed. Muhayisa; and his brother Huwayisa and Abdulrahman Ibn Sahl went to the Prophet; may Allah bless him and grant him peace; and Abdulrahman began to speak before his brother. The Messenger of Allah; may Allah bless him and grant him peace; said; The older first; the older first. Therefore Huwayisa and then Muhayisa spoke and mentioned the affair of Abdullah Ibn Sahl. The Messenger of Allah; may Allah bless him and grant him peace; said to them; Do you swear with fifty oaths and claim the blood-money of your companion or the life of the murderer? They said; Messenger of Allah; we did not see it and we were not present. The Messenger of Allah; may Allah bless him and grant him peace; said; Will you acquit the jews for fifty oaths? They said; Messenger of Allah; how can we accept the oaths of a people who are kafirun? Yahya Ibn Said said; Bushayr Ibn Yasar claimed that the Messenger of Allah; may Allah bless him and grant him peace; paid the blood-money from his own property. Malik said; The generally agreed on way of doing things in our community and that which I heard from whoever I am content with; concerning the oath of qasama; and upon which the past and present imams agree; is that those who claim revenge begin with the oaths and swear. The oath for revenge is only obligatory in two situations. Either the slain person says; My blood is against so-and-so; or the relatives entitled to the blood bring a partial proof of it that is not irrefutable against the one who is the object of the blood-claim. This obliges taking an oath on the part of those who claim the blood against those who are the object of the blood-claim. With us; swearing is only obliged in these two situations. Malik said; That is the sunna in which there is no dispute with us and which is still the behaviour of the people. The people who claim blood begin the swearings; whether it is an intentional killing or an accident. Malik said; The Messenger of Allah; may Allah bless him and grant him peace; began with Banu Harith in the case of the killing of their kinsman murdered at Khaybar. Malik said; If those who make the claim swear; they deserve the blood of their kinsman and whoever they swear against is slain. Only one man can be killed in the qasama. Two cannot be killed in it. Fifty men from the blood-relatives must swear fifty oaths. If their number is less or some of them draw back; they can repeat their oaths; unless one of the relatives of the murdered man who deserves blood and who is permitted to pardon it; draws back. If one of these draws back; there is no way to revenge. Yahya said that Malik said; The oaths can be made by those of them who remain if one of them draws back who is not permitted to pardon. If one of the blood-relatives draws back who is permitted to pardon; even if he is only one; more oaths can not be made after that by the blood- relatives. If that occurs; the oaths can be on behalf of the one against whom the claim is made. So fifty of the men of his people swear fifty oaths. If there are not fifty men; more oaths can be made by those of them who already swore. If there is only the defendant; he swears fifty oaths and is acquitted. Yahya said that Malik said; One distinguishes between swearing for blood and oaths for one rights. When a man has a money-claim against another man; he seeks to verify his due. When a man wants to kill another man; he does not kill him in the midst of people. He keeps to a place away from people. Had there only been swearing in cases where there is a clear proof and had one acted in it as one acts about one rights i.e. needing witnesses ; the right of blood retribution would have been lost and people would have been swift to take advantage of it when they learned of the decision on it. However; the relatives of the murdered man were allowed to initiate swearing so that people might restrain themselves from blood and the murderer might beware lest he was put into a situation like that i.e. qasama by the statement of the murdered man. Yahya said; Malik said about a people of whom a certain number are suspected of murder and the relatives of the murdered man ask them to take oaths and they are numerous; so they ask that each man swears fifty oaths on his own behalf. The oaths are not divided out between them according to their number and they are not acquitted unless each man among them swears fifty oaths on his own behalf. Malik said; This is the best I have heard about the matter. He said; Swearing goes to the paternal relatives of the slain. MuwataMalik-017-001-34743Yahya said that Malik said; The way of doing things in our community about which there is no dispute is that women do not swear in the swearing for the intentional act. If the murdered man only has female relatives; the women have no right to swear for blood and no pardon in murder. Yahya said that Malik said about a man who is murdered; If the paternal relatives of the murdered man or his mawali say; We swear and we demand our companion blood; that is their right. Malik said; If the women want to pardon him; they cannot do that. The paternal relatives and mawali are entitled to do that more than them because they are the ones who demand blood and swear for it. Malik said; If the paternal relatives or mawali pardon after they demand blood and the women refuse and say; We will not abandon our right against the murderer of our companion; the women are more entitled to that because whoever takes retaliation is more entitled than the one who leaves it among the women and paternal relatives when the murder is established and killing obliged. Malik said; At least two claimants must swear in murder. The oaths are repeated by them until they swear fifty oaths; then they have the right to blood. That is how things are done in our community. Malik said; When people beat a man and he dies in their hands; they are all slain for him. If he dies after their beating; there is swearing. If there is swearing; it is only against one man and only he is slain. We have never known the swearing to be against more than one man. Malik spoke about a slave who had his hand or foot broken and then the break mended. He said; The one who injured him is not obliged to pay anything. If that break causes him loss or scar; the one who injured him must pay according to what he diminished of the value of the slave. Malik said; What is done in our community about retaliation between slaves is that it is like retaliation between freemen. The life of the slave-girl for the life of the slave; and her injury for his injury. When a slave intentionally kills a slave; the master of the murdered slave has a choice. If he wishes; he kills him; and if he wishes; he takes the blood-money. If he takes the blood-money; he takes the value of his slave. If the owner of the slave who killed wishes to give the value of the murdered slave; he does it. If he wishes; he surrenders his slave. If he surrenders him; he is not obliged to do anything other than that. When the owner of the murdered slave takes the slave who murdered and is satisifed with him; he must not kill him. All retaliations between slaves for cutting off of the hand and foot and such things are dealt with in the same way as in the murder. Malik said about a muslim slave who injures a jew or christian; If the master of the slave wishes to pay blood-money for him according to the injury; he does it. Or else he surrenders him and he is sold; and the jew or christian is given the blood-money of the injury or all the price of the slave if the blood-money is greater than his price. MuwataMalik-017-001-34745Yahya said that Malik said; When the relatives of the deceased accept the blood-money then it is inherited according to the Book of Allah. Daughters of the dead man inherit and so do sisters; and whichever women would inherit from him ordinarily. If the women do not take all his inheritance; then what remains goes to the agnatic relations who most deserve to inherit from him in conjunction with the women. Malik said; When one of the heirs of a man killed by mistake attempts to take his due from the blood-money while his companions are absent; he may not do that; and he has no right to any of the blood-money; however large or small; unless the qasama has been completed by him. If he swears fifty oaths then he has the right to his portion of the blood-money. That is because the blood-money is not established as due without there being fifty oaths; and the blood- money is not established as due unless the responsibility for the blood is established. If any one of the heirs comes after that he swears a number of the oaths commensurate with his fraction of the inheritance and takes his right until all the heirs exact their complete right. If a maternal uncle comes he has one sixth and must swear one sixth of the fifty oaths. So whoever swears may take his due from the blood-money and whoever abstains annuls his right. If one of the heirs is absent or is a child who has not reached puberty; those who are present swear fifty oaths and if the one who was absent comes after that or the child reaches puberty; they swear. and they swear according to their due of the blood-money and according to their shares of inheritance from it. MuwataMalik-017-001-34872Malik said that Ibn Shihab said; The precedent of the sunna in the intentional murder is that when the relatives of the murdered person relinquish retaliation; the blood-money is owed by the murderer from his own property unless the tribe helps him with it willingly. Malik said; What is done in our community is that the blood- money is not obliged against the tribe until it has reached a third of the full amount and upwards. Whatever reaches a third is against the tribe; and whatever is below a third; is against the property of the one who did the injury. Malik said; The way of doing things about which there is no dispute among us; in the case of someone who has the blood-money accepted from him in intentional murder or in any injury in which there is retaliation; is that that blood-money is not due from the tribe unless they wish it. The blood-money for that is from the property of the murderer or the injurer if he has property. If he does not have any property; it is a debt against him; and none of it is owed by the tribe unless they wish. Malik said; The tribe does not pay blood-money to anyone who injures himself; intentionally or accidentally. This is the opinion of the people of fiqh in our community. I have not heard that anyone has made the tribe liable for any blood-money incurred by intentional acts. Part of what is well-known of that is that Allah; the Blessed; and the Exalted; said in His Book; Whoever has something pardoned him by his brother; should follow it with what is accepted and pay it with good will Surat 2 ayat 178 The commentary on that - in our view - and Allah knows best; is that whoever gives his brother something of the blood- money; should follow it with what is accepted and pay him with good will. Malik spoke about a child who had no property and a woman who had no property. He said; When one of them causes an injury below a third of the blood-money; it is taken on behalf of the child and woman from their personal property; if they have property from which it may be taken. If not; the injury which each of them has caused is a debt against them. The tribe does not have to pay any of it and the father of a child is not liable for the blood-money of an injury caused by the child and he is not responsible for it. Malik said; The way of doing things in our community about which there is no dispute; is that when a slave is killed; the value for him is that of the day on which he was killed. The tribe of the murderer is not liable for any of the value of the slave; great or small. That is the responsibility of the one who struck him from his own personal property as far as it covers. If the value of the slave is the blood- money or more; that is against him in his property. Malik said about a man who pardoned murder; after he had claimed his right and it was obliged for him; There is no blood-money against the murderer unless the one who pardons him stipulates that when he pardons him. Malik said about the murderer when he was pardoned; He is flogged one hundred lashes and jailed for a year. He ordered him to eat it. Then he asked Zayd Ibn Thabit about it; and he said; Does a corpse move? and he forbade eating its meat. Malik was asked about a sheep which fell down and injured itself badly and then its master reached it and slaughtered it. Blood flowed from it but it did not move. MuwataMalik-017-001-35533Yahya related to me from Malik that Humayd Ibn Oays AlMakki told him; I was with Mujahid while he was performing tawaf around the Kaba; and a man came to him and asked whether the days of fasting for kaffara had to be fasted consecutively; or could they be split up. I said to him; Yes; they can be split up; if the person so wishes. Mujahid said; He should not split them up; because in Ubay Ibn Kaab recitation they are referred to as three consecutive days. Malik said; What I like most is what Allah has specified in the Quran; that is; that they are fasted consecutively. Malik was asked about a woman who began the day fasting in Ramadan and though it was outside of the time of her period; fresh blood i.e. not menstrual blood flowed from her. She then waited until evening to see the same; but did not see anything.Then; on the next day in the morning she had anotherflow; though less than the first. Then; some days before her period; the flow stopped completely. Malik was asked what she should do about her fasting and prayer; and he said; This blood is like menstrual blood. When she sees it she should break her fast; and then make up the days she has missed. Then; when the blood has completely stopped; she should do ghusl and fast. Malik was asked whether someone who became muslim on the last day of Ramadan had to make up all of Ramadan or whether he just had to make up the day when he became muslim; and he said; He does not have to make up any of the days that have passed. He begins fasting from that day onwards.
